at least one of the teenagers arrested in connection with the death of a 3-year-old boy may be tried as an adult. this is the suspect, he is 17 and his court appearance set for today was called off. the san mateo district attorney says prosecutors are now reviewing the case and a decision will be made tomorrow on whether they will bring him into adult court. he and another teenager are accused of opening fire on a car with the family inside. 3-month-old isaac garcia was shot and killed. a memorial fund is being collected at wells fargo branches. tonight new fall out in the case of a man who died in the waters off alameda's crowned beach while a number of rescue workers stood on the shore and watched him drowned. ken wayne has the story. >> reporter: well gasia, tonight the alameda city

blue shield of california announced a change in the way they do business that gives money back to members. it's starting with $180 million with earnings last year. policyholders will get a 30% credit on their october bill. that's $250 for family. blue shield came under fire earlier this year when it filed for a 59% increase in premiums in some cases which it later withdrew. a $5 billion extension of children's hospital is set to start this summer. the palo alto council approved the move. officials say they need the project in order to meet state seismic requirements and an increase in the number of

neighborhood in east oakland. >> we can't tolerate this behavior anymore. the killings have to stop and our kids are walking through it, living it daily and it's time to stop the violence. police in pittsburgh say they plan to increase patrol after a violent incident on a trail. the latest incident involved three people holding a woman. a seconds person tried to intervene but the men also assaulted that person. and winds gusting pushed that massive wildfire in arizona even closer to homes. smoke filled the skies over the town of coyote creek as residents got ready to leave. at least 10,000 people have evacuated in the face of the

wallow fire. more than 2,000 firefighters are currently on the ground and in the air. but authorities say at this point that fire is still completely out of control. smoke from that fire is causing problems hundreds of miles away in colorado. health officials there issued an advisory. they at one point cancelled it, but people with complications said they could feel the complications from the smoke. temperatures went up immediately, 10 to 15 degrees warmer than yesterday. you're noticing it out there as well. a big dose of fog this morning it was all over the place. let's go outside to live storm tracker 2. the fog still lies outside. what's going to happen tonight is this fog right here is going to push in like it did last night. so it's going to have a pretty big inland push, probably into the bay, oakland, berkeley. that fog will start you off cloudy in the morning hours as

a new poll puts former massachusetts governor mitt romney in a virtual tie with president obama in the race for the white house. the washington post poll shows that in a match up mitt romney is dead heat against the president. the survey also asked republicans and conservative independents who they strongly favor and who they strongly dislike and then averaged the two numbers. the top five scores are in order, mitt romney, rudy giuliani, herman cain, tim pawlenty and michelle bachmann. former new mexico governor says cnn has only invited those who poll higher than 5%. he noted that bill clinton,

years to come. also about permanent ti jobs. reporting live, tom vacar, ktvu channel 2 news. in 90 minutes at 7:00, the santa clara city council will get a new plan on building a stadium . the stadium would be ready in time for the 2015 season. voters went to the poll today to decide whether to raise the city's sales tax to 10.25%. if that passes there's an advisory measure on the ballot asking to split that new tax money between programs for the city's poor and public schools. if the measures fail, richmond officials say they will have to cut an additional $2 million from the budget.

berkeley police say a car fished out of the water at aquatic park this morning was empty. news chopper 2 took this video of the car submerged at the south ends of the par near interstate 80 onramp. a man who pulled over near by to use his phone noticed it and called police. the 1995 nissan maxima was stolen in san francisco. authorities are trying to determine if it was used in a crime. by all measures she is a stellar student. a south bay 18 years old who is about four years ahead of schedule when it comes to

what will happen now as the pattern becomes more typical. you are going to see that coastal fog start to set up. i'm seeing it out there right now. it's patchy at best but this morning there was a dose of it. there'll be a dose of it again tomorrow. so lots of low clouds, burn off around 10:30, 11:00 like it was today. temperature forecast for tomorrow, the yellows are 70s. oranges are 80s and look, oranges popping up. we're going to see some low 80s tomorrow. we're going to see lots of 70s and upper 60s. the jet stream stays news, stay -- stays north. it's not where it's supposed to be. that's what was unusual. lots of low 80s. we're not going to get into the upper 80s, we're going to be in the lower 80s, upper 70s right through the bulk of the week. coastal fog will become more dominant on friday. you see a big dose of it going
