well -- well, good morning to you. i'm dave clark. >> i'm tori campbell. we begin with the release of johannes mehserle. he was released from the los angeles county jail at one minute past midnight this morning. mehserle served 11 months of a two-year prison term after being found guilty of involuntary manslaughter for killing oscar grant. let's go live to claudine wong.

claudine? >> reporter: we found a lot of cameras here and oscar grant's uncle and son people who wanted to see him get out -- and some people who wanted to get out. he's a free man. nobody watched it happen. that's because this was not a typical release. we never her saw him -- we never saw him. his attorney said there were enough safety concerns. i asked about what is next for mehserle. he said looking forward to getting a job and getting on with his life. >> reporter: does he have any plans to contact the grant family? >> his plans are to wait and see what level of -- shall we say interest and anger is up in the bay area. i nope johannes wants to -- i know johannes wants to talk to

the grant family. but there's a civil suit and i'm not so sure it's a good idea to talk with the grant family until that is settled. >> reporter: now, oscar's uncle was here overnight. >> you don't want -- i don't want any discussion with him. but i want him to know i will be apart of his life the rest of his life. >> reporter: so what's next? well, there is a rally scheduled down here at the los angeles county courthouse in about an hour. as far as mehserle is concerned, his attorney says he knows where he wants to live and what kind of work he now wants to do because he can no longer be a police officer. we'll talk about that coming up a a little later on -- coming up a little later on "mornings on 2." back here live, you are taking a look at the twin towers correctional facility. this is right across the street from the central jail.

police perimeters out of site. for two hours there was an open mic opportunity for anyone who wanted to publicly event. organizers said they pushed anarchists to get the word out. they didn't want any vandalism or spray paint. >> he's a murderer! >> justice has not been served. it's more like a punch in the gut that this man is getting out. [ chanting ] >> reporter: the protests stayed peaceful. police only made one arrest for tagging. the protests at the fruitvale yesterday may have prevented swellups. we wanted to show you this morning that looters damaged this footlocker last summer

retail center. let's check in with allie rasmus. let's start with a look at 101 in san jose. things were slowing down in the right-hand lane. it looks like it's picking up again. elsewhere in the south bay, things are still slow at 237 in milpitas. this is heading west. this is because of an earlier accident in that area. so expect delays if you are traveling there. on 880 in oakland, traffic is moving very nicely. but just south of the picture, there is a report of a tire in the lane near the marina boulevard exit. so be aware of it in that area. here's steve. 7:5. we have sunshine for some already, but some low clouds in place. a westerly breeze from sfo to oakland airport out to fairfield. some of the fog burning off. we'll see fog burn off center

people are rumping hole -- are returning home. caseyal is live -- casey segal is live to tell us what area looks like now. >> reporter: hi, tori. good morning to you. yeah, when we talk about the evacuation orders being lifted in two towns that encompasses 7,000 people out of the 10,000 originally ordered out of their holes when the wall low fire was racing out of control throughout the eastern portion of the state. here's what we should talk about that's important this morning -- the fire is still out control and is still growing. it's burning now in more remote areas of the apache national forest. it's not threatening nearly as many structures now. it is in a very rugged and remote area and that is why a number of the evacuation orders have been lifted but still very much a around-the-clock operation trying to get

containment. when we talk about containment, when we spoke to you guys on friday morning, it was at 5%. they did make some progress over the weekend, obviously and this morning that number is now at 10%. again, that is why we have seen some of the evacuation orders lifted because the containment lines around populated areas have been strengthened. but boy, this has certainly done an awful lot of damage already. more than 450,000 acres have burned. in that number about 30 homes. 0 structures. 22 of them in the community of greer. it really is a gem, a jewel in white mountains here of eastern arizona, a relatively small community, mostly a tourist area. but that area is still under the gun at this hour and the folks who live there are not ahowed in just yet. one of the other things we have seen problems with the heavy smoke associated with this

fire. at one point over the weekend, victimmallists were saying that the levels of soot particulates in the air here were more van federal health standards. that's something that people are dealing with here. not just folks on the front lines but hundreds of miles away as the soot and smoke is carried all the way to states like colorado and kansas. but -- but certainly we'll take some of the good news here that the containment is getting moved in the right direction. that's the latest from springerville, casey seagan. >> and i know the weather can be critical to fighting fires. any idea on the weather the next couple of days? >> reporter: well,er to, i the forecast is looking more positive. over the weekend, we've had

for training. this will span the space for those living near the jail. this will take place from 8:00 in the morning until 3:00 in the afternoon. vallejo firefighters are also planning controlled burns them -- burns -- burns. they will be burning near the sue juancy reservoir -- swancy reservoir. the burns will start at 10:00 a.m. the fire crews will stay there until they are out and safe. 7:33 police are investigating a shooting that injured three people over the weekend. it happened near martin avenue and mount pleasant road. police say one man and a juvenile were shot around 1:30 a.m. yesterday. police say a third shooting victim turned up later at a local hospital. all three shooting victims are expected to survive. so far, no arrests have been made. 7:4. the family of missing nursing student michelle lee have not give be up hope of finding her alive. about a dozen people went door to door yesterday in hayward

indiana for lauren spear. >> this weekend, fox's "america's most wanted" aired a segment on search for 20-year- old indiana university student lauren spear. she disappeared ten days ago. police say she was last seen walking alone and barefoot through downtown bloomington after spending the night partying with friends. the search involves many volunteers and even some members of the state militia. they put us in dense woods to search. a lost us are ex-military. police are questioning ten possible suspects including the missing person's boyfriend. so far there have been no arrests. 7:36. governor jerry brown says there will be a budget vote on wednesday. that's the constitutional deadline for lawmakers to get a balanced budget on his desk. now, the governor said he's frustrated he has not been able to get the four votes needed to

it doesn't appear to be affecting oakland traffic on 880 as you pass coliseum. we don't know how many people are affect but they are waiting for another bus to pick them up. so be aware of that if you are passing through. traffic on the sunol grade is looking good, the chp is in the process of clearing up an accident that happened there between a semitinker and a truck. but the sunol grade looks okay. not the same situation on 24 in la fayette. you can see it's still slow as you make your way to the caldecott ton. if you are taking a look this morning, you might want to do it morning. still some fog over the bay, it's re-- it's retreating fast. temperatures inland are already in warm category for some. i mean it won't take too long.

from jail at one minute past midnight this morning. he served 11 months of a two- year prison term after being found guilty of involunteer ray manslaughter for killing -- involuntary manslaughter for killing oscar grant. we first go to claudine wong. >> reporter: good morning. we're on street where the jail is located. now, johannes mehserle knew today would be the day he would become a free man but details of his release were a mystery and kept secret into the night. i want to show you. it's a very big facility. you have the twin towers on one side and then on the other side you have the central jail where he was housed. we kind of camped out in this area waiting for him to get out. the media was there, oscar grant's uncle was there.

but johannes mehserle never came out the door. mehserle's attorney says he never came out because there were safety concerns. do you consider it preferential treatment? >> not at all. the goal is to make sure that he leaves the jail safely. >> reporter: johannes mehserle is gone now and in an undisclosed location. his attorney says he wants to end up back in northern california in the place he used to call home. apparently he's had a couple of job offers. >> i guess the question remains, can go home again? >> well, we don't know. we will know over -- more about that in the next ten days. weigh we hope he will be able to go home. he's always called northern california home and he doesn't really want to call any place else home. if he can't go home, he's going to call another place home and will go there with his family and he will live a productive life. >> reporter: now, oscar grant's
