good afternoon. topping our news. >> barry bonds was back in the federal courthouse this morning. the former giants' slugger wanted the judge to force prosecutors to decide once and for all if they are gog to retry him on perjury charges. new at noon, we can tell you the judge made a quick desist. claudine wong is live -- quick decision. college is -- cot joins us live. >> reporter: prosecutors toll the judge they really haven't decided yet if they are gonna charge him on perjury. the judge very quickly said. all right. go a's. take a little more time to -- go ahead. take a little more time to think about it. >> what do you think about what happened in court today? >> it will be in the news. you guys will see it. >> reporter: that's all barry bonds would say. the news from the judge, not

what h-- not what he wanted to hear. bonds wanted to find out if they were gonna retry him. his lawyers said if the feds want to try him again they need to do it next month. >> i thought, and thought for a long time that the government has had months to decide whether they intend to retry the counts to which there was a hung jury. they said in court today that they haven't decided. >> reporter: the judge said in court, the act still seems reasonable to give the feds a little more time. in light of the fact bonds is appealing his obstruction of justice. >> we remain optimistic about that. we think this is a very, very powerful motion throughout the last count. >> reporter: so it looks like everybody will be back here in late august.

in the meantime, bonds' attorney says he always believed he would be vintedcated and that hasn't changed -- vindicated and that hasn't changed. back to you. >> thank you. less than an hour ago,, the capital corridor train was heading from san jose to sacramento when it hit a person on the tracks. there's no word yet on whether the person intentionally stepped in front of the train. the alameda county coroner is on the scene right now to investigate the death -- investigate the death. none of the crew members were hurt. the passengers are being transferred to other amtrack trains or to -- amtrac. president obama is meeting

linked to shootings last year. he was arrested last friday after spotted in arlington national cemetery in the early- morning hours when the cemetery was closed. he was carrying a backpack he said was full of explosives. that turned out not to be true. but police found evidence tying him to shots fired last year at military buildings in northern virginia. a marine recruiting system, the pentagon. the fbi suspected the shooter had some sort of gripe against the marines. all four suspects in the corruption case were in court facing a long list of charges. ktvu's jade hernandez was also there to tell us what happened when they appeared before a judge. >> reporter: the four defendants pleaded not guilty to the more than three dozen felony charges. now a federal grand jury is involved.

the former head of the central contra costa's enforcement team, norman wielsch, entered the courtroom with his attorney in a suit. >> right from the first day he was arrested before he had, as they say, lawyered up, he sat down with investigators and he told them his involvement. >> reporter: cardoza who often acts as a ktvu legal analyst blames this man today, chris butler. butler also came to court in walnut creek today to enter his plea. >> i called -- i call him the butler fairytales. he came out with a 34-page statement about a month and a half after he was arrested and got out of a jail. then all of a suen, he comes out with this. well, i -- then all of a sudden, he comes out with this, and then blamed everybody but himself. >> every day he goes over in his head, you know, his

fire crews had to free a person stuck inside a toyota prius inside the crash. witnesses say the driver of the prius ran a red light as it was traling on 19th street. -- traveling on 19th street. a fire broke out at about 1:50 a.m. on caliente drive. investigators say a resident left his food cooking and fell asleep while watching tv. he was awakened by the smoke detector alarm and suffered second-degree burns when he tried to put out the fire. the fire at the fraternity house, there was so much, fire officials cannot determine where it started. students say they thought it started in the laundry room. one firefighter suffered burns to his head.

struggling financially. an east bay congresswoman this morning joined other lawmakers in an historic push to repeal federal marijuana laws. this is the first time congress has considered striking down the laws. it would allow states to make and enforce their own poll sis on the cultivation, use and sale of pot. barbara lee and republican presidential candidate ron paul are two of the bill's co- sponsors. a group that's been pushing to lift the federal ban on pot says there is a lot of momentum to get it through congress. >> this is really significant, in that it is going to end a major portion of the drug war that's responsible for huge tax payer expenditures, mass incarceration and leading to violence on both sides of our border with mexico. >> the bill's sponsors say they are not trying to legalize pot but want to eliminate conflicts

between federal and state laws. sheriff deputies in riot gear were called in to arrest protesters at an upscale east bay golf course this morning in an ongoing labor dispute, and we got word minutes ago that sheriff deputies cited and release 925 people for civil disobedience. the workers sat down on the streets at the castlewood country club trying to disrupt the men's invitational tournament to call attention to this -- to their contract. the workers have been locked out of the club in pleasanton for 16 months after the contract talks sales. >> asking us for over 50% of our paycheck is a little bit extreme. >> ktvu called the castlewood country club but has not yet

received a response. historic hangar one at moffet field in may be having new siding put on it. supporters of hangar 1 say this is just one more hurtle they plan to overcome. the city of san leandro is doing its part to keep trash out of the san francisco bay. metal screens will be added to catch basins in 250 storm drainpipes around san leandro. that will help catch trash before it reaches the bay and beyond. work is expected to be completed in the first week of july. the city received more than 110,000 in federal and state funding to make the changes.

the dow is down 75. the nasdaq is actually in positive territory 612. s&p is down 5. now, the big reason that the stocks have come back again today. the obama administration said today it is releasing 30 million barrels of oil from the nation's strategic petroleum reserve. the secretary of energy says the oil is being released due to supply disruptions. white house officials say the move is intended to increase u.s. supplies during the peak summer driving season. some analysts say this could mean a drop of 50 cents a gallon at the pump in a few weeks. the time something prompting criticism from republicans who say president obama is playing politics with the country's oil
