right now inside the san jose police department police are interviewing a man suspected of killing a 24-year- old man. how the two knew each other and what may have lead up to all of this. the decision for san francisco's new top cop is finally in. his background with fighting crime and the controversy he's been tied to in the past. and the new change in bart. the new change bart is considering to please late night workers and partyers on the weekend. it's all ahead on the ktvu morning news.

hour. all is quiet there. police have left that scene and all of the focus turns to the police department. inside the police department interviews are under way with a 28-year-old suspect and possible witnesses. the victim was pronounced dead around 7:30 last night. this is video from the scene which is in the 1800 block of st. andrews place just about five miles from the police station. it all happened in a home that serves as a residential care facility. the victim lived there. according to police so did the man suspected of killing him. >> preliminary investigations suggests that the victim was assaulted or in some fashion confronted by a 28-year-old male who is also a resident of the facility and we suspect that the suspect and victim were acquainted because they both lived at that resident. >> reporter: police tole me

this morning it appears the suspect and victim got into a dispute earlier in the day yesterday. they couldn't tell me what that dispute was about. right now the identities have not been released interview are still under way at this hour with the suspect and possibly any witnesses at this time. we will couldn't to talk to the police this morning. they expect to have updates within the hour or few hours. live here in san jose claudine wong. we are hearing san francisco mayor ed lee will swear in his choice for a new police chief this morning. according to several media reports the mayor has selected captain greg suhr. he is credited with reducing the homicide rate where he is currently in command. and he has support among fellow

officers but also sue has had his problems in the department. ever hundreds of police officer -- hundreds of police officers received pink slips. they could lose their jobs this summer. why some city officials say the massive layoff could be avoided. someone spotted an unconscious man yesterday. he can't recall much about the attack. now on friday, police say four suspects pistol whipped a 50- year-old homeless man and burned down his tent. that happened inside a hidden homeless camp at golden gate park. so far no arrests have been made. san francisco police are also increasing patrols at golden gate park after vandals targeted trees and park

benches. someone used a saw to cut a park bench in half. they also hacked down six trees including three young redwoods. that happened sometime over the weekend people living nearby says the park is safe during the day but nighttime is a problem. >> he lives right on thornton. if you see somebody going in you know that -- >> you shouldn't go in with them. >> reporter: you just stay aafter dark. >> yeah. park vandals destroys 44 trees and three dozen rose bushes and someone drove across the golf course and tore up the grass. suspected serial killer joseph naso is due back in court. he is expected to enter a plea in a case that is getting national attention. he killed four women in

northern california in crimes dating back to the 1970s. investigators say he may also be responsible for several unsolved cases. a suspected peeping tom has been arrested at uc berkeley. they noticed a teenager poking his head from a stall while they were taking a shower last week. one of the women reported the incident to campus police. a is-year-old boy was arrested. this is the fifth peeping to case reported since february. police are still investigating to see if there is another suspect. today a major restaurant chain will hold another fundraiser for injured giants fan brian stow. he was beaten outside of dodgers stadium. he is in a coma in southern california hospital. police are still searching for his attackers. today all of the chilis

restaurants will donate 15% of its profits to stow. state regulators are ordering pg&e to though say will not pay for the multimillion dollar retirement package. pg&e said customers would have to foot the bill for his $10 million pension. but after public outcry the utility agreed to cover his pension out of their own pockets. they told pg&e to set up a special account by may 15th to fund darbee's pension. bart could be running later at night and on weekends. it's considering a six-month test run this fall. bart station where the last train leaves at midnight on friday night would add one that leaves an hour later. saturday service would begin another later at 7:00 a.m.. it could become permanent.

govern skies -- good morning, skies are clear. not as cool. we will enup with sunshine. breezy again. hundreds of city workers in san jose are receiving pink slips this week. the city says it may have to lay off as many as 600 people to help bridge a $115 million deficit in notices are going out while many unions are still negotiating contracts with the city. the layoffs are set to take effect july 1st. >> i don't know how i'm going to tell my family or explain to
