. bay area news starts right now. this is ktvu, channel 2 news at 10:00. >> an unnerving sight for residents after two suspicious fires just two feet apart. good evening i'm heather holmes in for julie haener. >> and i'm frank somerville. an arson suspect turned herself in. the fires happened on mission avenue. ktvu's deborah villalon is in san raphael tonight with a case that barely had time to cool. deborah? >> reporter: yes, these fires

sent heavy smoke over central san raphael and the 101 freeway. take a look at news chopper two. this is san raphael hill which rises behind the historic selkirk mansion right next to downtown. it's public open space and known to attract homeless camps. and the alleged fire bug is one of those campers. >> it was the second fire that i heard the alarms. >> reporter: it was a two alarm fire. >> it was really close to our home. >> reporter: the first was set at this campsite. the second was higher up. and police had a good description of the woman running from the hill. so they were looking already. >> she showed up at the police department earlier and commit -- admitted to doing the arson. >> reporter: why? >> at this point we don't know. >> reporter: passed fires on this hill have been accidental usually from house fires.

some who hike here understand though why the homeless come back. >> the only option left for those that are unfortunate enough to find themselves necessarily out of doors. there are others as well. this is one of the spaces. >> reporter: but it took eight engines and some 30 firefighters to keep this blaze to under two acres. >> the vegetation is still a little bit green so it's not going to burn as well yet in the year. later in the year it obviously would have been a different story. >> reporter: the arson suspect, jailed tonight, is 38-year-old hope windham. again there is no clear motive. but witnesses say she was heard on the hill shouting erratically before the fires. and that her mental health may be an issue. live in san raphael, deborah villalon, ktvu, channel 2 news. cal fire declared today the official start of fire season for much of the bay area and santa cruz county. in the south bay, cal fire crews began conducting wildfire training along with san jose's fire department.

the opening of fire season means that cal fire is banning virtually all open air burning in san mateo, santa cruz, santa clara, contra costa and alameda counties. but the state's budget crisis means cuts in staffing. >> the staffing will be a little reduced. three people staffing on our engine companies instead of four person staffing. >> as they do each year firefighters are urging people to clear the brush from around their homes especially after all of the rain we've had this spring. >> a three alarm fire at a big apartment building sent dozens of people into the street this evening in san raphael or san leandro. the challenges facing firefighters coming up in a few minutes. mehserle is a free man tonight. his defense attorney tells us mehserle would like to meet with the family of oscar grant some day. mehserle left the la county jail just after midnight this morning. oscar grant's uncle johnson was waiting outside to see him released but mehserle never appeared. and then at around 12:25

johnson received an automated message on his cell phone. >> this offender is no longer in custody. >> you don't want to have any discussion with him from this point on? >> no, no discussion at all. but i want him to know that i will be a part of his rest the rest of his life. >> officials say they allowed mehserle to leave through a secondary entrance for security reasons. mehserle served one year of a two-year sentence and received early release thanks to a year of conduct credits. he was convicted of involuntary manslaughter for the death of oscar grant. about two dozen people, including members of the grant family, gathered outside the la county courthouse to protest mehserle's release. the demonstrators say mehserle's killing of grant exemplifies a decades long problem of white police officers killing african american men. following the rally, the demonstrators marched to the federal court house to ask the u.s. department of justice to investigate grant's death. so what's next for

mehserle? the corrections department tells ktvu news that he was released on unsupervised parole. the release is to the jurisdiction of alameda county where he was last living. but there is no word tonight on where he plans to live next. mehserle won't have to report to a parole agent because he is deemed low risk. his parole is scheduled to end one year from today. mehserle's lawyer says his client is now looking for work. >> he's gotten a couple of offers. but, you know, offers for jobs up in northern california are dependent on the mood and the claim ate of the people -- climate of the people. >> he says it is not clear if it will be safe for mehserle to stay here in northern california. but he says no matter what, mehserle is ready to move on with his life. >> even though he is out of jail messages early's legal trouble -- mehserle's legal problems aren't over yet. they have filed a $million dollars unlawful death against him. the civil rights division is

still reviewing the killing of oscar grant to determine if it warrants federal charges. the arrests of more than 150 people for a justice for oscar protest are now at the center of a class action lawsuit. the protest was last november. the legal papers were filed today. the plaintiffs claim they were unlawfully arrested and miss treated. the alameda county sheriff's department says some of the people arrested were held longer than usual because there were so many to deal with and because other deputies were assigned to riot patrol in oakland. our coverage of the bart shooting case continues on our website at ktvu.com. you will find more information about mehserle's release and what's next. >> new at 10:00 tonight, san francisco muni operators are upset after an orb traitor ruled against them and put a new contract into place. the arbitrator handed down her decision tonight and said the operators must abide by a contract. they overwhelmingly rejected last week. some operators began talking about a strike, although their

contract prohibits that. the new contract takes effect july 1st and contains a wage freeze and allows for the use of part-time operators. management says they will reduce overtime costs. muni says they will save $38 million over the next three years. >> the marin calendar restaurant chain is filing for bankruptcy and closing restaurants. hundreds of its workers are without jobs. the chain known for its trademark pies closed 13 restaurants including eight here in the bay area. ktvu's maureen naylor tells us more closures could be coming. >> just disbelief. >> reporter: yes. >> this mother of four came to see for 0 herself that her employer of 14 years had shut its doors. >> i called in last night to see if i come in at 4:30. they came back on the phone and said, sorry, but we closed. and that was that. >> closed, what? >> reporter: at lunchtime today dozens of patrons one after the

other found the door of the restaurant closed in walnut creek. >> we regret to announce. >> reporter: a sign on the door. >> oh, my god, we can't believe it. we're shocked. >> reporter: the manager said it caught everyone by surprise. >> i looked in the window this morning and there were still pies on the shelves. >> reporter: 30 closed yesterday. in walnut creek many patrons live at the nearby rossmore senior community. >> it is going to mean less choice for the seniors here who have mobility considerations and can't travel. >> reporter: the company blamed the closures on underperformance and a weak economic climate. this vendor today picked up unused bread now headed for a local food bank. >> i have seen the numbers gradually decrease over the last few years. >> reporter: in terms of what they order? >> yeah. >> reporter: the company's ceo said the process to identify underperforming locations

. a three alarm fire chased people from their residence. and at this hour those residents haven't been allowed to stay. lloyd lacuesta is live outside the building on hay street near davis to show us just what happened. lloyd? >> reporter: let me show you the scene right now. the people you see on the corner are residents who have been waiting out for three hours to see when they can get back to their homes. their home is this apartment complex the ball mark apartment on hay street. now it is a three story structure. but up on the roof there is another structure which is a penthouse. and that's where the fire started at around 6:00 tonight, sending dozens of people going for safety. >> we heard a loud boom. and when we heard the loud boom we went outside to check and the patio again. and this time there were flames coming out of the third floor.

>> you could see the smoke coming out to impact. the next thing we came out and you start seeing the flames coming out through the roof. >> firefighters went door-to- door of this 66 unit complex to tell people to leave. some residents say they heard the fire alarm going off. but they thought it was a false alarm. >> it looked like the whole roof was actually on fire. but i don't know how severe it was. but as soon as we came out, i mean this whole area was basically a cloud of black smoke. >> everyone got out safely, including this woman confined to a wheelchair. firefighters put the flames out within a half an hour. 50 firefighters responded. the chief says there were some challenges. >> we have an apartment complex with 66 units trying to evacuate all of the residents while we put firefighters into the building advancing the hose lines up the stairwell. >> well, you can see that this is still a very active fire scene with firefighters still out here trying to help. now, we have learned that 14 residents of this apartment complex will not be allowed back in because they live in

one of five severely damaged apartments. it is just too unsafe to let people go back in there. as for the other residents, well, they are hoping that they will get them back in before this night is over. live this is lloyd lacuesta, ktvu, channel 2 news. sunnyvale police have announced an arrest in the killing of a woman whose body was found inside a garbage bag. police identified the suspect as 47-year-old man from santa clara. last week the body of maria was found in a large plastic bag. the coroner said she suffered trauma to her head. police credited the public with giving them several leads. prosecutors today said they will not seek the death penalty against six people charged in connection with the murder of a german tourist. she was caught in a cross-fire of a shoot-out between two rival gangs near san francisco's union square last august. five suspects have been charged with murder. the sixth has been charged with accessory to murder. their arraignment has been

postponed until july 19th. the san carlos city council has selected a new mayor. mclean will re place amad. the lifelong resident was elected back in 2009. klein also served as chair of the general plan advisory committee. interim san francisco mayor ed lee said he has no intention of running for mayor in november. but this website hopes to change that. it's called run, ed, run. it features people from various neighbors and walks of life holding signs encouraging lee to seek the office on a permanent basis. it has also a petition people can fill out and submit. lee has about two months to change his minute. >> there is also a let ed be facebook page that asks for people to support ed lee and respect his desire not to seek the mayor's office. and when we looked tonight, there were three posts on the wall and 70 people who liked that page. a judge is suspect today

make a decision by noon tomorrow on whether or not proposition 8, the state ban on same-sex marriage, should be reinstated. as ktvu's paul chambers says, supporters of the ban say the judge who ruled that it is unconstitutional is bias. >> reporter: san francisco judge james ware sat through two hours of argument. one side the sponsors of proposition eight. they are asking judge ware to overturn retired judge's vaughn walker to eliminate the ban on same-sex marriage. >> the supreme court has long said that no man can be a judge in his own case. and no man is permit today try cases where they have an interest in the outcome. >> i believe that it's discriminatory. i believe that it's about the judge's status in his private life. a few months after judge walker ruled that same-sex marriage is unconstitutional, he admitted he was in a long- term relationship with a man. the defense in this case argued because of that judge walker might have wanted to get married, which means his ruling could have been biased and that's why judge walker should

have recused himself. >> judge walker's decision must be vacated and reconsidered by a neutral judge who has no direct or substantial personal interest in the outcome. >> reporter: this ploy has been used throughout history in civil rights cases. when litigants try to disqualify black judges from sitting on cases involving equal protection. >> judge walker's ruling to overturn the ban on same-sex marriage is being repealed, meaning things can't move on in that case until there is a decision on this motion to recuse. >> the further they can keep us away from that truth and the longer they can keep us in the courts the longer we can't get married. >> judge ware hopes to have a decision by noon tomorrow. paul chambers, ktvu, channel 2 news. california's budget deadline is now just two days away. and the state legislature still has not agreed on how to eliminate a nearly $10 billion deficit. some plans are being floated around the capitol. one would extend temporary taxes another five years

. new at 10 tonight new reason to check your fruit and vegetables bins. a report out tonight list the 12 vegetables that tested highest for pesticide residue. live in alameda with a closer look at that report. janna katsuyama. >> reporter: well, heather this report found that one peach that was tested had 57 different pesticides. the report also lited produce that had -- listed produce that had the highest and the lowest pesticide levels. summer brings a bounty of fresh fruits and vegetables to

the area shopping basket. >> we like green beans and whatever is in season and whatever looks good. >> we have romaine lettuce. >> but the fresh produce can come with dozens of pesticides. the environmental watch group published a list today of the so-called dirty dozen. 12 fruits and vegetables with the most pesticide residues. apples topped the list. 92% had two or more followed by is celery and then strawberry, peaches and spinach. the data was based on a report that they were peeled before testing. >> unfortunately if you just wash the apple you won't get rid of all of those pesticides that the usda is finding. some of the pesticides are actually incorporated into the tissues of the fruits and vegetables. >> over 900 pesticides registered for use here. so over 150 million pesticides are used every year in california. about a third of those are among the most toxic that we know of. >> reporter: one option is to

which puts officers on alameda school campuses. new video just into our newsroom of a special education teacher arrested by police on charges of rape. a ktvu cameraman captured these pictures of 56-year-old jerry johnson after 10:00 tonight. he is accused of raping a developmentally challenged student aide. police say johnson sexually assaulted the 18-year-old at the elementary school where they worked. we are told the teenager has the mental capacity of a 7-year- old. the police say if anyone suspects there might be more victims, give them a call. there is word tonight that a half brother of convicted killer yousef bay the 4th was released from jail this weekend. joshua bay spent nearly four years in custody as part of a plea bargain. he had agreed to testify against bay to avoid facing a possible life sentence. joshua bay had been arrested in the kidnapping and torture of two women in 2007 at a house in east oakland. stocks fuelled a rally this

morning on wall street. about you it pretty much fizzled by the time the closing bell rang. the dow industrials eked out a gain of a little more than a point. the nasdaq was down four. the markets have posted losses in six consecutive weeks. it is the longest losing streak since october of 2002. a cnbc report has projected that facebook could be worth more than $100 billion if and when that company goes public. the report says the filing could happen this fall with the actual ipo being held early next year. the company had an estimated value of $50 billion in january when goldman sachs made a private investment in the company. some major deals today. vf announced it is buying timberland for $2.2 million. they make boots and clothing. vf wendy's sells arby eights

. firefighters are keeling with the massive wallow fire shifted their attention today to a small town in new mexico. the clears spent the day clearing brush and attempting to create a fire break. that fire has burned 550-acres since memorial day and now only 10% contained. 31 homes and four cabins have also been lost. seven people onboard a world war ii bomber burst into flames following an emergency landing. the pilot reported a fire shortly after takeoff and attempted to return to the airport in aurora are. he couldn't make it so he put the plain down in the corn field. officials say this same plane

was grounded over the weekend because of mechanical problems. an oakland student is under arrest tonight and two staff members have been on leave all because of a school project that was a bit too realistic. eighth graders at united for success academy were making a movie about gang violence at union point park last weekend. a teacher and a counsellor were supervising that project. district officials say they told the students to bring fake guns for props. but the fakes looked too real and one gun actually was real. ktvu talked to one student about the ordeal. >> a lesson for everybody? >> it was. but i didn't think they would bring real guns. >> so when you heard there was a really gun there, what did you make of that? >> i was scared. >> reporter: the student under arrest reportedly got that gun the previous night. the teen is now in juvenile hall on gun charges. and in san mateo county, five boys ages 12-14 were arraigned today on charges that they sexually assaulted two classmates. all were 7th graders at kennedy

middle school. the girls are 12-year-old. the district attorney says the attack happened during a field trip to a redwood city park back in march. but the attack wasn't reported until the last week of school. the students were part of the newcomer program, meaning they have been in this country less than a year. in news of the world tonight, in new zealand powerful aftershocks rattled christ church causing one death, several injuries and new damage. a fives 5.2 aftershock was followed by a 6.0 just an hour later. there have been thousands of aftershocks since the quake last february killed 181 people. today's were some of the strongest. in libya rebels came under intense fire today. government forces shelled them with rocket, artillery and mortars at a rate of seven per minute. the opposition is trying to take control of three towns. also today a long-time friend and apply of moammar gadhafi reportedly defected and left the country. and in china, a new high-

class catamarans tipped over. they showed this picture of it capsizing. and christian cafton tell us that san francisco taxpayers may end up paying some of the costs. >> oh, look at that sail. >> reporter: a 45-foot catmaran preparing to race in the america's cup testing the san francisco bay weather this afternoon. so far the america's cup organizing committee has only raised $2 million. if the committee doesn't raise the cash, the money would have could topple from the city's general fund. >> i am very optimistic they will raise all of the funds. >> reporter: mayor ed lee on the bay to watch the action today on the bay says he doesn't expect the organizing committee will have any difficulty fundraising. >> they are just getting their non-profit status started and they are raising the funds. i have every faith that they will be able to raise all of the private funds that they need and make sure that the city is covered as well. >> reporter: at the harbor, sailing enthusiasts watched as some of the fastest sailboats

happening out to blow off a little steam after a rough road trip, returning with a new manager. the guys looked happy on the course today. very upbeat about having bob melvin as their new manager. a guy who makes it clear he always has his players' back, as evidenced yesterday in a loss to the white sox. he will speak his mind. >> it's a motivational thing for me i think when your coach is supporting you like that and constantly behind you. he was showing us some life, you know, even when our heads were down in the 8th inning he was going out there keep your heads up and let's keep going. when you see that in a coach it kind of motivates you to keep going and do your best and try to help him win. well, whether it's cleveland or miami he is still the lord of no rings. but down in dallas, they would like a little less focus on what lebron james does not have and what they do have. that would be the nba championship trophy. and as the mavericks land down in the big d this morning after a night of drinking champagne and smoking cubans, the celebration of the title, the
