>> we are not here to criticize l.a.p. d. you know sometimes, this can be a very tough business on both sides. we make mistakes, the defense good faith mistakes. >> reporter: meantime stow's family says their focus is on bryan who had emergency surgery on monday but has since given a nurse a thumbs up and responds when asked a question. >> he response with eyes following some simple commands. so it was very nice to see. >> reporter: we caught up with bryan stow's cousin. he tells us this has been an emotional week for the family. nearly every day there's been a major unexpected development concluding with these three new arrests. patti lee, ktvu news. a vigil is growing right now in san francisco's bay view district in the wake of anger over the recent officer involved killing there. david stevenson is there with

the peaceful gathering put together after that violent confrontation, david. >> reporter: julie, this anti violence vigil has just gotten under way here in the bay view district it comes as some residents say they're skeptical about a new shooting about a police shooting here. police chief greg suhr demonstrated why he believes kenneth harding jr. may have fired a shot that killed him. >> apparently the officer shot, hit the suspect in the leg, so imagine if you would an instant hamstring pain pull would cause the person to lurch. the gun entered the left side of the neck and exited the cheek. >> reporter: the medical examiner said yes that the gun ár shot that killed harding did not come from a police gun. police confiscated a gun that was at the scene but did not fire the bullet that killed harding. police believe the shot seen in

this widely seen video fired the shot. it has not been found. investigators say the first shot was fired by harding. today they said they don't know which of the other nine shots killed him. >> that shot in terms of its proximity to the body itself may have been muffled because of potentially a contact shot or very close in itself. and the system may not have picked up that shot. >> reporter: these latest case developments including the missing gun have deepened distrust of police. >> the gun should have been directly up under the kid's body, okay. i mean it's just a lot of of discrepancies not fitting together. >> reporter: the officials say they will help pay fare for young people who don't have money to ride nummi. bay view residents erupted

in anger after the death of kenneth harding jr. many wondered why they were so upset after all harding was a convicted felon who police say fired his gun at them. well residents we spoke with today said it really had little to do with harding himself. many say, the tension was already bubbling under the surface. >> you get asked, is your boyfriend a drug dealer, where are you from and who's car is this. so that definitely hinders you being black when it comes to the police. >> reporter: many residents agree while there may be a t enuous relationship with police they are working to work on improving that relationship with police. >> our coverage continues online. ktvu has a special section for the officer involved shooting. federal investigators say the small plane that crashed just over two weeks ago killing a santa cruz family of four

nose dived into a watsonville medical office. the ntsb says the single engine plane took off at steep angle from watsonville airport. the plane then rolled, spirals and then crashed nose first into the building. the first report is probably a year away. history was made in washington, d.c. today as president obama certified the repeal of don't ask don't tell. the move clears the way now for gays and lesbians to serve openly. the that notice will go to congress ending the don't ask don't tell ban. congress repealed the controversial policy last year. the ban will be lifted in 60 days. once the repeal is final, service members can no longer be discharged for openly admitting they are gay. the president signature was met with great excitement here in the bay area. ktvu was with retired naval commander zoe dunning when she

received the official news. 13 yearing ago dunning won her case against the don't ask don't tell policy. she was allowed to serve out her military career openly as a lesbian. >> in all the leadership training that the military had given me said if you see something wrong, step up and do the right thing. and to me that was doing the right thing. >> dunning was standing next to president obama when the president repealed don't ask don't tell. the retired commander has paveed the way for openly gay and lesbian service members who want to be true to themselves and serve their country. the policy was enacted in 1993 by then company bill clinton. today there are 66,000 gay and leabian service members in active duty. in the past 17 years, more than 14,000 service members have been discharged under the law. the debt show down escalate

into a war of words. >> in the interest of being serious about deficit reduction, i was willing to take a lot of heat from my party. >> it's the president who walked away from his agreement and demanded more money. >> reporter: john boehner and president obama both said they believe congress can raise the debt limit in time to avoid a government default. the president has called a meeting at the white house for tomorrow morning with all four top congressional leaders to try to hammer out a compromise deal. a stretch of highway 101 is going to be shut down once down once again tonight. starting at midnight, caltrans will close all lanes on the 680 connector. the lanes should reopen at 5:30 in the morning on saturday. they will close again saturday night and sunday night. crews are improving the tulley road interchange. an angry debate is brewing over new proposed district boundaries. if approved martinez and

pleasanthill will no longer vote with contra costa county in state elections. john sasaki is live now in martinez with why some people are against the idea. >> we're standing in martinez which is in the seventh california senate district. but at the latest proposed map holds martinez and pleasant hill will leave their contra costa behind to cross that water to join davis. martinez is the contra costa county seat. >> it's the focal point. it's the focal point of our jail system. it's the focal point of decision making, it's where we all come together. >> reporter: it's a critical part of this boating district says county board of supervisors chair gail okama. she was stunned to hear that martinez could be moved. >> we would be a very insignificant portion of that

district. >> reporter: this idea has also riled feathers at pleasant hill city hall. >> i can't imagine a senate from that district who basis is solano, i cannot imagine that person having an understanding of what central county are all about. >> i think it's outrageous. >> reporter: we went to davis this afternoon. even here residents are dumbfounded by the idea. >> martinez, california. i've heard of it. >> martinez is over in the bay area, right? >> you think that makes sense? >> no, kind of far distance from this area. >> reporter: the commission finalizes the maps on august 15, but it's accepting public comment through tomorrow possibly through the weekend.

robert handa. at&t is still selling more iphones than verizon. verizon says it activated 2 million compared to 3.5 million at at&t. verizon announced an increased profit. root metrix says the download speed at verizon is faster than at&t. stanford researchers found when they look at 65 advertising companies. many still create profiling based on users online activities so they can target

four middle schoolboys are heading to trial after being accused of sexually assaulting two girls. they are accused of taking two 12-year-old girls to a secluded area of a park and assaulting them back in march. the boys are being prosecuted as minors. a public memorial service will be held next week for a marin county sheriff's deputy who was killed trying to help some friends. the service for 49-year-old jim matheson is scheduled for 11:00 a.m. next friday at the marin veterans memorial auditorium. matheson was off duty when she was shot in petaluma. he was trying to diffuse a

situation between a friend and that friend's boyfriend. today the san francisco police department added eight new officers to the force. the new graduates are from the lateral academy. they are experienced officers from other agencies who receive additional training before being sworn in as san francisco police officers. two of the officers are from oakland, one is from antioch and the other is from half-moon bay. state senator leland yee entered the race for san francisco major. the candidate planned to make quite a visual statement today with his filing. >> reporter: in the race to win san francisco's top job, senator leland yee certainly earned some bragging rights. but his candidacy was never in doubt. >> reporter: down mcallister road they marched with their

candidate leading and thousands of signatures in hand. >> the fact that we're the first individual to collect the 10,000 signatures, valid signatures mind you, it just indicates the strength of our campaign. >> reporter: the deadline for candidates to file is thursday. others will follow. >> i think it's symbolic to his campaign in terms of the mayor structural it doesn't mean much. >> reporter: yee is considered to be a front runner along with herr era and chu for now. >> how does that shift up the calculation and what do candidates do in response to that. >> reporter: signs like these are popping up in san francisco, run ed run. lee for the first time refused to rule out running. leland yee's campaign posted this you tube video highlights lee's promise not to run.

but candidate yee says he welcomes all potential candidates. >> if he decides to run i wish him well. but my focus is on my running for this mayorship. >> reporter: the final date is august 12. there could be more than 30 names on the ballot. ken pritchett, ktvu news. property values grew by $2 billion in the past fiscal year to $163 billion. that's an increase of nearly 1.5% during a tile when many areas saw declines. demand for commercial property exceeds the supply. california's unemployment rate rose slightly last month even though the state added thousands of jobs. the state added 28,000 jobs last month. even so the unemployment rose

to 8%. only nevada is worse. the country's unemployment rate climbed to 9.2% in june. u.s. stocks ended today's session on a good note. good news from computer chip makers propelled the nasdaq. while news from caterpillar dragged down the dow. the dow was down 43 points. right now i'm tracking fog into your bay area weekend forecast. it does mean a little bit cooler daytime highs for your saturday. maybe a little warmer on sunday. let's go take a look at all of that. you can see right here around santa cruz, it's starting to clear on the best side of the town up on the boardwalk. it's been a foggy day in santa cruz and capitola. more fog is well, very little clearing if any out toward molina and stinson beach. so just basically a foggy day. same deal tomorrow. these are the highs based on the cool sea breezes we had
