buy the sweat shirt just to get through the afternoon. and tomorrow the weather will be even more bizarre. san francisco is known for being chilly in summer, but rarely rainy. >> it is one thing for it to happen in january, february, part of march, rain late in the season throws off people's plans. >> reporter: but rain is on the way tomorrow and temperatures are expected to drop 10-30 degrees across the bay. >> i can't remember it ever being this cold. >> reporter: zack tory, who grow up here, says it is the strangest weather he remembers. >> i can't remember having this many short waves of different weather. >> reporter: in walnut creek it was warm enough to use the pool today. but with temperatures going from triple digits to down right chilly, parents say it is hard to make plans for the summer break. >> we were thinking of buying a season pass but with the weather as it is we can't see why we should. >> reporter: the upcoming 4th of july weekend is supposed to be hot. but with the weather so

unpredictable, many families won't commit to an outside event. >> one of the reasons we lived in california is that we usually can count on -- pretty consistent nice weather, so yeah, i would like it to stay warm and not just be a surprise when it is. >> reporter: for jeff who rents bikes in san francisco and sells tours to visitors, it makes the plans a guessing game. >> the first question, if they're here for a couple of days. i say it may be a good thing to wait. >> reporter: and the unpredictable weather is the new normal this year in the bay area. a strangeness that the residents hope will change as quickly as the temperatures have. reporting live, san francisco, patty lee, ktvu channel 2 action news. and it is rare to get rain this time of year. it is not unheard of. we saw rain two years ago this time of year. but here is what i am watching, that is significant looking rain heading our way. it will have the impact on some

of the commutes. the rainshowers as we talked about earlier, perhaps up to an inch in the north bay, a 10th of an inch, a quarter of an inch in the south bay. the rainshowers, affecting the commute. i'll be back in 12 minutes with a forecast, breaking down hour by hour the shower activity and the commute. and tomorrow morning beginning at 4:30 in the morning, they will let you know if the approaching rain will impact the morning commute. we have breaking news from walnut creek at this hour, two people wounded, possibly shot or stabbed at a car wash. a ktvu news crew is on the way to the scene. here is what happened, the fight happened at about 915 tonight at the walnut creek car wash on north main street near geary road. the two people are said to be in critical condition. we'll have more coming up shortly on a live report. and new information tonight about the driving history of the man behind the wheel of the big rig that slammed into an amtrak train sparking a deadly

fire. according to the nevada department of motor vehicles, the truck driver, 43-year-old lawrence valli, had six moving violations since 2008, including four speeding tickets. friday's collision, east of reno, killed valli and five people on the train. witnesses say the truck ran through the crossing gate and hit the train broadside. skid marks indicate that valli tried to stop. investigators say they found a cell phone at the scene of the crash that likely belonged to valli. it is now being looked at to see if he was talking architecting at the time. one of the prior citations was for driving with a cell phone in his hand. the national transportation safety board has video also from recorders on the train. the investigators say the video shows nothing blocking the crossing and no weather problems. new details happening tonight about the famous mob boss, bulger, and how he lived

on the run. he stashed hundreds of thousands in an apartment in santa monica, admitted to traveling to las vegas to play the slos, and to buy medicine. he said he returned there during the 16 years on the run to take care of unfinished business. request denied, the response denied that the suspected serial killer received in marin county. he asked the judge to dismissal counties and set him freement he was charged with killing four women in southern california. the judge granted his request to delay a hearing set for july 11. naso is acting as his own attorney. and new tonight, the city of oakland reaching tentative agreements with the labor union as they look at the budget shortfall of course they agreed to pay 9 9 test of the

tension plan, they are looking at thive 9%, tomorrow morning, the city council will hold a closed session to discuss the dealsment tomorrow night, council members will vote on a budget. budget cuts being felt in san jose, we were there this evening as people found library doors closed. at 10:30, the impact of budget cuts and layoffs citywide. and a possible break through tonight in a state budget crisis. governor jerry brown giving up hope of striking a deal with republicans, hoping to push through a spending plan with support only from democrats. governor brown showed his new budget plate late this afternoon, not re lying on an extension of taxes as the governor had hoped, but instead it makes deeper cuts to schools and social programs. a vote could come as soon as tomorrow. we have more from the reporter. and in case we are over- optimistic, we have severe trigger cuts. >> it is always the threats,

and what do we put on the block? the things that are most important to the taxpayers. >> the new democratic budget supports the billions in funding for public education as the previously vetoed budget. but this one relies on taxes that may or not be available. is this too big a gamble on education? >> well again i can't speak to what is happening in san francisco, but only in davis. what is happening in davis is the truth that the state budget process has grown too unpredictable. >> leaving uc davis to take a new approach to budget for state universities. >> they're focusing, looking for new revenue streams and focusing to find efficiencies on the campus, and then if worse comes to worse, going to the actual budget cuts. >> we caught up with one spokesperson who said in this economic climate it is hard not to be concerned with the budget. two years ago i got into seven universities, and couldn't go

to any of them. >> it is making me nervous, of course for years to come. >> and of course the roll on the dice, the money the state may not have? >> it is not good for the future of the country, the state, anything. >> for sacramento, ktvu. and the department of public health announced today that personal information of 9000 current and former state employees has been compromised in a security breach. this is the second breach to hit the state health department in -- health department in a year. they say there is no sign that the information has been misused but is offering free credit monitoring to victims. a state employee is suspected in the latest incident and is now on administrative leave. and a congresswoman from the area, retiring, north bay democrat linn woolly won't seek re-election next year. >> it has been a privilege, a privilege to serve you and work with you. and from the bottom of my heart i thank you. thank you. . new details tonight about how a day at the beach left a teen buried alive. he and his friends dug a sand tunnel several feel under great when it all collapsed. others see how the community came together today to pray for his recovery. brian buchanan is in a hospital bed, while others at the service have faith their prayers will heal. he was buried saturday when a tunnel he worked on collapsed

on him. another boy also underneath was dug out unhurt, but ryan had no pulse, not breathing. >> everybody on the beach was praying. >> reporter: the group works with them every summer for the overnight troop to santa cruz. >> there was no concern, the kids were playing in the sand. that is what you do on a weekend. nobody saw it. nobody thought it could happen. >> reporter: and each night since, this congregation has come together. the teens who rushed to save ryan still reeling. >> we love them and encourage them, we're all very, very proud of them. >> reporter: the young people know how difficult it can be, life guards warn beach goers not to bury themselves, but the tunnel was 100 yards behind the life guard tower, unseen.

>> certainly if one of our employees were to have seen this, i would expect that they would have contacted these folks and asked them to stop. >> we're not mad at god or anybody else. and we're just going to -- take it a day at a time. >> reporter: and at last check, ryan was in critical but stable condition. everybody at the service tonight tells us they are hoping for the best. and a young woman from foster city filed a lawsuit regarding a head scarf she wore at work. kahn says she was hired to work at hillsdale mall in 2009, saying the store manager had no problem with her wearing the head scarf. but when a district manager spotted her on the floor, she was suspended when she refused to take off the scarf. and a week later, she says she was fired. >> this case is about the right to express your religion freely

and to be able to work in this country. >> fitch denied any wrong doing, releasing a statement saying we comply with the law regarding religious accommodation, and we'll continue to do so. and an update on the story we first brought you over the weekend. the san francisco police identified one suspect in a shooting that september sent five people to the hospital. this was released of 18-year- old blay, and a teen who were accused of assault with a deadly weapon and a shooting that injured five people. and a mill valley man arrested for drunk driving three times in three days, pleading guilty today in all cases, thomas mcgowan faces multiple charges, time in jail for his arrest elsewhere. mcgowan is scheduled to be sentenced on friday. he will receive treatment for

alcohol abuse while in jail. and confronting the giants fan, brian stow at dodgers stadium. the video was taken just hours before stow was brutally attacked in the parking lot. ktvu maureen nailer has the video and how it affects the case. >> reporter: the 11-second video inside dodgers stadium is shaky, but police confirm it shows a dodgers fan in the number 23 jersey pointing his finger at brian stow, before and after the fan moves away, you can see him in the seat with his hands up. >> it goes to what everybody said, brian didn't start it. >> reporter: today, stow's close friend watched the video and said it likely explains this text message that stow sent him at 7:03, the night of march 31st. >> he sent metext, saying he was scared to be there. >> reporter: los angeles police received the entire video, going through each strain, and

looking at incidents with other fans and investigating if the dodgers fan seen here is in any way related to stow's beating. >> at this point we don't know, i mean again it is another piece of the puzzle, another thing to follow up on. we look at every piece of information and investigate it thoroughly. >> reporter: stow remains at san francisco general hospital where he was recently updated from critical to serious condition, now is opening his eyes. >> he tracks with his eyes, looks at you. whether or not he sees you, i guess we don't really know. but he will follow you around the room. >> reporter: police say their investigation is continuing, and that giovanni ramirez is remaining their prime suspect. maureen nailer, ktvu. and one of baseball's proudest franchises, the dodgers filing for bankruptcy protection, the owner says he is on the edge of running out

of money. tomorrow he will ask for permission to borrow 150 million to meet the team's payroll. they are blaming others for the deal mccourt planning to use the deal to keep the team afloat. and the debt crisis in europe, possibly averted. the nasdaq climbed 35 points today, the markets have posted losses several of the last eight weeks. and myspace is expected to lay off at least 100 employees this wednesday. the social networking website already cut back on its staff in january. myspace is expected to announce a sale this friday. the company was one of the original social networks but has been trumped recently by facebook, twitter and other social media. and tech analysts say that apple could show two new models, a faster version of the current iphone 4 model, that

could come without a contract, and feature a pre-paid calling plan. the new phones could be announced this september. and we have rain in the bay area forecast, good thing, the plants will receive water, and here onshore, backing out a bit. rain in the forecast as we go through tomorrow. here is how the model sees it. here we are at 8:00. looking at the commute, mainly north bay showers, here in san jose, and ocean beach, towardings montero, that is the heart of it at 3:00. now in the afternoon commute, wet roads as you travel along at 6:00. not a big system or crazy unusual, but it is rare to get a system this time of year, and when we come back we'll have the complete forecast, the timing and long range with the

heat in store. and two peregrine falcons struggle to survive tonight after they were shot in oakland. the department of fish and game says they think the same person is responsible for the shootings. the first bird is the mother bird, found near laguna and alita street. nine days later, her three month-old female off spring was found, both birds had broken wings, had surgery. >> they're not out of the woods yet. they're on medication to stop infection, and to control it. we're just hoping that the healing process happens. >> the birds are doing better at the museum hospital. the peregrine falcons are protected under california law and there is a thousand dollars reward that leads for information or conviction of the person or persons who shot the birds. and a live report in walnut creek right after the break. plus, the out of control

take a step forward and chase what matters. . breaking news from walnut creek, two people stabbed outside a car wash on north main street. ktvu is live at the scene. deborah, what have you learned so far? >> reporter: well this is still a very active crime scene, take a look, police tape and activity is going on around the car wash. at the north main apartments right next door, and a couple of stabbing suspects are still on the run. walnut creek police started to get calls about an hour ago from folks who live in those apartments. people heard a man fighting outside. by the time officers arrived they found two men with multiple stab wounds, both of them taken to the hospital. police don't have any word yet on how severe the injuries are. and they also don't have a

motive. they say this fight went from words to fists to knives, very fast. and that the men who did the stabbing ran into the neighborhood and have not been seen. we don't have any description on them yet. but police are still here, they are taking witness statements as they continue their investigation. north main traffic is running normally. and there have not been any type of evacuations in the neighborhood. violent crime reports unusual numbers in the city of 70,000 people. and south bay prosecutors are deciding whether a 90-year- old woman will face criminal charges for saturday's deadly accident at the nursing home, in the parking lot on peterson avenue. she hit the gas instead of the brakes and crashed through a wall into a common room. the accident killed the two women, and investigators are trying to figure out whether

there is any evidence of criminal negligence or if this is simply just an accident. >> at this stage in the game, what those officers determine is that this probably was the latter of the two, just a tragic accident. >> and one of the nursing home staff members told ktvu today the elderly driver has already surrendered her driver's license. and a wildfire is burning tonight at the los alamos nuclear lab in new mexico. the lab is closed and thousands of residents who live in the area have evacuated. that fire started yesterday and has burned about 50,000 acres, destroying 30 buildings to the south. the lab is run by the university of california, and is best known for developing the atom bomb. it is located outside of santa fe and houses nuclear material in secured vaults. that fire reminded us of another wildfire back in may of 2000. a ktvu crew shot this footage of los alamos which has turned pretty much into a ghost town.

the wildfire burned hundreds of honests in about hundred buildings on lab property. and overall it caused more than a billion in damage. and a new chapter beginning for san jose library, not an easy read for library users. and a serious accident on the popular bay area lake involving a child. we'll show you how to stay safe on this upcoming holiday weekend. 7

. new at 10:00, the city of san jose started to feel the sting of the budget cuts as some of the public libraries were closed. a few dozen library workers count themselves among the 264 jobs being eliminated. >> it was one of 18 libraries

in san jose, people could put their books there, but others found it locked and closed. this family was disappointed. >> it is unfortunate, because what can the children do in the summer? >> reporter: today was the first day of san jose library closures caused by budget cutbacks. >> this is just tougher for the kids. my daughter loves to read every single day. >> reporter: this library was open today. libraries in san jose are now open either monday through thursday, or wednesday through saturday. >> i feel bad because this is only open for four days. >> reporter: some 30 library workers lost their jobs today. three years ago there were 365 library workers in san jose. as of today it dropped to 270. >> you find that you can visit libraries, fewer story times and fewer after school activities for children. of course they wouldn't be open all the school days anymore. >> reporter: adults will also be affected. >> i enjoy coming to look at

the magazines out, read newspapers from other states. the computer, i don't have one at home. >> reporter: the library workers now have to work in two other libraries every week. and neighborhoods will have to do with less. >> we went down from a five and a half open days, to four open days now for each of the facilities. and each one of them is heavily used. so it is a burden to each neighborhood. >> reporter: last year, 14 million books were checked out and returned at san jose libraries. and yet there is talk that there will be even more cutbacks and closures in years to come. live in san jose, ktvu. and bull dozers working to stand on stanford university, at the construction site, parents say they learned two weeks ago that a parking garage will be built in the middle of school's playground. stanford is working to relocate

part of school away from the construction zone. and police say today they found the remains of a woman kidnapped and killed in 1977 at the age of 21. the remains of the woman were found in a drive river bed near lake berryessa, she was the first of the six victims. he told investigators where the remains could be found. it took several searches to find them. roger kibbe is currently serving a life sentence. and in danville, somebody breaking in to steal the copper, the break-ins happened between noon saturday and 8:00 this morning. last month the construction trailers were broken into, tools stolen. danville police want to hear from anybody who may have seen anybody suspicious. and a jury convicted former illinois governor rod blagojevich of corruption in

his retrial. he was found guilty of 17 of 20 counts. he spoke briefly after the verdicts were read. >> patty and i obviously were very despited disappointed in the outlook. i frankly am stunned. there is not much left to say, we want to get home to our little girls. >> when the couple got home, they were greeted by a crowd of supporters and reporters. a hearing on his sentencing is scheduled for august one. he faces up to 300 years in prison, but legal experts say he will probably get anywhere from six to 15 years. and a california law to ban the sale of violent video games to children shot down by the u.s. supreme court today. the justices ruled that the law was unconstitutional. we learned what the bay area politician who drafted the law plans to do now.

>> these ultraviolet video games to be in the hand of our children. >> reporter: they thought they made a mistake. >> in the past we protected them from alcohol and cigarettes, and porn, and we felt it was on that level. >> reporter: this law banned the sale and rental of violent video games to minors. grand theft auto is one game that shows police officers being killed. >> video gamings games are a protected art form just like anything else. >> reporter: the entertainment industry saw it as a ruling for free speech and technology. this man has been playing games since he was 12. he says that technology has made today's games more life like, and that could be dangerous. >> you have to be able to explain to the parent, look this is fake. >> violent video games already come with warning labels, for

example, this one is for mature audiences only, 17 and up. but it is just a recommendation. so that means that anybody, including children can still buy them. one woman says it doesn't change the games her son plays. >> he normally buys the games, they're supervising the child. >> reporter: they're working on a revised bill. and next term, the u.s. supreme court says it will take up another first amendment issue, the question of nudity and curse words. there was a fine levied on nypd blue in years past. they are threatening shows in which guests use curse words. others rule it is out of date, and that cable and internet has broad free speech protection. and not for the faint of heart, the cat walk installed on the bridge, the crucial role

. ringing the bell today, to signal that the california street cable car line is back in business in san francisco. the line was shut down for the past six months as crews made 24 million in upgrades and repairs. while that work was being done, the city also replaced sewer lines and took care of other repairs so that the streets wouldn't have to be torn up a second time. if you crossed the bay bridge recently, you may have

noticed color additions, cat walks to be used by iron workers as they string the new cable there. the two cat walks should be fully installed by july, then two more installed after that. workers will have to be tied to them to stop a deadly fall or slip. caltrans says at the steepest, they form a 45-degree incline. and a new report showing many with diabetes, tripling over the past several years. there are more than in years past, 36 million live in the u.s. doctors say the diabetes epidemic is related directly to diabetes. others blame lack of exercise, and easily accessible fast food . >> it is heavily advertised, promotes disease. >> diabetes is known to increase the risk of heart

disease, stroke, kidney disease and blindness. diabetes contribute to many deaths each year. and today, the trial beginning for the survivors of the kmerrouge. an estimated 170 million people died during that time. all four defendants say they are not guilty. in china, officials said today at least nine people died in a land slide at a factory in the northern province. four others were injured. the slide buried a number of buildings where the miners lived. the rescue crews are still looking for other victims. and in libya, people celebrating the news that the international criminal court issued an arrest warrant for libyan leader gadhafi. the court accused him and a son

of crimes against humanity. and the plane hijacked during the september 11th attacks, today, the national park service released two drawings, showing what part of the memorial will look like in pennsylvania, where flight 93 went down after payings fought back. only relatives of the 40 passengers and crew who died will be able to enter the crash site. but the public can get close enough to view it. pop star lady gaga facing a class action lawsuit tonight. the suit was filed over the weekend, accusing her of keeping a portion of sales from these bracelets, meant to raise funds for japan's earthquake relief. the complaint says that buyers were charged almost double for shipping. those involved say the fee is too high for a package that weighs less than an ounce. and sheriff's deputies making sure there is not a repeat of a boating accident

. a follow fun family day out on the lake, turning into panic when the young boy is caught in the propeller of his dad's boat. the sheriff's deputies are stepping up patrols for the busy 4th of july weekend. amber? >> reporter: julia, we're on a hill looking over lake sonoma, behind me you can see the lights of some of the boats docked at the marina. a serious accident in the area is prompting the sheriff's office to step up patrols heading into the holiday weekend. sergeant ed haynor took us out on patrol to show us the common

mistake boaters make, such as leaving the motor on while pulling somebody in. >> turn off your motor. >> reporter: this group of friends told us they boated a few times before, but admitted they don't know all the safety rules, including how to wear a safety vest correctly. >> it is just the summer, you want to be in the water. and it is a nice way to cool off. and just go for a little swim. >> reporter: on saturday, a family outing on this lake ended in a serious accident. the sheriff's deputies say a 7- year-old boy was taken to the hospital after getting caught in the propeller of his father's boat. >> as the line and tube got closer to the back of the boat, the child jumped off to avoid making contact with the prop, however, he was not successful. >> reporter: the boy is expected to survive. but it serves as a reminder for the family of santa rosa. they say with children around it pays to be extra careful. they plan on enjoying a few days of playing in the water.

>> now to just be very -- you have to be very careful with safety. very important. >> reporter: the sergeant says that alcohol was not a factor in saturday's accident. but says it is 20% of the time. >> keep it safe and sober, right? >> all right. >> all right guys, thanks for cooperating. >> reporter: the sergeant says he expects hundreds of boaters to visit the lake this weekend. you don't need a license or any special training to drive the boat. so he advises anybody who wants to go out on the water to go on line and read up on safety. reporting live, amber lee, ktvu. and there is concern tonight about a possible mussel invasion at lake sonoma and lake mendocino. many are asked to protect their boats to make sure they are not clogged. others worry that as the mussels spread they can get into the water ways and later

clog the dams and reservoirs. the obama administration pushing for economy. the goal is 56-miles per gallon for cars and light trucks by 2025. while that would help drivers save money on gas it would add to the cost of motor vehicles. some estimates show 2600 at least per car. they plan to make proposals in september. and a strike by canadian postal workers disrupting the mail, but now they will once again accept mail headed for canada. the canadian government passed a law requiring postal employees to return to work. but it could take time for the back log to clear. and a tracking device on a car without a warrant at issue. last month we told you about a college student from santa clara who said he discovered a gps tracking device on his car,
