topping our news, the supreme court has overturned a california law banning the sale of violent video games to children. new at noon, we have reaction from the bay area man behind the bill. kraig debro will be joining us shortly about that to give us information about this rather unusual ruling. in other news, this morning, there was some more information on this amtrak train accident. we're now hearing that later today, the nevada highway patrol will release the names of the truck driver who slammed into an amtrak train killing the driver and five other people. the train was headed to the bay area when it was hit by the truck friday afternoon about 70 miles east of reno. witnesses say the truck skidded for the length of a football field before crashing through the crossing gates. this morning we spoke to some people who had just passed the accident site on their way into

the bay area. >> we came that way and saw the cars. it was a horrible sight. all on the train, they were very upset you can tell they were all grieving. >> the ntsb is now looking into the safety report of the trucking company that owned the big rig. they still did not know why the truck did not stop. the conductor was also killed in the crash and five people are still unaccounted for. a second person has now died after a car crashed into a nursing home. suzanne infantty died from her injuries yesterday. police the 90-year-old driver hit the gas pedal instead of the brakes and the car crashed through the window.

two people are being treated at hospitals. the driver has not been charged. right now, a danville teenager remains in the hospital following a weekend accident at a cruz county beach. on saturday, 17-year-old ryan buchanan went to sunset state beach with a group from creekside community church. he was critically injured when the sand tunnel he was digging collapsed on top of him. he was taken to san jose's valley medical center. doctors say his heartbeat is strong and his first brain scan was encouraging a. there's no video out showing beaten giants' fan bryan stow in an argument with another man. the cell phone obtained by tmz was taken in the bleachers shortly before stow was brutally beaten in the parking

lot. it shows a dodgers' fan pointing a finger in his face. it does not appear to the giovanni ramirez. the police are aware of the video but have not asked of -- asked for it. >> if the l.a.p.d. does go through the proper channels if this tape is subpoenaed properly, obviously, we will comply. >> stow remains in serious condition in the hospital. the suspect is being held on parole violation. he was transferred over the weekend to a correctional facility in san diego. the los angeles dodgers this morning filed for bankruptcy protection. the chapter 11 filing sets up a showdown with mlb over the future of the franchise. the team blames major league baseball for failing to approve a deal with fox sports. the owner, frank mccourt, was

we have a developing story about a crime scene. police have blocked off the intersection of 81st avenue and international boulevard in east oakland. officers are not giving much information at this time. but it may be the location of a deceased person. more information on the person and on later newscasts and on ktvu.com. union police are investigating a shooting say it happened at a -- at the same house where two other people were killed. police found a 22-year-old latino man suffering from gunshot wounds.

a major fire has destroyed a hotel in florida. the fire burned for hours causing the roof to collapse. 150 people had to be evacuated from the facility. not far from disney's animal kingdom park. a television station reports that 12 people were taken to hospitals. we don't know the extent of their injuries.

the cause of the fire is under investigation. it's been one month since nursing student michelle le disappeared and family members and friends are still hoping she will be found alive. over the weekend, dozens of volunteers searched rural parts of the east bay. they are searching with limited information but are focusing on areas based on tips from police. le was last scene at the kaiser. this is day one of a homeless survey being conducted in santa clara county. volunteers gathered early this morning at the west gate church in san jose before setting up teams. their goal is to house 1,000. >> this week we're going out in the streets and registering all of the weeks that are most at
