we're ready. good morning to you. it's monday june 13th. i'm dave clark. >> good morning. i'm pam cook. pretty nice over the weekend, steve, we're liking the son at least. no rain. no. no rain there, pam. what we had at the beginning another month was probably going to do it. but that was an impressive system. but now we have high pressure building in not too strong but strong enough to give inland areas low to mid-80s. still a lot of low clouds and fog and 60s and low to mid-70s closer to the bay. here's allie. traffic over on 880 in oakland it's not too crowded over there. traffic moving at the speed limit north and southbound. no problems to tell you about or delays there. over at the bay bridge toll plaza metering lights aren't on yet so traffic is moving nicely towards the bay bridge. time now 6:01. back to the desk. topping our news this morning mesherle is a free man. the former bart police officer was released from the los

angeles county jail at one minute past midnight this morning. ktvu's claudine wong has been up all night outside the jailhouse this morning in los angeles. she joins us now to talk about the security surrounding mesherle's release. good morning, claudine. >> reporter: good morning, pam. yes, we knew pretty early on this wasn't going to be a typical release. we are in front of the los angeles county jail this morning. behind me you can actually see a pretty big facility twin towers correctional and the central jail. and just down the street from where we're standing are two doors. typically that's where inmates come out once they are released. that didn't happen that way this morning with mesherle and that's because it appears safety and security still an issue in that case. security being cited the reason we never saw him walk out of the jail this morning. his lawyer says there have been big security concerns and they even offered to bring their own people down to facilitate a safe release. the sheriff's office declined that offer and put their own plan into place. his attorney says they're going

to be monitoring things in the coming days to determine if it's even safe for him to still live in northern california. >> i guess the question remains can he go home again? >> well, we don't know. we will know more about that over the next ten days to two weeks. we hope he will be able to go home because he's always called northern california home and doesn't really want to call any place else home. if he can't go home, he's going to call another place home. and he will go there with his family and he will productive life. >> reporter: now oscar grant's uncle is promising to be a part of mesherle's life if only as a reminder of what happened on that platform back on new year's day 2009. he was out in front of the jail this morning saying he was here to remind himself and others how much work needs to be done to fix what he calls a flawed justice system. >> anxiety of course. the work that has to be done

much thought about that and how to get it done. >> reporter: so what's next? well, the grant family is promising to continue to protest they're actually having a rally planned at the courthouse here in los angeles. that's set to start between 8:00 and 8:30. as far as mesherle is concerned, well, he apparently already has a couple of job offers and we're going to talk about that coming up in our next report. live here in los angeles, claudine wong, ktvu channel 2 news. time now 6:04. well, hundreds of people staged a peaceful march through the streets of oakland to protest the release of mesherle. >> last night's rally began at bart's fruit vale station. that's where unarmed passenger oscar grant was fatally shot a year and a half ago. police shut down several streets as though demonstrators marched into downtown oakland. there was very little trouble. in fact, there's word of only one arrest. that was for a minor act of

vandalism. now this morning oakland police will become the target of a class action lawsuit connected to last year's riots in the mesherle case. the national lawyers guild's bay area chapter will sue the oakland police department. that lawsuit focuses on the mass arrests of 150 demonstrators after mesherle's sentencing last november. the lawyers guild will give us the details of their lawsuit during a 10:00 news conference this morning. make sure you stay right here with us at ktvu all morning long for complete coverage of the mesherle release. you can also get updates on our channel 2 website ktvu.com. just click on the mesherle tab right near the top of the page. san jose police are investigating the shooting that injured three people over the weekend. that happened near martin avenue and mt. pleasant road. police say one man and a juvenile were shot as they were walking around 1:30 a.m. yesterday. police say a third shooting victim turned up later at the local hospital. all three shooting victims are

expected to survive. so far no arrests have been made. time is now 6:05. the family of missing nursing student michelle le have not given up hope of finding her. a dozen people went door to door yesterday in hayward passing out flyers. the 26-year-old nurse went missing may 27th from hospital in hayward. police declared the case a homicide. family members say they're not learning much about the investigation from police. >> we don't have any evidence as to where the case is going or whether or not she you know whether or not we should stop our efforts. so until we get the evidence, we're going to fight for her. >> also with them was mark class. that's him on the right there. he helped to pass out flyers showing support for the family. his daughter was murdered after being kidnapped from her mother's home in petaluma in 1993. prosecutors in los angeles have still not filed formal charges three weeks after the arrest in the bryan stow case.

but police insist they still have a strong case against giovanni ramirez. the main suspect in the beating of the giants fan. investigators say they're interviewing witnesses and going over evidence they say will prove ramirez is responsible for the savage beating outside dodgers stadium. ramirez's attorney says he has a dozen people ready to testify that his client was at home at the time. time is now 6:07. well, the bay area minister who predicted the end of the world is recovering from a stroke. 89-year-old harold camping was rushed to a hospital last thursday from his home in alameda. a neighbor told the oakland tribune that camping is doing well but his speech is slurred right now. camping received national attention for his most recent prediction that the world would end may 21st. when that didn't happen, he changed the date to october 21st. as congress returns to work this week, there is mounting pressure for new york

congressman anthony weiner to resign. coming up at 6:15 we'll have a live report from our washington d.c. newsroom with what weiner is doing after another batch of lewd photos has surfaced. republican presidential candidate newt gringrich is trying to get his campaign back on track. last night in los angeles gringrich made his first campaign appearance since several top aids resigned. >> i will endure the challenges. i will carry the message of american renewal to every part of this great land, no matter what it takes. and with the help of every american who wants to change washington, we will prevail. berkeley now with more on the remarkable journey of the cal bears. kraig. >> reporter: dave, last time the cal bears were in the college world series, george h.w. bush was in the white house. and many of these cal players were not even born. in any other year the team's long absence from the series would be the lead story here, but this year the story is that of the 2011 baseball team was almost the last year for cal baseball. long before the last out was made on the field at santa clara university yesterday, cal baseball program was basically over. last september the university eliminated baseball and a few other sports in order to save money. players on the team began looking at other schools, recruits began dropping, visits from the schools to visit a number of major leaguers who played at cal were among those to step in. with promises of money and soon $10 million was raised and so was the future for the cal baseball. it is fitting that cal's returning to the college world series for another reason.

rockville in montgomery county there. police have evacuated a metro station there after receiving a bomb threat. that came in at 7:30 a.m. eastern time this morning. right now it's not known if police have found anything, but you can see that investigators are still there at the station at this moment. the search is also causing delays for early morning commuters. again, this is in rockville, maryland, where there was a bomb threat, a bomb scare. they have closed down a metro station there. we have live pictures. we'll continue to get updates as soon as they become available. all right. time now 6:16. strong aftershocks hitting crease church new zealand still recovering from a deadly earthquake. look at these pictures. dozens treated for minor injuries from falling debris in the 5.2 and 6.0 quakes. those quakes hit within an hour of each other.

demanded weiner step down from betraying the public's trust but several con stitch wants want him to stay on the job. >> i believe what he did was disgusting but i think he's done an excellent job. i support him. i would vote for him again. >> reporter: he's staying put for now. his wife in the meantime is still overseas with her boss, hillary clinton, i'm hearing he won't any decision about his future until she returns later in the week. live in washington, ktvu channel 2 news. time now 6:18. word today from jordan that the motorcade king abdul will of jordan was attacked with bottles and stones as he toured the town. the king was not hurt. it came after hours he appeared on television announcing sweeping reforms. the king promised to set up parliamentary government that's been a key demand of protesters who have been calling for changes. the los angeles times reporting that after years of audits and investigations u.s. defense officials can't account

for $6.6 billion in cash that was sent to iraq in 2003 and 2004. right after the u.s. invasion of iraq in march 2003 united states sent plane loads of cash to iraq to pay for reconstruction projects. however the auditors say u.s. officials in iraq often didn't have the time or staff to keep track of all of that cash, so a lot they say was probably stolen. many public health experts say they are not surprised that bean sprouts were the source of the e. coli outbreak that killed at least 35 people in europe. the health experts say any kind of raw sprouts provide the perfect breeding ground for bacteria such as e. coli. sprouts have been linked to dozens of bacterial outbreaks in the u.s. in the past 20 years. time now 6:19. many california lawmakers are encouraging all of us to eat more local foods. the farming industry says if all california residents ate food only from california just one day a week, that would

boost the local economy by $15 billion. the california assembly unanimously supported the idea. now the state senate will take up this matter. san francisco assemblywoman says becoming a local could cost a bit more but it will be worth the time and money that's spent. >> what? >> yes. all right. let's check in with allie rasmus. i think my allergies are getting back to me here this morning. >> that will help with the commute won't it? oh, yeah. we're going to tell you about some traffic hazards. i don't know if maybe the wind or something there is effecting your allergies, pam, but it may be blowing some stuff out on to the highways. this one is at northbound 880 at maori avenue. there's some reports of a garbage bag partially blocking one of the far left hand lane over there. be aware of it if you're traveling in that area. there's nothing blocking the roadway over at 280 in through san jose north and southbound traffic there isn't even that many cars on the road there. things are smooth over in that

both at 51. hayward says 56. high building in is here today and tomorrow sunny and warmer weather after the fog burns off and it will be sooner today. fog on the coast though but there will be areas where it gets the sun should be chewed up as well. 60s, 70s coast and bay then low to mid-80s inland. looks like we'll continue this theme into tuesday. now wednesday looks like i think that fog will start to regroup. then it will come in thursday and friday. that will cool us down. not much in the way of any extreme one way or the other as we go into the weekend. pam and dave. thank you, steve. well, a report released this morning says chinese consumers are becoming much more sophisticated in their taste. the study by the american chamber of commerce says chinese shoppers have wider access to information and travel. ask that's raising awareness of different lifestyles. that in turn is driving greater demand for more choices than in the past. the study also says chinese shoppers will become the second largest consumer market in the world by 2015 trailing all of us here in the u.s.

u.s. gas prices continue to fall for the fifth week in a row. the national average now stands at $3.70. that's down about 20 cents a gallon in the last month. california average is $3.94. san jose and oakland prices are slightly less than that. but in san francisco the average still is more than $4 airmail listen. time now 6:22. where hondas are loading up their guns ready to shoot bears. however critics and animal lovers are saying not so fast. and a horrific crash during a race in france. why experts say the driver was able to walk away without any injuries. and taking a look at 101 in san jose traffic is a little slow on the right hand lane. well, it was slow. now things are picking up again. but overall things looking good as you approach the 880 interchange. more on traffic and all the day's headlines after the break. policewoman

heading that direction east of the toll plaza on eastbound 80. 6:26. let's go to the desk. well, a race car driver was able to walk away from this terrifying crash in france. alan mcnish hit another car. his car was sent airborne into a barrier. take a look at that. but he was able to walk out unhurt. protective measures built into the car's roll cage are being credited for mcnish's safety. time now 5:27. anger over the response to a suicidal man who drowned in alameda triggered a very unusual demonstration. >> can you hear us out in the water? >> a group of alameda residents waded into the bay yesterday to demonstrate just how easy they say it would have been to save 53-year-old raymond zack from drowning. mr. zack waded into the crown beach on memorial day. first responders were on the scene but they said there was nothing they could do to save

them because they were not properly trained. the firefighters union posted a statement on the union's website. they said the guild welcomes an independent investigation of that incident. some people in lake tahoe are suing to halt nevada's first black bear hunt. the lawsuit raises concerns about public safety and the negative impact that bear hunting could have on tourism. state wildlife officials say hunters will be trained so that they know where it's safe to shoot. fire season arrives in three bay area counties. the steps being taken to reduce wild fire danger. >> reporter: how the city prepared itself for the release of mesherle in los angeles. ♪ let's go out to the dmv

ktvu's jade hernandez is in oakland right now. but first we're going to go live to ktvu's claudine wong. she's outside the jailhouse in los angeles. claudine. >> reporter: well, we're in front of los angeles county jail where mesherle spent the last 11 months. he was freed at 12:01 this morning. but we never saw him. instead, we simply got an online confirmation and oscar grant's uncle got this call. >> no longer in custody. the change took place on june 13, 2011. >> reporter: that recorded message came from the department of corrections at 12:25 this morning. he was disappointed he didn't actually get to see mesherle with his own eyes this morning. he said there had been so many rumors he needed to see him walk out of the jail where he served his sentence. >> there were many rumors that he wasn't even really locked up

here. so to see him actually exit at least in some way validated the fact that he may have truly been here for the time period he should have been here. >> reporter: mesherle's attorney says there were just too many safety concerns to let his client just walk out the door. now that he is free though attorney mike rains says mesherle is going to try to get a job and already gotten a couple offers. >> yes. there are people who know him, who knew of him, who know his family who know what he's truly all about. and people that are wanting to help him out. >> reporter: is it possible he'd go out of state for parole? >> well, that would have to be arranged through parole if he would go out of state. >> reporter: there's also one thing his attorney says mesherle wants to do. he actually wants to sit down and meet with the grant family. we talked to oscar grant's uncle about that possibility and coming up we'll tell you why that meeting might not happen any time soon. live here in los angeles, claudine wong, ktvu channel 2

news. hundreds of people took to the streets of oakland to peacefully protest mesherle's release. ktvu's jade hernandez joins us now to talk about what's going on in downtown oakland this morning. jade. >> reporter: well, that's right. after the sentencing of mesherle, looters took to the street and there were businesses that were damaged. but with mesherle's release this morning you can see this time no one was taking any chances. these windows are boarded this morning. but the mood was different last night. the night before mesherle's release from a los angeles jail hundreds spilled onto broadway and 14th street in downtown oakland. officers did not try to clear any intersections and kept the police perimeter out of sight. for two hours there was an open mic opportunity for anyone who wanted to publicly vent. organizers say they pushed anarchists to get the word out they did not want any spray painting and vandalism. oscar grant's mother and daughter spoke to those gathered. she like so many others feel mesherle who served only 11 months of a two year sentence should still be in jail.

>> he lost his daughter. she loved her dad and her father. and she was robbed of a father and i'm robbed of a son. i just want accountability. >> just look to the sky and pray. >> reporter: well, it appears the protests stayed peaceful. police only made one arrest forking. we checked in with the oakland police this morning at the alameda county jail to update that number and it seems to remain at one. free bus rides back to the fruit vale bart station where yesterday's protests began may have helped quell any violent flare ups. gatherings are expected later today. we have a call into several contact people for more information as soon as we get more on that we'll bring that to you. now we wanted to show you this morning across the street there's a building with posters with oscar grant's picture on them. a sign to those passing by they sympathize with grant's supporters and family. and they trust protesters enough to keep their windows free of any boards this morning. reporting live from oakland, jade hernandez, ktvu channel 2 news. all right.

election ballot. >> i'm not asking the legislature to make all these decisions. i'm asking for a vote of the people. >> democrats are trying to avoid having to close the remaining $9.6 billion budget deficit with spending cuts alone. time now 6:36. in arizona thousands of people are now allowed to go back home after being chased out by a massive wild fire. it's a big welcome home sign right there on your right there flashing on the road yesterday. look at the air. still very thick with smoke. people are being warned about possible health hazards. however, authorities say the threat to the communities of springerville and eagar have passed. about 7,000 people were cleared to go back home. >> we didn't know what to expect. >> i was thankful it was still here and didn't look like it had been in a fire at all. >> about 2700 people in several resort communities are still waiting to go home. fire officials hope to reach 10% containment today.

the start of fire season begins in parts of the bay area today. the santa clara unit of cal fire will declare the start of the fire season in santa clara, contra costa and alameda counties. as a result, staffing will be increased and burn permits will be suspended because of the potential fire danger. well, a new bus is helping relieve some of the congestion on the busiest muni rail line in san francisco. an njuta express buzz actually started running minutes ago. so every ten minutes that bus will leave juta street and 48th avenue. it will make stops until 19th avenue. then it will go straight to bush and montgomery streets until 9:00 a.m. now afternoon service that will begin at 4:00. that bus picks up at san tom and sutter streets and go to 19th. i'm sure a lot of people will be happy about that. let's check in with allie rasmus who is in for sal today. hopefully no big problems for

the commute. no big problems but it is picking up a bit. about ten minutes ago we told you about a traffic collision just east of the toll plaza on eastbound 80. here's the view from the macarthur maze from our camera. we can't see the accident from this vantage point but i can tell you that chp is on the scene of that collision and the car is now on the right hand shoulder. they're in the process of clearing it all up. now taking a look at the bay bridge toll plaza things are getting a little more slow there. it's getting a bit crowded there. we're still waiting to see if they have turned on the metering lights there. i don't see any reports of that from chp just yet. but also want to tell you about chp is also en route to an accident at the 580-680 interchange. so that's in the pleasanton area. so expect some slow downs around there. time now 6:39. here's steve. allie, thank you. very good morning. happy monday. come on sleepy heads let's get going. burning daylight. still fog and low clouds out there. little warmer for those away

welcome back. we are following some developing news. and we have some new details about that situation in maryland this morning. take a look. here's a live picture this morning. it's in rockville, maryland, in montgomery county. police evacuated a metro station there this morning after receiving a bomb threat. now metro officials are saying that a woman at the station said that she had an explosive device as she was getting off

of the train. now so far we hear that investigators have not found anything suspicious but they are still searching it. they have the metro station closed as a precaution. search is also causing delays for commuters. we understand they are helping buses to help those who normally take the trains. live pictures in rockville, maryland, where there is a bomb scare. so far nothing suspicious found. all right. here's a quick look at some of the other top stories we're following for you right now at 6:46. former bart police officer mesherle was set free from the los angeles county jail at one minute past midnight this morning. mesherle served 11 months of a two year prison term after being convicted of involuntary manslaughter for the killing of oscar grant. ktvu's claudine wong is in los angeles. she will have a live report at the top of the hour. san jose police are busy searching for a gunman who wounded three people over the weekend. this happened right near martin avenue and mt. pleasant road on

sunday about 1:30 in the morning. all three of the shooting victims are expected to survive. and new york congressman anthony weiner taking a leave of absence to get professional help. that's after even more lewd photographs of the congressman surfaced. more members of congress are calling on him to resign. arizona congresswoman gabrielle giffords released the first photos of her since she was shot in january. one photo shows her smiling. a car on her neck is the only physical sign that she was injured. a second photo shows her again smiling with her mother. doctors say giffords has relearned how to walk and talk. her staff members say her recovery so far is nothing short of miraculous. time now 6:27. well, tonight, seven republican candidates for the 2012 presidential nominate election will face off in a lecture. heading that debate is front runner former massachusetts governor mitt romney.

he's going to faceoff against six rivals including former house speaker newt gringrich. congresswoman michelle bachman tea party favorite will also be in that debate even though she hasn't formally joined the race. that debate begins at 5:00 . well, first it was cut then reinstated after a large fund raising effort. now the cal baseball team is headed to the college world series. ktvu's kraig debro is with the team this morning with the road to omaha. >> reporter: good morning. we thought it would be a lot more exciting around here but this is a sign of recession. not a lot of students around here. this may be the first time that a team like the cal bears has been in the field. the bears defeated the dallas baptist patriots last night to clinch the three super regional tournament in just two games. pac 10 player of the year had three hits and pitcher johnson threw six innings of three hit ball. some of the bears have started to believe they are the team of destiny. so it didn't matter they were

playing a school called the dallas baptists. it's a season of comebacks for the bears. in september they learned that the 2011 season was supposed to be the last for baseball at cal. the program was eliminated because of a lack of money. private fund raising effort led to the reinstatement in april. then after reinstatement in april the bears lost their first game in the regional tournament but won the last game in the bottom of the ninth to make it to the super regional. getting into the series may be as positive a thing for the program as elimination was a negative thing. the college world series is nationally televised on espn both before and during the game the announcers are certainly going to talk about what happened to cal and how they made it here with a good comeback for them. it means a good sign of a good team and a good program. reporting live in berkeley, kraig debro, ktvu channel 2 news. all right, kraig. they are celebrating in dallas now. the dallas mavericks beat the miami heat 105-95. and the mavericks are the nba champions for the first time.
