traffic and weather. good morning steve paulson. hello, pam cook. we do have some fog on the coast. but on the sonoma and marin county getting wiped out by a northeast wind. there's still plenty on the san mateo santa cruz but inland today all systems go for 80s and 90s. first 90s of the season for many. what do you mean yahoo? 60s, 70s closer to the coast. here's allie. good morning steve. good morning to everyone. this is your first look at traffic this morning. this is highway 4 at bay point. ing see everything's good there. oakland 880 to the coliseum north and southbound traffic there moving smoothly. let's go back to pam. overnight one person is now homeless after a fire in san francisco. ktvu's jade hernandez is at the scene with why firefighters had trouble getting this fire under control. good morning, jade. >> reporter: good morning. san francisco firefighters put this fire out quickly but not before they ruled it a second alarm. firefighters had to fight the flames trapped between two

structures. >> fire looks like it started between the two buildings and went up and got into the building here on golden gate and into the building in the back of the sea exposure. got into both buildings so they pulled the second alarm because we have units in the alley and out back here. >> reporter: firefighters received word from dispatch around 1:00 this morning about flames at 1127 elm in san francisco. the deputy fire chief initially thought eight neighbors were effected. but we spoke to the american cross upon our arrival this morning and learned fortunately only one person was left without a place to stay. no one was hurt. the firefighters fought flames from the alley which is closer to golden gate and scott here in the western edition. as i mentioned, no one was hurt. arson investigators were looking for a cause this morning. all but one resident was left without a place to stay. i want to bring you back out live to 1127 elm. you can see there's a bunch of debris in front of a place

effected this morning. one person effected. reporting live, jade hernandez, ktvu channel 2 news. well, in just a few hours america's first lady will be in berkeley. michelle obama is in california this week to raise money for her husband's re-election campaign. at 8:30 the first lady will attend a breakfast event at the claremont hotel organized by super star chef allis waters. later she will attend a pricey luncheon across the bay in san francisco. the fund raising trip has created some controversy. critics say the first lady is spending taxpayer money to foot the big bill. today president obama will make a rare visit to puerto rico with his eye on next year's election. the president's stop on the u.s. island territory is designed to boost his popularity among the millions of puerto ricoens on the mainland. now they have become a powerful political force. this is the first official presidential visit to puerto rico in 50 years. back in 1961 president kennedy

and his wife jackie made a memorable trip to the island. well, a homeless man -- homeless woman that is is in jail this morning after she confessed to arson. this is san rafael hill located right next to the downtown area yesterday two different fires were set there about 30 minutes apart. homeowners in the area say they saw a woman on the hill just before the fires. she turned out to be 38-year- old hope windment, a regular resident of a nearby homeless camp. >> she was seen running down the hill. and low and behold she showed up at the police department a short while later admitting to doing the arson. >> police say they aren't sure why she turned herself in or why she set the fires. they say she may have some mental health issues because witnesses report seeing her shouting to herself before the fire started. firefighters managed to keep the fire to less than two acres. no homes were damaged.

and no one was injured. fire season is officially underway in much of the bay area and santa cruz county. cal fire crews began conducting wild fire training in the south bay with the san jose fire department. the opening of fire season means burn permits are suspended for san mateo, santa cruz, santa clara, contra costa and alameda counties. firefighters are also urging people to clear brush from around their homes. mesherle is now on unsupervised parole. he was released to the jurisdiction of alameda county upon his release from an l.a. county jail early yesterday morning. there's no word on if mesherle plans to move. though he won't have to report to a parole agent because he is deemed low risk. his parole is scheduled to end in one year. mesherle served one year of a two year sentence and received early release thanks to a year of conduct credits. he was convicted of involuntary manslaughter for the death of

oscar grant. mesherle's legal troubles are not over yet though. the family of oscar grant has filed a multimillion dollar wrongful death lawsuit against the former bart police officer and the u.s. justice department civil rights division is still reviewing the case to determine if it warrants federal charges. a class action lawsuit has been filed against the oakland police department and the alameda county sheriff's department over the arrests of more than 150 people during a justice for oscar grant protest. legal papers have been filed over the protest after which happened after mesherle was sentenced in november. the plaintiffs claim that they were unlawfully arrested and mistreated. the sheriff's department says some of the people arrested were held longer than usual because there were so many of them and because other deputies were assigned to riot patrol in oakland. now our coverage of the bart shooting case continues on

our website ktvu.com. you will find more information about mesherle's release and what comes next. a special education teacher in vallejo is in custody this morning facing rape charges. police fear there could be more victims. a ktvu news camera man captured these pictures of 56-year-old jerry johnson last night. he's accused of raping a developmentally challenged teacher assistant who works with him at loma vista elementary school. the teenager has the mental capacity of a 7-year-old. police are asking for the public's help as they search for more possible victims. fourteen people including four children are looking for a new home this morning after a fire at a san lee andre apartment building. that happened yesterday about 6:30 p.m. at a 66 unit building on the corner of has and thornton streets. firefighters went door to door telling people they needed to evacuate the building. >> it looked like the whole

roof was actually on fire. i don't know how severe it was. but as soon as we came out i mean this whole area was basically a cloud of black smoke. >> firefighters say five of the apartments are unfit to live in. the red cross is now setting up temporary housing for those people. everyone else was let back into the building close to midnight. the cause of the fire is still under investigation. a major ruling in california's battle over same sex marriage could come within the next several hours. a federal judge's decision is expected some time before noon. the battle focuses on now retired judge vaughan walker. the gay judge who presided over proposition 8. now last summer he ruled the california's ban on same sex marriage is unconstitutional. the conservative christian group contends walker might benefit from his own decision if he wishes to marry his long time partner. >> the supreme court has long said that no man can be a judge in his own case.

and no man is permitted to try cases where they have an interest in the outcome. >> i believe that it's discriminatory. i believe it's about the judge's status. >> yesterday the federal judge deciding this case heard several hours of heated legal arguments. the judge made it clear that he was wading into uncharted legal territory in this complex case. time now 4:38. allie rasmus is in again for sal this morning. allie, how's traffic so far? it's looking good so far, pam. good morning to you. good morning to everyone out there. i'm filling in for sal this morning. let's go outside look at the east shore freeway 80 eastbound as you head towards the bay bridge everything looks good there. same story over at the toll plaza. an easy time getting on to the bay bridge if you're traveling at this hour. no problems over there. but over on eastbound highway 4 there is a report of a traffic collision just west of franklin canyon golf course. chp is on their way to the scene there. time is 4:39. here's steve. all right, allie, thank you

very much. little north wind right along the sonoma and marin coast. point rays lighthouse a northeast wind from south golden gate it's clear. temperatures come up today. warmest day of the week. inland we could see our first 90s of the season. very mild lows compared to where we've been lately. little cool for some. 52 san francisco. 59 concord and 58 fairfield. still a westerly breeze though. it's about cut in half compared to yesterday. but it's still there. high pressure will build every over us today. weaker system just beginning to show itself. today if you're away from the coast, warm to hot. if you're near it, maybe not too bad as we start to see warmer weather move in. some morning fog but mainly south right now. highs today 62 to 90. this is looking more like a summertime pattern again along parts of the coast. the north wind will take care of the fog and a beautiful day. just not really warm. for some areas inland it won't

take long. see temperatures starting to move up into the low and mid- 80s. warm today. warm to hot and wednesday about the same then cooler weather takes us thursday and into the weekend, pam. oh, boy. all right. a missouri river levee has failed along the border between iowa and missouri. take a look. these overhead shots show the breach near the iowa town of hamburg. crews are now racing to build a protective wall. the army corps of engineers says worst case scenario flood waters could dump up to ten feet of water into southern hamburg. people there have been told to head to higher ground. arizona's wallow fire has now burned close to a half a million acres and could become the largest wild fire in the state's history today. the exact size is unclear. but it is estimated to have burned up to 463,000 acres. the state's largest fire burned about 468,000. that was in 2002. fire officials say 31 homes have been destroyed by the

fire. far fewer than those that were lost nine years ago. officials say that's because of preventive measures like thinning forests. seven republican presidential candidates share the stage in new hampshire. the one person they all took aim at and who local experts think won last night's debate. and there's a new union contract in place for muni workers. why they are not happy about it. highway 4 at bay point looks good in this picture, but just west of here there is a collision west of franklin canyon golf course. bring you more details on that. more traffic and all the day's headlines straight ahead.

good morning. some fog but mainly south of san mateo santa cruz coastline most of marin and sonoma coast clear. north wind. set to warm up pretty fast here. first 90s in a long time. overnight eight people killed in an attack on an iraq key government compound. two car bombs set off in a city about 35 miles northeast of baghdad. gunmen then stormed the building and took hostages. there have been conflicting reports about whether that situation is under control. in kriss church new zealand a pair of aftershocks caused the death of a nursing home patient. the 5.2 and 6.0 earthquakes hit

within 90 minutes of each other yesterday. the area is still recovering from an earthquake in february that killed 181 people. the aftershocks have caused new damage to buildings. thousands were without power overnight as temperatures approached freezing. congressman anthony weiner is facing more pressure to resign including from the president. over the weekend tmz.com posted more photos of congressman weiner. they show him shirtless and working out in the house members gym. in a taped interview yesterday, president obama talked about the scandal. he says if a politician gets to the point where they can't focus on their job, maybe they should step back. >> ultimately there's going to be a decision for him and his constituents. i can tell you that if it was me, i would resign. >> right now the congressman is on a two week leave of absence. his wife, an aide to secretary of state hillary clinton, is currently in africa with secretary clinton. sources say the congressman is

waiting to speak with his wife in person before making a decision on whether or not to resign. well, seven republican presidential candidates joined forces to attack president obama in a debate last night in new hampshire. >> when 14 million americans are out of work, we need a new president to end the obama depression. >> the candidates seemed to go out of their way not to criticize each other. they didn't even go after front runner mitt romney. instead they took aim at the president. >> the message everywhere around this country from business leaders, large and small including manufacturing, is get the government off my back. as president i will. >> i will be a president to do what's right, not what is politically right. >> i want to announced to president obama is a one term president. >> any one of the people on this stage would be a better president than president obama. >> congresswoman michele bachmann used the debate to announce she has filed the

paperwork to make her presidential run official. the uc berkeley journalism professor covered presidential elections for the new york times. we asked her who won last night's debate. >> the front runner didn't get beat up. so by definition the front runner wins. and i would say the front runner is still mitt romney at this point because he's got the money, because he's got the organization, because he did this once before. >> analysts say with the presidential election still 17 months away, there is a lot of room for change in the field of the republican candidate. san carlos now has a new mayor. andyline will replace o mar who died suddenly of a heart attack last month. he's been serving as interim mayor since the death. he originally withdrew his name from consideration after a drunk driving arrest just two days after his death but climbed through his hat back into the ring after a test showed his blood alcohol level

was below the legal limit and the district attorney did not press charges. a website has launched hoping to get interim san francisco mayor ed lee to run for the position in november. run, red, run features people from various neighbors and walks of life holding signs encouraging lee to take the office on a permanent basis. lee has no intention of running but has about two months to change his mind. there's also been a let ed be facebook page asking people to respect lee's desire not to seek the mayor's office. this morning san francisco's muni workers are angry because they will be working under a new union contract. late last night an arbitrator ruled the contract they overwhelmingly rejected last week will go into effect on july 1st. the new contract includes a wage freeze. and it allows muni to use part time workers. muni management says that will help reduce overtime costs. muni says the new contract will

save the agency $38 million in the next three years. hall of fame quarterback joe montana will not pitch a luxury hotel plan to the santa clara city council tonight as originally planned. montana is recovering from an accident over the weekend. it's not clear exactly what happened, but his attorney says the injuries are not life threatening. montana's attorney is -- has asked that discussion of the hotel project be postponed to an unspecified date. the city has not yet rescheduled his appearance. the hotel would go right next toot planned 49ers stadium. well, it was one week ago that san francisco police officers shot and killed a suspected bank robber. the meeting happen tonight over that deadly shooting. plus it wasn't all smooth sailing during the oracle racing team's first published america's cup practice.

new this morning information about two u.s. soldiers killed in iraq. the military is not giving details on the celebration only saying the two were killed yesterday. they've not been identified. eight u.s. troops have been killed this month in iraq. sunny vale police have arrested a man in connection with the death of a woman whose body was found in a garbage bag. 47-year-old was arrested friday night and is being held in the santa clara county jail. police believe he killed 46- year-old maria at a home in sunny vale and then dumped the body several blocks away. her body was found in a large plastic bag in front of a home. police say the suspect and victim knew each other but a motive for the killing is not yet known. tonight san francisco's police chief will discuss the

deadly police shooting of a suspected southern california bank robber. officers say they were forced to shoot and kill 25-year-old josh smith after he tried to run over them with a stolen car. it happened last tuesday near bun vista park. authorities believe smith was the so-called gen-exbandit due to knit cap and plaid flannel shirt similar to a man who robbed two banks inner vine. tonight's meeting starts at 6:00 at the recreational art center on scott street. coming up on 5:00. back over to allie rasmus in for sal this morning. any problem spots this morning? there is a traffic hazard to let you all know about. it's on southbound 280 just north of bunker hill drive. there's a deer in the middle lane. chp is on the way over there but be aware of it. that potential hazard if you're driving in that area. 280 and san jose traffic is moving very smoothly there. no delays, no problems. and over on highway 4 at bay point back to this picture again. you can't see any problems from

our camera, but just west of here near franklin canyon golf course exit there was an earlier accident. chp and triple a are out there clearing it up. it's 5:54. let's go to steve. allie, thank you. mostly clear skies. fog on the coast. it's not making a big surge inland or anything. in fact it's actually being wiped out along the sonoma coast and parts of the marin coast due to a north-northeast wind. the question is will it make it south? doesn't look like it will yet. on shore push from the golden gate out to the delta but it's not that strong today. still some thick fog mainly highway 1 on the beaches and clearing to the north. local drizzle is possible too as that fog kind of gets chewed up a bit. 50s to upper 50s. these are the warmest lows we've seen in a while especially fairfield, concord at 58. one system will move in. the high's over us today and then as it moves out it will get replaced by a system moving into the pacific northwest and that will usher in cooler weather but not until tomorrow. morning fog mainly south of the

golden gate. north breeze temperatures up today. 90 antioch. napa 80. vallejo 80. 86 santa rosa. 75 oakland. still a lot of fog. little leery about warming up the city too much. 82 san jose. 87 livermore. 77 redwood city. but a lot of fog towards san mateo, santa cruz coastline. i think that will stay with them most of the day. fog, sun, warm on wednesday but cooler weather starts to take over and that will carry right into the weekend. well, the wind on san francisco bay proved too much for the crew of one of oracle's new racing catamarans. whoa is right. the boat was blown over during the team's first public practice on the bay. one sailor is being treated for a rib injury. the rest of the crew resumed practice for the 2013 america's cup yacht races which are being hosted at san francisco. one person is homeless
