starlets now. good afternoon. i'm maureen naylor in today for tori campbell. we begin with an anuancement from governor jerry brown this morning that puts the state budget battle back to square one. he vetoed the budget passed by democrats yesterday and posted his comments on youtube. >> today i vetoed the california state budget. i do so reluctantly, but with clear purpose. for a decade, the can has been kicked down the road and debt has piled up. in january i presented a balanced budget solution of deep spending cuts and a proposal to let the people of california vote on whether to extend some taxes on a temporary basis. unfortunately, the republicans said no. they didn't want the people of california to have that right to vote. the democrats on the other hand made some very deep cuts. and in the budget that i received today there was more

positive work. unfortunately it doesn't go far enough. california is facing a fiscal crisis. and very strong medicine must be taken. so i am vetoing today because i don't want to see more billions in borrowing, legal manufactures that are questionable and budget that will not stand the test of time. >> governor brown had threatened to veto a budget filled with what he called gimmicks. the budget is now back in limbo with only 14 days left in the fiscal year. now to our other top story within the past hour embattled new york congressman anthony weiner made it official and announced he's resigning. >> i'd hoped to be able to continue the work that the citizens of my district elected me to do. to fight for the middle class and those struggling to make it. unfortunately the distraction that i have created has made that impossible. so today i'm announcing my resignation from congress. statement in his new york city congressional district. he did not take any questions. it comes after weiner last week admitted he sent lewd photos and inappropriate messages to several women. in just a few minutes we'll go live to washington d.c. for the reaction there to congressman weiner's resignation. back at home san francisco police right now are looking for suspects in a shooting that critically injured an innocent bystander this morning. the incident happened about 7:30 on sixth street in the south of market area. ktvu's kraig debro joins us live with what police are now saying led up to the violence. good afternoon, kraig. >> reporter: good afternoon. still police presence here after a few hours lot of places evidence could have been tossed. locals call this neighborhood sixth street because it is on sixth street between howard and mission. people live here but it's not the kind of place you take your kids to play. gang members proving it's not always safe to walk the streets here in broad daylight. this morning police crime scene investigators focused their attention on the street. the unidentified man shot near

the intersection of sixth. the bullet entered near his left ear. police describe him as a filipino man. the victim was shot at 7:30 this morning. caught in the middle of a deadly fight between gang members and unintended target. >> most likely it's a gang case. there's a couple individuals that we have talk today this morning who were out here who we know were involved in some gang activity down here. it's leading towards being a gang task force case. we're down here now investigatorring it. >> reporter: police say it's not only a gang-related shooting, it's also a retaliation shooting. they say it is the result of a fight between two groups of men. a man who lives here told me the fight took place last night and the victim was badly beaten. police say for the shooter to pull the trigger when he did is surprising. >> normally gangsters are not out at this time in this lively so to speak. it's unusual. >> reporter: late this morning

that's rocked the political world and made headlines around the world. >> today i'm announcing my resignation from congress. >> reporter: the married lawmaker's decision comes more than two weeks after lewd photos first spa surfaced. the first images sent through his twitter county. he blamed hackers at first. >> i can definitely say i did not send this. i can definitely say it looks a lot like a prank on a joke about my name. i can say with certitude that i have hired someone who is going to come in, deconstruct this as best they can to make sure this doesn't happen again. >> reporter: but weiner dodged specific questions. >> i'm not going to talk about this anymore. >> reporter: over the next several days a number of women came forward with explicit texts and photographs they said weiner sent to them. the new york democrat finally made an admission to the media, his constituents and his wife, an aide to hillary clinton. >> last friday night i tweeted a photograph of myself that intended to send as a direct message as part of a joke to a

woman in seattle. i panicked, took it down and said i had been hacked. i would like to make it clear that i have made terrible mistakes that have hurt the people i care about the most and i'm deeply sorry. >> reporter: there are a few things that still need to take place at this point. his letter of resignation will have to be read on the house floor before it becomes official. then the new york governor will have to declare a vacancy and make an appointment. that being said, his district 9 house seat could actually disappear through all the redistricting going on in new york city. so that could become mood even before the next election comes up. >> interesting to see what happens. thank you very much. a small liquor and grocery store in san francisco is losing its liquor license today for selling alcohol to minors. a few hoursing a officials at the california alcoholic beverage control paid a visit to bob's liquor and grocery on harrison street. they posted notices that the story's liquor license has been revoked. the disciplinary action was carried out after a three year battle with the owner.

>> this store owner pursued a hearing and then challenged our findings and took it through the appeal process to the very end. >> state officials say the store was cited three times in three years to minors. that's the threshold for a loss of license penalty. a new report reveals how california farmers weathered the recent three year drought and some results are surprising. water shortages drove down revenue in some farming districts by as much as 20%. but state and federal crop data shows many of the biggest farms with senior water rights in the san joaquin valley received all the water they requested. and helped boost state farm revenue to $35 billion in 2009. that's the third highest year on record. a warning is going out today for the bay area for those who live in one high fire danger area. ktvu's claudine wong is live in oakland this afternoon with the important safety reminders being delivered today. good afternoon, claudine. >> reporter: good afternoon,

maureen. this is the type of tall high grass that can send a fire on a hot day racing through the oakland hilts. homeowners are busy cutting it down. firefighters are out to be making sure that work is getting done. >> before i can see that the other house. >> reporter: so you cut that much down just this year or this is last year as well? >> this is last year. >> reporter: she says she trimmed down all 32 trees on her property herself but says she still has more work to do. >> i come out here. i didn't do well and they give you a warning. >> reporter: fire inspections are set to begin in the oakland hills. that means firefighters will be taking a look at almost 26,000 properties in the city making sure they have weeds and trees trimmed to give firefighters their best chance at saving homes and stopping fires. >> when you've got really tall grass, it's a very dry day, hot and winds, it goes so quickly that you can't -- you can't even get in front of it. there's just nothing you can do but try and get to where you think you can stop it. >> reporter: at this training

center today a mutual response area meeting also got underway with agencies all talking communication. >> well, it can be a challenge, but certainly communication is key to the safety of personnel that respond to the emergencies in our ability to communicate the strategy and tactics established by incident commanders. it plays a key role. >> reporter: this $700,000 mobile command center is new to the firefighters this season. the latest in high-tech communication thanks to grant money given to the oakland police and fire department. all part of a community wide effort that keeps everyone on their toes. >> our family complied. >> reporter: usually you get a passing grade. >> right. >> reporter: she says it's hard work but she sees the result. >> makes a big difference doesn't it? >> it's a big difference. yeah. >> reporter: do you mind doing it? >> i don't mind. [ indiscernible ] >> reporter: firefighters sent out these notices a couple weeks ago warning homeowners about this inspection period that's going to take place. but this is an annual event.

homeowners know it's coming. and firefighters say really they are usually 80% to 90% compliant. live in oakland, claudine wong, ktvu channel 2 news. all right. thank you. there's a bit of positive news for firefighters in san jose. the department's going to hire back 49 firefighters who were laid off last summer due to budget cuts. the move comes after the city council voted to accept a $15 million federal grant. most of those san jose firefighters are set to be retrained and back on the job next month. ahead, why the next fight in the conflict in libya may be battled in a u.s. courtroom. also we'll update the situation on the west coast city where some fans did not react well to losing a sports game. and meteorologist montana will be up soon to tell you if it will cool down enough in your neighborhood and just how much. also.

looters left cars burned, stores in shambles and windows shatter over a ten block radius over the city's main shopping district. in the growing dispute other u.s. involvement in libya, several house members are suing president barack obama. the bipartisan group says president obama violated the constitution by authorizing military action without congressional approval. the law only allows for 60 days of involvement plus a 30 day extension. this morning house speaker john boehner said the president's argument doesn't pass the straight face test and threatened to cut off funding for libya operations. that's after a report out yesterday saying congressional approval is not needed because american troops are not facing any hostilities. college football player from san francisco was arrested yesterday at san francisco international airport after he refuse today pull up his pants when he boarded a u.s. airways flight. 20-year-old grew up in the bay view district and now plays for the university of new mexico. he had been in san francisco for the funeral of a childhood

friend. u.s. airways employee called police to say someone was exposing yourself. he was reportedly wearing his pants between his knees and waist exposing his boxer shorts. police say he refused to pull them up as he was asked to leave the flight. >> the report indicated that it actually got a little heated at some point and the captain in fact cleared the aircraft of all the passengers. >> police arrested him for trespassing, battery and resisting arrest. he's being held on $11,000 bail. police are warning residents in sausalito about an increase in telephone scams. the scammers are identifying themselves as law enforcement officers or a law firm representative and threatening arrest if victims don't pay a fine. the callers typically have an accent or speak in broken english. police are reminding people not to give out personal information over the phone and to notify police about suspicious calls. when students at emery high in emeryville return to class next fall, they'll likely

80. seismologists found the fault five years ago. if a quake hit that fault, it could weaken the nearby creek dam. water levels behind that dam are kept low. but with this year's heavy snow, that could fill it up and threaten 72,000 homes beneath the dam. another nice day back here in the bay area. little bit haze out there looking out toward mostly sunny skies in san francisco. you will notice a bit of a cool down that will begin today. they'll actually carry us into the weekend. right now the maps one reason for that cool down the fog returning right around monterey bay closer to monterey eastbound santa cruz and already a few patches closing in on the san mateo county coastline. look at the overall weather story for today. we have a cooling trend begins tomorrow even a bit cooler. the weekend here's the overall theme. cool temperatures for the beaches, inland mild numbers out there with temperatures on either side of 80 degrees. current numbers just updated santa rosa right now 76. san francisco 62. concord 78 degrees.

livermore at 74. these neighborhoods that are in the 70s right now yesterday at this time they were in the 80s. that's a pretty good sign that we will be cooler for today. here's a look above from the satellite. big ridge in the pacific warmed us up over the past few days. some act it up to our north will be dropping to the south. as it does it will drag in the fog down toward monterey bay closer to the bay area. with that here's the overall forecast for friday. and it's a saturday morning. cloud cover given way to increasing sunshine into the afternoon and most areas will fall within this range in the 60s and the 70s. a few neighborhoods tomorrow could still be flirting with the lower 80s. here's our fog forecast model. you'll see this afternoon doing a nice job on picking up on some of the overcast primarily south of the bay area. as we do put this into motion by this evening we'll have an increase in the low clouds especially near half-moon bay. low clouds regroup and push back into at least right around the coast and even a few patches into the bay. first thing tomorrow morning.

but even if it's not covering your neighborhood, just this coupled with a stronger on shore breeze that will translate to the cool down as we head into your friday and then into friday afternoon the clouds pull back to near the shoreline. for today's forecast here we go at 3:00 mostly sunny skies. temperatures low 60s all the way to low to mid-80s. by 7:00 some patchy coastal fog 58 to around 74 and fog will continue to be on the increase primarily coast side and a few patches around the bay late tonight into early tomorrow morning. forecast highs this afternoon santa rosa 85 degrees. fairfield at 86. and oakland 72. that typical on shore breeze will continue to be on the increase. with that the sea breeze around 10 to 20 miles an hour. san jose right around 79 and los gatos tops out 84. here's a look ahead for your friday threesome fog in coast side around the bay to start out the day. cooling trend will continue. saturday probably one of the coolest days of the period. a little bump in the numbers

for sunday and then into next week we could be talking about more significant warming for monday, tuesday, wednesday possibly return of the 90s across parts of the bay area. so it's nice to have these breaks in the heat but coming back. looks like that's the plan over the next few days. >> that's good it's been so dramatic from cool to hot. >> yeah. cool to rain but now feels like summer. all right. thank you mark. san francisco's head of municipal transit agency asked to leave the job. he's been in a battle with the transit workers union. muni's chairman told ktvu ford will leave with a severance package of $384,000. ford says he does not have another job liked up right now. muni will start looking for a new executive director immediately. today commuters are being urged to reduce their gasoline usage and "dump the pump." transit agencies asking people to leave their cars at home and use public transportation.
