just a short time ago, ktvu news learned the woman driver was behind the wheel as late as yesterday. that is despite being on paid suspension. ktvu kraig debro is talking with muni chief spokesperson this morning. he will give us a live update from san francisco in our next half hour. also this morning police are looking for suspects in an overnight shooting. that happened just before midnight at 73rd and bancroft. investigators say one gunman opened fire at the gas station injuring two people. both victims are expected to survive. witnesses spotted several young men running if the scene. so far police have not made any arrests. time now 6:02. san francisco police are looking for a man that exposed himself to one woman and sexually assaulted another. they think one man is responsible for both attacks even though the sketches appear to be different.

both happened on the inner sunset last saturday about 2:00 a.m.. the man first exposed himself to a woman near stanon and fredericks streets. he followed another woman into her apartment and began sexually assaulting her. the vote on a target store in san rafael won city council approval after seven hours of debate at 1:00 this morning. the future store will open on shoreline parkway. ktvu tara moriarty is in downtown san rafael where many business owners are not welcoming the new neighbor. >> reporter: mer channels in downtown san rafael say a new big box store would hurt their livelihood. it's a debate that lasted from 6:00 until 1:00 this morning. protestors said a big chain store would crush small

businesses, pay poor wages, and cause unwanted traffic. supporters claim target would create jobs and $5.5 million in revenue tax. in the end the council voted 3- 2 to allow the chain to come to town. >> i do support target. i do believe if more money can come into this community it will help my business. >> reporter: the nearest target is in nevada. building one in san rafael would cut down on the amount of traffic and lower pollution. >> this is a very -- this is very misleading when target presenting they are stewards of the environment. that is the worst thing, the dumbest thing i have ever heard in my entire life. >> the new store will be built on a new landfill. target has promised to hire 200 local workers and donate $250,000 over the next ten years to the downtown library. the new store will open in 2015

watsonville. that fire has been burning since wednesday afternoon. firefighters are soaking the building using ladder trucks. piles of burn products can be seen through an open doorway. martinelli family stores its juices and cider. they expect shortages in the summer and fall. >> we lost about 6,000 bins of apples that was in this cold storage last night too. and there is no way to replace that fruit. >> smoke is also a big problem. people with respiratory problems should stay indoors. it could be next week before it's safe to enter the building. if you are frying up bacon and eggs for breakfast this morning, the left over grease could be used for the skyrocketing gas prices. claudine wong is live. >> reporter: that there is a

science behind this that is apparently 200 years old. you take this old cooking oil and put it through this whole process and what do you end up with? you end up with a bio fuel in your diesel trucks. is it cleaner? yes. is it cheaper? that is the selling point. diesel is $4.30 to $4.70. paul is the ceo that does all of this. tell me about demand growing for bio fuel. you say demand is there. >> demand is there. the bay area is a marketable place. people are interested in green fuels. it's a great opportunity for us. >> reporter: we talk about the chemistry of all of this. you put this display for us to show us really kind of what you are doing. this is the cooking oil you get get from restaurants. >> that is true. it comes in with cooking oil with a lot of food and water in the bottom. we have a process that removes that food and water.

we add the chemical. you can see the stuff that has fallen out. the reacted oil is put through a wash process that then looks like this. we run that through our filters which gives us bio diesel. >> reporter: you are saying this can be used in any truck that uses diesel? >> yes. >> reporter: you cannot use it in your gasoline powered car. >> reporter: which is unfortunate if it is cheaper. >> it would be nice. >> reporter: the other question has people saying really i'm going to put this in my truck? no problems. you have people that are using this. >> this is not new. the technology is 200 years old. back in june last year, we bought a used truck about five years old. converted it over to bio diesel by filling it up with fuel. >> reporter: i want to show you something really quickly. what is also happening today

military help. carol. >> reporter: senator john mccain calls the libyan rebels his heros. he himself this morning got a heros welcome. as a tough republican he has been pushing for u.s. military intervention to remove moammar gadhafi from power. the purpose of his trip is to meet with rebel leaders. in the meantime president obama had green lighted the use of drone proditors. they began flying thursday. two will be flying over the country at all times. >> the president has said that where we have unique capabilities he is willing to use these and in fact hi has approve -- he has approved the use of armed predators. >> we are sending in the drones but secretary gate says it doesn't mean we are sending in

troops. live in washington carol han. last night in libya a greek passenger fairy arrived in ben gad city. it was carrying the bodies of two photo journalists. they were holding these banners showing support for the united states for britain, and the families of those journalists. california's jails and prisons increationed by 17% since 2003. now according to a new federal audit there were more than 100,000 illegal immigrants in 2009. it cost more to maintain an inmate in california. here in california it's 34,000 a year in texas it's 12,000. california has repeatedly tried to get more federal reimbursement. police in antioch say three people are now in custody for the shooting death of a suspected marijuana dealer.

however, the suspected gunman is still on the loose. police are out there looking for 21-year-old michael pulliam >> banks. he's wanted for the fatal shooting of 24-year-old michael. investigators say the suspected drug dealer was shot in the head and then pushed out of a car. police say that killing came after the four suspects tried to steal his marijuana along with his money. a new medical marijuana dispensary is up and running in the city of antioch. the dispensary is located inside a shopping center on hill crest avenue. several neighboring businesses are now complaining about the smell and smoke coming from the dispensary. as a result they will consider a 45 day moratorium on new dispensaries at its meeting on tuesday. time now 6:17. there is word the nba is taking a serious look at keeping the

kings in sacramento. today sacramento bee is reporting nba executives will be in town for a special meeting on monday. he will be looking at ways to stop sacramento's nba franchise from moving to antioch. sacramento mayor said the meetings have gone very well. the golden gate transit agency says fairs will go up for the next five years. it's recommending a five-year program will raise fairs. a final decision is expected to be made today. the fair increases are needed to close an $89 million budget deficit. 6:18. let's check in with sal. i'm seeing good conditions out there on this friday if you are driving on 237.

but the latest jd power survey also shows bank customers are less satisfied with the fees banks charge even though fewer people are paying fees. the survey also finds the number of people do their banking is growing rapidly. this year 23% of people under the age of 30 say that is how they prefer to bank. that is twice as many as last year. time now 6:20. jerry brown will go if a business summit with south bay executives to talk about how to make california and businesses all over the state stronger. it's part of the business climate summit in san jose. the mayors of all three of the largest bay area cities will be talking about local business challenges and regional solutions. another featured guest is ibm watson computer. the one that beat two grand champions on the tv show jeopardy. something went terribly wrong at a practice for a boat

good morning, bay area bridges traffic looking pretty good. this is a look at interstate 880 and that is also very light. we are off to a very nice start on this friday morning. 6:25. the practice for a big boat race almost turned deadly in washington state when one of the boats burst into flames. take a look. there is some type of explosion prompting the driver to climb out and jump into the water. firefighter boat came to the rescue and was able to put out the flames as the driver swam to shore. there is no word on what caused the explosion. a little league team is being created for helping a napa man stealing league property. on wednesday a father and son were practicing drills on their

little league field when they noticed a man removing scaffolding from a storage unit. they wrote down the number of the get away car and called police. police soon found the suspect and arrested him. time now 6:25. firefighter training. a historic hotel is being used to train san francisco firefighters to navigate high- rise fires. now the cathedral hill hotel opened as the jack tar hotel. now it's owned by california pacific medical center. san francisco firefighters are training there free of charge. they are breaking through walls and doors and practicing real life rescue scenario. >> you just can't put a dollar value on it. we have training facilities in san francisco. our firefighters have been to it as many times. there is nothing like a real live building to do these

welcome back. thank you for joining us here. welcome to friday, april 22nd i'm dave clark. >> and i'm pam cook. it's good friday so the markets are closed. time now is almost 6:30. there is a special hearing to determine the next step involving the muni driver that was caught texting while driving. >> reporter: i just got off the phone with paul rose and said he will be planning a hearing for today. it's a lot more complicated than they thought it was. trying to talk to some drivers this morning. let's just say they were not in the talking mood. nobody wanted to talk about what is going on here. this is a strike authorization mode.

muni passenger took this video. the passenger reported the incident to muni. she admitted she was texting but said she pulled over first. the unidentified woman said the text was because of a family emergency. when this first aired on ktvu last month earlier this month officials said they would move to fire the driver. muni's chief of operations said he would seek to have that happened today. according to a section of muni's contract firing the driver might take a little longer. before an operator is suspended or terminated the operator may have the right to be heard and face his or her accusers. now it's against the law to text and drive. muni operators tell me they realize the offense is serious. in june of 2008 a operator --

the driver was use his cell phone at the time. one hewn nigh driver said there is 2200 of us out here. this is one of the very few incidents that has happened. reporting live in san franciscokraig debrond. we could find out today if muni operators are closer to going on strike. they have been voting on whether to authorize the strike. it doesn't mean they would hit the picket line. the operators union says the vote is -- that include hiring part-time drivers and cutting overtime. time now 6:32. in the south bay local state and federal agents wrapped up a surprise sweep of registered sex offenders. >> sheriffs office. >> look at this. they went door to door looking for sex offenders violating

their patrol or probation. ktvu's cameras were rolling as agents made that one arrest. authorities say found pornography on his laptop computer. that in itself is a patrol violation because he had been convicted of a sex offense against a child. >> we will take the computer to the sheriffs office and have them do a more thorough search to see if there is anything more child related. >> they made three arrests. 14 were living in a hotel in santa clara. police at ucsf are looking far man with unusual piercings that sexually assaulted a woman. they released this sketch. the man has a black piercing in the bridge of his nose. the attack happened last friday night near the medical school at lincoln way and third avenue. police say the man groped a

ucsf employee who was walking to her car. lock your doors and windows that is the message after two home burglars this month. they happened west of elle camino royal. the burglars got into the home through unlocked windows. in both cases computers were stolen. there was an attempted break in in the area. the suspects removed a window screen but left after they found the window was locked. a grieving father is speaking south about the death of his son. andy zeng was found dead in a home. yesterday his father said he doesn't believe andy's death was an accident. he is hoping justice will be done. two teenagers are facing murder charges in connection with that case. prosecutors of the chauncey

bailey murder trial. yesterday bey's former girlfriend testified she couldn't remember any comments bey had made about the case. prosecutors said she told the grand jury they he asked her to watch a news report about his death. late last night the planning commission approved the proposal for # thousand -- 8,000 new homes, a park, shopping, and offices. others worry about the islands safety in an earthquake. and what it will do to traffic. >> they can't be bringing more cars out here. there is only so much that bridge can support. >> this is an opportunity we have to put carpenters to work. >> it could take as long as 15 years to complete. even if the supervisors approve the project in the next few weeks. if you drive a diesel truck

one that will decide what is next for that controversial muni operator caught texting while driving. ktvu news has learned the female driver was behind the wheel as late as yesterday. also today senator john mccain is mealing with rebel leaders -- is meeting with rebel leaders in libya. he is a big supporter of u.s. military intervention in libya. it could be days after fight fears put out this huge fire at a warehouse. it stores martinelli's juices and apples. it started wednesday afternoon and nearby residents with breathing problems are advised to stay indoors to avoid that smoke. state lawmakers are calling for changes to a commission charged with cracking down on teacher misconduct. that is after a recent audit of the commission called it quote one of the worst run organizations the auditors have seen in a long time. in one instance the teacher was

charged with exposing medical school students with pornography. people who cleaned up after the september 11th attacks will now have to go through terror screenings before they can claim health benefits. letters will go out to police officers, firefighters, and anyone else that helped in that clean up to let them know their names will be checked against a terror watch list before they can get those health benefits. there is a controversial provision in the new 9/11 health bill. it's designed and necessary to make sure no terrorists try to get the benefits. time is 6:45. republican senator guenon son said he will resign next month. he insists he has done nothing wrong but says he wants to spare his family and constituents. he's being investigated because of an affair he had with his staff. he announced he would not run for reelection. a vote on a new target for

san rafael won after city council vote. >> reporter: the sign on the market behind me says it all. no target. target sells grocery. this store is afraid it will take a chunk out of its business. some small business owners like this one lost their fight. plans to bring target to san rafael have been under fire for six years now. just six hours ago the city voted 3-2 to allow the chain to come to town. protestors say a big chain store would crush small businesses, pay poor wages, and cause unwanted traffic. supporters claim that target would create jobs and more than half a million dollars in sales

traffic. what is going on sal? >> traffic is light in almost every area. we have been looking san jose northbound 101 traffic looking good. of course we check in with chp gosh constantly. we don't have a lot going on. we do have a new collision on highway 4 at a street in antioch. that one just came in a little bit ago. we do have one crash now on highway 4 at eighth street. when you get to the toll plaza it is light. if you can bring ups maps in the control -- bring up the maps in the control room i can show you on the top right hand side if blocking but it's before all the slow traffic. even on this day when traffic is lighter, that two-lane section of highway 4 in antioch very slow which is why people want that freeway widened. i don't blame them.

earthquake and tsunami. americans that travel over seas might consider getting new credit cards. chase and wells fargo are trying out if the chip credit cards. they replace the current magnetic strip and supporters say that are more secure. however, most u.s. banks say the high cost of switching over is preventing them from making the change. time now 6:50. rebuilding japan. what is the government is doing now to help its people bounce back from the disaster. the ordeal one woman put herself on just to get on a plane to london. highway 4 is moving along pretty well. if you are in antioch that is a different story. i will tell you more about why traffic is so slow there right now.

the japanese government taking the first steps toward rebuilding. some coastal villages were completely ruined by last months quake and tsunami. they have approved $50 billion for reconstruction. that will cover only a fraction of the total cost of the disaster which could reach $305 billion. time now 6:54. police are investigating a shooting in the east bay shoot of course pittsburgh.

this happened last night outside of an apartment house on leland road. stray bullets litter the street here. there is no information of any arrests made. grocery store workers are waking up hungry this morning. this is a protest against their former employer. they are staging a two-day hunger strike against the grocery store. the former workers are now demanding their jobs back after being laid off in january. they say they laid off 300 people even though the chain is still opening new stores. spokesperson told ktvu said only 150 people were laid off. company also says the layoffs were made because of the struggling economy. a young woman from mexico city staged a hunger strike but for a different reason. the 19-year-old did not eat for
