a 4th victim, a pregnant woman showed up at highland. i had bullet grazed her and the 5th went to alta base hospital. police are searching for suspects. also in oakland, police are investigating the 54th homicide of the year. a man was shot driving on bancroft between 72nd and 73rd avenue shortly after noon. he ended up crashing into some cars a few blocks away. witnesses took him to the nearby east mont police station and then paramedics took him to the hospital where he died. >> a man police say is the suspect in the beating of brian stowe is heading to prison. giovanni ramirez was sentenced to 10 months in jail because of a parole violation. they will appeal it.

>> fight isn't over. there is an appeals process that takes place. >> so far ramirez has not been charged with the stowe beating. his attorney said he had nothing to do with it and he wasn't near dodger stadium the day he was attacked. the attorney also claimed 11 family members and friends have provided an aliby. brian stowe remains in critical but stable condition. >> pg&e said it'll pay $26 million in fines in connection with a fatal natural gas explosion back in 2008. this was the scene on december 24th when the blast claimed the life of a 72-year-old. the california public utilities commission said they admitted it violated safety laws in connection with that explosion. that included installing a pipe with thinner walls than allowed for gas lines and failing to test the pressure properly.

the fine requires final approval. >> massive sexual discrimination lawsuit against wal-mart has been blocked by the united states supreme court. it started in 2000 when a store greeter claimed she wasn't getting the same opportunities as men. we spoke to that woman today who said she will continue to fight for justice. >> reporter: she started the largest discrimination class action lawsuit in united states history but this morning the court threw it out after a ten year battle. >> definitely today corporate america has won. >> reporter: betty dukes said she and more than a million women who work at wal-mart stores across the country were denied equal pay and jobs promotions back in 2001. the court disagreed saying there were so many women and to many jobs for one lawsuit. >> they have made it possibly harder to raise -- to raise the

. new york state is one vote shy of legalizing same sex marriage and protesters tried to make sure it stayed that way. opponents lined the halls of the capitol. the state needs just one vote in favor to make it law. it's already passed the assembly and the governor is a strong supporter. there could be a vote by wednesday. with just two sentences anti weiner made it official. he handed in his letter to resign to the government. last week he announced he would resign after a scandal over his texting lewd photographing to women online.

said the storm reached hurricane strength about two hours ago. in brazil a military and police operation is underway. hundreds of soldiers and police officers are trying to drive away drug gangs ahead of the soccer matches and the summer olympics. the towns are with in sight of the stadium. authorities have control of 17 of them. >> the police chief of san jose has ordered increased patrols to deal with the high homicide rate. they say 14 of the 25 homicides this year are gang related. last year 20 people were killed in san jose. detectives say six of them were gang related. the police department said it's now trying to find specific patterns in this year's homicides. >> something causing this rise in violence. the bottom line is we will look back and see if we can identity a pattern that made that number

go up faster than usual. >> the two people killed at san jose university aren't reflected in the count since it was campus police handling that investigation. >> san francisco police are helping investigate a long distance kidnapping that started in louisiana and ended in the city. police say they found a 51-year- old woman last night and nearby was the car she was apparently kidnapped in. the male suspect is still at large. the woman said she was grabbed in louisiana and driven here. >> it's shaping up to be an iconic statue. a display that will soon make its home in oakland. >> and 70 degrees at this hour in oakland. just how hot it's expected to get. bill martin is back in six minutes.

. there was plenty of splashing at raging water, it may have been the last day of spring but it felt like summer in the south bay. the water park said it was its busiest day so far this year. a warning tonight for parents just in time for summer, a new study shows portable pools more dangerous than once thought. the report said about two dozen children a year drown in them and nearly all of them are under five-years old. the author said that unlike permanent pools portable pools aren't normally required to meet local safety standards. >> and welcome back. we have a warm day today. right now the winds are going off shore. take a look at the -- you can see the winds pointing basically just out of the north. that's what we have. we have a real strong north

applying vegetable shortening before we put the plaster on. that's so the plaster will separate from the rubber easier, the mold that to break apart to remove it. the labeling is really important because it's a huge puzzle and once we take all the sections off they cast wax inside the molds and cast the heads separately in bronze and then weld it back together. it's kind of a crazy way to do it but it's working for us. this is where it turns into metal. we will melt the bronze. i'm doing that now. kind ever i like fire, i like -- i like the intensity of it. >> when we get the mold from mario we are the last in the process. we are the last to grind. this is a challenging piece because it's very big and will make it to come together, it's
