the building straight ahead. >> reporter: in brentwood five dogs and a cat poisoned in one neighborhood since yesterday. what the owners are asking police to do. a firefighter hurt in an overnight house fire in oakland. we'll bring you the latest on that firefighter's condition. and the heat is on here in the bay area. we're going to tell you about the alert issued as a result as the morning news continues. good morning to you. welcome to tuesday, it's june 21st. i'm dave clark. >> good morning. i'm pam cook. it's also the first day of summer. >> ah, yes. >> steve is telling us just how hot it's going to get today. hi, steve. >> summer starts at 10:16 this morning and temperatures, it'll feel like summer, and then about two days from now it'll feel like june gloom because the fog is close, but it's not much of a factor yet, although it might be later on today, but not before inland areas hit the upper 90s to 100 degrees, a lot of 80s around the bay or low 90s.

the coast will be tricky, but i think 70s or 80s until that sea breeze kicks in. here's sal. >> reporter: right now northbound 280 traffic looks good through downtown san jose, it's nice and light for the trip to the west valley. also the morning commute is okay on interstate 880 right near oakland. 6:00, let's go back to the desk. we are following breaking news in san jose. fire crews are battling a large fire at a fraternity house right near san jose state. we've been following it from the air, now we join allie rasmus who is there on the ground. allie, what can you tell us? >> reporter: well, pam, it appears firefighters are now getting a handle on this fire. if you look behind us, this is the building we're talking about. this is the kappa sigma fraternity near the san jose state university campus. and you can see that there are no longer these big orange flames shooting from the roof of the building. there are three area ladders pointing their water hoses directly onto the building. we saw a little bit of smoke a short time ago. let's show you what it looks

like live right now from overhead in news chopper 2. there is a lot of damage to this building, but you can see the flames for the most part seem to have been put out, and at this point they're kind of shooting water on some of those hot spots and making sure nothing flares up again. now, there were 75 firefighters working this fire at one point. san jose fire department had to call for mutual aid from santa clarita because this -- santaclara, you can see from the pictures about an hour ago, at one point it was a four-alarm fire. there were no reports of injuries among any of the people living in the fraternity. there were about 28 fraternity brothers living inside this house when the fire started at 3:00. all of them got out safely. joining me now is captain rob brown with san jose fire department. tell us about some of the challenges involved in fighting this fire. >> this type of fire, the first concern we had was the occupants, high occupant hazard. we had a lot of students still here, even though it is

summertime, we had 28 occupants in the building at the time. they were all evacuated safely. we confirmed there are no injuries. we are currently working on them with local from a ternlts taking them in for housing, things like that. we had no injuries like that. the concern of this is the size of the building and the fire got into the attic early on, creates a lot of problems for us, a lot of difficulty, requires a lot of manpower. you have a big area. we gotta get a lot of different hose lines in there. [ no audio ] >> again, we've been getting a live report on that frat house fire in san jose with allie rasmus. we'll get back to her a little bit later on with the very latest on that. time now 6:03. another overnight house fire sent a firefighter to the hospital. this one happened just after 2:00 this morning on 23rd avenue near east 17th street in oakland. now, eight people were inside

this retrofitted victorian home when the fire started. everybody got out unharmed, but, as we mentioned, a firefighter had to go to the hospital, suffered a back injury fighting this. the crews have contained the fire and the flames. they're still on the scene, though, looking for hot spots. >> the investigation -- it's still being investigated by an investigator on scene, but it appears like it might have started in the first floor living area and then made its way out the window and worked its way up to the second floor living space. >> and the red cross is busy helping out two affected families. also this morning two overnight homicides are being investigated by oakland police. gunfire was reported at 32nd and market street around 8:30 last night. now, police found no victims, however, four people showed up at local hospitals with gunshot wounds, one of them died. another shooting victim is pregnant. bullets grazed her back and her head and so far no arrests have been made.

at around noontime yesterday, police say a man was shot while driving on bancroft avenue between 72nd and 73rd. the wounded man's car crashed into several cars blocks away. witnesses took him to the nearby eastmont police station. he was then taken to highland hospital, but he died there. we still do not know that man's name or who shot him. time now 6:04. animal control officers in brentwood are investigating the deaths of at least a half dozen pets that were poisoned. this is a story you'll see only on 2. ktvu's kraig debro talked to one of the pet's owners who had a really hard night overnight. kraig, what's the latest? >> reporter: yeah, he found out another dog died overnight, but then i just spoke with the other pet owners that own the other two dogs that died, a total of five dogs died, they live right here. they just came out and told me this isn't the first time that one of their dogs had been poisoned. we're working to confirm that. right now neighbors say that contra costa county animal control is investigating how

five dogs and a cat died suddenly, although the pets seemed in perfect health. the victims say what they lost are more than pets. >> an animal is like a family member, you know? everybody that has an animal, you know, treat them like your family member, you know? they just become so important in your life. they become like your best friends. >> reporter: take a look at this picture. this is cinnamon, happy and daisy. all these dogs belong to a man named tony diat. now all these dogs are dead. the owner blames a neighbor for intentionally poisoning the dogs. tony just addressed our cameras last night and he's holding a dog. the dog holding a few hours ago, seemed alive and well, daisy, died overnight. enrickay dominguez lives next door. the family's two chihuahuas died yesterday. he says his dogs ate meat laced with antifreeze. he says his neighbor cooked the meat and then threw it over the fence.

>> he just threw it over, threw it over to this house down here next door and threw it over here over to this house as well. >> reporter: the owners of both dogs say animal control was out here talking to the man who they accuse lacing meat with poison and intentionally poisoning their dogs. they tell me that animal control says the man denied the allegations. we know where he lives. we're going to go around in a few minutes to see if he'll answer the door and answer our questions out here. in the meantime, we're going to talk to the dominguez brothers coming up a little later on the newscast and see if we can get an update for them. reporting live in brentwood, kraig debro, ktvu channel 2 news. happening right now in florida, the casey anthony murder trial is once again under way. we want to take you live to the courtroom this morning in orlando. casey anthony is the mother accused of killing her little daughter, caylee in 2008. today's session comes after the judge scolded attorneys on both sides of the case and abruptly

ended yesterday's session. now, he says the attorneys are playing games. to prove his point, he asked both lawyers to look at the clock and tell them the time and each, believe it or not, gave him a different number. >> that shows that the two of you will never agree on anything and will never interpret anything the same way. >> casey anthony is charged with first-degree murder in the death of her 2-year-old daughter. she faces the death penalty if convicted. time is now 6:08. a new court hearing, scheduled now in iran for the three americans charged with spying. an attorney for shane bauer, josh fattal and sarah shourd said he was notified the case will come up july 31st. a hearing scheduled in may was canceled by the iranian government. the three uc-berkeley graduates were detained in 2009 along the iran/iraq border. they denied the spying allegations. bauer and fattal are still in

custody, shourd was released last year on bail. she's refused to go back for this trial. this morning the government is unveiling new graphic warning labels for cigarette packs. this is an example of one of the labels. take a look. coming up at 6:15, we're going to show you the other new labels in a live report from our washington d.c. newsroom. time now 6:08. pg&e is being fined $26 million for a deadly natural gas explosion near sacramento in 2008. now, it happened december 24th. this one killed a 72-year-old man in rancho cordova. the california public utilities commission says pg&e admitted it violated safety laws in connection with that blast. those violations include installing a gas line pipe with thinner walls than allowed and failing to test the pressure properly. that fine still has to be approved by the commissioners of the cpuc. today the san jose city council is expected to take a final vote on next year's

budget. in an effort to close $150 million budget gap, 500 city jobs are being cut. that includes laying off 100 police officers. one change, mayor chuck reid now says he's delaying a request for the city council to declare a fiscal state of emergency. now, that would force pension reform. he's changed his mind because five city worker unions agreed to take part in negotiations on retirement reform. time now just turned 6:10. hey, sal, how is that 880 doing? >> reporter: doing pretty well, dave and pam. right now traffic is moving well in both directions on interstate 880 north and southbound here right near the oakland coliseum. northbound traffic continues to look good all the way up to downtown oakland. and the morning commute looks good. if you're coming to the bay bridge toll plaza, usually they don't turn the metering lights on until 6:15 or so. another five minutes. we'll see what happens there. if you're driving into livermore

valley, livermore to castro valley, some slow traffic on highway 884. if you're driving southbound from hayward to union city, looks good. looks like a crash on westbound 92 at 280. watch for slow traffic in that area. 6:10. let's go to steve. >> thank you, sal. today first day of summer, 10:16 in the morning and the future is bright, very bright. you'll need shades today and it'll be hot too. the coast could be a little tough over there, but inland it won't matter, 90s to 100 degrees for many. we will top out, though, today and start a cooling trend tomorrow. it will still be hot inland, but coast and bay will cool off dramatically tomorrow. today we start off very mild, 58 to 66. there's a little more of a component of a westerly breeze than 24 hours ago, very little i should say. 65 and 90 by noon. it won't take long to get to the 90s. that happened yesterday for inland areas. and then 70 to 100 degrees, so it will be nice for some, warm

for others and really hot for some. the fog is trying. i mean, it's probably going to make it into the santa cruz area today. it's very shallow, but it's working its way up the coast and also looks like it's on the mendincino coast. 50s now san francisco, san ra fell, napa. hayward, mountainview, san jose, so some areas are really mild. west at six sfo. yesterday at this time they were calm, i know that's not much, but if you're looking for a little sea breeze, if you're closer to the coast, i think that will win out over time here, but we're going to start off really warm. system digging in from the gulf of alaska is going to settle in and knock the high outta here and start a southerly surge for the fog more likely late tonight and tomorrow. it'll move into monterey bay today and then start moving up the coast as a rather strong system, another one begins to dig in by thursday and friday which means even inland areas will start to cool down.

today sunshine, first day of summer. there will be a late sea breeze, but not before areas in the city hit the mid-80s again. inland it won't matter, it'll still be in the upper 90s to near 100 degrees. then we start a cooling trend coast and bay on wednesday, for everybody on thursday and that looks like it takes us right into the end of the week and the weekend. a shark at stinson beach. if you're looking to cool off today, restrictions are still in place. you want to see the sharks? we have new cell phone video and we'll tell you when the timeline for those beach restrictions could be lifted. also we are still watching san jose breaking news. this is a live picture, a frat house near san jose state went up in flames. the very latest coming up.

good morning to you. welcome back. time now 6:15. the federal government taking dramatic action today to stop americans from smoking. ktvu's alison burns live in our washington d.c. newsroom with new cigarette warnings unveiled this morning, alison. >> reporter: dave, that's right. you won't be able to miss them. these new warning labels will cover half of every pack of cigarettes by september of next year and it's hard to ignore the messages, smoking can kill you. cigarettes are addictive and warning cigarettes can cause strokes and heart disease. matt meyers with the campaign for tobacco-free kids hopes the labels will be especially effective in stopping young smokers. >> the new warning labels come at a critical time because the reduction in tobacco use among

youth has stopped falling. these warning labels give us a new tool to help jump start that again. >> reporter: the tobacco industry is fighting the new labels in court. 35 countries now require similar labels and studies show people in those countries are more aware of the dangers but have not necessarily stopped smoking because of them. reporting live from washington d.c., alison burns, ktvu, channel 2 news. 6:16. with the resignation of new york congressman anthony weiner becomes official at midnight tonight. weiner's official resignation letter will be read on the floor of the house today. he announced last thursday he would resign after 13 years in office. that was after he admitted tweeting messages and sending explicit photos of himself to women. the governor of new york will call for a special election to fill weiner's congressional seat. autopsies have been performed now on an mtv star and his fellow passenger, killed in a fiery car crash in

pennsylvania. the autopsy results haven't been released yet, but police say 34-year-old, the actor crashed his porsche in suburban philadelphia about 2:30 yesterday afternoon. ryan dunn is the actor there. the car went off a highway and went right through a guard rail before bursting into flames. now, an hour before his death, ryan dunn posted a picture on twitter showing him drinking with two other friends. police haven't said if alcohol was a factor in the crash, but they believe speeding was. san francisco police are working with officers in louisiana to try and figure out who kidnapped a woman in louisiana, then drove her all the way to the city. officers found the 51-year-old sunday night at filbert and battery. the woman was disoriented and suffering from amnesia. she claimed someone kidnapped her from aland ro mat in monroe, louisiana before driving her to

san francisco. the suspect is a man in his 40s or 50s, that's all they know. gotta show you new video of a great white shark that was in the waters over the weekend in marin county. look right in the middle of your screen. oh, boy. that off-duty lifeguard shot this with his cell phone. this is off the malinas coast sunday. it's believed that's the same shark spotted earlier in the day by the coast guard off stinson beach. lifeguards now banning surfing because of those shark sightings and visitors, you're being warned, stay out of the water that goes past the knees. if that shark isn't spotted again by thursday, they'll probably consider lifting those restrictions on friday. >> five days is a long closure, but that's the norm and that's how long it's been. i think that's the same with california state parks as well. >> now, 12 people have been attacked by sharks off the coast of marin county in recent years, so pay attention to the warnings, right? >> definitely. 6:19 is the time. let's go back over to sal for a look at traffic. >> reporter: i want to show you the fire pictures from news

chopper 2. let's go right to news chopper 2. pardon me. i had to cough there. you can see that the fire stream has stopped from the water towers above. the truck companies have their water towers raised so it looks like they have actually extinguished the fire. they haven't given us official word of that. ktvu's allie rasmus is down below on the street interviewing some of the people who live there, so we're going to hear from them soon. you can tell, though, that this building is -- well, i wouldn't say completely destroyed, but significantly damaged by this four-alarm fire reported three hours ago at first. let's go out and take a look at westbound 80 heading out to the mac arthur maze. no major problems on the way to the bay bridge toll plaza which is getting a little bit busier. north san francisco, 101 northbound traffic looks good. let's go to sal. steve. >> thank you very much, sal. summer starts at 10:16 this morning and for many it's going to feel summer like because it's

going to be hot. a brief system sending in a few clouds, no big deal, won't take the edge off anything, although a sea breeze might. that will only impact the coast and maybe parts of the bay by late this afternoon. there's some fog coming up the coast and also on the mendincino coast, it is very shallow, but getting closer. 50s and 60s. some of these are mid-60s on the temps, so a mild start. there's a little bit of a southwest wind component from sfo to fairfield. that was not the case yesterday. high pressure is a biggen. warm to hot depending on your proximity to the coast. i doubt the sea breeze has any impact for inland areas. up to 100 degrees, sacramento brentwood, 90s in between or 80s and a few 70s by the coast. fog, though, will cool down coast and bay on wednesday and then everybody cools down thursday and it carries right into the weekend. toyota plans to hire at least 3,000 temporary workers in japan as it prepares to bounce back from the earthquake and

tsunami. production at toyota and other japanese automakers dropped after the disasters because of shortages of key parts. many suppliers were also devastated but are now recovering and toyota expects to be back to full production by october. u.s. car makers are cutting back on what used to be a vital piece of equipment, the spare tire. 13% of all cars and light trucks sold last month did not offer the extra tire as standard equipment. car makers say replacing the extra wheel with tougher tires and a can of tire sealant reduces weight, increases gas mileage and lowers costs. many drivers say the trend is unsettling, but others say just rely on roadside assistance. our time now 6:22. a new power plant project may be approved today in sonoma county. wait until you hear what will power the power plant. and researchers have found a link between apparent profession and higher levels of autism. >> reporter: good morning.

traffic is going to be affected in an area near san jose state on 11th street, south 11th street. fraternity house fire urks the kappa sigma house unfortunately suffered extensive damage because of a four-alarm fire reported at 3:20 in the morning. these are live pictures from news chopper 2. you can see how badly damaged the structure is. the ktvu's allie rasmus is on the scene. she'll have a live report coming up soon. in just a few hours sonoma county supervisors could give their okay to a new facility that turns chicken waste into useable electricity. if approved, the power plant would be built near the sonoma county airport in santa rosa. opposition to the plant dropped when it was moved to that location. the $48 million project would be financed through bonds. time now 6:26. medical researchers say there may be a link between parents who work in certain fields and their children developing autism. 6,000 bay area children have been diagnosed with autism and

june 21st. i'm dave clark. >> good morning, i'm pam cook. time right now is 6:30. we continue to follow breaking news in san jose this morning. a large fire at a fraternity house near san jose state university has displaced about 28 people living there. ktvu's allie rasmus joins us now. allie just talked to some of the members there at the fraternity house who escaped the flames. allie. >> reporter: we did, and, pam, the good news is that everyone who lived in this building escaped with no injuries, but at one point the fraternity president told us that some of the guys got on the roof of the building with some fire extinguishers because they didn't quite understand just how intense and how big this fire was going to get. right now you can see firefighters have put this fire out. if you look behind me, there are the fire trucks still out here lined up on south 11th street, but those aerial ladders that we saw working just about a half hour ago are no longer shooting out water onto the building. there are no more flames or visible smoke here. this building that you're

looking at, this fire happened at the kappa sigma fraternity house near san jose state university and it first started a little after 3:00 this morning. news chopper 2 was overhead just after it started and you can see large flames shooting from the roof of the building. the fire captain out here explained to us that this frat house is essentially a large apartment building, so that means it can be very challenging to put a fire like this out once it spreads throughout the building. they provided us some pictures of what it looked like inside the building when the fire started intensifying. you can see some of the flames coming down the hallway and firefighters had to switch to a defensive position. they had to switch and move out of the building and tackle this fire from the outside and that's why you saw those area ladders out here a little while ago. we talked to the kappa sigma fraternity president who described the scene just after the fire broke out this morning. >> all i hear is like people screaming in the hallway, there's smoke in the house, and we're, like, you need to get out right now. everyone was screaming. we went, like, all over the rooms, knocking on doors and

everything and they got me out. >> reporter: there are a total of 28 fraternity members living in the house for the summer session. they all got out fine with no injuries. we talked to some of them. they say they have a place to go, some of the other fraternities here on south 11th street have offered to take in some of the members who don't have alternative housing. initial reports were that this fire may have start inside a laundry room, that's what some of the fraternity members told the firefighters out here, but right now the fire investigators are just getting out to the scene. they couldn't start the investigation process and figure out how this fire started until the fire was out. but, again, no one injured. there was one firefighter who suffered an injury, a burn injury to his hand. we've been told that firefighter has been treated and released. live in san jose, allie rasmus, ktvu channel 2 news. another overnight house fire sent one firefighter to the hospital with minor injuries. that happened just after 2:00 this morning on 23rd avenue in oakland.

now, eight people were inside that retrofitted victorian when the flames started. they were all able to escape unharmed and that fire is still under investigation. time now 6:33. at least half dozen pets were poisoned to death in brentwood. now animal control officers are launching an investigation and this is a story you'll see only here on 2. ktvu's kraig debro is here now, says the pet owners believe they know who's killing their cats and dogs. kraig. >> reporter: yeah, david. as i was talking about a half hour ago, we learned that this isn't the first time for a set of the pet owners that one of their pets has been poisoned. take a look at this, this is the medical records from that time. it's not dated from yesterday. you look over at the far right, it's dated from 11/23/06. take a look down lower, we'll show you some videotape of the report and you can see on the report that down at the bottom, a likelihood of rat bait ingestion down at the bottom of the report.

these aren't the only dogs that were poisoned or allegedly poisoned. according to the neighbors here four other dogs -- excuse me, a total of five dogs and one cat were poisoned, cinnamon, happy and daisy all belonged to tony diat. those dogs are dead. he blames a neighbor for intentionally poisoning the dogs. diat just addressed our cameras last night with one of the dogs that died overnight, daisy. take a look at her. she looks perfectly fine. enrique dominguez lives next door. his two chihuahuas died yesterday. he said his dogs ate meat laced with antifreeze. i talked with his brother, he said the reaction from the rat poison and the antifreeze reaction was a little bit different. >> the rat poison kind of like dealt with them more slowly. but whatever this was was a little more effective because all the symptoms that all the dogs had and the cat that we saw had seizures, whatever it was that led to seizures.

>> reporter: you're taking a look at both of their dogs, the two chihuahuas that died last night, one on the way to the vet and one at the vet, and then we spoke to tony diat around 4:30 this morning, and he showed us the fence between his home and a neighbor's home. both sets of owners believe a neighbor is responsible for poisoning all six of these pets. we haven't had a chance to yet, but we plan to go over and talk to that neighbor to get his side of the story. reporting live in brentwood, kraig debro, ktvu channel 2 news. san francisco police are admitting to using pepper spray to break up an out-of-control fight involving several girls. it happened at about 9:15 last night on third street in newcomb in the bayview district. officers say they arrived on the scene to help break up a fight involving about 14 girls. they say that the girls wouldn't stop and officers used pepper spray. more people started showing up, though, and started throwing

bottles. officers arrested one person. time now 6:36. at 7:00 this morning former utah governor jon huntsman will officially announce he's running for president. huntsman joins a growing group of candidates vying for the republican presidential nomination. huntsman served as the u.s. ambassador to china for two years after being appointed by president obama in 2009. he's going to make his announcement this morning in new jersey. he'll have the statue of liberty as his backdrop. we, of course, will bring you live coverage of this when it happens. mitt romney is bringing his presidential campaign to the bay area today. the former massachusetts governor will appear at a campaign fundraiser at the poretola valley home of scott mcí neely. he's the cofounder of sun microsystems. romney is making a fundraising swing through california. he also has events scheduled in sacramento, los angeles and orange county. time is now 6:37. tomorrow president obama will announce plans to withdraw

american troops from afghanistan beginning next month. there are about 100,000 american troops in afghanistan now and that includes the 30,000 surge troops sent there in 2009. some of the presidents advisers are pushing for a significant troop drawdown soon, while others like the retiring defense secretary robert gates want a more gradually reduction. some people have been allow today return home in arizona as firefighters make some progress battling the wildfires there. the wallow fire which is along the new mexico border is now just about 56% contained. evacuation orders have been lifted for the small town of greer. that town lost 20 homes and cabins. people forced out by the monument fire are waiting to survey the damage there. at least 60 homes and several businesses in sierra vista have been lost there. favorable weather conditions are expected to help firefighters again today. time now 6:38. california firefighters expect

the first full day, but you might want to think about not taking the car. let's move along and take a look at oakland, northbound 880, that traffic is moving along okay, driving up past the coliseum. if you're driving on the peninsula this morning, highway 101 and 280 looking pretty good. and if you're driving to livermore valley coming in from thality month pass -- altemont pass, it's slow. steve. >> thank you, sal. sunshine on the first day of summer. yesterday felt like it, but today will really feel like it, it'll be warm to hot. after today temperatures start to drop off pretty fast. there are a few clouds up there, but high pressure is here for today and it's right over us. so any fog that does make it will get squashed and it will only be right around the immediate coast and so far there's nothing there yet unless you're around pg down towards caramel, that's about it. tomorrow we'll start a cooling trend. i think it'll be pretty dramatic by the time we get to thursday and friday. tomorrow probably only the coast and bay. the fog is trying, but, again,

it hasn't had much of a chance, although the wind is showing signs of not being northerly which we had yesterday, it's turning more westerly, and i had a very good question asked of me and i'll tell you on twitter s.p. weather. some mid-60s, napa airport, 55. that's a lot cooler than hayward mountainview or san jose. sfo west at six, that is the direction the wind is blowing from. so it's going from the southwest to the northeast, the direction the wind is blowing from. that's a sea breeze. yesterday it was a north wind. it was blowing from the north which is why everyone warmed up, including san francisco yesterday to 88 degrees. by the way, most of the records yesterday fell short by about four to six degrees because most of the records were set in 2008, three years, some people remember it. it was really hot then. we weren't even close yesterday, even though it was very warm. the front will start to work its

way up the monterey area, into monterey bay. it made it briefly there yesterday and then just ran into too much resistance. but that surge will make it up the santa cruz and san mateo coast, maybe tonight and then a west wind kicks in by thursday, five to 15 degrees cooler inland. temperatures will really tail off. today sunny, nice to warm to hot with a mild sea breeze. 100 in clear lake, sonoma 94, 93 kentfield, centerfield 92. 98 danville, 100 in brentwood. 86 berkeley, 88 in oakland, 100 morgan hill and gilroy. 93 santa rosa. 90 woodside, san mateo, redwood city, we'll go 70s on the coast, could be a little tough, but i think we'll hit it and the sea breeze will kick in about 1:00 or 2:00 for those on the coast. fog returns wednesday and everyone cools down thursday and we'll take that right into the weekend. right now we want to go out to jade hernandez who has some new information for us.

welcome back. here's a quick look at some of the top stories we're following for you right now at 6:45. a four-alarm fire raced through the kappa sigma fraternity house right near san jose state university. we can tell you all 28 people inside made it out safe. a firefighter, however, is being treated for burns to his hands. animal control officers in brentwood are investigating the poisoning deaths of at least a half dozen pets. the pet owners are blaming it on a neighbor who they say is in the process of losing his house. and oakland police are searching for suspects in a deadly quadruple shooting. one person was killed, a pregnant woman is among the wounded. this happened near 32nd and market about 8:30 last night. getting a taxi cab in san francisco could be difficult this afternoon. as ktvu's jade hernandez joins us from the city, she says the cab drivers are being asked to take part in a protest, right, jade? >> reporter: well, that's right. taxi cab drivers are upset over credit card fees and

instructions from the san francisco mta. we're live in san francisco this morning. some taxi cab drivers say they've had enough, they're striking, as a matter of fact, they're striking at noon today and tarque mahmoud joins us this morning. you were part of a strike last month, you are part of one today. tell me, why are you so upset with the sftma? >> we're upset because the fees are to benefit some cab companies and the stockholders and this money was part of our the original lease fees we pay to them everyday to go to work. >> reporter: what are you telling folks who aren't going to be able to get a cab today? it's quite an inconvenience for them, but what are you trying to get across? >> we are extremely sorry for that. we went to the town hall meetings to work out the details with the sftma, we spent 36 hours in nonstop meetings. we did every best minute and

effort to get out of this gridlock, but they are kind of stubborn, they are not ready to back out on certain things. >> reporter: and you're ready to strike? >> and we are ready to strike. >> reporter: he is one of the main organizers of today's strike. it's at noon today. now, the san francisco municipal transportation has ordered cab companies to charge drivers 5% for credit card transactions. that's what tarque was speaking about earlier this morning. the sftma operates the cabs. last month a strike was held in front of city hall to express frustration. will the strike affect riders today? we spoke to the sfmta spokesperson by phone 15 minutes ago. paul rose tells us he doesn't feel the city will be affected since they have 1500 taxis roaming the city on any given day. >> at this point we don't think the protests will have a

different than when we didn't have any at all. temperatures already in the mid-60s for some. it'll be pretty easy to hit the 90s by noon for some. late sea breeze, but very mild, lows will give way to warm afternoon highs, 90s to near 100 degrees will do it for morgan hill, gillroy, out to vacaville, but 90s in between, 70s and 80s closer to the coast. fog comes back wednesday, it'll impact the coast and bay and then inland areas cool down thursday and everybody does by friday. >> sounds good. verizon is not commenting on reports that it's about to end its unlimited data plan. several tech websites report verizon plans to introduce tiered pricing for new smart phone customers. one site says that will start next month, but there's no indication that the change will affect current subscribers. checking in on the big board this morning, live look, dow jones up about 34 points to 12,114. again, we do have some earnings reports coming in.
