saturday, july 16th. fog and drizzle out there for many of you waking up this morning. let's check in with rosemary on your weekend forecast. good morning, rosemary. >> good morning to you! and the clouds piled up pretty high. we've got all the way inland, even into the central valley this morning. they're seeing some of the low clouds and fog. we're going to be slightly warmer this afternoon, but that warm-up is going to be so suggested. , some of us may not even really feel it. the inland spots expected to warm just a couple degrees. we'll have late clearing along the coastline, some of the coastline may not clear at all. so i guess to sum it up, more of the same. we'll look at your temperatures outside this morning and what you can expect for the afternoon, coming up. and topping our news this morning, a deadly shooting in hayward. the victim has been identified to ktvu by multiple sources as johntue called well. he was with oscar grant when he was shot and killed on a bart platform. kristin joins us live on more

with what happened. >> reporter: good morning, i spoke with police about a half hour ago and received this e- mail press release. let's give you a scene, a look at the scene of where that shooting happened. witnesses do tell police the victim was sitting in a cadillac when the shooter approached from the side and fired several shots into the car. police say they were flooded with calls from potential witnesses shortly after that shooting. witnesses tell ktvu the victim in this case was johnt, e called well, a friends of oscar grant, the victim of the bart officer involved shooting in january 2009. caldwell was on the platform when grant was killed and had his own $5 million against bar for allegedly violating his civil rights. this morning we spoke with attorney john burris, he's not representing caldwell but did represented the grant family. >> i have very fond memories of him. he's a positive young man who i thought had a very good future

ahead of him. of all of oscar's friends, with him that night, i had a very positive impression of him. >> we are looking for an update from hayward police and the court more's office. the latest details indicate that a ward police believe it was in the a random act. we're live in hayward, christian kasdin, ktvu channel 2 news. overnight, oakland police began interviewing a person of interest in connection with the killing of a young woman whose body was set on fire. yesterday the woman was identified as 21-year-old monica rodas, the mother of a three-year-old son. thursday morning police say her body was dumped in the rockridge neighborhood and set on fire. we spoke with her family who says she left home wednesday night with a friend and now they say they're struggling to understand why this all happened. >> monica was always happy. she was a good girl. it was just an injustice what they did to her. >> late last night, police

began questioning rodas's most recent boyfriend. so far he has not been charged or arrested, and tomorrow a car wash will be held at the east lake ymca. the family is raising money for fun to rational costs and a trust fund for the victim's son. in one hour volunteers will begin another search for missing nursing student michelle le which follows a similar effort yesterday. organizers have been concentrating on rural areas of alameda county, hoping to finds the 26-year-old who was last seen at kaiser hospital in hayward. investigators are treating the case as a homicide, but le's family is holding out hope she may still be alive. the reward in the case now stands at $100,000. you may have felt t a small earthquake shook the bay area overnight. it was a magnitude 3.4, centered around berkeley. the quake struck just before 4:00 this morning and it was

strong enough to wake up some of our viewers. we did get several calls from the east bay and san francisco. most people describe feeling a sharp jolt. no word of any damages or injuries. the city of vallejo is agreeing to scale plaque plans for a new park after a protest by native american tribes. for the past three months local native american tribes have been camped out in the area. they say the site is an ancient burial ground and must be protected. this week the two sides reached a deal. the city will share development rights with two of the native american groups. in return they have to agree to some of the proposed projects, including rest rooms and hiking trails. in san francisco's bayview district today, supporters of mayor ed lee will be out canvassing the neighborhood. the supporters are part of the run ed run campaign. it has been trying to convince mayor lee to run for election this november. lee says he is not interested. the board appointed ed lee as mayor in january to finish out

some of gavin newsom's term. today's canvas in the neighborhood starts at 10:00. mayor lee will also be in the bayview today at a separate event for a neighborhood clean- up. the wheels of justice could soon spin slowly in san francisco. the bay citizen reports the city's superior court will announce deep cuts on monday. 25 of 63 courtrooms could close almost all in the civil division. two hundred employees could also lose their jobs. a spokeswoman predicts it could take a year and a half to receive a divorce or a child custody order. less state funding, san francisco support court faces nearly a $14 million deficit. a socially conservative group is preparing to take action trying to overturn the new state law requiring public schools to teach gay history. senate bill 48 was signed by governor jerry brown on thursday and will be implemented beginning january 1. yesterday afternoon, the sacramento based group capital resource institute filed

documents to start a voter referendum. if they can collect about 434,000 signatures, the law could be rejected. the group has a long history of opposing california's efforts to expand rights to the gay population. responding to the request from the obama administration, the military has been ordered to temporarily continue its "don't ask, don't tell" policy. the ruling came down late yesterday afternoon based on new information from the government. it says dismantling the program suddenly could be problematic. instead, the government says all of the facts need to be considered and the policy needs to slowly be rolled back. and that ruling is not going to stop hundreds of active duty troops and veterans from showing their support for gay rights. in san diego, a former navy specialist is organizing what is believed to be the first military group to lead a gay pride parade. participants are being warned that marching in the parade could be a risk for their military career, but supporters

say it's time for gay service members to stop living in fear. that parade is set to begin at 11 a.m. this morning the debate over the debt ceiling rages on. in his weekly address, president obama targeted the issue both sides need to compromise on. >> the truth is you can't solve our deficit without cutting spending. but you also can't solve it without asking the wealthiest americans to pay their fair share. >> the president says we need to cut spending on domestic and defense programs and rework programs like medicaid. he also says the biggest challenge seems to be taking on the tax code. he says we need to cut the tax breaks and deductions for wealthy americans and big corporations. republican leaders continue

to disagree with the president's stand on tax breaks. they say the government should focus on bigger spending cuts. >> our stands on the debt limit has been clear. there can be no tax hikes because tax hikes destroy jobs. we need real spending cuts. and real spending cuts that will exceed of the amount of increase in the debt limit. >> next week republicans say the house will vote on their bill. they call it cut cap and balance. they say it will balance the budget. it will also include a live in the debt ceiling. good morning to you! waking up with gray skies out there. live look at the city and the bay bridge. even a little bit of drizzle around the bay area so if you're going to be outdoors early this morning, maybe a hat. temperatures this morning running a couple degrees warmer than yesterday. but with all that gray sky out there, and a little bit of a breeze, it's going to feel cool. mid-50s san francisco right now, 57 in oakland. upper 50s concord. 57 in livermore. the north bay looking at 55. napa as well as santa rosa. for the afternoon, it's going to be a mild one inland it's going to be cool along the coast. more of the same. your fog forecast here, we are expecting clearing once again but take a look at how widespread it is this morning.

>> edward o'toole's great grand nephew is the only known living relative and yesterday he accepted on behalf of the family the flag from the casket. supporters of president obama will fan out today to sign people up to vote. the obama re-election campaign plans nearly a thousand event in more than 40 states. the day of action has been heavily promoted through social networking sites, grassroots event including volunteer drivers. the campaign has already opened 60 field offices. on the republican side, g.o.p. presidential candidate mitt romney has a war chest larger than any other republican. campaign finance records show the former massachusetts governor has a $12.7 millions in cash reserves. that is 3 times more than his next closest rival, congresswoman michele bachmann. romney raised more than $18 million in just the months between april and june. texas governor rick perry remains tight-lipped over

giffords continues to recover from injuries after being shot in the head on january 8th. an aide says her friends are making sure she has the resources so she can return to capitol hill. people here in the bay area who are struggling with their taxes can get help from the i.r.s. today for free. the i.r.s. will hold an open house today at two locations. agents will be standing by to help people sort out their tax issues and get back on the right track. although the event is to help tax delinquents, anyone can show up to get answers to their tax questions. no appointment is necessary, and the services are free. the open houses go from 9 a.m. to 2 p.m. in san francisco. it's being held at the golden gate office and in san jose at the i.r.s. office on south market street. up next, a potentially deadly illness found in a posh las vegas hotel. and why you may see west beach if you travel to lake tahoe

also successfully launched a delta 4 rocket from cape canaveral, carrying a navigation satellite for the air force. this satellite should have a longer life span while enhancing military signals and are more resistant to jamming. bp hopes to win back the confidence of regulateddors. the oil giant says it will impose new safety standards that drilling project in the gulf of mexico. the safety measures exceed federal requirements. bp pledges better supervision and improved drilling practices aimed at preventing blowouts like the one in april of last year. the explosion killed 11 rig workers and released nearly 5 million barrels of crude oil into the gulf. a potentially deadly disease has surfaced in one of las vegas's most glitzy hotel and casinos. the aria sent letters this week to 18,000 former guests, exposed alerting them they have been exposed to the bacteria that causes legionnaires disease. tests of the water supply there

show high levels of bacteria between june 21st and july 4th. >> most people who get exposed to this are fine. but there's no reason to take any chances. >> i'm okay with it. i think we're more likely to win in gambling than to get that. >> although no one adds reported -- guests of the aria during the last two years contracted it by inhaling mist from the water supply. symptoms of the disease include headaches, muscle aches and chills. and people with weak immune systems such as the elderly and children are most vulnerable. lake tahoe beach-goers have less area to sun faith in this summer. the snowpack this month is more than double the normal size and water levels have risen 5 feet this year. about 20 feet of sandy beach that was around the lake last year is now under water. >> it's not that abnormal to have small beaches. however, it is abnormal to have sump a large rise in one year. >> water officials say lake

complete. this morning's service is at 10 a.m. at the twin lakes church in aptos. witnesses say hospital shuttle bus in a deadly crash may have run a red light. the shuttle was headed to san francisco general when it cloyded with a big rig on thursday morning. the impact ejected 52-year-old psychiatrist dr. kevin mack. he landed under the big rig and was pronounced dead at the scene. witness reports suggest the driver may have run a red light on oak street. the intersection of oak and octavia boulevard is known as one of the most dangerous in the city. cars headed down a popular san francisco can soon make room for bike lanes. the city agency is considering biplanes for fell and oak streets. 67,000 vehicles combined to use the two roads each day. the pros bikeway would have a buffer zone and be wider than standard bike lanes, but to do that the city is going to have to remove travel lanes or street parking spaces. residents of a san bruno neighborhood are looking into

installing security cameras for lighting following a string of recent car vandalisms. the latest incident was reported on thursday morning. 29 cars were damaged on evergreen drive. maywood and oakmont drive in the rolling woods neighborhood. vandals caused thousands in damages. neighbors believe kids are stake, out their neighborhood to make sure no one is around before they strike. san bruno city leaders are questioning the findings of a state report regarding last fall's pipeline explosion. state panel blamed a 2008 sewer project for weakening the pipeline. san bruno officials call the report poorly researched and they blame pg&e for the explosion. the city wants the national transportation safety board to be the ones who determine the exact cause of that blast. almost two dozen san jose firefighters are a job again after being laid off due to butt cuts. at yesterday's ceremony, the

chief returned the badges of 22 firefighters who were among the 49 laid off. the rehiring was possible thanks to a $15 million grant from the federal emergency fund. >> you can't even explain it in words. it's a great feeling. this morning putting my uniform back on was just amazing. smile from here to ear, and i just can't wait to put the badge on now. >> the other 27 firefighters who were laid off will not be coming back. they either were hired on in other cities or chose not to return. their spots will be filled by new hires. police have uncovered a million dollar worth of marijuana plants. officers say they found the plants in the regional wilderness near san ramon yesterday. during the raid officers uprooted 3300 plants. police say the growers had tapped into the park's water supply and used various poisons and pesticides. so far no one has been arrested. it looks like opponents of a target store in san rafael

have fall on a few votes pass to pass a referendum that would stop a store's development. the group keep it local needed about 2700 signatures. earlier this month, county election officials rejected some of the signatures leaving the group 37 signatures short. when the group contested, five of the names were valid but it's still 32 signatures short. the group will continue to fight against the target store. a judge ruled san francisco has the right to ban the sale of tobacco at the city's pharmacies. the suit was filed by safeway. it challenges city law that forbids selling tobacco in stores with pharmacies. the measure had an exemption for stores and big box stores, but that exemption was removed after a california appellate court found it violated a guarantee of equal protection. san francisco lounges are going in smoke and owners say they are being unfairly targeted. yesterday the dream hookah lounge was the latest to be shut down by the health

department. 17 other hookah lounges are also told to shut down for allegedly violating the city's and state's bans on smoking indoors. another 20 are being investigated. o.j. simpson say the charges don't make sense. >> the city allowed us to open up a hookah lounge and now they're saying you can't smoke indoors. >> but they might have -- not have to close their doors permanently. the department of small businesses is working with some lounge owners to operate in a smoke-free environment. and anyone in a commercial building built before december 21, 2009 can apply future a license to allow smoking in and enclosed space. the new jersey man accused of stealing a picasso from a san francisco art gallery is scheduled to return to court next month. a judge ordered us not to show his face as he appeared in court yesterday. he pleaded not guilty to stealing a quarter million dollar sketch from a union square art gallery. police say security photos show him with the sketch. new jersey authorities say a raid on had been his apartment

in new jersey uncovered 11 stolen artworks, including another picasso. >> all the things that were taken were apparently taken in the last 45 days. and that speaks more to a first of compulsive energy than someone who has the ability and the sophistication to go out and fence these paintings. >> the court has seized his passport and denied a defense request to reduce his $5 million bail. lugo also faces charges of shoplifting three bottles of wine worth $6,000. the opening weekend of the final harry potter movie is off to a magical start. the film has not even been out for 24 hours, but it has already brought in $90 million. and analysts are expecting more people to line up to say good- bye to the boy wizard. they say the movie is on track. it will score the biggest worldwide opening of all time.

fairfield blowing pretty strong and that delta breeze helped carry that marine layer into the central valley. let's talk about what is happening right here at home. cup see it's very widespread by 9 or 10:00 we want to begin to burn off the north bay, far east inland, concord, livermore, south bay looking the mostly sunny skies. but still around lunchtime or so we've got it around the bay area. out bay area cities will continue to see this. looks like san rafael into san francisco at your lunch hour just clearing the oakland water front there. so we will be in between the partly cloudy skies and then for the late afternoon, it looks like it's going to just continue to hug the coast. may not see a lot of sunshine for the coastline today. it's the trough hanging over the west coast that will continue to bring us the onshore flow, that southwesterly breeze, and will continue to bring us the cooler air mass. for anywhere from five to 10 degrees below average for the bay area and inland from 10 to 15 degrees cooler than what we should get this time of year. right now temperatures not too bad but with gray skies, light

breeze it does feel cool, 58 in concord. 57 in oakland. 55 san francisco. mid-50s santa rosa as well as napa. and your afternoon highs for today, look at actually pretty nice. that zoomed right by but we're looking at widespread upper 60s, for most of the bay area. inland spots will actually feel good and we'll continue to see the afternoon highs along the coast. a cool one. so upper 50s, low 60s coastside, inland spots mid and upper 70s from mid-july. wow. you might be saying keep this coming. it feels pretty good with le see changes. tomorrow temperatures warm slightly then a bigger bump by monday. inland spots at least looking at 84 degrees and then upper 80s tuesday, 90 degrees on wednesday. so you see the gradual warming trend there. meanwhile, on the coastline it will take longer. we'll still be in the low 60s tuesday into wednesday. we've got your day planner coming up in just a little bit. time is 7:41. we'll take you outside for a live look at the bay bridge

toll plaza. look at that, looks like a little bit of a slowdown for folks who are not going through fast track lanes. so if you have to pay, it may be slower four this saturday morning. the bay area has some 474 miles of carpool lanes with more on the way. but the percentage of drivers who carpool is falling. only 10% of commuters in santa clara county carpooled last year, compared to 14% in 1980. however, carpool lanes do remain busy because of the number of cars in california has nearly tripled in the last 30 years. on average, people who carpool in the bay area travel about 19 miles an hour faster than solo drivers. striking down on immigration is not quite working out the way it was planned. why a new law in one state is backfiring on some businesses. and a new trend is filling up the stomach with happy commuters in marin county. but why some business owners aren't smiling.

jail where she is being held just one day before she is set to be released. this is attorney mason, seen yesterday at florida's orange county jail. he would not say who he was there to see, but people are speculating that it was anthony. he also would not say what time she will be released tomorrow. anthony was found not guilty of murdering her two-year-old daughter caylee. de sure manman removed from a u.s. airways flight recently found out the charges against him were being dropped. >> i was ecstatic. i just -- so many emotions came through me, but it was basically a sigh of relief for me. >> he was taken off the flight from sfo for refusing to pull up his baggie pants. he was arrested on suspicion of trespassing, battery of a police officer, and obstruction. but the district attorney says there is not enough evidence to support those charges. a protest for prisoner

rights tied up traffic in downtown san francisco last night. a handful of marchers went down market street from u.n. plaza. they are raising awareness of inmate hunger strikes at pelican bay and other state prisons. the protestors claim inmates are subjected to inhumane treatment such as long confinement in windowless rooms, lack of health care, group punishment, and poor food. >> prisoners have had enough. and they're courageously going on hunger strikes, coming together from across racial barriers to say that enough is enough. >> prison officials say they monitor the health of inmates closely while they have treated a few inmates for dehydration. they say there have been no serious health issues with other prisoners. local families in need are going to receive some help today. six by area food banks will send volunteers it safeway stores throughout the bay area. they'll collect cash and food

donation. people can help by buying a specially produced $10 background of groceries. the food will go to needy families and bay area food banks say bay area demand has risen by 45% since 2008. a new trend is moving to marin county and is causing some concern for restaurant owners there. five gourmet food trucks from san francisco set up shop in the parking lot of the larkspur fiery and now the event will happen weekly. some are enjoying the new trend. >> any sister works in novato so she is talking about this so we request get -- all about [audio not understandable] >> it's a great idea. fabulous. >> while those working at restaurants in the area are not as fleesed, restaurant owners tell us the transit authority should have notified local businesses about the new concept and should have also asked them to participate. san jose police have recruited two federal immigration agents to fight

who is watching the chilly morning. >> good morning to you! our temperatures not too bad but when you add the clouds, maybe a little breeze, just cool this morning. and a little foggy to add to that. we've got drizzle falling over parts of the bay area. that will be with us to the morning hours. we are going have the afternoon sunshine with us, the inland areas will clear first and afternoon breeze expected, and we will begin to see a slow warm-up starting today, but it's going to be very subtle. we'll look at the temperatures outside your door this morning, what you can expect for saturday afternoon, coming up. well, you may have felt it, it was a small earthquake but it did shake the bay area overnight. the magnitude 3.4 quake hit just before 4:00 in morning. it was centered around berkeley. it did wake up some of our ktvu viewers because we got several calls from the east bay as well as from san francisco. most people describe feeling a sharp jolt. this point no word of any damages or injuries. continuing coverage now of the hayward gas station shooting.

we have been following since the 10:00 news last night. ktvu has learned the man killed is johntue called well. he was a close friend of oscar grant and at the scene of the shooting offer the bart platform in 2009. christian kazdin joins us live now with new details on what happened. christian. >> reporter: mike, in just the last half hour we've moved to the hayward police department looking for an update to the shooting. the police and coroner are not releasing the identity but multiple sources say the victim was johntue caldwell. police say it appears to have been a targeted attack. witnesses tell police the victim was sitting in a gold cadillac when the shooter approached from the side and fired several shots into the car, hitting the victim in the head and chest. police say they were flooded with calls from potential witnesses shortly after that shooting.

witnesses tell ktvu the victim in this case was johntue caldwell, a friend of oscar grant. caldwell was on the platform the night grant was killed and had his own $5 million lawsuit against bart for allegedly violating his civil rights. we've spoken with caldwell's mother in june in los angeles, while she was takenning the johannes mehserle case. she told ktvu the young people on the platform that night center had a tough time processing all the they've been through. >> we love our son. we love our kids. we love our nephews. we love them! and no one knows what they're going through. no one is helping them. no one seems like they care about the boys. they just seem like they all care about this cop. >> investigators are looking for anyone with investigation about yesterday's shooting to come forward. christian kasdin, ktvu channel 2 news.

oakland police are following several leads in connection with the killing of a young woman whose body was set on friar. yesterday the woman was identified as 21-year-old monica rodas, the mother of a three-year-old son. on thursday morning police say her body was dumped in a rockridge neighborhood and set on fire. we spoke with her family who says she left home on wednesday night with a friend and now they say they're struggling to understand why this happened. >> monica was always happy. sheriffs a good girl. it was just an injustice what they did to her. >> late last night, police began questioning rhoda's most recent boyfriend some far he has not been charged or arrested. tomorrow a car wash will be held at the ymca. the family is raising money fortune rational costs and a trust fund for the victims fund. volunteers are beginning another search for missing nursing student michelle le, following a similar effort yesterday. our cameras were at the search command center in hayward just before it got underway. organizers have been concentrating on rural areas of

alameda county, hoping to find the 26-year-old last seen at kaiser hospital in hayward. investigators are treating the case as a homicide, but the family is holding out hope that she may still be alive. the reward in the cass now stand at $100,000. in response to a request from the obama administration, the military has been ordered to temporarily continue its "don't ask, don't tell" policy. that ruling came down late yesterday afternoon and based on new information from the government. it says dismantling the program suddenly could be problematic. instead the government says all of the facts need to be considered and the policy needs to be slowly rolled back. that ruling is not going to top hundreds of troops and veterans, however, from showing their support for gay rights. in san diego a former navy specialest is organizing the first mill gary group to lead a gay pride parade. marching could be a risk for their military careers. but supporters say it's time for gay service members to stop living in fear.

the parade is set to begin at 11 a.m. and a socially conservative group is preparing to take action. they are trying to overturn the new state law requiring public schools to teach gay history. senate bill 48 was signed by governor brown on thursday and will be implemented beginning january 1. yesterday afternoon the sacramento based group capital resource institute filed documents to start a voter referendum. if they can collect about 434,000 signatures, the law could be rejected. the group has a long history of opposing california's efforts to expand rights to the gay population. the city of vallejo is agreeing to scale back plans for a new park after a lengthy protest by native american tribes. they were planning to redevelop parts of the glen cove waterfront. but for the past three months, local native american tribes have been camped out in the area. they say the site is an ancient burial ground and must be protected. this week the two sides reached a deal. the city will share development

rights with two of the native american groups, in return they have to agree to some of the proposed projects, including rest rooms and hiking trails. in the bayview district today supporters every mayor ed lee will be out canvassing the enable, as part of the run ed run campaign. the campaign has been trying to convince mayor ed lee to run for election this november. he says he's not interested. the board of supervisors appointed him as mayor in january to finish gavin newsom's term. today's canvas starts at 10:00. the wheels of justice could soon spin slowly in san francisco. the superior court will announce deep cuts on monday. 25 of 63 courtrooms could close, almost all the civil division. 200 employees could lose their jobs. a court spokeswoman predicts it cook take a year and a half to receive a divorce or a child custody order. with less state funding, san francisco's superior court faces nearly a $14 million deficit.

tibetan independence. today's meeting will take place in the white house map room. it is closed to the media. information seized from osama bin laden's compound shows he was targeting president obama. american forces stormed bin laden's pakistan hideout in may. in it, u.s. officials say it found documents bin laden wanted to attack the united states on the 10th anniversary of 9/11. plans included including general petraeus and shooting down air force one or the helicopter with a missile or rocket grenade. other documents show bin laden was pushing for a stronger terrorist presence in europe. bp hopes to win become the confidence of federal regulators. it will impose new safety standards at drilling projects in the gulf of mexico. the safety measures exceed federal requirements. bp pledges better supervision and improved drilling practices aimed at preventing blowouts like the one in april of last year. the explosion killed 11 rig

workers and released nearly 5 million barrels of crude oil into the gulf. in our economy watch in morning, we're learning more about the takeover deal targeting oakland based clorox. billionaire carl icon announced yesterday he is offering $10.2 billion for the company. however he feels he shouldn't, the only bidder for clorox. he said shop around it get the best deal. the company could get offers more than the $10.2 billion he is offering. cruise lines wants to go public. that's according do a regulatory -- thing filed yesterday. it expects to raise as much as 250 million by selling an unspecified number of shares. the honey would be used to help reduce its more than $3 billion in debt. they did not say when it plans to go public. and president obama is choosing someone other than controversial consumer advocate elizabeth warren as head of the

identity of the victim of yesterday's shooting and we have moved here to hayward police department and they are not releasing the official identity of the victim. but multiple sources have told us the victim was johntue caldwell, a longtime friends of oscar grant. police say they don't have a motive, but they have told us this appears to have been a targeted attack. witnesses tell police the victim in this case was sitting in a gold cadillac when the shooter approached from the vied and fired several shots into the car hitting the victim in the head and chest. police say they were flooded with calls from potential witnesses shortly after that shooting. witnesses tell ktvu the victim in this case was johntue caldwell, a friend every oscar grant, the victim of the bart officer-involved shooting in january of 2008. caldwell was actually on the platform the night grant was killed and had his own $5 million lawsuit against bart for allegedly violating his civil rights. early this morning we spoke with attorney john burris by phone, who is not representing caldwell but did represent the

grant family. >> this is just a tragedy. you know, this case is like tragedies just keep unfolding. and it's just terrible to think that johntue is now gone. >> in the press release from police this morning, they have said they're looking for any witnesses in the case to come forward. christian kasdin, cut channel 2 news. senator. new this morning, federal agents have pulled the curtain on a counterfeit movie ring in san jose. yesterday the agents arrested the alleged ringleaders of the operation at mia's fashion store on alum rock avenue. this store was the center of the operation. in a series of raids, agents seized thousands of dvdss, pinners, duplicators and 53,000 dollars in cash. all five of the people arrested are being charged with conspiracy to manufacture and distribute illegal copies of copyrighted movies. a memorial service will be held this morning for the victims of a plane crash in

watsonville. david houghton took his wife and their sons on a trip to yosemite. he was piloting the plane when it went down in a crash. an investigation into the cause will take months to complete. this morning service is at 10 a.m. at the twin lakes church in aptos. the new jersey han accused of stealing a picasso from a san francisco art gallery is scheduled to return to court next month. he plead not guilty. yesterday to stealing a quarter million dollar sketch from a union square art gallery. police say security photos though show him with the sketch. new jersey authorities say a raid on his apartment in new jersey uncovered 11 stolen artworks, including another picasso. >> all the things that were taken were apparently taken in the last 45 days. and that speaks more to a burst of compulsive energy than someone who has the ability and the sophistication to go out and fence these paintings. >> the court has seized his

closely and while they have treated a few inmates for dehydration, they say they have been no serious health issues with other prisoners. almost two dozen san jose firefighters have a job again after being laid off due to budget cuts. yesterday the chief returned the badges of 22 firefighters who were among the 49 laid off. the rehiring was possible thanks to a 15 million-dollar grant from the federal emergency fund. >> you can't even explain it in words. it's a great feeling. this morning putting my uniform become on was just amazing. smile from ear to ear, and i just can't wait to put the badge on now. >> the other 27 firefighters who were laid off will not be coming back. they either were hired on in other cities or chose not to return so those spots will be filled by new hires. police uncovered a million dollars worth of marijuana plants. officers say they fun to the plants in the regional wilderness near san ramon yesterday. during the raid officers uprooted 3300 plants.

police say the growers had tapped into the park's water supply and used various poisons and pesticides. authorities destroyed the plants and so far no one has been arrested. a federal judge has ruled that san francisco has the right to ban the sale of tobacco at the pharmacies. that suit was filed by safeway. it challenges the law that forbids selling tobacco in stores with pharmacies. the measure had an exemption originally for stores and big box stores. but that exemption was removed an it violated the constitutional guarantee of equal protection. for hookah lounges are going up in smoke as owners are say they're unfairly targeted. yesterday the dream hookah lounge was the latest to be shut down by the public health department. 17 other hookah lounges are also being told to shut down for allegedly violating city and state bans on smoking indoors. another 20 are being investigated. hookah lounge owners say they -- charges do not make sense. >> the city allowed us to open

up a hookah lounge and a year later now they're saying you can't smoke indoors. >> but they might not have to close their doors permanently. the county's department of small businesses is working with some lounge owners to plate in a smoke-free environment and anyone in a commercial building built before december 31, 2009 can apply for a license to allow smoking in an enclosed space. looks like the opponents of target store have fallen a few votes short. they needed about 2700 signatures. earlier this month county election officials rejected some of the signatures leaving the group 37 signatures short. when the group contested, five of the names were determined to be valid but that still leaves 32 signatures shorted of what they needed. the group says it will continue to fight against the target store. a new trend is moving to marin county and is causing concern for some restaurant owners there. five gourmet food trucks from
