6:01 am
patchy low clouds. little chill to the morning air. some upper 30s and 40s. everything looks good to go. little breezy at times, coast and hills but otherwise it will be 60s, lots of sunshine and a few low 70s. steve. right now traffic is moving along well if you are on northbound or southbound 880 looks like a very nice drive. alsos morning commute is going to be okay on the upper deck of the bay bridge coming in to san francisco. windy up there though. let's go back to the desk. an antioch man was shot and killed overnight following a deadly confrontation at his home. police made an arrest just hours ago. ktvu's allie rasmus has a lot more on why neighbors say that victim was targeted. good morning, allie. >> reporter: good morning, dave. the 26-year-old man who was shot and killed lived in this home with his step dad and two other house mates. this is on pine nut way in antioch. antioch police say this was not a random crime. they believe the suspect
6:02 am
targeted the victim. and some of the neighbors here say they know why. according to neighbors this young man had helped out one of his roommates in the past defending her from neighbors describe as a violent ex- boyfriend. antioch police say it was that ex-boyfriend who came to the home around 9:30 last night, got in a confrontation and then shot and killed the 26-year-old victim. now we only know the victim's first name, dave. antioch police aren't releasing his full identity to us yet. last night after the deadly shooting, the victim's stepfather and neighbors gathered in front of the house to pray and console each other. antioch police arrested the ex- boyfriend, the suspected gunman in this case, he is now in police custody. >> he had beat her up and david stopped him from doing that and he came back and it was like retaliation to get dave because he stopped him from beating up his girlfriend. >> reporter: now the same day this shooting happened on monday afternoon antioch police released new data about the crime rate in this city. and according to that police
6:03 am
data, they say crime is on the decline here. police say there were three homicides in the first three months of the year 2010 compared to just one homicide in the first three months of this year. that is obviously before the shooting death that happened here last night. police also say the overall crime rate dropped 18.8% and the property crime rate in antioch dropped about 10%. but neighbors we talked to say after what happened here last night, they're having ahearted time believing that data. reporting live in antioch, allie rasmus, ktvu channel 2 news. time now 6:03. well, a third gang in oakland could be hit with an injunction. the oakland city attorney's office is now going after a gang in east oakland. oakland already has a gang injunction in north oakland. now the city's in court pursuing another one in the fruit vale neighborhood. that injunction seeks to limit 40 suspected gang members from associating with each other. it would also impose a curfew. this morning we have new
6:04 am
information on the huge fire that destroyed a warehouse that was housing products from the maternally company. the fire started last wednesday in wattsonville. firefighters did not get control of the flames until this past weekend. piles of product from the company burned in that fire. now the santa cruz sental reports arson has been ruled out as a likely cause. the focus is now turning to ignition sources around the warehouse. the city of san carlos has rejected a controversial plan to outsource its fire department. ktvu's tara moriarty tells us that the vote came late last night and we understand it was a lively debate, tara. >> reporter: that is true. and after four hours of that fiery debate, the city council came to a unanimous decision. it will pursue a hybrid fire department with redwood city. we're here at the belmont san carlos station and the two are set to break up come this fall. now last night it was a packed house. the police actually pushed the
6:05 am
crowd overflow into hallways and more than 100 people showed up at the meeting. at times the mayor had to pound on his gavel to keep the noise down. the big controversy, well, the council was considering giving the job of fighting fires to a private company called waken hut. >> fire to a contractor, a low bid contractor, what happens if they fail? will any of you guarantee that they can save my house in a fire? >> reporter: but others angry about what they call the bad intentions of city firefighters say they would be willing to give the private company a shot. >> we enter and terminate services if they do not perform satisfactory. >> reporter: now ultimately the council voted for the redwood city option. but if negotiations fail, which they have in the past with other agencies, then waken hut is back on the table. contract negotiations with redwood city starts in june. so why was san carlos in this predicament to begin with? we'll address that issue later
6:06 am
in our broadcast. reporting live from san carlos, tara moriarty, ktvu channel 2 news. the days may be numbered for a program that allows san francisco police officers to collect a pension and a salary also known as double dipping. the examiner reports that the program is actually costing taxpayers $52 million more than it would to hire new officers. one reason is that according to the report officers are getting payouts even if they don't stay in the program. but the police union president says the department would be left short staffed if the program is allowed to expire in june. time now 6:06. americans in syria are being told get out while you can. the u.s. government said that. coming up for you at 6:15, we'll bring you a live report from washington d.c. on the brutal crackdown by syrian government troops against demonstrators and the white house is condemning it. a new twist in the same sex marriage battle. critics are saying the judge who declared proposition 8
6:07 am
unconstitutional should not have heard the case because he's gay. now people against same sex marriage have asked the u.s. district court to throw out judge vaughan walker's decision. in a 26 page motion filed yesterday they say the judge should have removed himself from this case. they say he's been in a same sex relationship for ten years and could benefit from the outcome of the trial. >> he was obligated to either recuse himself or provide full disclosure of this relationship at the outset of the case. and these are the circumstances that demand setting aside this decision. >> does that mean that a woman judge or jurist cannot rule on a case involving women? does it mean that someone that's african-american cannot rule on a case involving african-americans? >> well, some legal experts estimate it will take about two months for the court to decide this issue. the federal ban on gay marriages is also facing legal troubles. the law firm hired by republicans to defend the gay marriage ban has quit.
6:08 am
the atlanta based firm was hired after president obama ordered the justice department to stop defending the defensive marriage act. they decided to drop the case after receiving intense criticism from gay rights groups. but not everyone at the firm agreed with the decision. attorney paul quit the firm to he could continue to work with the republican party on the gay marriage ban. a flag fight is developing in san francisco's castro district. that focus is the huge rainbow flag at castro and market streets. last month some castro residents wanted the flag to be flown at half staff to mark the death of actress elizabeth taylor. but the castro merchants group that maintains the flag said no. so now some castro residents are demanding more community input in deciding when the flag is lowered. that's only happened five times in the past ten years. your time now 6:08. pg&e customers you won't have to pay for the outgoing ceo's
