he is now a free man. he was released from los angeles county jail at 12:01 this morning. who was waiting for him outside the jail and why they never saw him. i declare. >> the latest demonstrations protesting the release were peaceful, but there will soon be a new lawsuit tied to demonstration after his sentencing. plus, the way some people can get to work in san francisco this morning. it's all ahead this morning here on the ktvu morning news.

good morning. thank you for waking up with us. it's monday, june 13th. i am pack cook. it was a nice weekend for most of us, but is the weather getting warmer and or colder? hi, steve. >> he low. it will be getting warmer, especially away if the coast. there's still fog and plenty out there. and then temperatures inland, a lot of low to mid-80s. so pencil that in for morgan hills, san jose. but closer to the coast, 60s and low to mid-70s. good morning. this morning, let's take a quick look at traffic outside on 880 through oakland. you can see there's just a few cars on the roadway this morning. not too crowded headed to the 80 east shore freeway into the bay bridge toll plaza. more traffic on the roadway, but everything is moving smoothly. back to the desk.

on the our news, overnight, -- topping our news, overnight, he is a free man. the former police officer was released from the los angeles county jail at minute past midnight this morning. we have been up all night outside that jailhouse. and we are live in los angeles. good morning. >> reporter: good morning, pam. yes, it was official at 12:01 a.m., he was released from here at the los angeles county jail. there were a lot of cameras outside, and even the uncle who came to see him emerge, but no one saw him. details of how exactly he was released still unclear, but we did get indications early on that it would not be a standard release that's because there have been safety concerns in recent days and weeks. his attorney said he had been talking to the sheriff's department for weeks about how this would go down. the sheriff's department told him it wouldn't be necessary to

come down, they put their own plan in place. >> concerned enough that we feel and i think the sheriff's department in los angeles felt that this is not the situation, typical situation when one is released, they simply walk out the front door. i can't elaborate on much more than that. this offender is no longer in custody. did change took place on june 13ing, 2011. >> reporter: that is his uncle outside the jail about four hours ago. he hoped to see him this morning, but instead got that call from the department of corrections letting him know he was a free man. >> and they just now notifying me of his actual release. it is 12:25, yes. >> reporter: so what's next? well, this morning we have new information on the plans for his future and we're going to

hear what the police officer's uncle to say about hah he wants him to know. -- about what he wants him to say. about 300 people staged a peaceful march through the streets of oakland to protest the release. >> who want justice for who? >> foster grant. >> yesterday evening, rallies began at the site of the fatal shooting of oscar grant a year and a half ago. demonstrators held sign process testing the short time he spent in jail. his uncle spoke to the crowd that gathered. >> a crime was committed, but it wasn't paid for. this needs to stop. >> the large crowd also included oscar great's mother and daughter. police shut down several streets as the demonstrators marched into downtown oakland.

>> we are all oscar grant! . >> hundreds of people poured onto broadway early yesterday evening. oakland police stood by and did their best to keep a low profile. the organizers also did their part to keep the peace and encouraged people to demonstrate without any vandalism. >> can't control what they do tomorrow or next week or even late tonight, but i think most people want to focus on the message. >> those efforts were successful. so far, there's word of only one arrest for a minor act of vandalism. now stay with us here on ktvu channel 2 for continuing coverage of the release and any new developments today. and you can find updates under the tab on our website. well this morning, oakland police will become the target of a clash action lawsuit tied to the case. the national lawyers guild bay area chapter will sue the

oakland police department. the suit focus on the mass arrest of 150 demonstrators following the sentencing in november. the legal group will reveal the details of the class action lawsuit during a 10:00 news conference this morning. the next legal battle over the state's same sex marriage ban begins today. judge walker walker ruled proposition 8 unconstitutional last month. they argued because judge walker was in a long-term same- sex relationship, he had a conflict of the case. judge walker has retired from the bench. the family of the missing nursing student of michelle lee say they are taking matters into their own hands. about a dozen people went door to door yesterday to pass out fliers in hopes of finding lee. she went missing from the hospital in hayword. police have declared the case a

homicide, but family members say they are not learning much about the investigation from police. >> we don't have any ed as to where the case is going. or whether or not she, you know, whether or not we should stop our efforts so until we get the evidence, we're going to fight for her. >> mark class helped distribute fliers. his daughter was kidnapped from her home and murdered in 1993. in arizona, thousands of people have been allowed to return home after being chased out by a massive wildfire. a welcome home sign flashed along the road yesterday. the air is still filled with thick smoke, and people are being warned of potential health hazards, but authorities say the threat to the communities of springerville have passed. roughly 7,000 people were cleared to go home. >> we didn't know what to expect. >> we were thankful it was still here and didn't look like it had been in the fire at all.

>> but about 2700 people and several resort communities are still waiting to go home. fire officials expect to reach 10% containment today. the start of fire season begins in parts of the bay area today. the unit will declare the start of fire season in several counties. as a result, staffing will be increased and burn permits will be suspended because of the fire danger. people living near the jail will likely see some smoke and fire today and today. the county fire department is conducting a controlled vegetation management and training burn. that burn will increase the defensible space for people living near the jail. and it will be from 8:00 a.m. until 3:00 p.m. and firefighters are also planning some controlled burns. they'll burn grass and vegetation just below the reservoirs today, that's northeast of the bridge. the area is prone to fires.

the burns will begin at 10:00 a.m. and fire crews will stay on the scene until they are out and safe. governor brown says there will be a budget vote on wednesday. that's the constitutional deadline for lawmakers to get a balanced budget on his desk. in a statement on youtube, the governor expressed frustration that he has not been able to get the four republican votes needed to put the question of tax extensions on a special election ballot. >> i am not asking the legislature to make all these decisions. i am asking for a vote of the people. >> democrats are trying to avoid having to close the remaining $9.6 billion deficit with spending cuts aloan. well, seven republican candidates for president will debate in new hampshire tonight. coming up in just about ten minutes, who is taking part without officially declaring for the race. well, in just a couple of hours, people in the outer sunset will have a quicker way

to get to the financial district in the form of an express bus. the service begins service at 6:30 this morning. it will make stops athrong street between 48th and 19th avenues and then go straight to bush and montgomery streets. it runs every ten minutes until 9:00 a.m. afternoon service begins at 4:00 in the afternoon. that bus picks up at sitter streets and goes to 19th avenue. it is the busiest rail line. 4:40 is the time. speaking of traffic, how is traffic? >> i'm happy to report, everything looks good so far. let's show you the cameras outside starting with the east shore freeway heading towards the bay bridge toll plaza. probably the busiest freeway at this hour. a lot of cars on the road, but no delays or problems to report over there. as you head towards the toll plaza, traffic is moving nicely there. no major desomeplace we're a

couple hours -- delays and we're still a couple of hours away from the metering lights. time now is 4:40. here's steve. >> all right. all right. boy, i apologize. creature of habit there. good morning. well, temperatures coming up a little bit. we had the cool, cool saturday. system dropped in, what's new and then rebound yesterday. didn't take long inland. by the coast, we have to deal with fog. high pressure is going to build in for about two days. warmer monday and tuesday. we will have mid-80s inland and probably warmer than it may be, no 90s yet, but maybe tomorrow. some low clouds and fog. even stockton with a west wind at 12 miles per hour. west, southwest 9 miles per hour. 52 to 56, 57 in there. everyone is rather close again. napa says 54. high pressure is building in. right there, monday and tuesday and then looks like the system

digs down. now as the high builds in, it will burn off the fog. but the fog will be on the coast. we don't have a breeze or anything, so fog and low clouds. probably foggy tomorrow along highway 1 as the high builds in. but sunny and warmer, all systems go, especially as the fog burns off. highs 60s, 70s and low to mid- 80s. they'll be up there today and tomorrow and probably transition day on wednesday. and then another cool down towards thursday and friday, pam. >> all right. thank you. well, new photos of wounded congresswoman gabrielle giffords five months after she was shot in the head. the progress she's making and she she could be released from the hospital. and it's been three months since the tuna plea from japan hit the harbor. how the only repair shop is trying to keep up with the dozens of damaged boats.

several people were hurt after a series of aftershocks rattled christ church, new zealand. a 5.2 earthquake struck during lunchtime yesterday and a 6.0

hit an hour later. a couple of billings did collapse. in february, christ church was hit by a major earthquake that killed 181 people. new photos of arizona congresswoman gabrielle giffords are posted on her facebook page for the world to see. they are the first since she was shot in the head at point blank range last january. one shows her smiling. a scar on the neck is the only physical sign sha she was injured. a second photo shows her again smiling with her mother. doctors say she has relearned how to walk and talk. her staff members say her recovery is nothing short of a miracle. >> the pictures show a very resilient, determined woman whose spirits are positive. just amazing really. just amazing the progress that she has made and continuing to make. she knows what's going on. make no mistake about that. >> now friends report that gabrielle giffords says she misses arizona and hopes to

come home soon. her aides say that could happen before the end of the month. anger over the response to a suicidal man who drowned sparked an unusual demonstration. >> can you hear us out in the water? >> a group of residents waded into the bay yesterday to nonstrait just how easy it would have been to save the 53- year-old raymond zack from drowning. he waded into crown beach on memorial day. first responders were on the scene, but said there was nothing they could do to save him because they we want properly trained. >> the only thing that will satisfy me and the others who organized this is a criminal investigation by the department of justice. something is wrong here. >> police and fire officials did not return phone calls asking for comment yesterday, but the firefighters' union posted a statement on the union's website saying that the guild welcomes an independent investigation of the incident. a hearing will be held this

morning about the mental competency of the man charged with killing two people. he has been charged with two counts of murder after police say he shot and killed two employees of a neighboring souvenir shop in january. they say the shooting happened after a dispute over selling similar items. a study is calling for improvements to crosswalks six months after a toddler was hit and killed. the 2-year-old died and her mother was severely injured when a car hit them as they crossed last december. tomorrow the city council will review a study of traffic and pedestrian safety. it reck mens a set of -- it recommends a set of improvements with a new crosswalk and street lights. three months after the tsunami hit the harbor, repair work on dozens of damaged boats is slow going. workers are overwhelmed with work orders. it's to only repair shop.

of absence. this comes after the website tmz published another batch of photos that weiner sent to women online. at least some of the photos appear to show him in the congressional gym. over the weekend, some of weiner's constituents called for him to resign. today president barack obama makes a move to reduce government waste. he will sign an executive order creating the campaign to cut government waste. the campaign's first action will be to target waste and duplication among federal government websites. it calls for an oversight board that will work with federal agencies to improve performance. cabinet secretaries will have to submit progress reports to vice president joe biden. the baseball team thought this season would be their last, but after being cut, the program was reinstated and they are now headed to the college world series. the big hit that sparked their

welcome back to the morning news. they are celebrating in dallas today. the mavericks are nba champions for first time. police in dallas say they made some arrest, but most of the large crowd downtown was cooperative. a lot of people gathered following the mavericks 105-95 win over the miami heat in game six. terry topped the team with 27 points. he added 21. you can see he went right off to the locker room because he said he could feel the tears coming. he was voted mvp. well their future was uncertain at the beginning of

the season, but after the program was cut and then reinstated, the cal bears baseball team is going to the college world series. the two-run home run in the 1st inning helped lead the bears to a win. it's cal's first college world series in 19 years. the world series begins saturday in omaha, nebraska. it is double elimination. all right, coming up on 5 :00. how's traffic? >> it's looking good, pam. things are picking up a little bit, but still too early to have major problems. the bridge, you can see a few taillights as people head east over the bridge. and going over to the grade towards freemont, no problems there. just a few headlights and tail lights on the screen there. now the other thing, there is a traffic hazard this just came down on the chp website on westbound 580 just west of

150th avenue. a car hit a deer many the road. chp is on the way to help the driver out, but it is blocking the middle lane many the area. so something to be aware of if you're traveling through there. here's steve. >> thank you. fog on the coast. some of it is moving inland, but it's going to burn off really soon and temperatures inland will come up. high pressure building in for about two days. mild to warm, depending on where you are. the coast is going to have to deal with fog and more in the form of fog into tonight and also tomorrow. still a westerly breeze. 50s, 52 to about 56 covers the spread here. one system went by, cool down saturday, yesterday, getting high pressure right there, builds over for a cup of days. by the coast, fog, low clouds and tomorrow, more foggy as the high pressure builds in. and then by wednesday, another system starts a cool down. sunny and warmer after the morning clouds with fog on the
