continues. the cost of fair services is up 30% over the last five years and with a $3.5 million budget deficit, something has to give. police pushed the crowd into hallways as the city council debated the controversial idea 6 hiring a private company as its new fire department. >> fire to a contract, a bid contractor? what happens if they fail? will any of you guarantee that they can save my house in a fire? >> what's our next step, black water for police services, haliburton to handle public works? >> reporter: we have a responsibility to the stockholders to do what's right to maximize profits. >> they say they have a long track record of providing fire receives at facilities including cape canaveral and will have to perform if they

skyline boulevard. it created a very long back-up. some drivers gave up and made u- turns. the leak was capped within a half hour. only eight pg&e customers were affected. the leak occurred anyway main street in half-moon bay. pg&e will begin testing a line similar to the one in san bruno. coming up at 10:30, we'll take you to the neighborhood where tonight residents learned about pg&e's plans. another twist tonight in california's legal battle over same-sex marriage. opponents are filing an appeal saying a federal judge should have never heard the case because he is gay. ktvu's amber lee is live in san francisco looking at whether the appeal has merit. amber? >> reporter: frank, this is the 26-page motion filed here this afternoon. saying that the judge should

have removed himself from this case. this is video of the judge speaking at the university of arizona two months ago. prop 8 supporters are now asking the u.s. district court to throw out walker's decision who ruled the same-sex marriage ban unconstitutional. they argue he should not have presided over the case because he's been in a same-sex relationship for ten years. >> he was obligated to recuse himself or provide full disclosure at the outfit of the case. these are the circumstances that demand setting aside this decide. >> something of a hail mary pass that of something of a desperate move. >> david levine says it's not likely the court will overturn the ruling. the judge's sexual disorientation doesn't disqualify him, just as any judge's race, gender, or

marital factors are not factors. they are not suggesting a gay or lesbian judge should not sit on the case but no judge is permitted to try a case who has interest in the outcome. that argument is a near smoke screen for fear and bias against gays. >> it's ridiculous. >> does that mean a woman judge or jurist cannot rule on a case involving women? does it mean somebody that's african american cannot rule on a case involving african americans? >> reporter: david levine said it will take about two months for the court to decide on the issue. reporting live here in san francisco, amber lee, ktvu channel 2 news. a prominent law firm hired by republicans to defend the federal ban on gay marriage quit under pressure. they hired the firm after president obama ordered the justice department to stop

defending the defensive marriage act, but the firm came under intense pressure. in a twist, one law firm partner quit the firm so he could continue working opt gop case. nfl players scored a victory today in federal court, but prospects remain clouded. a judge in minneapolis ordered an immediate end to the 6-week long lockout, but the league immediately appealed and is asking for a stay of the ruling. so what happens next is unclear, because there is still no labor agreement. however, the players association did advise players to report for work tomorrow morning. later this hour, what a prolonged lockout could mean for the bay area's two nfl franchises and the stadiums where they play. we learned both san francisco and oakland are scrambling to make sure they can make up for any lost revenue. a new community advisory committee met for the first time to address issues of

excessive force. as maureen reports, the department wants a new image but first has to face legal options. a 26 year old claims he was hurt in 2009. the second case filed in october of last year maintains police heard a convicted drunk driver after tackling him in 2008. chief chris moore hopes to avoid such lawsuits in the future by working with critics. >> we're really optimistic to developing a new era of police- community relations and are looking to the chief as a partner in building a safer san jose. jr. one of 18 -- one of 18 members on the new committee that met tonight for the very first time. the chief has implemented another change here. he's also made it easier for the public to file complaints. >> before citizens needed to come in to internal affairs. now they have the option of

voicing compliments or complaints online. >> reporter: the city's independent police auditor says it's critical the public report concerns. >> i haven't been able to determine trends yet, but those are the kinds of things i'm going to be looking at. >> in 2009, there were 214 complaints resulting in a total of 527 allegations. 19% of them were force. today we get to see the cover of the new auditor's report detailing last year's complaints. those figures will be made public next friday. in san jose, maureen nailer, ktvu channel 2 news. the oakland city attorneys office says it's taking steps to implement a third gang injunction in the city. it's focused on an unnamed gang in east oakland. currently, oakland has one gang injunction in place and are pursuing another gang injunction in the fruitvail neighborhood. that seeks to limit 40 gang

members from associating with one another. three men could face the death penalty in connection with the first homicide in alameda. it happened wednesday. the coroner has identified the victim as 32-year-old william adrian of oakland. prosecutors are charging three men with special circumstances murder and robbery in connection with with his death. two of the suspects are also charged with possession of marijuana for sale. an alameda widow says she's relieved that a second urn containing her husband's ashes has been found. on friday a caretaker discovered the ashes. the remains of marvin were taken from the same church last month. the ashes were in three urns inside a back pack that a thief grabbed. one of the urns was already recovered last month. california lawmakers are moving forward with an effort to get tougher on drivers who

refuse to put down their cell phones. the state senate voted to raise the fines were texting or using a hand held device while behind the wheel. a first offense would cost a violator $328. that's up from $208. repeat offenders would pay $528. the bill now heads to the state assembly. the state also passed a bill today requiring skiers and snowboarders under 18 to wear a helmet. that bill now moves on as well. if it passes, parents or guardians whose children are caught without a helmet could face a $25 fine. in the south bay, the board of supervisors is expected to vote tomorrow on a plastic bag ban. the proposed ban would apply to 56 retailers in unincorporated areas of the county. the ban would not apply to restaurants, fast food chains, or non-profit groups. i'm going to be back in about 8 minutes. we have clouds to the north of us, most of the showers are

nato air strikes hit the compound of moammar qaddafi overnight. by the light of day, the damage was clear. the bombs targeted a communications center that was used to coordinate attacks on civilians. libyan officials said it was a failed attempt to assassinate qaddafi. he was not hurt and said to be in well and high spirits today. heavy fighting reported in libya's misrata. including a family of six were killed. the qaddafi government claimed it was on hold firing on misrata. the public face of egypt is taking an extended city bat call. why he plans to use technology

to help fight poverty in egypt. he was instrumental during the uprising and was later arrested and beaten. following his release, he spoke before tens of thousands in tahrir square. cyber security was a hot topic in the bay area and washington today. local businesses want the government to keep them safe and say it's a matter of national security. >> the companies employee more than four million people. they are in washington asking the government to improve cyber security. >> it's as simple as really doing what we can to improve protection. >> janet nepal tan know said it's going to take government and private business to improve

shooting at an oakland nightclub. we have been digging deeper into the case and have learned the shooting started as a street robbery. it all happened at sweet jimmies, a bar and restaurant at 3rd and broadway near jack lennon square. debra is live tonight with new details on how it all happened. debra? >> reporter: well, we've learned the people standing here outside sweet jimmies were targeted by want 1s sizing up their -- suspects sizing up their cash and jewelry. the first victim was shot for resisting. victims had been at a concert and then came to jack london square for an after party, but also in the neighborhood, four men in a car like this, looking for people to jack and knowing concert goers would be here. at nations next door, they locked up hearing gun fire. >> a lot of commotion outside. i just locked the door. >> sources say the robbers

door white dodge avenger. now there's a $40,000 reward in the case. one man shot to death was the one who originally resisted the robbery, and the other was a man walking out of jimmies mens room and was caught by a stray round. reporting live in oakland, ktvu channel 2 news. of the four people injured, two remain hospitalized tonight in serious condition. the uncle of one of the wounded men tells us his nephew is a good kid with a daughter and is involved with his church. the uncle questioned the wisdom of police cutbacks. >> things get taken care of. not going to stop, but chances are you will curb violence. if it's not there, going to escalate. >> he told us his nephew was shot in the head and the family doesn't know if he will recover. as police search for the gunmen, stay with ktvu for continuing coverage. on our website you can get another look at the suspect's vehicle. the family of a german

tourist killed in san francisco has returned to the city. last august he and his wife were looking for a place to eat off union square. some teenagers nearby got into a fight and then the shooting started. he was shot and killed, the case remains unsolved to this day. stephen is here now showing their two sons their mother's favorite u.s. city. congressman ron paul says he plans to formally announce tomorrow he's forming a presidential exploratory committee. the texas republican is referred to by some as the "intellectual grandfather" of the tea party movement. he sports deep cuts to defense spending and opposes wars in iraq and avenges. paul has run for president twice. haleigh barber says he isn't feeling the fire in his belly and will not be a candidate for president.

the 63-year-old republican's announcement today came as a surprise to many. he recently visited several states with early presidential contest. barber is a social and fiscal conservative and is the former chairman of the republican national committee. he says he's not ready for the all-consuming effort that comes with a presidential campaign. so, no rain in the forecast, that's the good news. we have weather systems to the north of us. there were showers this morning, they were light, .5 of an inch, some .1 of rain. not very much. this afternoon things cleared out. overnight, we see clearing that allows temperatures to get cooler. it's also going to allow for fog to form in the north and east bay valleys. vallejo, napa, pretty good chance. it's late in the season but with last night's moisture and tonight's temperatures, good

san francisco firefighters say about a dozen people are out of their homes tonight following an early-morning fire in north beach. crews were called out about 12:30 this morning. one woman is credited with rescuing an elderly resident. the woman carried the man to safety. it appears an electrical problem is what started the fire. turns out firefighting foam washed into a nearby slew killing hundreds of fish. >> reporter: there are signs of life, wildlife today, at the slew, activity that disappeared here after a two-day fire destroyed a warehouse miles

from the slew. firefighters resorted to foam. >> it helps extinguish the fire, smothers it. >> reporter: the runoff, foam, and fire debris smothered hundreds of carp, sun fish, blue gill, and cat fish, but today they say there is no long- term damage to the slew. >> it's good news. >> reporter: fire chief is relieved but not surprised, since firefighters consulted environmental experts before using foam. >> without the foam we could have dumped an additional 2-3 million-gallons of regular runoff. >> reporter: the fire investigation is also impacted by the sheer size of the building. it will take some time before crews make the structure safe enough to enter, so they tried something else. >> part of the reason the crane is here to allow to get over the roof, closer to the building to look at the burn patterns to see if we can

determine where the fire started. >> reporter: from what they've seen, they expect to rule out arson. fish and game ended its investigation and say the slew will return to normal on its own. ktvu channel 2 news. some people in california's gold country are voicing hope that 2011 could bring back another gold rush. an 8-pound gold nugget was found recently an auctioned off for $460,000. currently, the price is gold is hovering near its all-time record high. the geologist that helped sell the nugget says he's going back to look for more gold and others are expected to do the same. >> the question, obviously, there's still gold out there in the hills. >> reporter: geologists call the 8-pound nugget a one in a billion find, something would- be gold diggers might want to consider. dow has lost 26 points,

new at 10:00, some south bay rebates are on edge after pg&e crews moved into their neighborhood. the utility is getting ready to conduct testing on sections of natural gas pipelines similar to the one that exploded in san bruno.

pg&e has it clearly labeled as you can see. here, the label 132-a. sound familiar in 132 was the pipeline that ruptured in san bruno, killing eight people. >> when i saw san bruno, i said i bet that's the line behind my house. i really thought it. >> this is what happened to line 132 in san bruno. line 132-a runs for about a mile and a half from under the shoreline golf links down and into the rex manor and sterling estates neighborhood. it's similar in age to line 132 and like san bruno, in a similar densely-populated, high consequence area. >> you were not aware there was a pipeline? >> not really. i've seen the crews here but didn't get the information.

fellow unions. members of nearly one dozen unions rallied and raised their voices outside the association that manages bay area ports. the union stays with a sympathy strike along with workers in wisconsin who lost their collective bargaining rights back on april 4th. now the union is being sued. >> this is not at all surprisings because we view it as a way of sending a message to all workers. >> the union is asking for the suit to be dropped. a spokeswoman for the port argued the long shoreman violated their contract. st. clair radiation levels county district attorneys office is reportedly getting ready to release guidelines on how to legally operate medical marijuana clubs in the county. santa clara officials suspended raids on dispensaries late last year. the move came after county

prosecutors said they wanted to review the law to clarify how the dispensaries should operate. the new proposed guidelines put an emphasis on remediation of problems instead of police actions. manufacturing flaws may be to blame for why a southwest airlines jet cracked open in mid-flight. the national transportation safety board today said some of the holes were too large, were not round, and did not line up correctly. a 5-foot long hole opened in the roof of that cabin. fortunately, there were no injuries. two electric cars passed crash tests with flying colors. chevy's volt and nissan's leaf are the first such cars to be tested. they are the winners of the top safety pick from the institute. the food and drug

administration said today it plans to regulate smokeless electronic cigarettes like regular tobacco cigarettes. they heat a liquid solution and emit vapor instead of smoke, but the fda won't regulate them. as we mentioned earlier, a judge ruled against nfl owners and ordered an immediate end to the lockout. the owners offered for a stay while they repealed. paul chambers looks at what oakland and san francisco are doing to prepare for a possible shortened season. >> candle stick park, home of the san francisco 49ers sits empty right now, and if the nfl is able to get today's situation suspended, the season could be in jeopardy. officials are scrambling. >> we will actively make sure the space is programmed to the best we can with or without the nfl. >> if there's no football

season, san francisco could lose up to $3 million. that's money it makes from concession sales and parking over the entire season. officials are hoping for its football season but point out they are only a part of san francisco's total revenue. >> we brought a lot of food and concessions into our events and we run a lot of programming. >> across the bay, things are different. the city would save several millions of dollars because there wouldn't be a need for the transformation from the coliseum from baseball to football. >> there will be a lot to do to maximize the availability of days. >> experts say if there's a lockout, the restaurant and hotels depending on the games will be hit the hardest. >> probably on the order of $20 or $30 million. >> experts say if it's a shortened season at all, it will hurt the nfl because a lot of fans tend to just lose interest. ktvu channel 2 news.

football player michael vic and the humane society today called on google to drop a dog fighting app. vic served 18 months on dog fighting charges and now speaks out about dog fighting. they say it could be used by real dog fighters. no immediate comment from google about the request. >> bart is weighing in. i'm back here in about 10 minutes with a forecast that's heating up. i'll let you know how warm it's going to get in your city. plus, an overtime finish just in the last half hour. the sharks try to move on to the stanley cup. details coming up later in sports.

muni says it will discipline the operator and make sure other operators know the proper way to secure an open door. house speaker john boehner is suggesting tax subsidies for oil companies. boehner is the most powerful republican in washington, and his comments could signal a significant shift for the gop. his remarks come as gasoline prices go up and up. in news of the world tonight, in afghanistan, more than 480 inmates escaped from a prison in kandahar. the taliban spent months digging a tunnel into the prison and it took 4.5 hours to get the prisoners out. millions were spent to improve security at the prison after another escape three years ago. in syria, anti-government protestors released videos of soldiers moving into the city of dara.

witnesses say soldiers opened fire on civilians and went house to house rounding up suspected protestors. at least 11 people were killed. the u.s. state department urged u.s. citizens in syria to leave as soon as possible. in japan, soldiers serged a swamp for people missing after the mass i have earthquake and tsunami. they stuck poles into the mud. some 12,000 people are unaccounted for six weeks after the disaster. by the end of the day, though, only 38 bodies had been found. another search is underway for those swept out to sea. body believed to be that of a missing 11-year-old boy. the boy and his family were visiting the park from new jersey. the boy's father said his son fell into a creek on friday night. it took crews until this afternoon to find the body about 400 feet down stream from where his father said his son

a essential nutrient. >> once the concrete dries, there will be no chromium problem at all when the tunnel opens on time next year. ktvu channel 2 news. police have released a photo they say shows three jewelry robbers in action. the photo was taken about 5:45 in the morning on pedaluma boulevard. the men broke in and smashed display cases to get to the jewelry. investigators say the get away car was a white 4-door nissan maxima or altima. most of what they took was inexpensive imitations. the california department of public health announced today it has fined a san francisco nursing home where a worker allegedly smothered an elderly resident. pleaded not guilty to the charges of murder. police arrested him after the

death of the 87-year-old last month. the center was fined $100,000 for failing to protect the resident. it was his first day at work. apple is facing a lawsuit over software claiming to track customers. new surface of secret files on ipads and iphones. the lawsuit claims the information puts users' rights to privacy at risk. apple hasn't responded to the lawsuit, but the post has not been sustainuated. jobs has been on medical leave since january. . >> yahoo bought a start-up company called into now. this is speculation yahoo paid more than $30 million. the company is only 12 weeks

old. and welcome back. we're looking at some clouds out there now. little bit of patchy fog at the coast and inland as well. live storm tracker 2 shows cloud cover now, 53 in san francisco, 53 in san jose and 54 in redwood city. see a little cloud out there. not a big deal, but nicer weather forecast in the future, it wassicky this morning with the drizzle and clouds. little on saturday too. kind of an unsettled nuisance shower pattern. it is gone. now we warm up as we go into tomorrow, temperatures back into the 60s, low 70s. as we head into the extended forecast, a spring weather pattern you'll enjoy. the forecast and weather systems turn to the north have a few showers lingering there, but see on the south end of this. earlier we had the jet stream when it was raining farther south or further south. in this case, it's further north. as you'd expect, jet stream rides north as the days get
