found. good afternoon. we begin with some encouraging news about giants' fan, bryan stow. late this morning, his doctors gave an update on his physical state. this story is brandnew. his condition has been upgraded from critical to serious. tara moriarty has more. >> reporter: the doctors say stow's condition has improved. he's breathing without a ventilator and he's also been waned -- weaned off the medication. but they say this does not mean he will make a full recovery. >> he's began to open his eyes. he's started to have movement of his left arm and he's intermittently been able to

follow some simple commands. >> reporter: he says in a couple of months surgeons will replace the portion of the skull they had to remove because of brain surgery. doctors believe stow might have not survived this injury had it happened ten years ago. but medical advances have made it possible. with these types of injuries more and more each year, more funding is needed. >> there's insufficient funding. >> reporter: now, stow came to sfo may 16th after being transferred from an l.a. hospital. the 4-year-old paramedic, father of two, was brutally beaten outside of giants' stadium. geovany ramirez was given time in jail for possession of a gun, a parole violation.

[ no audio ] >> we've lost our audio with tara there. we'll have more on the website and on later news casts. divers for the san francisco police department are in the water near fort mason this noontime looking for clues in the death of a man from washington state. you are looking live right now at the marina where the search is going on. you can see a little bit of activity there in the water. it looks like a driver swimming there. it's also -- like a diver swimming there. someone reported the body floating in the water. he had been stabbed several times in the chest. police say they found a trail of blood from a nearby post office. police are treating the case as a homicide. the san francisco board of supervisors is allowing a three- year program designed to keep police officers on the force to

expire. the voter approved program is meant to reduce the need to hire and train new officers by retraining veteran officers past their normal retirement age. officers who enter the program still get their retirement pay but it's deposited into a special account and collected upon actual retirement. it's supposed to be cost neutral, but the city controller says if it continues past the june 30th expiration, it would cost $6 million a year. some parts of the bay area are getting relief with cooler temperatures today. the coastal fog has mostly burned off. the temperatures are lower along the coast today because of that fog as we look live at downtown san francisco. but is it cooling off inland and will the cooling trend continue into the weekend? mark tamayo, ktvu's meteorologist, will join us later in the newscast. governor brown will revive

his state budget. this morning in san francisco, people said it is a tough job but that's what lawmakers are paid to do. >> i think there is sympathy but i think they need to come to some sort of agreement because at the end of the day, it's for the well being of the state. >> you can't cut any more from education. education is hurting. social programs, they are hurting. i don't know. that's a tough question. i don't know. >> lawmakers are losing about $400 of pay each day since the state controller was not balanced before the deadline. the dmv has now suspended mailing out vehicle

registration renewal notices for july and august. the dmv renewal fee is one of the tax increases that governor brown wants to extent to balance the budget. but republicans refuse and want this tax increase and others to, ex-- others to expire. drives are being contacted to let them know they are given a grace period. in a story that's new at noon, kraig debro has been talking with people involved during the past few minutes and is live to explain why the bill set to be on the november ballot is facing a legal challenge from several groups that normally oppose each other, right, kraig? >> reporter: that's right, tori. good afternoon. the groups met within the hour to seek the removal from the

ballot measure. they met on the steps of city hall about an hour ago. and the lawyer for the group says there are antisemitic over over-- overtones. >> as jews we take the threat of banning circumcision personally. this measure singles out along with the muslim community as illegitimate and unwanted in our own city. >> i believe it would take away my right as a muslim to circumcise my male children. vy a son i civic -- i have a circumciseed young son. >> reporter: they gathered signatures to put it on the ballot. if approved by voters it would be unlawful to circumcise anyone under 17 in san francisco. those who violate the ban could get jail time or pay up to

breaking news. a massive fire burning right now in georgia. clayton burning. it's burning between two commercial buildings. some construction materials are on fire. a warehouse fire is sending thick, dark smoke over clayton county georgia today. the fire apparently started in an outdoor storage area just a couple of hours ago. a newschopper that we're

looking at shows some pretty intense flames behind the billing. firefighters -- building. firefighters dousing the is fire from above. these are live pictures that we're getting from georgia, where a fire is burning at a warehouse. the family of michelle le is now working with a private investigator in their search for the missing nursing student. it's been more than three and a half weeks since she disappeared from the kaiser medical center in hayward. police are kerring her disappearance a homicide because of evidence they -- considering her disappearance a homicide because of evidence they cannot reveal. the family hired a private investigator to try to find her. >> we've seen a lot of these cases that there's a certain segment of the population that does not have a degree of comfort, for whatever reason, going to law enforcement. >> le's family organized a search party over the weekend with more than 400 volunteers

10,000 troops out by the end of the year. >> we should be talking about 20,000, 30,000. >> reporter: many in the president's party want a quicker end to the war, the public is increasingly growing wary of it, too. mr. obama is sticking to the dead line to pull back. >> this president made the decision that this was the strategy that was right for national security -- for the national security interests of this country. >> reporter: and that may include pulling out more troops next summer. >> we want to make the desist based upon what is -- decision based upon what is in america's best interest. >> reporter: by the time president obama faces reelection, there's still likely to be about 70,000 troops in afghanistan and that's gonna be a big issue as some republicans are talking about getting out.

in washington, doug luzader, fox news. >> the president will outline his plan during a live address at 5:00 p.m. we'll bring you the speech at 5:00. we'll also stream is live at ktvu.com. parking in downtown san jose will start more starting july 1st. the city council approved rate increases at city-owned downtown garages. they include a $5 flat rate to park on saturdays at three locations. the fees will expand to sunday starting next year. the evening rate will go up. less than two hours ago, oakland mayor jean quan introduced the city's new administrator. she is deanna santana. she worked in the oakland city manager's office from 1995 to 199 before she left to -- 1999 before she left to san jose.

uc berkeley says a report that finds chemicals in flame retardant do not row dues the spread or intensity of the fires. but they can cause lower iq and development among children. authorities in sacramento county are stepping up enforcement around the american river. the warm weather means more people are heading to the water to cool down. but officials say some rafters are not taking proper precaution and leaving their -- precautions and leaving their life rafts behind. >> if your children are under 14, get them out of the water without a life jacket. >> rescuers have been very busy. they've saved 30 people in the last three days. they say alcohol abuse is also a problem. well, it looks like temperatures have peaked for

the week with the fog. we still have numbers inland. no more 80s or 70s. right now, san francisco is checking in at 63. the fog not too far away. the fog -- here's the latest on the satellite. from bodega bay, ocean beach, pacifica and half moon bay. this will be the mechanism that will help cool down the bay area for the next few days. for today, cooler coasts. we'll still have muper -- pupper 90s -- mid- to upper 90s. that will take us into the weekend. santa rosa, 79. oakland, 69, temperatures down 2 to 12 degrees from yesterday. it's still heating up out towards livermore. livermore checking in at 91. high pressure has been responsible for the warmup for the last two or three days. the cooling trend will

continue. we still have 90s to report inland. you see the trend as we take this into thursday and friday and also for the weekend as this weather system moves in from the north, it will reinforce the dooling -- cooling trend with the fog. as a result, the warmest locations are only in the lower 80s. for this evening, the fog will be on the increase. this forecast model did a nice job, 8:00 tonight, pushing that fog locally through the golden gate bridge out towards oakland. but later on this evening and then for tomorrow morning we could be tracking dense fog pulling it back to the shoreline in the afternoon. 60 to 95 will be the range this afternoon. by 10:00 tonight, some patchy fog. temperatures by 10:00 in the mid-50 1s to right around 70. we still have some numbers to report in antioch and brentwood. san francisco only in the upper 60s and san jose right around 85 degrees. those temperatures checking in

about 3:00 in the afternoon. here is look ahead to the five- day forecast. temperatures still dropping off, and by the weekend, it looks like a quiet pattern. temperatures inland back up into the lower 80s. so tori, you can pretty much pick your temperature. 59 at the coast all the way to 95, 96. >> thank you, mark. today is showdown day in new york state for the issue of same-sex marriage. lawmakers there are ending the legislative session and taking a summer recess. the assembly has already passed the same-sex marriage bill, it's still one vote shy of passing in the senate. we have a special sneak preview of the washed ashore exhibit at the marine mammal exhibit. the artist and medicals of the project created these items.

or we could get no sofa. negotiating, eh? you got it! investors paid close attention to the press conference by ben bernanke. some of the problems he says that are slow into the economy could persist into next year. he says the slowdown is due in part to the depressed housing market but gave no further hints for the stimulation -- stimulus. new numbers just out on home prices. today, giving another check on the pulse of the economy, u.s. housing prices rose .8% in april compared to a .4 drop in march. it's the first monthly increase since may 2010. however, u.s. prices fell 5.7%

from a year earlier. the report was released this morning by the federal housing finance agency. and we want to take you back live to atlanta, georgia, where we're getting better pictures of a warehouse fire that's sending thick, black smoke. this is just south of atlanta. fire officials say the fire started in an outdoor storage area with stacks of roofing, paper and plastic pipes fueling the fire. you can see the very intense flames behind the building. firefighters dousing the fire from above. no report of any injuries at the scene but very thick, black smoke. again, live pictures from clayton county, georgia. first lady michelle obama enscurged a group of south african students -- encouraged -- encouraged a group of students to be the ones to banish hunger and end the a.i.d.s. epidemic. she first lady's visit is part
