>> reporter: there was a lot of confusion this morning. commuters we talked to are glad to see these boats up and running. the workers who were supposed to be on strike for one day strike actually showed up for work, opened these gates and allowed the passengers back on. that's when they decided to say ferry service will be back up and running this morning and it is. the first boat was able to get out of here just about ten minutes ago. passengers getting ready for a 6:35 service out of here. that is the next ferry that will be coming out. what was all the confusion this morning? well, it was a press released issued at 3:00 yesterday afternoon that said from the union they would be going on strike today for a one-day strike. they are upset about automation that will eliminate ticket takers jobs. the district that heard about the press release decided if they are not going to show up for work they will have to

cancel service. so they did. the union at 9:00 told the district we will show up to work. the district said we are not sure. we just left it as it was with service canceled. around 4:00 this morning as we stood outside this terminal we started seeing workers show up for work. once all the workers showed up for work here, than the district made a decision to yes, we will go ahead go with service. we will let these people on the boat. the first boat of the day got out at 5:50 this morning. we have seen passengers getting on these boats. a lot of people we talked to said i was in my car ready for my plan b when i heard that i didn't need my plan b. turned it around and came back here. the good news if you use the ferry out of larksburg you can do it this morning. if you need this service, it will billion here waiting for

-- it will be here waiting for you. >> and ktvu claudine wong was the first to tell you that as well. major cut backs at the san jose fire department begin today ahead of a hot and dry fourth of july weekend. this is part of the latest budget cuts tied to san jose's big budget crisis. on any given day a fire truck or fire engine will be out of service at one of san jose four stations. these cuts are raising public safety fears both in and outside the fire department. >> response times increase. fire intensity grows. and so upon arrival our firefighters will be faced with a greater workload, higher risk, and greater demand. >> that is not good for anybody. >> there will not be any re ductions in staff on sunday or the fourth of july. there are cuts that take place today. san francisco city leaders

failed to meet today's budget deadline. they were huddled in closed door meetings in city hall until late last night. they are still trying to figure out the final pieces of a huge budget package. now they have agreed on nearly all of the major points in ed lee's $6.8 billion spending plan. the remaining sticking points include proposed social services cuts and contracting -- contracting out security at some city hospitals. the u.s. senate canceled its holiday recess as the big debate continues. republicans made an offer to president obama to get the work done. we will tell you president obama's response to that invitation. that is coming up at 6:15. we'll have a live report from washington, d.c.. new this morning oakland police say a mentally ill man attacked an officer overnight. it happened just after midnight

this morning on piedmont avenue near 41st street. oakland police say the officer used a taser to stop the man. the officer did not suffer any injuries. the man is at the hospital in stable condition. amtrak has filed a $10 million lawsuit against the trucking company. truck driver lawrence slammed into the emeryville bound train killed himself and five others. time now 6:06. the fourth of july holiday weekend is starting now. that means fire works, barbecues, and of course a lot of traveling. kraig debro is live in oakland. he will tell us what you can expect if you are about to hit the road or hop on a plane. >> reporter: when you think of the biggest holiday you think of christmas, new years, but in talking to people this morning fourth of july is among their biggest of the year. if you look behind me we are at

terminal two at the airport. this is the southwest terminal. we have been talking to people flying southwest this morning. the people we talked with said the slow recory does have them watching their wallets. aaa says more californians will fly somewhere for the fourth of july weekend than last year. the economy fully hasn't recovered but the summers biggest holiday say they won't miss. >> i think i'm willing to make sacrifice for family. so i will go no matter what. >> that is the one we would cut back. usually we go out on memorial weekend to go somewhere or you know thanksgiving we will go away. fourth of july usually it's a home more homely. family comes together. some family members house and we just have a get together. >> it's a must do weekend. >> yes. >> reporter: despite the

increase in air travel driving is still king. now that number is bigger than the number of people flying. but the number of californians who will drive is down 2.5% over last year. despite the fact the price of a gallon of gas is down almost six cents many one week. reporting livend k. fire works go on sale today in five bay area cities. clover dale, roanoke park, pet knew ma and union city are on the list. any fire works not purchased from licensed vendors are considered illegal. now fire works are illegal in oakland and anyone caught with them can be fined up to $1,000. the oakland police department is setting up an anonymous tip line for people to report any

illegal fire works. they came in 41.31. san francisco i used our observer michael. i think he has very, very good records. his average is about 28.87. at 34.35. and san jose that six tenths they had on tuesday sure helped. they finished at 104% more than normal. they did come in over the average at 15.08. today is a brand new season. we have clear skies. fog is holding on to the san mateo coast but it's gone now. mountain view 59. 54 san rafael. one little system went in yesterday. that helped things in check a little bit. you just warmed up five to ten degrees. i think tomorrow really saturday and sun we will top

new. it's 6:15. the u.s. senate has called off its fourth of july recess next week to deal with the looming deadline. alison burns joins us live. >> reporter: that is right. we are seeing a lot more political posturing than progress this morning. republicans are criticizing president obama for fundraising in pennsylvania last night. and going to camp david this weekend instead of leading talks. gop senators invited the president for a meeting this afternoon. >> the president says he wants to get working. wants us to get working. i can't think of a better way than for him to come over today. we are waiting. >> reporter: president obama refused the invitation calling it political theater. for now it looks like formal negotiations won't resume until tuesday. reporting life from washington, d.c. alison burns ktvu channel 2 news. time now 6:16. better news this morning about that huge wild fire near the

los alamos nuclear lab. firefighters have thinned out a lot of the vegetation. they are keeping the flame from getting close to that nuclear lab. the fire is moving north though. it's heading toward land considered sacred by a native american tribe. a missouri man is accused of raping a woman as she lay unconscious on the street. the woman was walking in kansas city, missouri wednesday morning when she felt dizzy, sat down, and passed out. two witnesses say they saw melvin jackson on top of her. they flagged down a nearby patrol car. >> there were witnesses that saw this happening and they stepped up and reported it. they gave help to this woman. >> police say jackson told them i thought that lady was dead. the woman was taken to the hospital and examined. jackson is in jail on a felony assault charge.

now the defense starts its arguments. seven members of san francisco's ms13 gang are on --ms 13 gong gang are on trial. they are all from the 20th street click that centered around san francisco's mission district. the gang members face possible life in prison if they are convicted. this trial will resume tuesday after the fourth of july holiday. the man admitting to stealing ballots from a san francisco polling place is facing delay on his sentencing. he stole the ballots while working at a polling place that was set up inside of a garage. nicholas later accepted a plea deal but he delayed his sentencing when he asked to be sentenced by the judge that accepted his plea deal. time now 6:18. an adult softball league scrambling.

they have to reschedule their games after a copper thief hit them. police arrested two men yesterday morning. they stole copper wiring that is use to light the baseball fields. damage statemented at $25,000. now games are being caps led or rescheduled for almost 100 teams that play in the adult obviously summer league. there is another lockout in pro sports this morning. nba owners locked out their sports after the two sides could not reach an agreement on a new contract. they remain far apart on every gyre issue from the salary cap to revenue sharing. the long expected lock out puts them in jeopardy. a growing number of major league baseball teams including the san diego padres are catering to people with peanut

continue to warm into sunday and monday. the hotel industry is spending money. many are renovating to the tune of steps of millions of dollars. according to the san francisco business times hotels are refurbishing now because they had to cut corners against the worst of the recession. some are required to maintain a certain standard. they can include high definition tvs. 300,000 toasters are being recalled. hamilton beach says the heating element can remain energized and start a fire. we are showing a picture right there. customers should stop using that toaster immediately. time now 6:22.

that is the gate going up this morning. letting the first passengers through this morning. that is craig who ha a plan to get a ride from a friend. he was in the parking lot waiting. you look like you're trying to be patient with the whole process. >> yes, i am. >> reporter: so why all the confusion? this all started at 3:00 yesterday afternoon. the union representing the ticket takers and dock workers issued a press release saying they would be going on strike today for one day. the district found out about that from the media and said they could not confirm it but to be on the safe tide they decided to tell commuters service is canceled. it told the district yesterday about 9:00 at night there would be no strike at all. there are some trust and communication issues here.

>> they may have told our management that. given they issued a press release and never told us they were issuing a press release we felt it was in our best interest to wait and see who showed up for work. >> when they showed up for work those gates went up and people were allowed on board. those are the first folks boarding the ferry. the numbers of people traveling today will likely be lower than normal. you are taking a live look at the boat that is next to leave. an estimated 3,000 people usually take at ferry on afully before a long holiday weekend like this one. numbers are likely to be lowered because folks already made other plans. there are new public safety concerns in san jose this morning. jade hernandez tells us some drastic cut backs take effect today for the fire department just as the weather is heating

up. jade. >> reporter: that is right we are live in san jose in front of fire station 29 and rolling brown outs take effect today. that means one less fire engine at the station starting today. you might remember last weeks fire at san jose state. 100 firefighters responded. firefighters today face starting their day with two less fire engines on any given day. it will give stations four additional firefighters to staff companies throughout the city. rolling brown outs have been put into place to save money. the firefighters union says at what cost to taxpayers? response times are expected to be longer than the starter time of eight minutes. with firefighter on trucks down from five we will have to do more and get paid 10% less. >> we don't know what will happen. we are keeping our fingers crossed we will be able to have the staffing to take care of our needs. >> reporter: residence in the san jose foothills cleared out

brush around their homes prepping for one of the hottest weekends of the year. the july 4th weekend traditionally has more fires than any other part of the year. reporting live in san jose this morning jade hernandez. time now 6:34. oakland city council approved a new budget last night after many hours of debate. mayor jean quan cast the tie breaking vote. this new budget calls for rehiring 22 laid off police officers. it will also keep oakland libraries and fire stations open. the budget all depends on concessions from five of the labor unions. revisions could be necessary if the deals don't go through. oakland police are asking for the communities help in response to a surge in homicides. there have been 56 killings in oakland this year. one victim was shot and killed

over memorial day weekend during a street gathering. her mother says she is hopeful that police will make an arrest but police say investigations often run into roadblocks. >> we are seeing very uncooperative victims here and as much uncooperation from witnesses often. >> i feel strongly about they will find the person. oakland polystichia they have made an arrest. they have put dozens of officers on the street. time now 6:36. now this includes increasing the number of police officers and security guards. screening will be tighter for all school visitors. however, the board decided against putting in metal detectors at school entrances. they say it's too expensive and ineffective. police have seized a half dozen

guns at berkeley high school during this year alone. mg a is facing -- pg&e is facing new safety questions this morning. they iplay falsified inspection reports on under ground electrical reports. 14 inspectors failed to check dozens of under ground facilities across the bay area. pg&e is already under fire for its major role in the pipeline disaster. pg&e crews worked over night to cap a gas leak. that was reported at silver avenue in the cities mission district. pg&e tells us the leak may have been caused by a city crew doing work in the area. two homes had to be evacuated as a precaution. a medical set back for injured giants fan bryan stow. his family says briewas sed -- bryan was scheduled to have a

also the dumbarton bridge is looking good to east pal low alto. 280 northbound and southbound is at the speed limit. now let's go to steve. thank you, sal. it won't take long to warm up inland. temperatures near the coast 60s and 70s. our rain season ended yesterday. july 1st to june 30th. as you can imagine everyone ha a very good year. some had excellent years. santa rosa 129% of normal. and even san jose that is six tenths on tuesday. that is a lot of rain for san jose at the end of the season. that pushed them up to 1861. 34, 35 in san francisco. average 28.27. it's about a 30-year average.
