an east san jose shooting leaves one man dead and police searching for several possible suspects. police have finally released a suspect photo. what's next in the bryan stow beating case. and conserving the energy may not payoff after all. a major rate hike that could prove that theory. all ahead here on the ktvu morning news.

good morning. thank you for waking up with us. it's thursday may 26th. i'm pam cook. a bit of a change in the weather. let's check in with steve paulson for the forecast. hi, steve. hi, pam. we have partly cloudy skies. mostly cloudy towards the north bay and then partly to mostly sunny everywhere else. not that warmer. some rain could be clipping mendocino county. still on the cool side for 60s or many very low 70s. update on traffic with sal. traffic is moving well on interstate 880 in oakland. traffic looks good all the way up to downtown. also san francisco northbound 101 no construction work. that traffic is clear on the way to the lower deck. at 4:31, let's go back to the desk. well, overnight a man was shot and killed in san jose. and this morning police are still looking for the gunman. it happened on checkers just before 11:00 p.m. that's where ktvu's jade hernandez is with more on this

investigation. good morning, jade. >> reporter: good morning. we've just learned that officers have canvassed this neighborhood twice. they're looking for anyone who might have seen or heard anything. right now san jose police have their mobile command center out here. they had a canine officer also out here. and half a dozen squad cars are parked in and around this area. the car involved, not sure if you can see it, but it's the white car, a jetta just past the white suv in the foreground. that car was involved in the shooting. we tried contacting the spokesman for the department this morning we're still waiting to hear back from him. so far this is what we know from the information provided shortly after the deadly shooting took place. someone reported a shooting last night. when police arrived they found a man bleeding with a gunshot wound. that man died at the hospital. we've been in touch with lieutenant here on scene and right now we know police are looking for at least one suspect, possibly more. but right now no descriptions have been given out. the name of the suspect is not -- or the name of the victim is

not being released because relatives have not been notified at this point. this is san jose's 20th homicide of the year. and as you can see i can bring you back out live officers are gathering evidence here at the scene. we're waiting for any new updates. we know that a lieutenant has been touching base with us every 20 minutes or so. and as soon as we get more information, we will pass that along to you. right now what we know a deadly shooting happened just after 11:00 right here as you can see police still have the crime tape up. we'll bring you more information as soon as we get it. reporting live from san jose, back to you in the studio. also this morning police are trying to determine why a 17-year-old boy was shot and killed as he road his bike home from school. this is a picture of detained franklin jr. yesterday afternoon at about 2:30 police found his body on the corner of olive and richie in east oakland. he was only minutes away from his home before being gunned

down. >> i don't understand who would take that time of the day to lay waste to somebody's life who was doing something with it. >> known to his friends as tape he was a senior at castle month's leadership prep just weeks away from graduation. friends say he got out of trouble, spend most of his time with his brothers. the ceremony is now being dedicated to him and a handful of students who also lost their lives this year. we're getting our first look at the man accused in the savage beating of giants fan bryan stow. the los angeles police department released this mug shot of 31-year-old ramirez last night shortly after he appeared in a police line up. police say they are satisfied with the results of that line up. they now plan to take the case to the district attorney to consider formal charges. now lawyers for the suspect's family will also be busy today determined to prove that police have the wrong man.

they say ramirez's 10-year-old daughter will tell police that her dad was with her on the day of the attack and that they never went to dodgers stadium. >> i went through every detail of that day with his daughter and these other people as well and confident that he was not there. >> police have not yet commented on the reported alibi. investigators will only say that they are confident that they have a strong case against ramirez. investigators now say a florida man's death in an antioch lake last week was directly tied to the highly publicized doomsday prediction. 25-year-old victor drowned late friday night while swimming at contra loma regional park. his death came just 20 minutes before saturday may 21st, the day an oakland based evangelist predicted the world was going to end. family members say that rapture prediction was behind his bizarre late night trip to the park. they say he was convinced that god would help him reach the

other side of the big lake even though he couldn't swim. today the state public utilities commission will consider a plan that could raise electric rates for some of pg&e's poorest customers. pg&e is asking to change its rate structure for all residential customers. under the proposal customers who use a lot of energy would pay a lower rate. and customers who conserve would actually pay more per kilowatt. low income customers who qualify for reduced rates would pay an average of $18 a month more than they do now even though they use 30% less energy than the average customer. well, pre-trial discussions will take place in court today for lawsuits related to the san bruno disaster. more than 60 lawsuits have been filed against pg&e for last september's natural gas pipeline explosion that killed eight people and destroyed 38 homes. today attorneys on both sides will meet with a san mateo county judge to figure out

scheduling for depositions and other legal proceedings. as victims of the san bruno disaster rebuild, some say they're worried about the potential for another fire. the examiner reports that they are particularly concerned about the city's fireworks policy which allows people to buy or use safe and sane fireworks. fireworks that explode or fly are banned. one homeowner has reportedly asked city leaders to temporarily ban fireworks to help protect their properties. 4:37 is the time. let's check in with sal for a look at traffic this morning. hi, sal. pam, good morning to you. traffic is moving along pretty nicely around the bay area. so far anyway we're looking at the east shore freeway and as we look at this traffic is still looking very nice heading out to the west bay bridge toll plaza. and no major problems here. you can see traffic is light. a couple cars coming through of course but not going to be a big delay on the bridge. also in san jose northbound 280

traffic looks good getting up to highway 17. south bay freeways check in just fine. 4:37. let's go to steve. sal, thank you, sir. very good morning. we have a little different pattern today although i have to lean on a lot of cloud cover especially in the north bay. a lot of low clouds streaming in from a very active jet stream. i'll say. tornadoes yet in butte county. couple. one was captured by a helicopter, media helicopter. we talked about severe weather for us we had the rain. it was decent in the north bay. not so much to the south. but the on shore push continues. it's not going to warm up very much. we have a westerly breeze. west-southwest at sfo. west-southwest at fairfield. therein lies another cool forecast. maybe slightly warmer today just by default because we'll have a little more sun if you're not in the north bay. 46 napa. 40s for many here are 50s a little more cloud cover in the 50s. one system swings out. but see how everything's just right at northern california. just like that. coming down the old slide here.

and that's going to keep north bay mostly cloudy. would not be surprise first- degree a passing shower came by. for everyone else it will be partly sunny, a tiny bit warmer. highs today 50s, 60s and a few low 70s. these are again well below average on these temps. it will be breezy. mostly sunny for some. but mostly cloudy farther to the north. partly cloudy, mostly cloudy friday. friday have to keep an eye on another system clipping the north bay. saturday looks all right but sunday windy and cool. maybe a little rebound on monday, pam. thank you, steve. want to talk more about the tornadoes, the weather you were talking about. minor damage is being reported in the rural area outside of key koa this morning after at least three tornadoes touched down. this is one of the funnel clouds spotted in butte county yesterday afternoon. it pulled debris off the ground but no one was hurt. this twister touched down near durham. take a look hat that one. a tiny farming community about five miles south of chico.

a tornado warning was in place until about 7:30 last night. we have more of that incredible video on our website at ktvu.com. look for it under the right now section right on our front page. about a dozen states in the midwest are under tornado warnings and watches this morning. no deaths are being reported in the latest hit in missouri or indiana after tornadoes touched down there yesterday. storms tuesday night in arkansas, oklahoma and kansas did kill at least 15 people at this point. and the search for survivors continues in joplin, missouri, where 125 people were killed. air traffic over europe is returning to normal this morning. we want to show you final eruptions. take a look at these pictures. that's from the volcano in iceland. that occurred early wednesday morning. now europe's air traffic control agency says activity has sharply declined. the ash in the air is breaking

up. and they do expect all air traffic to return to normal within the next 24 hours. well, she's sitting in jail accused of kidnapping her own granddaughter. the ruling that's now making it less likely that she will be released on bail. and the reason investigators say a recent fire at a mosque was no accident. the surveillance image they have to prove it. good morning. if you're driving on westbound highway 4 it looks pretty good so far. we'll tell you more about the morning commute and the bay weather straight ahead.

good morning. we have some low clouds. especially toward the north bay. mostly cloudy there. it will be partly sunny everywhere else. a lot of 60s or very low 70s. just about 20 minutes ago president obama arrived at the site of the g-8 summit in france. show you video of the new arrival this morning. there he is being greeted by many outside. he took time to shake hands out there. president obama is accompanied by russian president and french president. this is president obama's third stop on his six day european tour. meantime congress is rushing to get legislation passed today to extend provisions of the patriot act set to expire at midnight tonight. the legislation would extend for four more years. provisions that allow law enforcement fighting terrorism to use tools such as wiretaps

and surveillance of lone wolf suspects. if the measure is passed today, it would be flown to president obama in france for his signature. right now tens of thousands of people are rallying in baghdad calling for the u.s. military to leave iraq by the end of the year. the demonstrations come as iraqi leaders consider asking u.s. troops to extend their stay. now under an agreement, troops would be required to leave by december 31st. but the widespread instability now has iraqi leaders reconsidering that deadline. a fire that destroyed a mosque in stockton is now being investigated as a case of arson. federal investigators released this surveillance photo of a man with a bag on his head taken from inside the mosque back in april. fire officials say they believe that man is the arsonist. now the mosque and a church next door were damaged in that fire. investigators say so far there's no evidence that this is a hate crime, but there is a

$10,000 reward being offered in the case. a new report finds that 1500 california prison inmates were released on unsupervised parole last year by mistake. 450 of the inmates were classified as having a high risk for violence. a new program allowing for unsupervised release was intended for inmates with a low risk of reoffending. the idea is to have parole agents focused on supervising higher risk parolees, but the report says a computer program that identifies which inmates qualify for unsupervised release is flawed. >> i think people need to be irate about this. i mean we have got -- too many mistakes are being made all over the place and these people are getting paid a lot of money to take care of business and they aren't doing it. >> now the california department of corrections says the problem in the computer system that identifies inmates for unsupervised release have now been corrected. meantime the state officials looking for ways to meet a june 6 deadline to start

removing 30,000 inmates from overcrowded california prisons. the governor and corrections leader are pinning their hopes on a realignment that would send most nonviolent inmates back to county jails. that would require the state give money to the counties, something that's not likely to happen under the current fiscal conditions. well, the bail for the woman accused of kidnapping her baby granddaughter now stands at $5 million. investigators say 58-year-old erica took the 4-month-old baby from her contra costa county home last weekend. the child was recovered the next day in southern california. her bail was increased from $150,000. she's now also charged with an additional count of burglary. family members say they feared she was a flight risk. more than a thousand people attended an emotional vigil for a danville teenager who authorities believe took her

own life. there was song and prayer last night inside the danville congregational church in honor of 15-year-old allison bayliss. san ramon valley high school sophomore disappeared on monday. a photo from that day shows her exiting bart in san francisco. on tuesday allison's bike was found near the golden gate bridge. >> allison walked out on to the golden gate bridge shortly after 10:00 a.m. on monday morning. it does not appear allison walked off the golden gate bridge. >> be kind and compassionate towards one another as you can because you don't know what's going on at home and what's going on in people's heads. >> now the principal at san ramon valley high school is urging parents and students to talk openly about this. grief counselors are being made available on campus. there are questions about the effectiveness of san francisco's sit lie law in the hate ash bury district. one police lieutenant tells the examiner that officers have issued a number of citations

since that law went into effect in march. but there's not much improvement. she says people sitting on streets will get up when they see the police coming, but they just walk around the block and sit down again. the neighborhood association disputes the claim saying conditions have improved. this morning the bart board of directors is expected to vote on the plan to double the number of tasers for its police department. now that would allow every officer on the force to carry a stun gun. an outside consultant made that recommendation after the fatal shooting of oscar grab two and a half years ago. former bart police officer mesherle said he thought he was firing his taser instead of his gun. his lack of experience with tasers was a critical factor in that mesherle trial. well, parking tickets issued in san francisco, the controversial practice we uncovered that could lead to millions of those tickets be thrown out. and the injury that could put the giants chances of defending their world champion

the winner of "american idol" is scotty mccreery. [ cheering and applause ] >> last night the 17-year-old from north carolina edged out the judge's pick to become your new "american idol." after sharing the stage with his own idol, tim mcgraw, the aspiring country singer reflected on his big win. >> it hasn't sunk in yet. i'm just on top of the world right now. i never would have dreamed this would have happened. >> most relaxed 17-year-old i've ever seen. the season finale brought a number of big names to the stage including beyonce, tony bennett, tlc, the rest of the top 12 were also brought back to perform a handful of songs

together. the next step for scotty will be this summer's "american idol" tour. we hope we get to talk to him today. stay with us. starting late next year it will be much easier for car buyers to compare the actual costs of new vehicles. the federal government will require new car window stickers on all new cars, trucks and suvs beginning with the 2013 model year. now they will list how much fuel a vehicle uses when driving 100 miles as well as how much a driver could save with a high mileage vehicle. it will also have smog ratings. the epa unveiled the stickers at tesla headquarters in palo alto. millions of parking tickets in san francisco could be thrown out thanks to three little words. if visible through the windshield, parking officers are required to write the last four digits of your car's registration number on a ticket. but a ktvu news investigation found out most officers aren't even getting out of their vehicles to make the attempt to

get your vin number. we watched officers write the words cannot read on a handful of tickets despite our camera's ability to see the numbers clearly. if challenged, those tickets could be tossed out. >> they're wasting time giving citations which are not supportable in the event of a protest. >> we looked at more than 5 million parking tickets given out in san francisco in the last three years. almost half had the words cannot read. the city's transportation agency insists all the tickets are valid. but since our investigation, they do say they are retraining their parking officers and making an effort to include the vin number on more tickets. there you go, sal. we are working to save people money and get you out of a ticket if possible. my blood pressure just went up looking at those meter maids. >> it does stress you out doesn't it? >> good morning everyone. let's go outside and take a

look at what we have. traffic on northbound 101 approaching the 80 split the traffic looks good as you drive to the lower deck of the bay bridge. no major problems there. also this morning's commute is doing well on the san mateo bridge heading out to the high- rise and traffic continues to look good. 101 san jose, 280 and 85 in good shape as we start off the south bay commute. and i want to mention that the alameda ferry is now back open. it should be open today. high winds over the weekend damaged a dock at harbor landing canceling service to and from san francisco. they had to wait for some of these parts to come in. but now they say that today the ferry, the alameda harbor bay ferry leaving from harbor bay isle will be back in service. certainly a lot of good news for people who use that ferry to san francisco. 4:55. let's go to steve. thank you, sal. our impressive system our observer in cazadero almost half inch. kentfield .39. mill valley in there as well.

napa a third of an inch. san jose .01. about .05 to tenth of an inch san francisco. not too shabby for this time of year. low clouds left behind and very strong jet stream that continues to move right into northern california. there will be some sun today. more clouds to the north but still breezy. 40s and 50s on these temps. but temperatures today struggling again to get out of the upper 60s. very vigorous low an associated front has moved through. everything keeps coming. called a zone flow west to east, west to east. that will drag across a lot of low clouds mainly across the north bay. start with patchy low clouds. still some sun, breezy, slightly warmer. not much. upper 60s, low 70s. too much of a westerly wind and a west direction. some of the low clouds could produce a brief shower or two especially farther north you go. mostly cloudy friday could get a few light showers in here as well. saturday looks okay. then windy and cool on sunday. all right. if you haven't seen it, it's tough to watch.

but giant catcher buster possie is scheduled to undergo an mri today following a brutal collision at home plate. >> he scores. >> oh. the giants' chances of defending the world series championship took a major hit when he suffered that hit. look at him on the ground. his ankle could be broken. we don't know the extent of the injuries. it came during the 12th inning of last night's 7-6 loss to the florida marlins at at&t park. the reigning national league rookie of the year could be out for weeks, maybe even the entire season. overnight a man shot and killed in san jose. the latest on the search for the gunman. and it is going to cost you more to have that morning cup of coffee. how much more may surprise you.
