good morning. thank you for joining us. it's thursday june 30th. i'm pam cook. >> and good morning. i'm dave clark. let's check your weather and traffic. here's steve. pam and dave, thank you very much. we do have some mostly clear skies. some patchy low clouds around but nothing compared to yesterday or the day before. but temperatures will start to warm up about ten degrees inland from the 70s to the low and mid-80s still a little bit of a component of a westerly wind. 60s 70s closer to the bay. we'll have that long holiday forecast coming up in about five minutes. here's sal. steve, right now westbound 24 looks good if you are driving up to the tunnel it should be a pretty decent ride for you. also this morning we're looking at the commute on northbound 101. it's clear into the city. now back to the desk. sal, thank you, time now 6:01. in two hours from now dozens of san jose police officers will turn in their badges. ktvu's claudine wong joining us live from san jose. she tells us this is happening during a very violent year in the bay area's largest city.

claudine. >> reporter: well, the budget crisis hits home this morning for the san jose police department as almost 70 officers are getting ready to turn in their badges this morning as part of the city's effort to close their budget gap. that process expected to get underway in just a couple of hours at the department. emotions are expected to be high. now the union tried through negotiations to save jobs with a new contract. they were able to save hundreds, but they weren't able to save these. and in a letter published in the san jose mercury news today the police union president is blaming city leadership saying they could have done more to keep these officers on the job saying the mayor and the majority of the council chose to "shut their eyes, cross their fingers and hope for the best." adding to the already tough times san jose's homicide rate which is at 28 this year on pace the union president says to beat a 30 year high. the mayor has called this a sad day but also insisted the budget gap needs to be closed and says everyone, every department, every area of the city is being squeezed. now we have called into the

union and the apartment and hoping to get reaction this morning. again, the process of having these badges turned in expected to get underway at 8:00 this morning at the police department. live in san jose, claudine wong, ktvu channel 2 news. time now 6:02. this morning a deadly house fire in el cerrito where a 98- year-old woman was killed is being investigated. this fire started yesterday evening on king drive in the hills above el cerrito. you're looking at amateur video some of the neighbors took of the flames. still no official word on the cause, but investigators are checking into the possibility it may have started from candles tipping over from a shrine that was inside of a closet. >> she's religious. they're from el salvador she is originally and she used to light candles and pray in her room. >> now the victim's 50-year-old son suffered minor burns trying to save his mother. by the way his child got out of that home safely. we are learning about a

potential new clue in the disappearance of missing nursing student michelle le. it is one that reportedly took the investigation out of state. ktvu channel 2 reporter jade hernandez joins us now from hayward with more on what police are uncovering. jade. >> reporter: that's right. hayward police right here at headquarters may be investigating several phone calls that came from michelle le's phone after her disappearance. that's the startling discovery here. those calls reportedly led detectives out of state to investigate. a source said one call came from a reno, nevada, phone and another somewhere in arizona. hayward police have reportedly traveled to arizona to speak to a woman there. a woman who then called le's family. a san diego television station is reporting sources close to the case have confirmed the calls. le is a san diego native. i received an e-mail from the family's spokeswoman late last night disputing the source saying hayward police and the family have not acknowledged the facts in the story. and michelle's brother,

michael, who is quoted in the report only says michael received a phone call and passed it along to police. not that the call had any significance to the case. the family contends they don't want to jeopardize this investigation. the family plans to head up another search for the 26-year- old next weekend. a $65,000 reward is still being offered for any information which might lead to le. police are still investigating this case as a homicide. now we've left messages for the family and for police and as soon as we get any new information we will bring that to you. live in hayward this morning, jade hernandez, ktvu channel 2 news. time now 6:05. an east bay teenager who was buried alive when seven feet of sand collapsed on him on a santa cruz beach remains in critical condition this morning. however, 17-year-old ryan buchanan's family has some hopeful news. doctors have weaned him off the drugs that kept him sedated and the 17-year-old is now functioning on his own. last saturday he got trapped under seven feet of sand after a cave he'd been digging with

his friends collapsed. nightly prayer vigils continue at his church in alamo. santa rosa police have arrested a man suspected of killing a former sonoma county corrections officer. the shooting happened tuesday just after midnight near third street ale work pub. 36-year-old jack ramiro was killed. police have arrested 29-year- old ryan mitchell deets and his girlfriend who they believe was an accessory. investigators say a motive in the shooting remains unclear but that the two men knew each other and had disagreements in the past. time now 6:06. there will soon be more police officers patrolling the streets of oakland's most violent area. the police department will expand its force in east oakland. that's a response to surging homicide rate. oakland's also dealing with a big budget crisis. however, police officials say they can still increase the patrols with a more efficient use of the officers already on the force. and tonight the oakland city council will try again to

pass a new city punishment just hours before the new fiscal year begins. now tonight's meeting is a follow up to the meeting on tuesday. that's when council members debated three different budget plans. they couldn't agree on which one to pass. the deadline to pass a budget is midnight tonight. today is defense secretary robert gates' last day on the job. coming up at 6:15 we're going to have a live report from our washington d.c. newsroom with the sendoff planned for gates this morning at the pentagon. time now 6:07. a united airlines flight that took off from san francisco made an emergency landing in nebraska. it was united flight 788. it was headed to boston when the crew reported a possible fuel leak. the pilot landed the plane safely in omaha, nebraska, last night. one of the passengers says the takeoff from san francisco was delayed three hours for mechanical problems. >> i think people mostly reacted decently because i think people were already frustrated from and already accepted that we were going to

be really late. so it was just like all right this is the latest in bad day of traveling. >> now the 181 passengers on board were put on a replacement plane that took them onto massachusetts. the plane with that reported fuel leak is being inspected. fewer californians are planning to hit the road during the 4th of july holiday weekend. triple a says about 3.6 million californians plan to drive at least 50 miles, but that's about 2% fewer compared to last year. air travel is actually expected to slightly increase. triple a says high gas prices and the economy are some of the reasons most people plan to stay closer to home. time now 6:08. always check with sal first. >> always. >> by the way how's the toll plaza right now? dave, i'm glad you asked that. >> i know that. >> traffic, dave and pam, is doing very well so far. and i don't know if you remember me earlier this week speaking of at some point we're going to see people taking vacation surrounding the 4th of july. this may be the day we'll see

good morning to you. welcome back. time now 6:13. major changes begin today for the nation's military. ktvu's allison burns live in our washington d.c. newsroom with the big names leaving the except gone. allison. >> reporter: dave, first let's talk about defense secretary robert gates. we shot this video of him attending a funeral this week for a marine killed in afghanistan. this is his last day at the pentagon after nearly five years as defense secretary and it has been a very emotional farewell for him over the past month. in just about an hour there should be a formal retirement ceremony for him at the pentagon with president obama. now this week secretary gates outlined some of his unfinished business and that includes the

formal repeal of don't ask, don't tell. that's going to fall to his successor, leon panetta. a lot of advocates for gay service members are frustrated he did not get that done. meanwhile here at the u.s. capitol the senate is expected to confirm general david patraeus to be c.i.a. director. that means he leaves his job as commander of u.s. forces in afghanistan. lieutenant general john allen will succeed him and begin the withdrawal of u.s. forces there this summer. reporting live from washington d.c., allison burns, ktvu channel 2 news. new this morning. we are getting word out of france of an incident today involving president nicholas star koas. he was reaching over a metal barricade to greet people in a southern town when someone in the crowd grabbed him by the shoulder and pulled him toward the crowd. the president started to lose his balance and fall but was able to catch himself. security officers then tackled that person who grabbed him.

a new study this morning suggests that it was u.n. peacekeepers that brought cholera to haiti last fall. the outbreak killed more than 5500 people as the nation was already recovering from a major earthquake. the study says u.n. peacekeepers from nepal spread the disease in the water. the study confirms they were experiencing a cholera outbreak at the teenage. 30 public swimming pools in massachusetts now closed after a woman drowned in a pool but they didn't find her for several days. the body of the 36-year-old marie joseph was found floating in the pool by some young people who jumped over the fence for a swim while the pool was closed. investigators want to know if she had been in that pool since sunday. >> my kids go to that pool. my kids are 4. so if they wasn't paying attention to a 36- year-old, what makes you think they going to pay attention to a kid? >> now police say the woman was

watching a 9-year-old boy who told the police she slipped on a water slide then went under water. now the little boy said he told the life guards about it but nothing was done. police investigation continues. los angeles police arrested a man for stealing gas on a grand scale. police say richard glover figured out a way to steal hundreds of gallons of fuel at a time just by driving his van to gas stations and using a garden hose. >> he acts like the vehicle is having mechanical problems. he works on his car as if he's trying to fix a problem. while he's doing this he's placing a tube down inside the tank and pumping gasoline into three large tanks that he has inside his van. >> the whole process took about 20 minutes. investigators say he could get more than $1,000 worth of fuel each time. time now 6:17. lawmakers are giving some of the state's biggest polluters more time to comply with new

emission standards. refineries, power plants and other major polluters now have until 2013 to prepare for a new cap and trade program. it will give financial incentives to facilities that cut their greenhouse gases. it also cracks down on big businesses that cause more pollution than the government thinks is necessary. volunteers are needed in vallejo for an all day community event. three nonprofit groups are teaming up on july 16th. it's for vallejo outreach and they need people to help host a health fair and pass out food and backpacks. fighting back partnership needs volunteers to paint over graffiti and also clean up parks. and rebuilding together will be sprucing up the homes of senior citizens in need. well, in just a few hours the gates for this year's marin county fair will open. this year's theme the 75th anniversary of the golden gate bridge. one exhibit will be a sculpture of the bridge made out of 100,000 toothpicks. the fair is open from 11:00

highway 101 and this morning's commute on southbound 101 looks good all the way down to highway 92 san mateo and beyond that. steve, 25 years ago i think lloyd worked here, he still does. [ laughter ] lloyd's a good tennis player by the way. >> he is. >> we have mostly sunny skies already. there's some patchy low clouds around but it's going to be a beautiful day. temperatures starting to warm up here after an incredibly crazy tuesday and then a cool wednesday. a lot more sunshine today. high pressure system is building in slowly. it really won't kick in i think until the weekend but it will show signs of itself today. low 50s for many. some upper 40s for a few. not lows posted here but low to mid-50s. see the system just kind of moving into the pacific northwest. that will really kind of keep the high in check. that's down in the four corners but it's on its way as it builds in friday start to jump up temperatures and be in the upper 80s and i think 90s come in by the weekend. if you're out by the valley maybe near 100. lots of sunshine today. breeze still westerly wind not strong but it's there.

60s, 70s and low to mid-80s doesn't take long this time of year to rebound from 20-degree below average temperatures, temperatures today will give near average to slightly below and warm up past that. friday take us right into the weekend and also on the 4th. well, bank of america stock closed up yesterday after the company announced it was paying $8.5 million to settle with 22 mortgage bond investors. the stock could take battering now analysts warn that will not be the last settlement over mortgage problems. the settlement is about twice what bank executives expected and lawsuits from other investor groups are still pending. b. of a. could be on the hook of another case involving several major banks. american airline asks not commenting on a wall street journal report that it plans to replace more than a third of its entire jet fleet. the paper says american will buy at least 250 aircraft with orders split between boeing and air bus out of europe. american currently flies an all

good morning. traffic is moving along well on 80 if you're driving in from vallejo. it is just a little lighter than usual. see how that turns out at the bay bridge coming up. time now 6:25. a small plane crashed into this house in michigan killed two people. the pilot trying to land at a nearby airport when he crashed. no one on the ground or in this house was hurt, but the homeowner was in his bedroom looking at that plane coming at his window. >> it hit the wall between the master bedroom and the guest bedroom and the whole house shook and caved in the window.

i jumped up, grabbed a fire extinguisher, called 911. >> both the faa and the ntsb are investigating. well, safeway is no longer buying pork from an iowa farm following the release of some undercover video. we want to warn you the images are tough to watch. the animal rights group mercy for animals recorded this video at iowa select farms. it shows workers tossing and kicking pig lets and pregnant pigs living in crates so small they can barely turn around. mercy for animals released the video to pressure costco, safeway and other stores from buying pork from farms like this one. >> in a civilized society it's our moral obligation to help prevent cruelty to all animals including mother pigs from needless cruelty and violence. >> safeway released a statement saying "safeway does not tolerate animal abuse of any kind and finds the images and

for the san jose police officers almost 70 officers turning in their badges today. you're upset about this. >> i'm upset too. even though we're able to raise the police department budget a little bit this year, it was not nearly enough to cover the increase in retirement costs in the department. $25million increase in the police department budget just for retirement costs and unfortunately that means we have less officers. >> reporter: what does this mean for the city of san jose in terms of safety, in terms of crime, in terms of service? >> that's a little unknown at this point. it's not good. i think we need more officers. we should be hiring officers and not laying them off. we just can't afford it. we're going to have reductions in every part of the city. the other departments took 10% reductions. the police and fire departments we were able to hold them flat and up just a bit. >> reporter: union president has a letter in the san jose mercury news certainly not holding back saying all i can say to the mayor, council majority and manager is this you were warned. whatever befalls san jose next

is your doing. your response. >> we're in charge. we have to allocate resources. believe community centers and libraries keeping them open even at reduced hours. it's an important part of public safety. we have 41 community centers we've had to give up operations on, cut back hours at the community centers because our people believe they have a role in public safety. it's a tough choice between libraries and police officers but it's a choice we had to make this year. unfortunately the cost in the police department are skyrocketing due to retirements. >> reporter: do you think this is it? do you think it's still going to get worse before it gets better? >> unfortunately next year we have a big budget gap with retirement costs going up again. costs have gone from $75 million two years ago to $145 million this year. that's a huge jump and taking that out of services to pay for the skyrocketing costs. >> reporter: again, difficult time this will be the last day of work for these almost 70 officers. this is the last day on the payroll. tomorrow starts a new budget. their jobs will officially be gone. live in san jose, claudine

wong, ktvu channel 2 news. new this morning a contra costa county school is trying to recover from damages caused by this week's unusual rainstorm. want to show you new video into our newsroom of the school in alamo. now the school was under renovation and we're hearing that it suffered major water damage in this week's rain. plastic covers have now been put up over the building. it is a k through 12th grade school for special education students. well, she vanished more than a month ago, but this morning there may be new clues in the disappearance of nursing student michelle le. ktvu channel 2 reporter jade hernandez joins us now from hayward with what investigators are uncovering and looking at this morning. >> reporter: good morning. we've called the le family and hayward police this morning over their response from this latest report. we can tell you there have been no significant leads which have surfaced until it seems now. now hayward police are investigating. we're live at hayward police headquarters this morning where

offered for any information which might lead to le. as for police, they are still investigating this case as a homicide and bring you any update we receive from hayward police or the family a little later on. reporting live, jade hernandez, ktvu channel 2 news. time now 6:35. the city of alameda now brought in a retired state fire marshal to investigate that controversial memorial day drowning of a suicidal man at crown beach. he has a website he offers public safety consulting services. now he will be issuing a report on this much criticized response by alameda rescuers in the case of a suicidal man. alameda's fire chief says his crews did not go into the water because they were not properly trained in water rescues because of budget cut backs. overstock.com and amazon are cutting all ties with thousands of california businesses. now that's because the new state budget requires online retailers to charge sales tax to california customers.

now the change could raise $200 million in new taxes. but amazon is not happy. they removed california based associates from its site. amazon is also hinting it could sue to have the law declared unconstitutional. time now 6:36. governor jerry brown still has not signed the main state budget bill passed by the legislature tuesday night. he's expected to sign the bill today. the new fiscal year begins tomorrow. governor brown vetoed the first bill sent to him by lawmakers last week. then he worked with democrats to come up with a revised version. time now 6:37. happening right now in orlando, florida, the defense in the casey anthony murder trial expected to rest its case today after calling its last witness. now this is a live picture right in the courtroom. i don't know who the woman is on the witness stand right there but these are live pictures. now a woman says she had an affair with casey anthony's father was the first witness that was called today.

george anthony has denied having an affair with crystal holeway who was also a volunteer who helped search for his granddaughter, missing granddaughter, in 2008. yesterday casey anthony's father broke down when he was telling jurors about a suicide attempt by him about six weeks after his granddaughter's body was found. prosecutors say the casey anthony killed her daughter in 2008. the defense claims little girl drowned in the family pool. today's the last day on the job for defense secretary robert gates. coming up at 6:50 we're going to go live to the pentagon where president obama is scheduled to make remarks at a tribute to gates. time now 6:38. prince william and his new wife, kate, will arrive in canada today. it's their first official overseas trip as a married couple. police in ottawa have been putting up the barricades, patrol cars and everything in place. they're practicing every security detail to make sure the royal visit has no

problems. now the couple will spend nine days in canada and head to california to go to los angeles for two days. i hear she's very excited because she's not been to the states. my girls will be watching for her. we're always on princess watch. >> that's good. a plot of interesting stuff especially when they're going to be out here on the west coast. westbound bay bridge toll plaza. this is a view from the parking lot or what used to be the parking lot there. there is a bit of a delay here this morning westbound coming up on the pay gates. now it's not a huge delay. it's about an eight minute delay coming up to the pay gates. but you will see the traffic is going to be not light. now tomorrow may be different. i guess people are working right on up to the 4th of july holiday and we do definitely have a crowd. let's move along and take a look at 880 oakland. that traffic moves well. there's a spider on the camera which happens from time to time.

well, good morning to you. welcome back. quick look at some of the top stories we're following right now at 6:44. in a couple hours 68 san jose police officers will turn in their badges. they're being laid off due to the city's budget crisis. reports this morning calls were made from nursing student michelle le's cell phone after she disappeared. one call was to reno. another one was somewhere in arizona. now police in hayward did go to arizona but there's still no word on if they have any new leads. and the investigation continues into a deadly house fire in el cerrito last night. a 98-year-old woman was killed. investigators say a burning candle may have started that

fire. there are now radiation monitors keeping an eye on the los alamos nuclear laboratory in new mexico as the wild fire continues to grow. the radiation monitors are just a precaution, but thousands of scientific experiments are now on hold. now the fire burning near the lab has grown to 125 square miles. 13 homes have been lost so far. three others were damaged. time now 6:45. there may be smoke over lake tahoe today because of two prescribed burns. they were set to start in different parts of national forestland in lake tahoe. one near the kings bury grade on the southeast side of the lake. the other above the bay on the southwest shore. now these burns designed to clear out some of that underbrush and help reduce the threat of wild fires. big changes in store tomorrow for drivers across the bay area. ktvu's kraig debro joins us now from the bay bridge toll plaza to tell us which drivers are going to be most effected. kraig.

>> reporter: yes, pam. if you cross a bridge -- the hybrid things are going to go away. look behind me at the toll plaza the car pool is still a good deal. look at these cars going straight through. more than 13,000 solar drivers now use car pool lanes during rush hour all for free. starting tomorrow it will cost $6 at least two people in the car and then cost $2.50. after that zero emission vehicles will get to cross the seven state owned bay area bridges for free. those include all electric cars such as the nissan leaf as well as vehicles that run on compressed natural gas or hydrogen. big rigs, 18 wheelers are going to take a big hit. starting friday july 1st it will cost $18 to cross the seven state owned bay area bridges $22 on the golden gate bridge. just in time for the 4th of july holiday weekend people who use a trailer to jet skis or boats will now have to pay $10.50 to cross the bridge. nothing appears sacred. a ride on the cable car also going up a dollar to $6.

muni fast passes they're going up too. $2 increase for most riders. for youth passes, senior disabled and low income those will go up a dollar. now the reason for the increases paying for seismic retrofits. we're going to try to get hold of somebody with the bay area toll authority to explain it. it was free for the hybrid vehicles until last year. that's when the first increases on the car pools went into effect. the first pay car pool went into effect $2.50 last year. it will still be $2.50 but you have to have three people in the car. hybrid stickers going away. zero emission vehicles now allowed starting tomorrow. reporting live at the bay bridge toll plaza, kraig debro, ktvu channel 2 news. time now 6:48. are you ready? a national safety group has a new list this morning of the beaches to avoid this 4th of july weekend. california right in the middle of the pack on america's dirty beach list. california ranks 22nd. there's not a single bay area beach on the list this year. most of the dirtiest beaches are down in southern

california. nationwide there was a big increase in polluted beaches because, well, a lot part is due to the gulf of mexico oil spill. 6:48 is the time right now. back over to sal to check in on traffic. >> well, you know, this morning, pam and dave, it is still somewhat of a normal commute. maybe tomorrow we'll have a little bit of a lighter one. but today it looks like there is pretty normal drive to work with some crowding in the usual spots. highway 4 antioch, highway 680 at 24 and then lafayette westbound traffic looks good but slowing near the caldecott. getting out to the san mateo bridge this morning we have traffic looks crowded all three lanes getting out to the peninsula but not a major delay getting to the san mateo bridge. some slow traffic in hayward on 880 near eighth street. and this morning on the peninsula traffic looks good. northbound highway 1 before half-moon bay in one of those lanes there is an injury crash there on northbound highway 1 before the half-moon bay intersection. so watch for some slow traffic if you're coming in from south

to half-moon bay. 6:49. let's go to steve. thank you, sal. patchy fog left and that's about it. it will be sunny today. temperatures starting to warm up. in fact we bottomed out on tuesday i would think so with temperatures so far below average and then also with all that rain it only makes sense we would rebound and we will. sunshine today after some patchy fog. tomorrow morning fog and very shallow burn off very fast only maybe hugging the coast. it will be warmer. take it right into the weekend. inland will be warm to hot by the coast nice to warm. system that we had on tuesday is long gone. left behind some patchy fog. that makes sense. low to mid-50s for everybody, coast, bay, inland, south bay doesn't matter. west-southwest to a west wind still a slight hint of a westerly or on shore wind. system that's moving into the pacific northwest will kind of stop the high from building in too soon. but it's on its way and it will start to work its way in i mean today's just kind of we lose the clouds and have more sunshine. high pressure's building in and then tomorrow we'll take that jump right into the weekend. so fog patchy at best.

position as secretary of defense for five years began under former president george bush then president obama asked him to stay on. the president we're waiting for him to arrive. he will be making remarks in honor of robert gates. and he has become very close the two of them through the years he has spent on the job. in fact that said he asked him to stay on. but you can see the pomp and circumstance very, very elaborate for robert gates. we'll check back later on and bring all the details to you later. a modest apartment could soon become a very hot property in southern california. it is the former santa monica home where suspected mob boss james whitety bulger hid from the f.b.i. for ten years. a line of people already jostling to get a look at that apartment once occupied by america's most wanted criminal. real estate agents say they're ready to pay top dollar. the 81-year-old is due back in court today to face 19 counts of murder and other charges.
