and controversial case. >> reporter: good morning. i said baggy in the open, but i also meant saggy pants. according to san francisco police, that arrest was made for trespassing. the dress code is sort of loosely defined if you will, 20, 30 years ago, all of these people would be in suits, but you can see how that has changed. desean marmon was cited for trespassing. we'll have to talk to the sergeant why he ended up in jail, if it was only trespass, but according to reports, there was a dispute about his clothing, you know how these kids wear their clothes these

days, lower than it their waist. this is what led to his arrest. we've got some video of the terminal, we just saw it a second ago, if you look inside the terminal there, you don't see anybody dressed the way that mr. marmon was allegedly addressed yesterday. i went up to the ticket counter and i looked for any sign that there was a policy on a dress code. i didn't see that. they had plenty of information about information of checked bags and overbooking of flights, but nothing about the dress code. we understand, u.s. airways did issue a statement. that was in a published report. we'll have to check with them ourselves. becausicly they say, if people are dressed inappropriately, they can deny them passage on an airplane. basically what this boils down to is flying in an airplane is

a privilege. there's no actual right to do that. so whatever happened yesterday was a privilege, and so mr. marmon may have been kicked off because of the dress code, but we'll have to see what happened. breaking news, we're now hearing new york congressman anthony weiner is going to resign. according to democratic sources, weiner will likely announce his resignation today. reportedly, he informed democratic liters yesterday, including house minority leader nancy pelosi. weeper is currently on a two week leave of absence, seeking professional help. the "new york times" reports weiner came to this conclusion that he could no longer serve after having long discussions with his wife, who returned

yesterday after traveling on a global diplomacy mission with secretary of state hillary clinton. we will continue to provide updates on this breaking news story throughout the morning. time is now 7:04. well, fire inspectors in oakland are going door-to-door in some areas, making sure homeowners are ready for the fire season. joining us live now with more. and i'm looking at what's all around you, claudine. what residents are required to do. >> reporter: in some places it's actually pretty high, almost as tall as me out here in the oakland hills. we've come out here, because all three these hills, we've been driving in them this morning, taking a look at homes out here, because around a lot of the homes, they have a lot of this high brush area. if you come down to this sign, right at tunnel road, just off the freeway. you can see signs posted the

fire danger is moderate today. they want people to be prepared. we have seen homeowners making an effort. i want to show you video, where the homeowners has obviously cut down a lot of brush around their house. that makes a huge difference if fire sweeps through the oakland hills. i did talk to a homeowner today who did not want to go on camera. she said look, this comes around every year, they're aware of it. she just hasn't quite gotten to it. that's what they're going tore targeting today. they've sent out fliers, telling them that inspections begin on june 15. they're going to make sure they've done the work around their homes. if they haven't, they'll give them a form, letting them know they've got some work that needs to be done. if they still don't get that work done, they're going to do it for you, send you a bill,

and they're going to fine you. 7:06, six bicyclists are seriously injured after being hit by a suspected drunk driver overnight, who was also using a cell phone. this happened around 2:00 this morning, about 8 miles south of downtown los angeles. in total, there were nine bicyclists out for their midnight ride when a woman drove into the group. right now, police are questioning that driver, but it's unclear whether or not she has been arrested. also overnight, we've learned al-qaeda has a new leader. several islamist websites say ayman al-zawahri who was osama bin laden's second in command, has taken over as head of the terror network. we'll have a live report from our washington, d.c. newsroom, with what terror experts are saying about the new man in charge. back here at home, a petaluma police officer responding with some injuries

about an outof control teenager. the 17-year-old was reportedly tearing up his mother's home, when police arrived, the teen ran away. officers say they quickly caught up to him, but he prepared to fight them, and even assaulted them. officers say they were able to restrain the suspect, who did suffer a head injury. he's expected to be in court on several charges, including battery on a police officer, and possessing marijuana. 7:07 is the time, let's check in with sal castaneda for a check in on the commute. >> already today, it's much better than we had yesterday. today it looks more like it should. we're going to start with 280 in san jose northbound. that traffic looks pretty good, getting up to the commute there, no major problems if you are driving on 280, getting up to highway 17. also, highway 17 is much better today than it was yesterday. i think yesterday was just a get it done day. right now, traffic is looking good on the san mateo bridge.

that looks very nice getting up to the high rise and over highway 101. and of course, a toll plaza was backed up. we're hoping this trend will continue. 7:08, let's go to steve. a very good morning. not too hot yesterday by the coast, very warm to hot inland. today temperatures coming down a bit. fog is all over the santa cruz coastline, but that's about the only place. signs now of more of a westerly push on the breeze, patchy fog, unless you're on the santa cruz coast, then it's solid. but fair, cooler, breezy, a few high clouds. mostly sun. saturday, it looks like a little warmer weather on sunday. we also have a very high pollen count, the grasses continue to be out front, but the trees are making a move threw. all the juniper and birch continue to be the highest. you have company with the

grasses if you're suffering. we have a system dropping down higher clouds from the north and fog underneath it. in the south, the warm has conquered at buchanan, 62. everyone else has 50s. i did see outside of sonoma, a 48-degree reading. a lot of mid-50s, there's is a southwest wind at fair field. yesterday, i think it was southwest at 7, so it's about doubled. west 14 at sfo. southwest napa, south of concord, these are all cooler directions. you can see why, the ridge of high pressure out in the pacific is driving on another area of low pressure southward. as it does, that gets rid of the hot conditions, unless you're really far inland. the cooling trend has started today, and will really continue into saturday. then it looks like a little bump up by sunday. fog trying to work its way up the coast and down towards santa cruz, there's a lot.

coming down, a lot of 70s and low to mid-60s. new this hour, the obama administration is reacting to the news that al-qaeda has selected a new leader. ktvu's alison burns is live in our washington, d.c. newsroom, with the white house response. >> reporter: tori, the bottom line from the obama administration is that ayman al- zawahri is no osama bin laden. overnight, several jihaddist websites announced he was the terror organization's new leader. he was bin laden's long term deputy, but senior administration officials are quoted this morning as saying, he does not inspire the same loyalty, and is not a strong leader. but we just talked to a former defense intelligence official who says al-zawahri is still a serious threat to the united states. >> i think al-zawahri is more realistic, and i think he brings with him, a revision of the most venommist, more active, and i do mean an

of power. saying president obama's argument don't pass the straight faith test. suing the president over the involvement in libya. however, in a 38 page report to lawmakers the white house says it doesn't need congressional approval to continue that military campaign. it's a nato led mission, according to the white house, with no american troops on the ground. we'll go to washington and bring you a live report on the tension now between the white house and capitol hill. a lawsuit filed in alameda county is accusing cnn.com of discriminating against a death. this lawsuit awe cueses cramp nn of violating california -- accuses cnn of violating by refusing to caption online americans. time warmer and cnn have made no comment on that lawsuit.

7:18. fewer americans applied for jobless benefits last week, but the number still remains higher than it should be in a healthy economy. 414,000 people filed for unemployment. that's down 16,000 from the week before. and a second drop in three weeks. continuing claims also dropped slightly to 3.68 million. today, ibm is celebrating 100 years of business. to mark the occasion, the company is looking back at its impact in the tech industry. pam cook is live in the newsroom with some of the technology we have today, thanks to big blue. >> reporter: ibm was famedded on june 16 -- founded on june 16, 1911. in the past 100 years, ibm has left its fingerprints on

7:23 this morning, police are still patrolling the streets of vancouver, after frustrated fans set fires and overturned cars. police made dozens of arrests the riot started moments after the canucks lost. vancouver was shut out 4-0. it was boston's first nhl title since 1972. police report only a handful of arrests during street celebrations in boston after the bruin's big victory. a new kind of left turn arrow is catching on in some cities, including right here in the bay area. take a look, it's a blinking yellow left turn arrow. it allows you to make a left turn after yielding to other traffic. the traffic is green coming for drivers in the other direction.

the drivers can make a left when you see a gap in the traffic. among the cities using this kind of arrow, minneapolis, st. paul, detroit, san antonio, and coopertino, here in california. lawmakers are considering a change to yellow lights. it would allow cities to lower the speed limits in some areas. if a 30 mile-per-hour speed limit can be adopted, cities can reduce yellow light times by a fraction of a second. it can lead to a huge increase in red light camera tickets along with increased revenue for the city. let's check in with sal, who i'm sure never does that kind of thing. always stop at the yellow. >> yes, i do. i don't like getting tickets. good morning, everyone, let's take a look at the commute now.

they've teamed up in trying to rally the public in their search to bring le home. this is despite the fact that hayward police have reclassified the case as murder investigation. her father says unless police can show him compelling evidence, he will not believe that his daughter is not alive. >> certainly, the family wants to help, they want to be part of this investigation. they want a resolution sh and they want to find michelle. to that end, we are going to meet with them and help coordinate that effort. >> reporter: hayward police are recommending the niles canyon area as a place to search. sources tell ktvu that investigators were able to pick up a ping on le's cell phone in that area, within 24 hours of her disappearance. le was last seen off sleepy

this. firefighters say these accidents are more common as the weather warms up. >> we all know the importance of keeping an eye on our kids. that's not to say that this is the case for this child. there is a lot of people there that clearly cared for him deeply. it's just one of those things. we have to keep a good eye on him. >> the little boy was air leasted to children's hospital in oakland, and underwent surgery. police say no charges are going to be filed and this was an accident. palo alto police believe they know who is responsible for robbing a teenager girl and gun point, and tossing her out a car. they stole her cell phone, and booted her out of the vehicle. she suffered cuts to her head and leg, and was taken to the hospital. 25-year-old antonio nunez has been booked for the attack. two other suspects remain at

large. police confirm they have made an arrest in the deadly shooting outside of sweet jimmy's bar in oakland. police are not releasing any more information about the arrest yet because of the ongoing investigation. santa fe police encouraging residents take back your neighborhood, after a series of gang related homicides. the wave of violence prompted this community meeting last night at city hall. san jose's deputy chief says half of the city's 25 homicides so far this year are gang related. there are some 6500 gang members in the south bay. >> we want to send a message to those who would do crime in our city that, you know, despite the fact that we have less staff, we're going to do our very best to really put a damper on their activities. >> reporter: community members are urged to call police when she see a cream, and also to -- see a crime, and also to work with children, to keep them out

of its soft patch. the dow up 56. nasdaq up 9. crude oil prices were heading back up today. they were up about $96 a barrel this morning. that is after it fell below $94 a barrel yesterday. the lowest price since february. checking the latest numbers right now, oil is back down to $94 a barrel. $94.77. hewlett-packard is suing oracle, it's long time partner on several projects. it accuses oracle of illegal behavior, by deciding future versions of software won't support a specific line of hp servers. the lawsuit is the latest sign of how much the relationship between hp and oracle has deteriorated. computer hackers claim they broke into the cia's website, and caused a lot of problems. the cia says the problem appears to be limited to its public site, which doesn't have

ago. he said the president's arguments about libya do not pass the straight face test. the libyan conflict could eventually be waged inside an american courtroom. >> reporter: well that's right because, good morning, actually. bipartisan group of lawmakers are suing the administration now for the u.s. involvement of military forces in the conflict in libya. but the white house, in response to calls to get more information about what is going on, in libya actually released a 32 page report, actually yesterday, indicating how much the effort is costing. so far, according to the report, the cost through june 3 is totaling $800 million. the estimated cost through september 30, will be $1.1 billion. that is not sitting well with a lot of lawmakers who say they want more answers as to how long troops will be involved.

calls is both outdated, and wasteful. the report says skyrocketing costs are creating huge budget problems. it concludes private ambulances can respond to calls quicker and save taxpayers a lot of money. there is a bit of positive news for firefighters in san jose. the department is going to hire back 49 firefighters who were laid off last summer, due to budget cuts. it comes after the city council voted to accept a $15 million federal grant. the san jose firefighters are set to be retrained and back on the job next month. two men accused of robbing and attempting to kill joss stone were arrested near the 24- year-old's home, after neighbors alerted police about a suspicious call. officers say the men were armed with swords, rope, and a body bag. they also had detailed maps and photos of stone's property. the suspect ordered them to be

held in jail until their next hearing in july. a newly discovered earthquake fault could mean the lake tahoe basin is at risk. it crosses the union pacific railroad tracks as well as interstate 80. seismologists found this fault just five years ago. if a quake hits that fault, it 0 could weaken the nearby dam. water levels in that dam were kept pretty low. however, this year's heavy snows, it could fill up, and threaten the 72,000 homes beneath that dam. all right, 7:55. let's check in with sal castaneda, to see what kind of challenges we're facing on the roads. >> we are just learning of some activity at 6th, and mission. that's creating a delay for cars. in fact, they've closed off the area. so sixth and mission is a good area to avoid. this happened about 7:35.

at a san francisco airport. more on this strange and changing, and quite controversial case. >> reporter: we keep hearing more about the story, i just spoke with sergeant mike rodriguez about the story, and it gets larger and larger every time i hear it. the ticket counter by the outside right nowment we just talked to sergeant rodriguez. he told us that you've been hearing the plane made the arrest. police said they could not make the arrest. it all started yesterday about this time. the whole thing started with baggy, saggy pants. >> the flight attendant talked to the customer service agent. they both said they thought it was offensive that his pants were down around his knees and his underwear was exposed. both indicated they also saw the front of his private areas without being exposed, but

indicated that was offensive. >> reporter: desean marmon is a maybe of the new mexico football team. police say he was warned three times to pull up his pants or get off the plane. police say he replied over and over again, that he paid for his ticket and wasn't bothering anyone, and he would not get off the plane, or pull up his pants. it wasn't so easy. it took five officers to subdue him. in fact, they had to put him in, well, it's not called a straitjacket. it's a two piece thing, but essentially restricts your movement. the officers said they did that for their safety and other people's safety as well. because they simply didn't want to chance it on the narrow staircase. he was put into a wagon, and

taken to the san mateo county sheriff's jail. where he was booked for resisting an arrest, and assaulting an officer. an officer was actually hurt in this melee. we talked to sergeant rodriguez, he told us, that the whole plane, everybody on the plane had to get off while this was going on. he talked to some passengers after this happened, and they weren't too happy. >> a lot of them thought this really could have been handled by the gentleman simply pulling up his pants, and they requested why he simply didn't do it. >> reporter: so after the arrest was made, he was taken to the san mateo county jail. that's where desean marmon is. we talked to sergeant rodriguez and a couple of other people. it's called sagging, it's cultural. in this instance, it was so low

are you ready for fire season? that's what firefighters want to know. claudine wong joins us live from oakland. >> reporter: spring rains brought a lot of growth and this is what you're going to see throughout the oakland hills. the problem is, you're also going to see a lot of homes. fire inspections are going to start today, with firefighters saying look, you need to clear the space around your home, just to make sure everyone is safe. we did talk to a lot of homeowners in the last hour. a lot of them said look, we are trying to get this done, but a lot of them said there's still work to do. >> before i can see the other house. >> so you cut that much down just this year? or this was last year as well. >> last year. so this year i started to do a

into the group. right now, police are questioning the driver, but it is unclear whether or not she has been arrested. the time is 8:07. the father of a 2-year-old boy in fresno who accidently shot and killed his stepsister is facing criminal charges. jared devioce was charged. in just a couple of hours, a jury will continue deliberations in an antioch women. police were called to her home and found 15-year-old jasmine davis dead on the floor. the coroner says she died from malnutrition, and physical abuse. her twin brother was also found in that home, severely malnourished.

helped redwood city police catch a car thief. investigators were searching for a lexus that was stolen last friday. so they went to a lexus dealership, and had the gps on the car activated. within an hour or two, they found the stolen car and the suspect. nicholas castro, according to police, tried to drive away, but he got caught in traffic, and was arrested when he tried to jump out of the car, and run. his girlfriend was also arrested for a misdemeanor warrant. also police have confirmed to ktvu they have made an arrest in that deadly shooting outside sweet jimmy's bar in oakland. the shooting back in april left two men dead, and injured four others. police so far have not released any more information about the arrest, because the investigation continues. it is 8:37, a san francisco jury is ordering a lake tahoe casino to pay $3.25 million in

damages to a woman severely injured after drinking what she thought was water, but turned out to be acid. four years ago, julia ellis ordered a bottle of water, when she took a drink, she doubled over in pain. a worker had apparently filled the bottle with a highly toxic cleaning solution, and it was mistakenly served to ellis. harrah's had already accepted liability, yesterday's verdict was for damages. many liquor stores in the city break the law when it comes to advertising to youth. it is against the law for businesses to cover more than 60% of their storefronts with alcohol advertising. but the survey finds almost 1/3 of liquor stores break that rule the students focus the story on the mission, bay view, and other lower income yours of the city. a bench warrant has been

made at san francisco international airport. ktvu's kraig devereaux is live right now, about who made that arrest. >> reporter: good morning, dave, just to give you an idea of how much your dress code has changed. 35, 40 years ago, all of those people would have been in suits. now according to a published reports, u.s. airways suggested what the passenger was wearing yesterday was indecent exposure. according to police, flying is a privilege not just a right. [ no audio ] marmon is facing trespass, battery on an officer. he boarded yesterday morning, but not before two flight attendants told him to pull up

his pants. marmon was sagging. he refused, he said i paid for my ticket and i'm not bothering anyone. the police took marmon off the plane, but it wasn't easy. >> the report indicated that it actually got a little heated at some points. and the captain in fact cleared the airport of other passengers fearing for their safety is what he indicated in the report. all the passengers were deplaned from the aircraft. >> reporter: marmon was taken off the aircraft. during the scuffle, an officer twisted a knee. now marmon is looking at battery and officer assault charge. i did talk to a couple of passengers. it was kind of mixed, the

welcome back. time now is 8:54. california's public universities may raise tuitions even higher, if cuts in the new state budget stay in place. it calls for cutting $150 million each from the university of california and the california state university systems. that's on top of cuts of $500 million for each of those systems that the governor imposed in january. the budget also calls for k through 12 schools to get $3 billion less than what the governor proposed in his revised plan back in may. california residents could soon pay sales tax when they shop online.
