steve's right there. i am indeed right here. and you're out there wondering what's the weather today. well, if you're inland sunny, warm and hot. by the coast some fog still lingering especially about san francisco south although there are some breaks in the clouds there. north there's not hardly any. north by that i mean marin and sonoma coast. inland 80s to near 90 degrees. here's allie. steve, i'm here too in for sal this morning. good morning to you. no accidents or delays to tell you about on 880 in oakland. traffic moving along just fine over there heading over to the east shore freeway it is getting a little more crowded as people make their way towards the bay bridge toll plaza. but no problems, no delays in that area. 6:01. back to the desk. an early morning fire in san francisco leaves one person homeless. this started right between two buildings. when firefighters arrived they found the fire burning between two buildings. that forced them to call in a second engine just to get the

fire under control. now the cause of the fire is under investigation. >> waiting for the arson squad to show up and come in and rule out the areas where they can start overhauling and then determine the cause. >> now officials say no one was hurt. the red cross is offering temporary housing for the person who was left displaced. fourteen people including four children are now looking for a new home this morning after a fire at a san leandro apartment building. that happened yesterday at about 6:30 p.m. at an apartment building on the corner of hayes and thornton streets. firefighters went door to door telling people they had to evacuate. >> it looked like the whole roof was actually on fire, but i don't know how severe it was. but as soon as we came out i mean this whole area was basically a cloud of black smoke. >> firefighters say five of the apartments are unfit to live in. the red cross is setting up temporary housing for those people. everyone else was let back into the building close to midnight. the cause of the fire is still

under investigation. our time now 6:02. a special ed teacher in vallejo is in jail this morning accused of raping a developmentally challenged student aide. ktvu's kraig debro tells us investigators fear there could be even more victims. good morning, kraig. >> reporter: yeah, good morning, dave. police say that the rape happened on the loma vista campus elementary school campus and happened during school hours. i just walked around campus trying to find out where the special education classes are held on campus. i wasn't able to find that but going to continue to look. ktvu is the only bay area station with video of the suspect. police say 56-year-old jerry johnson was arrested at home in elk grove yesterday. yesterday afternoon around 5:30. in this video johnson is being detained by vallejo police. >> he didn't seem terribly surprised by the arrest. it's a heinous crime. i can't account for why he wouldn't be shocked by his

arrest. >> reporter: johnson is being held in the van no county jail in lieu of $750,000 bond. police say johnson is not currently registered as a sex offender in this state but police are hoping the public will call them if they have a credible allegation against johnson. police say johnson teaches developmentally disabled kids between the ages of 3 and 5 at loma vista. the victim is 18 years old and is an aide to johnson. she also attend loma vista. even though the victim is 18 her mental capacity makes it impossible for her to give consent for such an intimate act. >> because of her mental disability or incapacity she's unable to give consent even though she's 18 years old to have sex with an adult. >> reporter: police say this rape occurred in february, but the 18-year-old girl just told her parents recently. that's why there was a delay between the allegation and the actual reporting to police. police say johnson has worked here for two years. right now it's not clear if the school or district even know

about this arrest. i've already sent the principal an e-mail and now i'm going to follow up with the superintendent. reporting live in vallejo, kraig debro, ktvu channel 2 news. in just a few hours the first lady will be in berkeley. michelle obama is in california this week to raise money for the obama re-election campaign. at 8:30 the first lady will attend a breakfast event at the claremont hotel organized by super star chef alice waters. later she'll attend a luncheon across the bay in san francisco. this fund raising trip has created some controversy. republican critics say the first lady is spending taxpayer money to foot the big bill. well, today the president will make a rare visit to puerto rico with his eye on next year's election. the president's stop on the u.s. island territory is designed to boost his popularity among the millions of puerto ricoens in the mainland. they have become a powerful political force. this is the first official presidential visit to puerto rico in 50 years.

back in 1961 president kennedy made the trip to the island. 6:05. last night sounded more like a friendly get together than debate among presidential candidates. coming up for you at 6:15 we'll bring you a live report from our washington d.c. newsroom on the common theme at last night's faceoff in new hampshire of seven republican presidential candidates. we have an update now on our breaking news in san jose. right now police are investigating the city's 25th homicide of the year. it happened at about 3:00 this morning on oxton drive when police arrived on scene they found one man dead from gunshot wounds. three other people checked in to local hospitals also with gunshot wounds. police believe they were all shot by the same suspect or suspects. no arrests have been made. ktvu's jade hernandez is headed to the scene to talk to investigators. she's going to give us a live report in our next half hour. time is now 6:06. now that former bart police officer mesherle is out of jail, he's on unsupervised parole. now he was released to the

jurisdiction of alameda county after getting out of jail yesterday morning from los angeles county. mesherle who was convicted of killing unarmed bart passenger oscar grant will not have to report to a parole agent because he's considered a low risk. his parole is scheduled to end in one year. mesherle served a year of a two year sentence and received an early release thanks to a year of conduct credits. now his legal troubles aren't over yet. oscar grant's family filed a multimillion dollar wrongful death lawsuit against the former bart police officer. and the u.s. justice department civil rights division is still reviewing the case to determine if it warrants federal charges. a class action lawsuit has been filed against the oakland police department and the alameda county sheriff's department. over the arrest of more than 150 people during a justice for oscar grant protest. legal papers have been filed over the protest after mesherle was sentenced in november.

the plaintiffs claim they were unlawfully arrested and mistreated. the sheriff's department says some of the people arrested were held longer than usual because there were so many of them and because other deputies were assigned to riot patrol in oakland. now our coverage of the bart shooting case continues throughout the day and on our website ktvu.com. you will find more information about mesherle's release and what is next for him. all right. time now 6:08. sal is out. allie rasmus is back. you're telling everybody to be careful around highway 4 right? that's right, dave. that's really the only problem spot we've noticed all morning long. there was an accident on highway 4 near the franklin canyon golf course. show you the map of where it was. and this happened an hour and a half ago. but it's taken a long time for chp and the drivers involved to kind of clear the accident out of the way. we believe it's on the side of the road at this point because it doesn't look like it's causing any major delays in that area. you don't see any red around the exclamation point icon. but something to be aware of if

you're traveling through there. no delays or problems for you on the bay bridge toll plaza. metering lights aren't on yet. it's a smooth drive on to the bay bridge. and at highway 101 in san francisco things look good as you approach the 80 split. 6:08. here's steve. look at that. little bit of sunshine there. we are seeing some of the fog get chewed up by a northerly breeze especially north of the city although there's still some around. we do have warmer weather on the weather menu today after some early morning fog here. sun then warmer inland. temperatures near 90 for the first time in about five weeks. about the same tomorrow. mild to warm although it looks to me like a good cooling trend will kick in by probably thursday and carry us right into the weekend. right now though the fog is getting smashed by high pressure which is building in. so there could be some local drizzle and some very thick fog along the coast, highway 1. 50s to low to mid to upper. few locations are just raring to go for warmer weather. not much of a sea breeze.

santa cruz capitol will lit 8 warmer. fog, sun, warm on wednesday and here comes the cooling trend as we head towards the end of the week. the deadline is midnight tomorrow for california lawmakers to send a balanced budget to governor brown. we're live in sacramento with the extra incentive lawmakers have this year to get that budget passed on time. good morning. >> reporter: yeah, that's right. good morning. they're not going to be paid until they pass that budget. so every single day that it's late lawmakers will lose out on their salary. now this is getting interesting because it's so late in the game now that even if they do succeed in placing a tax hike extension before voters we won't see that on a ballot until september. but the new fiscal year starts next month. so the question now is how will lawmakers keep california's finances running between july and september? yesterday democrats here at the state capitol called that a bridge saying they need an extension now of vehicle, sales and income taxes in order to

keep the state operating until september when presumably republican lawmakers agree to it a lengthier extension of those taxes would be before voters in a special election. if that happens if voters vote yes, then those hikes would help make up a $9 billion deficit. those hikes are set to expire at the end of this month. governor brown surrounded yesterday by law enforcement and education leaders urged legislators again to agree. >> the only people against this are relatively small number of influential republican activists who don't like this. it's part of their thing. without that no tax they can't go anywhere. >> what they really wanted to do from day one was just raise taxes and just keep doing business as usual. >> reporter: well, yesterday four republican lawmakers here said in a joint statement that they might support putting a tax hike extension before voters in september if that ballot measure also asked voters for a state spending cap as well as for pension reform.

time is now 6:15. republican presidential candidates used their debate last night to attack president obama. as ktvu's allison burns reports, they pretty much avoided attacking each other. allison. >> reporter: good morning. that's right. we were expecting some possible fireworks last night between two of the bigger named candidates front runner mitt romney and former minnesota governor tip pawlenty. but as all seven candidates took to the stage in new hampshire, they really did not lay a hand on each other. pawlenty had ridiculed romney on health care just the day before. he called president obama's health plan obaney care. >> why isn't he standing here with the governor right there? >> president obama is the person i quoted in saying he looked to massachusetts for

designing his program. >> reporter: minnesota congresswoman and tea party favorite michele bachmann made news just by appearing on the stage. she used the debate to announce her candidacy and declare president obama a one term president. now former white house spokesman robert gibbs is making the rounds on tv this morning saying last night's debate was just the same old same old and the candidates were aspousing the views that got the country in this economic mess. more from the candidates during my next update in about an hour. for now live in washington d.c., allison burns, ktvu channel 2 news. so far the united nations security council has not been able to come to an agreement on sanctions on syria to push for an end of the government crack down there. human rights groups say more than 1400 syrians have died and 10,000 have been detained since the popular uprising began in march. four european countries on the u.n. security council are

pushing for sanctions, but china and russia are against it. >> the security council react on syria which i think is extraordinary and disappointing. >> now in the last week more than 5,000 syrians have fled over the board tore turkey to escape the violence. a string of tent cities has now been set up along the border. time now 6:17. joran scheduled to be in courtroom in peru today. he's accused of killing stephanie flores in ally ma courtroom. he was arrested twice but never charged in the disappearance of natalie holloway. the high school student from here in the u.s. disappeared during a graduation trip to aruba in 2005. well, arizona's wallow fire it has burned close to half a million acres. this could become the largest wild fire in arizona's history today.

still not clear but estimated to have burned up to 463,000 acres. arizona's largest fire burned about 468,000 acres in 2002. officials say 31 homes have been destroyed by the wallow fire. that's less than were lost nine years ago. officials say that's because of preventive measures like thinning forests. it's now official, investigators say an arsonist is responsible for two early morning fires in the berkeley hills last week. they started just about the same time just a block apart. police are still searching for the arsonist who they view as very dangerous. the fire started while people in the two homes were sound asleep but fortunately no one was hurt. time is now 6:19. a novato man facing several charges after police say he threatened a woman with arrest and tried to run her off the road. now on saturday the woman told police the suspect identified as martin klem cut her off twice and approached her car saying he was going to arrest

her. she called the police after he drove towards her head on swerving in the last minute to avoid a collision. when police arrested him they say they found two loaded handguns, a taser, a machete tee and also marijuana inside of his truck. 6:19 is the time right now. let's go back over to allie in for sal today. any problems, allie? pam, i think a lot of people may be on vacation this week because we haven't had any major problems to tell you about all morning long. look at the san mateo bridge. traffic moving smoothly. lit crowded as you head east but no problems or delays in that direction. at 280/880 in san jose no problems. 280 northbound highway 17 top part of the screen you can see traffic zipping along there as well. over to the east bay on 24 and lafayette no problems as you make your way towards the caldecott tunnel. time now 6:20. here's steve. allie, thank you. sunshine, warmer weather today for many. a little tricky by the coast.

just a little tricky north of the golden gate. fog is getting chewed up. san francisco has some sun but still low clouds over the bay. question of how far south will that go go. could be a little longer but over the bay as well it will get chewed up. high pressure is our fair weather friend. also the first time in a long, long time. how long, steve? about five weeks that we'll see any 90-degree inland temperatures. early may we had some behaven't had any since. today looks like a good day for it. 58 concord. but temperatures inland they'll start to get into the 60s here i think about another hour or two they should have no problem. one system moves into the north. sunny and warmer. some morning fog, northerly breeze though taken care of some of the fog. not all of it. but something the coast hasn't seen much of. 60s, 70s and find a lot of low, mid, upper 80s and that few 90- degree temperatures today. first time in about five weeks. if you like warm weather today is the day because cooler weather is on the way. kick in thursday and carry us

right into the weekend. all right. sounds good. another japanese automaker is predicting a big drop in profits this year. honda expects profits will be down nearly two-thirds from this time last year. japan's second largest car maker released its forecast more than a month later than usual. honda says it needed the extra time to assess the damage from the march earthquake and tsunami. ford will appeal a $2 billion judgment. that settlement comes after dealers sued claiming they had been overcharged for commercial trucks for eleven years. ford says several legal errors were made including when the court allowed the suit to go forward as a class action. time is now 6:22. football legend joe montana was supposed to speak at the santa clara city council meeting tonight. we're going to tell you why he's not going to be there. looking at highway 4 at bay point. you can see it's a little bit slow. a little crowded. but that's not because of any accidents in that area. just the usual slow down. more on traffic, weather and news after the break.

101 just north of spencer after. we're trying to get a picture of it from our san rafael camera but you can see traffic here in this area looks just fine. 6:25. let's go back to the desk. all right, allie. south bay had an earthquake about an hour and a half ago. it was a magnitude 3.1. it shook san jose at 4:51 a.m. this morning. it was centered about five miles from alp rock. we checked with the u.s. geological survey, their website, dozens of people around san jose say, yeah, they felt it. pesticides in produce. it may be more common than you think. the environmental watch group released a report of the so- called dirty dozen. it lists the 12 fruits and vegetables with the most pesticide residue. apples top the list followed by celery, strawberries, peaches and spinach. the produce was tested after being washed and peeled. the group says one option is to buy organic. now our channel 2 website you

can find a complete list of the fruits and vegetables and how they ranked. just look for the rig now section at ktvu.com. profootball legend joe montana will not appear before the santa clara city council tonight pitching a luxury hotel plan as originally planned. he's recovering from an accident that happened over the weekend. still not clear exactly what happened, but montana's lawyer says the injuries are not life threatening. his lawyer has asked that discussion of that hotel project be postponed to another unspecified date. now the city hasn't yet rescheduled the montana appearance. the hotel would go right next to the planned 49ers stadium. well, it's now down to the wire in the stanley cup playoffs. >> yeah, he scored. boston bruins scored four times in the first ten minutes. boston's 5-2 win over the vancouver canucks last night. the stanley cup finals now tied

the first time in about eleven months. but it was really dragged down by car sales. the rest of the retailers actually doing okay. so we'll have those numbers for you in just a minute as we look live in the new york stock exchange. all right. we'll smile and say good morning to you. thank you for joining us here on the ktvu morning news tuesday june 14th. i'm dave clark. good morning. i'm pam cook. time now is 6:30. we do have developing news in san jose right now. police are investigating the city's 25th homicide of the year. it happened about 3:00 this morning on oxton drive. when police arrived on the scene they found one man dead from gunshot wounds. then three other people checked into local hospitals also with gunshot wounds. police believe they were all shot by the same suspect or suspects. no arrests have been made. ktvu's jade hernandez will have more on this story from san jose in jusabou15 minutes. our time now 6:31. a special education teacher in vallejo's in jail this morning

accused of raping a developmentally challenged teaching assistant. ktvu's kraig debro here now to tell us investigators are fearing there could possibly be more victims. kraig. >> reporter: yeah, dave, that's one of the reasons they're trying to reach the superintendent right now. no sign on the district's website or the school's website. this horrible allegation has reached the people who work here around the district, but the worry is there may be other victims. >> there's certainly a possibility that there have been other victims. the other kids have learning disabilities in this school, they're young, so certainly with them being in position there certainly could be other victims. we're concerned about that. >> reporter: kowhais the only video of jerry johnson following his arrest. will ask the district attorney to charge him with raping a person due to mental and developmental disabilities. he's being held in the county jail in lieu of $750,000 bond. the 56-year-old being held on

suspicion of raping an 18-year- old woman. the woman has a mental capacity of a 7-year-old. works as a special education teacher in loma vista. earlier this month the victim told parents johnson raped her. the rape took place in february. it's not clear what physical evidence still exists in this case if any. johnson was arrested yesterday afternoon around 5:30. police says he was arrested without incident during his arrest went along he cooperated with the investigators. few details are available, but police say the rape happened on campus and during school hours. still lot of questions to answer here. doesn't look as though this hour the school is in session this late in june. trying to get hold of some teachers and administrators as well. live in vallejo, ktvu channel 2 news. a homeless woman is in jail this morning after confessing to arson. this is san rafael hill located right next to the downtown

area. yesterday two different fires were set there at about 30 minutes apart. homeowners in the area say they saw a woman on the hill just before the fire started. she turned out to be 38-year- old hope windham, a regular resident of a nearby homeless camp. >> she was seen running down the hill. low and behold she showed up at the police department a short while later and admitting to doing the arson. >> police say they aren't sure why she turned herself in or why she set the fires. they do say she may have mental health issues because witnesses reported seeing her shouting to herself before the fire started. firefighters managed to keep fire less than two acres. no homes were damaged. nobody was injured. time now 6:34. tonight san francisco's police chief will talk about the deadly police shooting of a suspected southern california bank robber. now police say they had to shoot. they were forced to shoot and kill 25-year-old josh smith after he tried to run them over with a stolen car.

this all happened last tuesday. investigators believe smith was a so-called gen-ex, ban did because of that knit cap and plaid flannel shirt similar to a man who robbed two banks inner vine. tonight's meeting begins at 6:00 at the harvey milk recreational arts center on scott street. sunny vale police arrested a man in connection to a body found in a garbage bag. the 47-year-old was arrested friday night and being held in the santa clara county jail. police believe he killed the 46- year-old woman at a home in sunny vale and then dumped the body several blocks away. her body was found in a large plastic bag in front of a home. police say the suspect and victim knew each other but a motive for the killing is not known. time now 6:35. a major ruling in california's battle over same sex marriage could come within the next several hours.

a federal judge's decision is expected some time before noon today. the battle focuses on now retired judge vaughan walker. he's the gay judge presiding over the proposition 8 case. last summer he ruled that california's ban on same sex marriage is unconstitutional. conservative christian group contends that judge walker might have benefited from his own decision if he wants to mary his long time partner. five boys from a san mateo middle school are now facing felony charges. investigators say they tried to rape two girls during a field trip. the boys are all in 7th grade at kennedy middle school. investigators say the attack took place last march while 20 students were visiting a park in nearby redwood city. two chaperons, a teacher and a teacher's assistant were all there to supervise that field trip. a school project gets a little too real and no one -- now one oakland student is

facing gun charges. last weekendth graders at united for success academy were making a movie about gang violence at union point park. district officials told the students to bring fake guns as props. then they discovered one of the guns was real. the student who brought the gun was taken to juvenile hall. two staff members have been placed on leave. time now 6:36. it's looking like a helicopter used by the sonoma county sheriff's department may survive proposed budget cuts. the helicopter, the one you see right here, costs about $1.8 million a year to maintain and house at the sonoma county airport. during an informal vote yesterday, the county board of supervisors tentatively agreed to restore almost $6 million to the budget which would include money for this helicopter. an official vote is expected tomorrow. this morning san francisco's muni workers are angry because they will be working under a new union contract. late last night an arbitrator

ruled the contract they overwhelmingly rejected last week will go into effect on july 1st. the new contract includes a wage freeze and it allows muni to use part time workers. muni management says that will help reduce overtime costs. muni says the new contract will save the agency $38 million in the next three years. time now 6:37. allie rasmus says there's an accident in the south bay. what happened? we just got word of it about ten minutes ago. this is on southbound 101. let's show you the map right near the airport. this happened about ten minutes ago. but chp is in the process of clearing it out of the way. but you should be aware of it. you've heard the vehicles are now on the shoulder. but you could expect a little bit of slowing in that area. over at the toll plaza it is slow right now. metering lights are on and it is slow getting through. expect 20 minute delay to get on to the bridge. on 880 in oakland a little more crowded than what we saw

making sure the toll plaza works okay today. well, i was just going to say people trying to get on the bay bridge from the toll plaza may have some complaints this morning because the metering lights are now on and as you can see it's very slow getting across. it's backed up to the macarthur maze. expect a 20 minute delay to get on to the bridge. heading over to the maps we have here northbound 680 just south of marina vista this is in the martinez area. there's a report of a road hazard there after an earlier accident there was a couple tires out in the far left hand lanes. be ware of it if you're heading that direction. over 237 no accidents to tell you about. no accidents as far as we know. but it is still slow in the westbound direction. 6:48. here's steve. all right. thank you. very good morning. still have some fog around. low clouds. tough to move that out. water temperature still cold upper 40s low 50s. 51 outside the golden gate. 48 degrees off of bodying bay. there is a component of an easterly breeze on the marin

coast and sonoma coast. but still enough of an on shore push to keep that fog going for some. especially south of san francisco although there are some breaks in the clouds. fog, sun, warmer, fog, sun, mild to warm tomorrow. cool and breezy as we head into the weekend as another system will dig into the north and that will start a cooling trend. today if you're out yonder, 80s to near 90 degrees. first 90-degree highs forecasted today since early may. gone fife weeks since then. that's a long stretch. 58 concord. 50 san francisco. so if you live inland and you have to go to the city or commute into the city there's going to be a big difference in the temps today no doubt about it. there's still a little component of a sea breeze. but i mean this is just a far cry from anything we've seen lately. usually it's a rip roaring sea breeze. that's not the case. system in the north -- well, it's up north. move into the north will knock the high out of here after today. but today it's sunshine and warmer weather for many. not for everybody. there's still low clouds around. still some fog out there. 52 to 58. 60 to 78.

sunny and warmer. some lingering low clouds and then by this afternoon i'd say mild to hot cool, mild to hot this will be a june pattern no doubt about it. 60s, 70s 80s and some low 90s antioch, brentwood. a lot of mid-80s for others and then 60s and 70s closer to the coast. we will warm a little for santa cruz. usually by 11:00 that sun warms up. here comes cooler weather thursday and right into your weekend. well, american express is expanding the cards it offers. they will now have a prepaid debit card. that could be the start of the shift away for conventional charge cards from consumers. allow a customer to load a card with money and only spend that money. american express says customers will get one free transaction a month and then pay $2 for each use at an atm for the rest of the month. checking in on the numbers take a look at that. much better actually than expected early on. dow jones up more than 100 points. back above 12,000.

points. getting good economic news particularly retail stock. facebook, the world's largest social networking site is getting bigger but not as fast these days. at the start of june facebook had 687 million users. it gained almost 12 million users in may. but that's down from almost 14 million new users in april. facebook had been averaging about 20 million new users a month. it's losing some users. the biggest dropoffs occurring here in the u.s. and in canada. former talk show host montel williams throwing his support behind medical marijuana. williams bus just named the spokesman for the wellness clinic in sacramento. more than a decade ago williams was diagnosed with multiple sclerosis. part of his treatment included medical marijuana. but he wasn't told the proper dosage or the right product to use. >> he just said try cannabis. no direction. try it. >> now williams will council
