rain or shine, the show must go on. preparations are underway for the 35th annual union street festival. and the steady rain is soaking the bay area. what you can expect for your saturday coming up. good morning, and welcome to mornings on 2. it's saturday, june 4th. a very wet saturday! it is the first weekend of june, and it is quite a whetted

one. let's bring in rosemary and dive into it. good morning, rosemary. >> good morning to you! this storm quite unusual for june, this is something we see early spring, we're talking inches of rain before all said and done. and take a look at storm- tracker here. it's just very widespread and we've been watching did fall through moment of the overnight hours. through the morning as well. south san francisco seeing moderate rain at this time. san rafael, richmond bridge, some moderate rain as well. we'll see the downpour through the morning hours. we will get a break. we'll talk about when coming up in just a few moments. for the outdoor events, could put quite a damper on things. let's go to san francisco. >> reporter: good morning. they're hoping it's not going to be a damper on things. we're here where the union street festival preparations for the union street festival are getting underway now. cup see they're setting up tents out here, and they're getting food tents ready, setting out chairs, doing all of those preps that you expect. we have some video from earlier this morning of those

preparations underway in the rain this morning. there was a flurry of activity despite the rain to get the event ready. this is one of city's signature events set in the most picturesque neighborhoods. union street festival is known for music, gourmet food, and unique shopping all highlights from this cow hollow neighborhood. one of the event organizers is here now with little bit about this event today, and certainly the big message that you're trying to get out is that rain or shine, the show must go on. >> oh, yeah, the event is happening, none of our events ends because of rain. we produce 27 event from the bay area, we're about to get one hit. we didn't think it was going to be the biggest one of the year pretty much. we also knew more jazz festivals, north beach festival, june the first weekend who would have known, but everyone will be here, arts and crafts, food vendors, everybody. >> the rain can't put a damper on the good spirits. you're still hoping for the fun times, right? >> the fun times will definitely be had.

all of our restaurants will be open. our merchants on union street will be open selling their wares. we'll industrial our chef demonstration, entertainment stage, everything still happening. >> one difference we should note, deny than years past, despite all the rain the wet festival will be a dry festival, no alcohol served at this year's union street festival. >> that's right. for the first time in 35 years, the festival we're not selling alcohol at the event itself. we want to bring a little more family-friendly. it was getting out of control and we're really looking forward to the lower fun aspect that the no-alcohol being served will bring. >> all right. sarah, thank you so much for joining us this morning. and certainly, again, they're hoping that the rain doesn't dampen the spirits here. one more note about the fact there's no alcohol, this is a one-year experiment. they got together with the city

leaders. certainly the message that they're trying to get here is that the union street festival is going on today and tomorrow. it's going strong and they're hoping that lots of people show up for the festival despite a little bit of rainy weather out here. live in san francisco, christian kasdin, ktvu channel 2 news. a power pole is block the road in livermore. reports of a downed line came in this morning on mines road, just south of tesla road. early reports indicate that a chevy suburban veered off the road, hit a fence and then the power pole. so far, there is no word on any injuries or how many customers are without power. now there's some police activity in oakley. it is happened near o'hara avenue and cupboard wagon driver. we're hearing reports of a possible shooting but nothing confirmed at this point. you can see it there's a lot of police activity, canine unit searching the area, and we're working to find out more information and we'll bring you that as soon as we get it. critically injured san

francisco firefighter an a vareo is still fighting for his life this morning. dozens of his fellow firefighters came to visit him at san francisco general yesterday. some brought food for his family members, who continue to hold a benchside vigil. the family members say there's no change in his condition, he remains on life support and is boeing treated for burns to 12% of his body. >> cooled down, they'll warm him up, and they'll bring in a neurologist to see what the extent of some of his damages are. if anything brain-wise is bad. >> his colleague from engine 26 died battling the fire in diamond heights. funeral service will take place friday at st. mary's cathedral. questions still surround the circumstances of that fire. but there may be some answers in the dispatch audiotapes that record some of lieutenant perez's lasts words.

>> dispatchers tried to communicate with perez, again, but got no response. that's when a second crew entered the home. the photos from a neighbor showed the difficulty conditions that firefighters face. that second crew couldn't see inside and only found the men after tripping over them. >> we need to do a careful and thorough investigation of the fire, both the department and national institute of safety and health. they come in and just an after- action thing to see how we can correct it. >> the cause of fire is still under investigation. but initial reports suggest faulty wiring might have ignited a curtain. as the investigation progresses, stay with ktvu for continuing coverage on air and at ktvu.com. we'll bring you the latest information as we get it. a family in walnut creek is in mourning after learning two recent graduates were killed in a car accident. highway patrol says 18-year-old

christian bishop and 20-year- old maurice waters were passengers in a car that rolled several times yesterday morning. the driver of the car lost control of the vehicle, just about 20 minutes east of sacramento. bishop and waters died at the scene with the 26-year-old driver, none wearing seat belts. police are searching for a man accused of raping a woman in alameda and they have a detailed description of the suspect. a 22-year-old woman says she was raped yesterday in the stairwell of her alameda apartment complex. her family says the woman and her attacker were riding the same transit bus and when she got off the bus, he followed her. last night her mother called ktvu asking for help on getting the word out. we're not showing her identity in order to protect the victim. >> i'm just glad he didn't kill my daughter, you know? but i want to prevent this from happening to anybody else. >> her daughter got a good look at the man while the two were on the bus. she describes him as black, about 18 or 19 years old, 5

feet 7 inches tall with light brown skin and eyes. the woman says her attacker told her he attended skyline high school in oakland although it's unclear if that's true. a new agreement between leaders in san francisco and san mateo is ending some of the controversy with san francisco's local higher law. that law says a certain number of city residents must be hired for city funded construction projects like this building under construction back in march. now a new agreement allows san francisco public works projects located in san mateo county to hire and equal amount of workers from both counties. supervisors from both san mateo and san francisco must now approve the agreement. good morning to you. it is going to be a cool wet one. look at what is going here. rain on our lens this morning. likely the rain falling outside your door as well. in the winds are blowing at times. from 10 to 15 miles per hour along the santa clara valley as

well as salina, could be gustier through especially the morning hours. take a look at how widespread it is. i don't think anybody seeing a break at this time. if there is anything positive to talk basketball, maybe the numbers are up from 5 to 10 degrees from just yesterday, with all the cloud cover overhead. 50s in san francisco, between mid and upper 50s at this hour. 55 in oakland. you can see moderate rainfall. these yellow cells usually indicating quarter inch per hour, but they continue to move off so they're not sitting still for an hour's time. but here we've got some moderate rain and near the bay bridge at this time, and we've been seeing light to moderate rain throughout the overnight hours and now this morning as well. livermore checking in in the mid-50s, as well as concord. we head north just a little bit to areas right around santa rosa, napa reporting anywhere from one to two 10th of a rain over the last 12 hours and some of the san francisco area seeing more than that. some reason my radar has stuck for me. so we'll look at the satellite

going on here. we continue to watch this storm as it moves in. the steady rain, heaviest rain, falling this morning. we will eventually get breaks, but this center low will spin here for the next 24 to 36 hours, it's not going to move east until sunday afternoon, maybe evening, and that means we're going to remain cool and unsettled for the entire weekend. with again most of the rain falling this morning and through the afternoon. or so, moderate rain through 9:00, noontime if you're going to be outdoors for lunch still the steady rain falling. 4 or 5 p.m. we finally see a break here. and then through the evening hours scattered showers in the forecast although most of it will be off to the east but i'll shift here because that low still off the coast, still going to bring us scattered showers for tomorrow. so steady rain tapering off to showers for the afternoon. gusty winds at times close to 25 miles per hour. so it will be a day for the indoors, if you can handle

that. tomorrow we're going to see scattered showers continuing the front off to the east by then. but it's going to take all day for this. and that is the most unstable air. brings the possibility of thunderstorms in the afternoon for your sunday. cool wet for today, 63 in vallejo, 65 in hayward and 64 for san mateo. upper 50s in the coast and low 60s for san francisco. the extended forecast here. so today, tomorrow we're taken care of. a slight chance for scattered showers monday. by tuesday and wednesday we are finally drying out. our temperatures rebounding, low 60s on wednesday for the coast, upper 70s for our inland areas. we're going to be outside today we have that day planner coming up. >> thank you, rosemary. one of the two u-c berkeley graduates in iran today will mark his second straight birthday behind bars. joshua tall turns 29 today. they have been in prison since july 2009. they shared and were arrested

and accused of illegally crossing from iraq into iran while hiking. >> the whole world knows they meant no harm. they've committed no crime. and their detention has nothing to do with their actions and everything to do with animosity between the u.s. and iran. >> they were supposed to appear in an iranian court on may 11th but the trial was delayed without explanation. now their mothers have started rolling hunger strike until authorize sons' trial continues. today friends will fast in honor of the birthday. robert gates is in afghanistan right now on an unannounced farewell visit. gates flew in from asia, where he took part in a security conference. while in afghanistan he plans to meet with u.s. troops and talk talks with the afghani president of he is retiring at the end of the month. president obama has nominated

c.i.a. director leon panetta to succeed him. jure four nato service members are dead after a roadside bomb exploded in the eastern part of the country. the nationalities of the troops killed have not been revealed. the deaths come one day after two other nato service members were killed and their southern part of afghanistan. officials say more than 200 nato troops have died so far this year in afghanistan. the new jobs report issued friday shows the nation's unemployment rate is 9.1%. in his weekly online video address, president obama admits the economy is facing tough challenges. >> high gas prices, the earthquake in japan, and unease about the european fiscal situation, that's going to happen from time to time. there are going to be bumps on the road to recovery. >> president obama recorded the online video address during a video to a chrysler plant in ohio yesterday. that's where he touted the bailouts given to chrysler and

general motors, saying they've helped turn around the economy. she's been missing more than a week now, how family and friends are now stepping up their search for michelle le. and the painfulfully high price one teenager says he paid for the latest ipad. and a live look outside, the rain is falling down. the roads are wet. and causing problems out there. this is a live look at the east shore freeway. we're getting reports of flooding on the westbound buchanan street onramp to 80. so be very careful out there this saturday morning.

it's aesoping wet wet start! the trash pile-up in new york city has been the center of a five-month investigation. last december the sanitation department was accused of slowing down the clean-up

process. they wanted the mayor to stop cutting costs. but a report by the city found no evidence of this. officials say any slowdown in clearing streets or clean-up was due toe the blizzard. it's been one week since michelle le disappeared, and now the reward for information has doubled. yesterday friends and family held a vigil for le in hayward. they signed up for search parties and passed out signs and t-shirts with le's photo and description. her friend say it's critical to keep her name and picture visible to all. >> basically what i want to do is spread the word are everywhere. just be a walking billboard, asking everyone to light help bring her home, because as you can see here, a lot of people -- a lot of people love michelle. >> yesterday billboards with le's picture also went up

around the bay area and the reward money in the case was increased from $20,000 to $45,000. the 26-year-old was last seen more than 7 days ago at kaiser permanente in hayward. 18 people have died and 12 countries as a result of europe's e.coli outbreak. now the strain has made its way to the u.s. four people in the u.s. who recently traveled to germany have been affected by the virus. of those four, three are in the hospital with kidney failure. since the outbreak was discovered about two thousand people have become sick, mostly in germany. officials say the strand of the virus has evolved in a fast- spreading super-bug. >> the u.s. clearly could experience an outbreak similar to the one in europe. once these pathogens develop, they don't go away. >> health officials aren't sure how the bug is spreading, but are advising people to be cautious, especially when they travel. the u.s. is now stepping up inspections of any food

imported from europe. russia has banned european imports and german farmers have destroyed their own crops. because of the deadly outbreak, american airlines is pulling salads from all transatlantic flights. european health officials a salad filling such as cru couple better, tomatoes and lettuce could be to blame. american airlines will replace the salad menu item with other options. they say they'll return to the original menu when it's safe to do so. and airline passengers who do not travel light will soon have to pay more. delta airlines and united continental are raising fees to check a second bag on flights to europe. they both charge $50 for a second wag, but now delta will charge $60 for that second bag, if you check online and if you check out the airport, it will cost you $75. united continental says it will now charge you $70 for that second bag. this morning we can tell you a bomb scare in downtown

los gatos last night was a false alarm. last night police were called to the chase bank on north santa cruz avenue to investigate a suspicious package found inside the bank. an x-ray of the package was taken in a row pot sent into retrieve it. investigators won't say what exactly was in the package, only that it was not a real threat. state officials are now turning to dogs to keep cell phones out of prison so the pups are being used to sniff out the phones at the california ins talks to for men in chino. mobile phones smuggled into the inmates are used as a dangerous tool, they say prisoners use the phones to planets capes, harass victims and order hits on corrections officers. >> i do not know what they smell. you can hide a cell phone inside of a tv and get an alert. >> the senate has just passed legislation making it a misdemeanor for inmates to have cell phones if the governor signs the bill it would carry a $5,000 fine. some people are going to

the extreme lengths to get the new ipad 2 from apple including a teenager who sold a kidney to buy one. according to chinese television reports, a 17-year-old boy received 3400 dollars to have his kidney removed. this video shows the teenager and scar left behind from his surgery. he reportedly bought a laptop computer in addition to the ipad 2, using the money he received from his organ. but now his health is said to be worsening. officials say china has a huge black market for organs. it's one of arizona's largest wildfires in history. the new challenges firefighters are facing overnight as they're already stretched thin. really coming down out there this morning, and some of us have picked up more than half inch of rain so far. we'll look at what we have seen, but what you can expect for your saturday coming up.

this morning wildland firefighters in arizona are working to knock down two of the largest fires in the state's history. the fire seen here is burning the apache national forest near the new mexico border. officials say this fire has so far burned about 12,000 acres, four summer cabins destroyed, an estimated 1,000 people have been evacuated. burning south of the wildfire is the massive horseshoe fire, burning now for about a month. it has destroyed 90,000 acres and is 50% contained. the cause of the two fires is still under investigation. the security guard accused of killing a 16-year-old american student in costa rica has been charged in the boy's death. this is video from kansas, the hometown of justin johnson, who was on a trip to costa rica with his school spanish club. early thursday morning investigators say johnston and a group of boys were walk action cross the woods near the hotel. while heading back to their room, the security guard saw them, apparently mistook them for robbers, and fired his gun.

johnston was shot in the chest and died from his injuries. >> heartbreaking. it's -- you don't know what to think right now. one every my good friends, very good kid. always did good, loved sports. >> yesterday costa rican shorts said the guard had been charged with simple homicide, the equivalent of manslaughter here. authorities say he did not have a permit to carry his gun. the security guard will remain in jail until his trial begins. despite the wet weather, a dedication ceremony it planned today mark the opening of a new hiking trail in the east bay. a ceremony will be held just a few hours from now at 10 a.m. for a new trail on the top of the ridge in walnut creek. on a clear day you can see mount diablo, the tri-valley and the strait. the heritage land trust contributed $1.3 million to buy the ridge. today is national trails day, and in san francisco the recreation department is celebrating what the grand reopening of the interior

greenbelt park. the virtually unknown 12-acre public parkland has been closed 50 years. there's a trail in the park that begins at 17th and stan onstreets and leads to the summit of mount sutro. today -- rosemary looks like this is an unusual june day. >> it is. unseasonably strong storm moving through today, and while we are just messy out there this morning. if you do have someplace to be, you'll need that raincoat most of the day. giving you a live look at the oakland hills, where plenty of gray skies to go around. temperatures not too bad. look how much rain has fallen already. we're talking an inch and a third over the santa cruz mountains areas, then that quarter until san jose more than 6/10 in san francisco. with more to come. temperatures outside this morning, sitthin 50s. we're warmer than yesterday, but it's still going to be gray, cool and wet. for the even, even breezy,

we have team coverage on the record-breaking rain that we're seeing right now. rosemary is tracking the storm from our weather center, but we want to begin with ktvu's kristin kasdin, live in san francisco where the rain is putting a damper on a long running city tradition. >> reporter: they hope it won't put too much of a damper on the union street festival. they're still setting up. this is one of the food areas that will later be filled with barbeques. they've set up some. tables here, and they're certainly getting the the area ready, including the food tents, getting all of that ready for today's big event. >> we have a bit of technology and the rain will stop it, but we will certainly still be sampling a lot of our products and stuff so people should come down. >> so vendors clearly really hoping people come out today. there was a flurry of activity despite the rain to get the event ready and the union street festival is one of the city's signature events set in

one of san francisco's most picturesque neighborhoods. union street festival is known for music, gourmet food and unique shopping. there is one big change this year picture that is no alcohol. >> definitely more family- friendly. we're trying to get back to the roots of the union street festival where you can walk around, have fun, not worry with people getting too drunk. the crowds being too big. we want families and we want to have it -- to make it what it once was. >> the alcohol ban is a one- year experiment after this festival organizers will get together with san francisco police and city officials and review how it went and decide whether or not they're going to permanently ban the booze. now, again, the big message that everybody out here is trying to get out is that despite the rain today, the event is still a go. they're trying to get people out today it goes on again tomorrow. we're live in san francisco, christian kasdin, ktvu channel 2 news.

good morning to you! giving you a i live look there. san francisco in the distance. the bay bridge, it is a wet one out there. you may experience some hide owe planing and puddling. so take your really easy. it will be wet most of today. the steady downpour will eventually lighten up but we're seeing quite a bit of rain, showed you some totals just a while ago. take a look at how widespread it is. just pretty much anywhere you go. we're seeing light rain falling this morning, even moderate at times. areas around the vallejo and east seeing some moderate rain. and it pushes off towards pittsburgh, antioch and bethel island. here on the peninsula, oakland seeing light to moderate rain. and seeing quite a bit at times. areas around san francisco, oakland seeing anywhere from 5 to 6/10 since the rain started just about 12 hours ago. we will continue with this system for the next couple days. it may not be a steady downpour like we're seeing now, but the scattered showers will remain through sunday, even monday. look at what is going on.

by 10:00 or so we're still dealing with light to moderate rain, heavier rain closer to the delta and east bay. by the afternoon we see a break in things. we'll have scattered showers in the forecast but not this steady heavy rain that we're seeing at times this morning. but there's more to come bus the center of circulation still off the coast. it's going to hang there for the next 24 to 36 hours. and then by tomorrow afternoon, it eventually slides in. here we are through the overnight hours, still mainly dry but we'll remain well scattered showers a possibility some heavy rain this morning, afternoon showers, maybe even breaks in between. partly cloudy, mostly cloudy skies. come sunday we could be partly to mostly cloudy, and with that sunshine even bringing a better possibility of the afternoon showers and the thunderstorms when the most unstable air mass rolls through with the center of that circulation. temperatures this morning not band at all, in the 50s. we're actually warmer than we were yesterday. but for the afternoon, we'll be cool once again. we'll be wet. you're definitely going to need

a jacket. 63 vallejo. 64 soon mateo. and the santa clara valley could be breezy as well. 58 expected this afternoon in pacifica. the extended forecast here, wet today, wet tomorrow. again, our afternoon may bring a thunderstorm on sunday. that will be the best possibility there. it's going to take until monday before the storm finally pushes east towards the mountains. leaving with us still lingering showers on monday, drying out tuesday and wednesday. and temperatures rebounding as well. inland areas could see a mid to upper 70s by wednesday along the coast sitting right about 63. coming up in just a little bit, how much rain we expect which monday. >> thank you, rosemary. the rain usually means snow in the sierra, but that's not the case this time. you're looking at a live picture of interstate 80 at kingville. damp but no snow. rain is in the forecast so anyone driving up is advised, tahoe, take your time and be cautious on the road.

giants fan brian stowe is now able to track with his eyes. the family is sharing the update on his website. doctors sat san francisco general say they are not sure if the tracking means stowe can see or if his brain is just reacting to voice and movement. this development comes as doctors continue to slowly take stowe off seizure medication. the man accused of beating brian stowe remains in jail this morning. a parole commissioner ruled yesterday to keep him locked up on an alleged parole violation involving a gun. but the commissioner also said that right now there is not enough evidence to keep ramirez locked up for stowe's beating. los angeles police chief beck says the evidence is coming. >> we'll have a full hearing in which evidence will be presented, the witnesses will be heard. present evidence in the media. >> another potential problem for l.a.p.d. concerns ramirez's daughter that 10-year-old claims she was with her father when stowe was beaten on march 31st, and not

anywhere near dodger stadium. last night she went before tv cameras and defended her tad. >> it's not my dad and eye know it's not him. and other people are saying that it is him so that part makes me mad. but then i'm also sad because he's in jail now. >> the attorney says ramirez stayed at a comfort inn in los angeles on april 1, the day after the stowe beating. he claims that video will show ramirez with a head of hair, and witnesses to the attack of hair describe the suspect as a man who was bald. legal team for a man charged with killing two shop owners at fishermans wharf is questioning if he's mentally competent to stand trial. this is video of the scene at jefferson street back in january. police say shop owner walked into the souvenir store and shot and killed the owners. they say he then stood outside with a semi-automatic handgun on the ground next to him until

police arrived. his defense attorney says she doubts he is competent to stand trial and doesn't understand the charges and can't assist in his defense. the court is appointing a doctor to examine him. a 14-year-old boy has been charged with murder following the death of an oakland business owner. 57-year-old man own this store on mountain boulevard in oakland. he died tuesday of an apparent heart attack. police say it happened after he was struggling and fighting with the teenage boy over two bottles of vodka. prosecutors have also filed robbery charges against the teenager. the corruption scandal involving law enforcement is now in the hands of federal investigators. contra costa county district attorney mark peterson made that announcement yesterday. he says the federal government has taken the lead because it has more resources. investigators and independents than the county. so far, four people have been charge in the scandal, including the former head of narcotics, norman wielsch. >> it's not good news to us

because that means they are probably looking at public corruption and the drug dealing that went on in this particular case. >> beside public corruption and drug dealing, federal investigators could also be looking at other crimes including the operation of grow houses, the operation of a brothel, and conspiracy. a former san francisco drug lab employee pleaded guilty to possessing illegal drugs. 61-year-old deborah matting was ordered into rehab for one felony count of cocaine possession. she is accused of taking small quantities of cocaine from the city's crime lab. this forced the lab to close and the dismissal of hundreds every drug cases. a former gilroy city councilman accused of stealing money from a holiday event now faces a charge of grand theft. the district tone says he was unable to account for taking more than $8,000 from the memorial day parade committee. gartman ran the others between 2002 and 2008.

he turned himself in to investigators yesterday and was released after posting bail. we left a message at his home, but have not yet heard back. in san carlos, 11 people have applied to take the city council seat of the late mayor. he died last month after heart attack. city will meet on monday to interview the 11 candidates. the council could then appoint one of the candidates that same day. san jose police officers are set to start voting on a tentative deal next monday that could save jobs. the deal reached yesterday calls for cutting salaries by 10% and that means the jobs of 156 officers would be saved this year. the police officers association says changes to its pension plan will also save the city $100 million over 16 years. >> we are hopeful that by making this deal with the city, that the city council will find additional funding to help minimize the layoffs of those 122 officers so that we can keep more officers on the

damaged 15,000 almond trees. now forecasters say the weekend could bring more severe storms and possible tornadoes to the area. a memo from fire officials shedding new light on the controversial drowning of a man on memorial day. officials say 52-year-old raymond zach waded into the bay and intentionally drowned himself. police and firefighters watch from the shore but did not attempt to rescue him. saying they were not properly trained. a memo written by the interim fire chief in march of 2009 is now surfaced, in it says water rescue training was supposed to resume 30 days from the date of that memo. the city council says it will investigate why that training did no go ahead as planned. a virginia man at the center of a cross-country kidnapping case that ended in the bay area has been charged with murder. 33-year-old jeffrey scott easley is accused of murdering his ex-girlfriend tina smith and then kidnapping her daughter. yesterday a grand jury issued an indictment charging him with

murder. san francisco police arrested him in december after locating him with the girl in the city. the trial of casey anthony continues today in florida, where an fbi analyst is scheduled to take the stand. video of the defendant has already been key in this case, including these tapes from august 2008. she had already been behind bars for about a month here as a suspect in the disappearance of her two-year-old daughter. the visits were were her mom and dad, who were still trying to find their idea daughter. when casey's mother pressed for information on where the girl was, casey grew angry. >> >> on december 12, 2008, the remains of two-year-old cale lee were found around the corner from where casey lived. now the defense is trying to prove caylee drowned accidentally and her distraught

authorizes say the bus company involved in this fatal accident tried to stay open by using a different name. on tuesday, a sky express bus crashed just north of richmond, virginia. four passengers were killed and dozens more injured. the transportation department revoked the company's operating authority. but yesterday found out that the same company was trying to operate and sell tickets understand a different name. now the company has been order today shut down completely. a project in marin county is $8 million short and taxpayers could have to make up the difference. transportation officials say the proposed sonoma rail transit project would run a rail line and pedestrian path from cloverdale. voters passed a quarter cent sales tax increase in the area but now transit officials say another $8 million is needed and they say they want to use

more tax dollars. voters don't approve that, the funds will be taken from other roadwork projects. the high speed rail project is going through a leadership change. the state assembly voted yesterday to place the $43 billion project under a new department of high speed trains within the existing agency. the current board will now have an advisory role p when it's done the rail system will link san francisco with los angeles and anaheim. up to 2 way to miles per hour. a new jersey amusement park is expected to ropelewski after an 11-year-old girl fell to her death from a ferris wheel yesterday in wildwood. the girl plunged more than 100 feet. an ambulance rushed the girl to the hospital but she died 45 minutes later. one person at the park when the accident happened described the scene as chaotic. >> people rushing towards the ferris wheel, and i'm like, what's going on? i ran over, and all of a sudden i see like this towel and

alarm. >> it passed an inspection in march, and police say there's no sign that any horseplay on the ferris wheel led to her fall. they're calling the girl's death a freak accident. a 10-year-old boy in texas will be starting his vacation inside a courtroom. on tuesday afternoon marshall may was picked up from school by a relative. that's when the two were pulled over by an officer and marshall received his first ticket. he says she was wearing his seat belt behind his back instead of across his shoulder. the police officer said marshall was breaking the law but defense attorneys are not so sure. >> the law allows a 10-year-old to receive a citation for breaking the law, this particular law requires that a child be -- or a person be over the age of 15 years. >> that law also states that because of marshall's age, the driver should have received the ticket. because he is a juvenile, marshall will need to be present in court. his family hopes the judge decides to dismiss the ticket,

it's not been confirmed by police. we'll bring you more details when we find out. san francisco firefighter anthony valero is fighting for his life this morning. dozens of his fellow firefighters came to visit him at san francisco general yesterday. some brought food for his family members, who continue to hold a bedside vigil. those family members say there is no change in his condition. he remains on life support and is being treated for burns to 12% of his body. >> cooled down, they're going to warm him up, and they're going to bring in a neurologist to see what the extent of some of his damages are, if anything brain-wise is bad. >> his colleague from engine 26 vincent perez died battling the fire in diamond heights. funeral service for him will take place friday at st. mary's cathedral. questions surround the circumstances of that fire, but there may be some answers in the dispatch audiotapes that recorded some of fire lieutenant perez's last words.

police have a very detailed description of the suspect. police say a 22-year-old woman said she was raped yesterday in the stairwell of her alameda apartment complex. her family says the woman and her attacker were riding the same ac transit bus and when she got off the bus, he followed her. les night her mother called ktvu asking for help on getting the word out. we are not showing her identity in order to protect the victim. >> i'm just glad he didn't kill my daughter. but i want to prevent this from happening to anybody else. >> she says her daughter got a good look at the man while the two were on the bus. she describes him as black, about 18 or 19 years old, 5 feet 7 independence tall, with light brown skin and eyes. he also has a tattoo of the name paul on the right side of his neck. the woman says her attacker told her he attended skyline high school in oakland, although it's not clear if that

is true. defense secretary robert dates is in afghanistan right now on an unannounced farewell visit. gates flew in from asia where he took part in a security conference. while in afghanistan he plans to be with u.s. troops and hold talks with afghan president karzai. gates is retiring at the end of the month. president obama has nominated c.i.a. director leon panetta to succeed him. also in afghanistan, four nato service members are dead after a roadside bomb exploded. it happened in the eastern part of the country. the nationality of the troops killed has not been revealed. deaths come one i did after two other nato service members were killed in the southern part of afghanistan. officials say more than 200 nato troops have died so far this year in afghanistan. a bomb scare in downtown los gatos is called a false alarm. around 7 last night, police were called to the chase bank on north santa cruz avenue to investigate a suspicious package found inside the bank. an x-ray of the package was taken and a robot was sent in

an estimated 1,000 people have evacuated about another fire south of the fire still burning after a month, that one has destroyed 90,000 acres. an arizona family is mourning the loss of a 13-year- old boy who died after being hit by a baseball during a little league game. 13-year-old tried to bunt a pitch tuesday night but it hit him in the chest. he took two steps towards first base before collapsing. he died the next morning. officials say he died from a disruption of the heart rhythm, that happens after a blow to the area directly over the heart. charges have now been filed against the security guard accused of killing a 16-year- old american student in costa rica. this is from kansas, the hometown of justin johnson. he was on the trip to costa rica with his school's spanish club. investigators say early thursday morning, he and a i group of boys were wakaluk the woods near their hotel, a security guard saw them, mistook them for robbers and

>> nice to see the word dry on there! california highway patrol is revving up public awareness about motorcycle safety. the fourth annual motorcycle open house will be held at the san jose chp office at 2020 junction avenue from 10 this morning until 2 this afternoon. the agency has riding demonstrations and safety information planned today as well as live music, food and a helicopter landing. hundreds of garbage trucks powered by the same trash they pick up. they're running on liquefied natural gas. the gas is made right at the dump out of the methane created from the decomposing trash. experts say the process is keeping harmful gas from being released into the atmosphere. the only downside is that this type of gas costs a lot of money to produce. >> it is expensive because we have to put it through a multi- step purification system to remove all the impurities in the landfill gas. >> this facility in livermore

more than seven days ago at kaiser permanente in high ward. teachers in walnut creek mourning the deaths of two students killed in a car accident. two young mention were passengers in a car that rolled several times early yesterday morning. officers say the driver of the car lost control of the vehicle just about 20 minutes east of sacramento. they died at the scene with a 26-year-old driver. none of the men was wearing a seat belt. giants fan brian san francisco is now able to track with his eyes. stowe's family is sharing the update on its website. doctors at san francisco general say they're not sure if the tracking means he can see or if his brain is just reacting to voice and movement this. comes as doctors continue to slowly take stowe off seizure medication. the men accused of betting brian stowe remains behind bars. they ruled to keep him locked up on alleged parole violations
