see kind of game. right now here in oakland, mike mibach. a tanker truck crashed and then caused traffic for miles. it happened about 12:45 this afternoon in oakland. traffic backed up as we said for miles, the tanker truck was carrying a thousand gallons of biodiesel fuel. the driver was injured, but there is no word on his condition. now even though the scene was cleaned up hours ago, one lane remained closed. and that led to some major back ups all afternoon. these are live pictures. the northbound lanes there are on the right. the traffic is still flowing very slowly as we head into the evening commute. traffic in the other direction is also slow. a memorial service will be held tomorrow for omar ahmad the san carlos mayor who died of a heart attack on tuesday.

the public is invited to attend the memorial which will begin at 3:00 p.m. at the heller university museum. the 46-year-old had become mayor in november after serving in the city council since 2007. in accordance with islamic custom, he was buried a day after his death following a service in a mosque. and we are expecting a decision in a legal challenge in the jonesboro memorial. it'll be dedicated to those who died three decades ago. a woman who lost 27 members of her family is leaving the lawsuit against the memorial. she says she's angry that it includes the name of jim jones who led his followers into suicide. jones son told ktvu he's baffled by the opposition. >> i think the key thing is that it's a place of remembrance to a tragedy that's

overdue. the memorial is done, you can't put the genie back in the bottle. >> reporter: the official dedication ceremony is set for the ends of this month. a judge refused to grant an injunction to force the release of records of california's lethal injection drug. the drug is a controlled substance one that is illegal to import. the group wants the drug enforcement administration to release a statement on how the state got the drugs. he has ordered both sides to report back next week. a brutal attack inside napa state hospital has left a patient in grave condition. patients from inside napa state hospital called our station soon after the bloody fight. this comes just days after a staff member was attacked by a patient. ktvu's janine de la vega is live in napa now with more on what happened, janine. >> reporter: frank a hospital

spokesperson is not releasing much information but she did confirm that one patient allegedly assaulted another patient. we're told by staff that the victim is in a coma an on a ventilator and the attacker is behind bars. 31-year-old victor mandujano was booked in for battery. patients inside the state hospital say last night he attacked one of his roommates described as a frail man in his 60s who was a new patient. >> he just started pounding on him, pounding him to a bloody pulp. to where he they didn't even know who the person was when they walked in and found him. >> reporter: sources inside the hospital say the attack happened in the unit that holds the most acute mental patients who are considered highly dangerous. patients told them that mandujano had told them for a while that he's tormented by voices in his head that tell him to harm others. the hospital is investigating the incident. earlier this week the

department of mental health told ktvu it is hiring 35 staff members who are safety and security focused. but employees say more change is needed fast. >> they are trying to protect ourselves and individuals and it's very hard with lack of staff and lack of security. >> reporter: more police are needed, right now officers are stationed on the outside and their primary job is to prevent patients from escaping. >> small changes have been made but not of significance, like in safety. people are still feeling unsafe. >> reporter: mcintosh says that one of those changes is last names were taken off employee badges as a security measure. but mcintosh feels that as well staff members and patients are becoming victims because they are not being as protected as well as they should be. janine de la vega, ktvu. a police officer has been cleared in any wrong doing for

live was so sweet for san jose sharks fans a few weeks ago. that mood has turned ice cold as the sharks are ready to play an all or go game. >> it is an early start and we have seen people rushing to get here on time. but the shark's spirit around town started early. >> go sharks. >> reporter: there is no pessimism dousing the spirit of these fans. it was hard to go any where from san jose without seeing some play off fever being displayed. but there is a little aparen he thinks since the sharks once led 3-5. >> it's so important.

on wall street today stocks initially dropped more than 150 points but ended up edging higher after a late rally. the market improved today thanks to a recovery in commodities and companies that make food and beverages. coca cola, mcdonalds and kraft foods all posted gains. the dow up almost 66 points closing at 12,695. the nasdaq rose about 18 points closing at 2,863. a free man, we were there as a convicted killer was released this morning from san quentin. his emotional apology for the crime that sent him to prison. mary tyler moore is headed to surgery. the reason why the famous actress has chosen to go under the knife. new at 6:00, gas prices

a convicted killer has been behind bars in san quentin now for more than 20 years is a free man tonight. he also says he is a changed man. claudine wong was one of the first to talk to ernest morgan the moment he was released. >> reporter: when 42-year-old ernest morgan climbed out of this van outside of san quentin prison there were tears but few words. for the first time in 24 years, morgan is a free man.

>> i took the life of my stepsister charlotte mccline. that was 24 years ago, i'm not the same person that i was then. >> reporter: then 18-year-old morgan shot his 14-year-old stepsister during an attempted burglary at his stepfather's home. >> if i have to do the rest of my life in prison i can understand. >> reporter: the crime ripped apart his family. >> i could never imagine after 24 years this was going to happen. >> reporter: but morgan said when he focused on himself he started to change, then came forgiveness. >> my husband feels good, he's charlotte's father, that's a very important thing. he feels good about what he has done. >> reporter: morgan educated himself, became a model prisoner and helped at risk kids. morgan took off his prisons blues and saw his little

to jail. he was released then ten minutes later he broke into a home. he ended up in jail that same night. a judge sentenced john demania was sentenced to prison for being a security guard at a nazi death camp in 1943. actress moore is 74, she has menongioma it is a slow growing tumor in the membranes that cover the brain. a spokeswoman saying doctors have been monitoring that tumor and that the surgery is elective. the date of the surgery has not

a gruesome mystery is unfolding, all be it slowly in the south bay. what we do know is that early this morning a man was found bleeding on the sidewalk in santa clara. this happened in the 3,400

block of lafayette. paul chambers there live, what are investigators telling you. >> reporter: i just got off the phone with police, they say they are releasing very little details because it might compromise the investigation. they are not releasing the name of the victim because they say they are still notifying family. right here is where they found a 62-year-old man's body inside of this business behind us. a man lived next door in this apartment complex, every day he would leave his apartment, walk along this path and go to the store behind the bushes. he says this morning he arrived at work at 5:00 and there wasn't anything going on. an hour later, -- >> some where around 6:00 a coworker had gone next door to robin robby and had noticed the individual here on the ground. >> reporter: just before 6:00, police say they received a 911

call of a man lying outside of robin robby bleeding. >> shortly after 6:00 at about 6:04 this morning our victim was pronounced dead. >> reporter: there's surveillance cameras on the side of the building but police say they are not working. police have ruled this a homicide. >> many different factors have led them to believe that this is not an accident. >> reporter: according to rodel, those who knew the victim said every day before work he would make a short walk to this store. >> he comes over to rotten robby to get a cup of coffee every morning and returns back to his house. >> reporter: it's unclear if the victim was on his way to the store or headed back home. police would not say how he was killed but did say there was a lot of blood involved. investigators do not believe this was a random act. if you know anything about this case you are asked to call santa clara police. san rafael police have now made four arrests and located a car in connection with a gang related fight that ended in the death of a 21-year-old man.

the fight was yesterday on b street near the san rafael community center. the suspected get away car, a white pontiac grand am was found sunday after midnight. four suspects have been identified, police say all four are gang members. >> he said help me, help me i'm dying. and he said they hit me. they hit me. i thought he got hit by a car. >> reporter: the victim later died of stab wounds. he is identified as 21-year-old jeffrey olmstead. a contra costa officer is

denying charges that he opened a brothel. but welsh's attorney says it is a lie and that butler is simply trying to get his jail time reduced. more than a dozen officers from the oakland police department finished a grueling four day bicycle ride today. they road in memory of the four police officers who were killed in march of 2009. they joined hundreds of officers from all across the country cycling from new jersey to washington. the ride memorialized all those who have died in the line of duty. >> i think we're healing and coming together stronger as a family. there's a couple survivors that are riding with us. and this is a way to tell them you are not forgotten as well. >> reporter: the ride kicked off police week in washington where thousands of officers and families have gathered. back now to the san jose sharks game. this is arguably one of the biggest games ever played in san jose and the season here is

are not play off contenders. fred inglis, ktvu news. four months of demolition work is now finished and the construction is underway. look at those pictures there of memorial stadium. it is dramatically different. the historic facade will remain but the plan calls for completely rebuilding and retrofitting the inside. two sections of floating seats in the area of the hayward fault that are designed to ride out an earthquake. there will also be theater style seats and a lower field to improve sidelines. the $231 million project is set to be completed in september of next year because of the prompts, the bears will play their home games at at that time park. looks like republicans could have a crowded field of presidential candidates leading up to the 2012 election. campaign aids today said ron paul will run for president for a third time. the texas congressman is expected to make the announcement tomorrow while in new hampshire. so far five republicans including house speaker newt

three weeks ago we showed you these rare pictures of a bat ray thrashing in the water near redwood shores at the same time as dozens of dead leopard sharks were turns up on the shore. they found internal pleading and lesions on the brains of those sharks. the american academy of pediatrics and other health organizations called on the fda

today to ban menthol in cigarettes. health experts said 600,000 americans are expected to die by the year 2050 from smoking menthol cigarettes. they say the tobacco industry have targeted african american smokers. >> menthol's taste and cooling affect mask the effects of tobacco. making it easier for people to start smoking tobacco and hard to quit. >> menthol is the only flavor that is allowed to be added to tobacco. the issue is resinating with many voters. yesterday some house republicans gathered outside the capital to call on the president not to use the issue

transportation officials say bicycle riding has increased 58% in the last four years. bike to workstations were set up near the golden gate bridge on the peninsula and in many bay area cities. and while the goal is to encourage new riders to bike to workday, many say they are doing it all year round, especially as the price of owning a car has gone up. >> i save approximately about $300 a month just from biking. >> reporter: evan wilson says he has a car but only uses it when he has to bring large items to work. he says he does face challenges using this as his primary commute vehicle. >> concessions you have to make riding a bike, such as carrying all your stuff on you on your back. dodging cars, getting doored, the whole risk factor is very present. >> reporter: officials have been prompted by bicycle groups to make bicycling safer by designating bicycle only lanes. >> as we build better bike ways like here on market street more

traffic controllers has jumped up by 63% in the last year. air traffic controller reported that 53% were still in training compared to 25% still in training in 2004. now those replacement controllers are nearing retirement leaving the nation's air traffic centers with fewer experienced workers. we have an update now on a story we brought you earlier in this newscast. a judge has just denied a request for a temporary restraining order against a controversial jones town memorial. that means the work on the monument can continue. while the monument itself is almost complete it's after the evergreen cemetery. the monument will be dedicated to those who died in the mass murder. but one family member is suing the cemetery because the plaque
