here illegally. >> reporter: i.c.e. statistics show that 241 people have been deforted. 111 of those people had no prior criminal conviction. david stevenson, ktvu news. san francisco major ed lee spoke today about the sheriff's refusal to comply with security. >> if it's up to the federal authority to tell us that it's up to us. if they are saying on the one hand that it's not that you can't opt out and there's no choice on your part then we don't have a choice to not comply. >> reporter: mayor lee said the sheriff's decision will not be implemented until june. the opposition is also spreading outside the bay area. a similar bill is pending in illinois. colorado has negotiated a modified agreement with the government. and washington recently became

the first state to refuse to join the federal program. the congressional hispanic caucus has added its voice. the caucus sent a letter to president obama yesterday asking him to halt the program. san jose business owners are hoping this doesn't happen again tonight. it unfolded live last night on the 10:00 news. news chopper 2 is overhead before police had everyone arrived. as hundreds of cinco de mayo revelers got out of hand as they began rocking cars and vandalizing shops. store owners there are still on edge. robert handa has the story. >> reporter: some business here are boarded up right now and plan to stay that way until after the cinco de mayo celebrations calm down. they say they have reason to worry. >> the windows are being covered but not replaced. that's the attitude many san jose business owners have after

their buildings were vandalized during cinco de mayo celebrations. around 10:30 last night. news chopper two captured pictures of people harassing drivers and jumping on cars. police had not arrived because officers were busy diverting traffic from downtown. >> they started throwing stuff into the places. to my place they threw a big plant that i had in the front some rocks and everything. >> retaliation more for the cops i guess stopping their fun downtown. >> reporter: police plan to remain aggressive because of the seven arrests last night. two involved weapons and as ktvu showed some gathering turned into violent confrontations. >> there was a stabbing, we don't want people walking around with weapons. you mix weapons with alcohol that could be a bad mix. >> reporter: while many business owners try to deal with the destruction. some that escaped major damage

crews clear oil from the highway. an accused serial killer will act as his own attorney in the death penalty case involving the killings of four north california women. 77-year-old joseph nasso appeared in court for the first time today. the court told nasso told the court, i am convinced you know what you're doing. the federal receiver put in control of medical care at california prisons is defending his reform efforts tonight. california's inspector general released his report that health care remains unsemiable at 2/ -- remains unacceptable at 2/3 of prisons. >> we need to deliver medication to every cell front. instead of having the inmates come to a line. that's just almost impossible for us to do given the

numberover prisoners in each of these facilities. >> reporter: the supreme court will decide next month if the state has to reduce the inmate population to improve prison health care. >> reporter: gas prices are easing slightly at the pump. in fact, aaa says prices appear to be stabilizing but with the nationwide average at $3.98 today, some folks are apparently getting desperate. and ktvu's allie rasmus is live at the park and ride with the bold action that someone took there. allie. >> a bold action that is costing some drivers money. we talked to one man who parked his truck at this concord park and ride at 6:00 a.m. yesterday, by the time he came back from work at 3:00 in the afternoon, he discovered someone had pried open his gas compartment. he also found a chain just like this one next to his truck. >> i thought my gas had been stolen. >> reporter: by the time he got into his truck his gas tank confirmed his suspicion. >> it was about a half tank. >> reporter: he had the

equivalent of $50 of gas siphoned out of the tank. >> i was pretty surprised. pretty surprised that people just go in the broad daylight and do that. >> reporter: this man says the same thing happened to his friend who had parked his car in this same lot last week. his gas cap was tossed on the floor and there was gasoline next to the car. at the same park and ride we found three other cars with his gas tank open. >> people are going to get a little more desperate. >> reporter: so far perry is the only person to call about gas theft at this park and ride and the 45 others across the bay area. but chp has alerted it officers about the problem. >> as of right now it appears to be an isolated incident. but we do remember from a few years ago when gas prices spiked we have had many reports from park and rides and other places. >> reporter: and even if you have a gas door that opens using a lever from inside the car, chp says these doors can

be very easy to pry open. so they recommend you get a gas cap with a lock on it to protect yourself from future theft and they say you can buy those gas caps with the locks on them at any auto parts store. reporting live, allie rasmus, ktvu news. and taking a look at gas prices, san francisco is still the most expensive at $4.32. in oakland and san jose the average for a gallon of unleaded gas is $4.28. the town council voted earlier this week in favor of an ordinary requiring that 75% of all apartments be nonsmoking. a second vote will be taken next month to ratify the measure. if passed it would affect any apartment complex with four or more units. researchers at ucsf are raising questions about the

safety of stun guns. ucsf cardiologists looked at a number of safety studies. they found 96% of studies consider tasers to be safe. while only 55% of studies believe them to be safe. past ucsf studies have warned about the risk of cardiac arrest of people who are taserd. president obama flew to meet with the troops who recently returned from afghanistan. >> you showed incredible skill and courage of countless individuals, intelligence, military over many years. the terrorist leader who struck our nation on 9/11 will never threaten america again. >> reporter: president obama awarded presidential unit citations to the helicopter pilots and navy seals who carried out the osama bin laden

a glimmer of hope along the road to recovery for the giant's fan who was brutally beaten after a dodger fan in los angeles. his doctors in l.a. decided today they do not need to conduct surgery to remove swelling. his girlfriend is taking his two children out to dinner tonight maintaining a routine while their father is in the hospital. stow's roommate is among those waiting for him to come home. >> it's hard not to think about it, i mean there's cars in front seatover my house. it's there. i see his stuff every day. >> reporter: bryan stow remains hospitalized in los angeles. he has remained in a coma since the march 31st beating. police are still looking for the two men who nearly killed bryan stow. these are composite sketches of them. one is described as a stocky latino of average high with a shaved head, mustache and goatee. he may have have tattoos as

there and more people hoping to land them. the u.s. labor department says the economy gained 244,000 jobs in april. business are feeling more confident. workers must feel the same way because more people resumed looking for work last month. however that move pushed the nation's unemployment rate up to 9%. ceo's are getting paid more than they were before the recession -- ceos are getting paid more than they were before the recession. that's 24% higher than the year before. the highest paid ceo was viacom chief who took in $84 million for running the company that owns mtv and paramount pictures. an early burst of trading on wall street slowed by the closing bell. the jobs report sparked the activity but a sell off softened the stock excitement.

cooler and some clouds. there might be a sprinkle out toward fairfield, davis, sacramento. this is the forecast, it shows rain too. saturday morning, clouds. more clouds saturday afternoon, that's certainly going to help with the cooling, then here we get into sunday, you see a few sprinkles stray up in the north bay and eureka. sunday evening, just clouds and cooler. so that's it. the clouds will be the main impact or the most noticeable thing on sunday. the showers, i don't think we're going to see any. but we will see cooler daytime highs. so forecast day temperature in vallejo 67, 72 in antioch. 72 in concord. these forecast highs significantly cooler than they were two days ago when morgan hill was almost 90 degrees. we had record highs two days ago. we had 90s yesterday. that's done. that's done until next week. then temperatures warm up again. the bay area weekend which is right in view because it's right here. we'll have temperatures cooler
