>> we got ballistic confirmation in morning that that was the gun that killed harding. >> reporter: harding got into a shoot out with police in the bay view district. >> they were able to identify a person on friday that we believed knew the whereabouts of the gun. through interviews and negotiations we were able to get the gun back on saturday. >> reporter: the county's medical examiner last week outraged some residents. a tip led to the recovery of a..45 caliber gun in a location not far from the shooting but police were initially unable to produce the .380. suhr says it's unclear whether anyone will collect a reward for the gun's recovery or will be arrested for removing it from a crime scene. >> we haven't made an arrest up to this point. we're continuing to talk with the person who helped us get the gun back. i'm not exactly sure how that

story ends at this point. >> reporter: protesters at an anti police harassment rally today called the newest finding part of a cover up. >> they've done told so many lies, who else can collaborate that? >> reporter: the lawyer for kenneth harding's family this eving evening told us they are shocked and stunned and don't know what to believe. the father and mother will árally has -- the family has asked for the release of that gun to conduct a private investigation. a town hall meeting by the chief of police ended abruptly when some at the meeting tried to shut him down. last friday police revealed evidence that harding died of a self-inflected gunshot. on monday, harding's family announced they have hired an

attorney to look into the circumstances of their son's shooting. our chopper was over head on 20th avenue around 3:30 this afternoon as police brought customers outside with their hands drawn in the air. those customers tell ktvu a man police were looking for walked inside that coffee shop. when he eventually walked out, police arrested him. there's no word yet what that man was wanted for. pg & e crews began pulling a pipeline -- pg & e crews began pulling a pipeline from san bruno. >> reporter: in this neighborhood where new homes are like phoenixes are rising from their ashes, pg & e is still searching and digging for clues. under orders from the public utilities commission, pg & e is

last night. friends and relatives in a near by hot tub noticed the two had gotten quiet then found them unconscious at the bottom of the pool. a friend pulled them from the water and did cpr. >> i had only done it on a dummy, so to do it on an 8-year- old girl was pretty nervewracking. a good samaritan who was shot while feeding the homeless died last night. he was parked with his pregnant wife and two young daughters on 47th avenue and international boulevard early yesterday morning handing food out of their van. someone pulled up alongside them and opened fire. paris wife and three-year-old daughter suffered wounds. the family had been handing out

meals to the needy for more than a year. only on 2, rob roth tells us how an eviction for a charity now has a happy ending. >> reporter: we're inside the fire house where firefighters have been running their toy program for needy children. there's still some stuffed animals left to box up. but this is a story with a happy ending and an unlikely hero. >> reporter: firefighters helped clear the boxes behind the giants ballpark this afternoon. after almost four decades here the toy program must move out by this weekend. you might say the program which helped 40,000 families last year is the in the way of progress. >> it's a bit frustrating that we're losing this space because it suits our needs very well. >> reporter: the old fire house build in 1917 is about to undergo a re retrofit and the

came early this year. rob roth, ktvu channel 2 news. san francisco's interim mayor ed lee indicated he might run for the job in november but that isn't stopping other candidates from officially getting into the race. >> avalos. >> just two hours ago supervisor john avalos turned in signatures to get his name on the ballot. avalos represents the outer mission district. and david chu delivered his final batch of signatures to get his name on the mayoral ballot. nine candidates not including mayor lee have announced they are running for the mayor's office. a new law bans using the homes of registered sex offenders as polling plays. governor brown has signed the law. it requires county election officials to check the polling addresses to megan's law.

a congressional anti trust hearing is set for september 31st and it find that google ranks users to send them chosen sites. they are also looking into charges that google -- the deal is worth up to $1.3 million and is meant to help electronic art to compete against zynga. peninsula congresswoman anna echu is calling on president obama to require contractors to disclose their political donations. republicans have blocked such legislation, in a letter to the president she urges him to sign an executive order. she says quote anyone benefiting from taxpayer money has the responsibility to be fully transparent. a group of supervisors has

removed a measure to change san francisco's care not cash program from the november pal lot. that - - november ballot. supporters say that would free up shelter beds reserved for the program that go empty. the city says it is looking for changes in the way shelter beds are allocated. the future of the palo alto airport is up in the air tonight. the airport is currently one of three airports run by santa clara county. the county will drop its lease in 2014 giving it back to the city of palo alto. the county will continue to run the airport until then. this mother gray whale is still far from home but her situation has actually improved now. the surprise find by scientists today who are monitoring her health. and right now i'm tracking some fog moving in over the

the man once considered the prime suspect in the beating of giant fan bryan stow is asking to be released from prison in los angeles. giovanni ramirez was never charged in the attack but was being held on a parol violation for having a gun. two other men were charged in the case last week. it could be the break they need in the search for a bank rubbery suspects. a critical clue is left mind at

the bank. one robber grabbed the security guard's gun while at least two others demanded cash the teller. a witness told us it all happened very quickly. >> all of a sudden i look to my left and i see two guys hopping over the counter saying where's the money at, where's the money at. >> reporter: the robbers abandoned their get away car a stolen mercedes. investigators are now reviewing fingerprints from that car. thiefs have stripped $100,000 worth of cooper wires out of six schools over the summer. this school franklin middle school was hit last night. the robberies have left the school without power. investigators say the thieves know exactly what they're doing and are able to steal the cooper within as little as 15 minutes. bank of america has agreed to help californians who are facing foreclosure. it is joining the state's keep your home california program. that program began in february but so far only 500 homeowners have had up to $100,000 shaved

off their principal. state officials hope the inclusion of bank of america will help them reach far more homeowners. >> we are looking for people who are delinquent on their loans or having trouble are unemployed or under water. the federal government has given $1 for every dollar. and the whale may have treated its own health concerns, ken pritchett. >> reporter: after a month why doesn't she as her calf did last saturday swim back to the ocean just a few miles away. >> how is she going to get out?

of food or lack of water. >> the best scenario, she will turn around and decide it's time to leave. >> reporter: until then, she will be a sight to see. ken pritchett, ktvu news. a city commission last night recommended the city council draft an ordnance to outlaw single use plastic bags. it would also require retailers to charge 10-cents per recycled paper back. the city council is expected to take up the measure in september. palo alto follows san francisco to be the first to require a plastic bag ban. santa cruz harbor is getting a facelift tonight. the old u dock is the first to be replaced. 23 of 29 docks there were heavily damaged by that tsunami and strong winter storms. the federal government will cover 95% of the cost.

the repairs will continue well into next year. here we are into your thursday, the fog is returning. temperatures today were on the warm side especially inland. we have fog if you will showing up in our avenues of san francisco out toward daley city, pacifica. that's granada where my curser is. the fog making a play back for the coast tonight. tomorrow will be just like today, maybe a degree warmer. these were the highs from today observed at the local airports, the big ones and the small ones like out in antioch. 94degrees there, 91 in livermore and 90 in morgan hill. forecast highs for tomorrow, about the same, a little warmer in fairfield. the forecast then for tomorrow just like for tonight just like it was last night. for tomorrow, a lot like today but slightly warmer. the changes very subtle. it's unusual that we get, when we get unusually mild weather this time of year.

but it's unusual that we have so few changes. the differences in daytime highs forecast daytime highs versus what's actually occurring very subtle. so that's how it continues. that's good news for firefighters. fire danger very mild for this time of year and air quality very good. tomorrow afternoon, it starts to heat up. there was heat in the central valley today. you're getting your upper 90s toward red bluff. i have enough of a sea breeze and enough fog at the coast that's keeping things on the mild side for this time of year. some high clouds coming in from the gulf of mexico. those clouds could trigger a few thundershowers. south toward mammoth lake. i don't know how big they'll be but the concern any time of year or this time of year for any kind of lightning strike is fire. so we'll watch that for you tomorrow. not a major outbreak but there could be a few thunderstorms off to the east. the forecast high in the morning 7:00 a.m. looks like it did this morning. rapid burn off like this

morning. more sunshine and daytime highs where some of that heat comes out of the valley. we're going to see a lot more 80s and 90s tomorrow, still cool along the coast. 91 in fairfield. you have to find those mid-90s out toward brentwood and antioch. 91 in livermore. no red flag warning but it is creeping up into that territory as we get into that very, very warm weather pattern toward the weekend. i guess it is hot in very inland areas but very warm and it's been a cool week so you will notice the differences tomorrow. >> where should we probably be under normal circumstances we would be mid-90s? >> i would expect those hot spots in the mid-90s. people against circumcision
