alert is now in custody. ktvu's janine de la vega is live at atascadero on the latest on this developing story. >> reporter: ken that's right, 4-year-old jeremy guthrie has been found. he has been reunited with his mother in the last 30 minutes. we're told they're at the police department and that he seems to be okay. now in the last 30 minutes, we also heard that police arrested his alleged kidnapper 53-year- old annette hail in atascadero near an abandoned car dealership. police say hail got into an argument with jeremy's mother at a homeless shelter. when his mom woke up, jeremy was gone and she found a rambling note that led her to believe that hail had kidnapped him. volunteers held a massive search all day looking for hail and the boy. and shortly after 5:00 tonight, jeremy was found and hail was

arrested. we're joined right now with rob brim from the atascadero police department. you're a spokesperson. tell me what is the latest, you were able to capture annette hail, how did you do that? >> i'm with the sheriff's office. we're here on mutual aid to help atascadero police. it was a huge effort by people working the homeless encampments. distributing information, so and so forth. we believe she then knew that she was in trouble. at which point she allegedly made a phone call and told us where to find the boy. and then an alert to atascadero state hospital officer saw her hiding in the bushes and with assistance took her into custody. >> reporter: so she was cooperative? >> well, i don't have the details of the arrest, but at this particular point in time our whole concern was the child. we have him, he's in good

shape. he's been examined by paramedics and as you mentioned he's reunited with his family. that's the big top of this story tonight. >> reporter: okay, and i mean this was very serious. we heard she had a history of mental illness that she could have been dangerous. >> any time you have a third party abduction like this. that's something we need to be very concerned about. that's why we scrambled assets from everywhere from fbi los angeles to all we emptied our detective division, our narcotics division. we had everybody in the field. and then we helped coordinate. >> reporter: okay, thank you so much. rob brin with the asatcadero sheriff's department. they were going to hold a candlelight vigil tonight. you know hoping for jeremy's safe return. but instead, instead of the vigil they are going to have a celebration where community members will come and right now they are really just overjoyed that this little boy was found

safe. reporting live from atascadero, janine de la vega. a 9-year-old boy is in critical condition tonight after being struck by a hit and run after last night's giant- phillies game. david stevenson spoke to the friend of that hit and run driver about what happened today. >> reporter: the 9-year-old boy was hit in this intersection after leaving the phillies- giant's baseball game with his parents. police believe the hit and run driver was drunk. his friend tells us what happened. at 10:30 last night a white truck drove the wrong way up montgomery street striking two people and hitting two cars before racing away. today white is in critical condition after san francisco medical hospital. a 58-year-old woman suffer add foot injury. police are crediting 15 witnesses with helping to identify the alleged driver. >> there were a ton of people

running after the car trying to stop him. >> reporter: hayward police arrested 21-year-old andrew vargas in that city an hour later. san francisco police said he tested over the legal alcohol limit. >> investigator from san francisco took witnesses over to hayward to identify the vehicle as well as the suspect in this case. >> reporter: ktvu has learned vargas just graduated with a business administration degree from cal state east bay in june and is enrolled in graduate courses there for the fall. tonight he is facing felony hit and run and dui charges. he is under a psychiatric evaluation. >> he is a good person, he wouldn't be my friend if he wasn't. he is visiting from mexico city, that's where he grew up. so he's just taking him around because his friend has never

been in the bay area before. >> reporter: the san francisco district attorney's office tonight tells us vargas could have his first court appearance on tuesday afternoon. reporting live in san francisco, david stevenson, ktvu news. many people heading to at at&t park for tonight's game said the hit and run on their mind. the giants said they will acknowledge the 9-year-old fan. from the team to the fans everybody says they are pulling for the boy's recovery. >> fans travel pretty well. i'm not surprised the family came down here. it's a tragedy this happened. >> a lot of people we talked to said it's extremely troublesome that the hit and run driver fled. a child has drowned. officers say the mother was at home with the baby and another child, and lost track of the

toddler for just a minute. the mother found the 15 -month-old in the families aboveground swimming pool. neither she nor paramedics could revive the little girl. police in san jose said a man called 911 to report a homicide he had committed himself. it happened around 2:30 this morning at the park kyley luxury apartments near interstate 280. police say the 48-year-old man stabbed his 33-year-old girlfriend. neighbors said they heard the couple fighting this morning. investigators have not yet releaseed the names of the victim or the suspect. in the north bay authorities made a gruesome discovery inside a burning car near tamales bay. the marine county department said crews found a body inside the car at the miller park boat lodge around 6:00 last night. officials tell us they are working to identify the person and then most notify family members before releasing a name. we're following developing news on the nation's debt

crisis. tonight standard and pore says it plans to downgrade the u.s. credit status from triple a to a+ . it would be the first such downgrade in u.s. history. a washington postreports administration officials are challenging the decision saying there's a math error in the calculations. rumors that the downgrade was coming helped fuel a wild day on wall street with the mayor indexes seesawing positive then negative then back again. the dow closed with a gain after falling more than 400 points early in the session. the nasdaq lost 23 points. traders were rattled by concerns over the week u.s. economy. >> there's a lot of low priced stocks out there. but there's also a lot of fear that we could be going lower. >> reporter: all three major stock indexes are in a correction. down 10% or more off their recent highs. a popular north bay youth center is set to close next friday. we were there in 2006 when the

marin youth center opened its doors. the mic as it's known offered classes in music, and computer among other things. the marin foundation says it plans to use the space for vocational training. it may reopen the clubhouse as a computer center. property owners in eastern contra costa county are assessing the cause of five fires. they all started along a stretch of railroad tracks shortly after a freight train passed through the area yesterday afternoon. darrelle hardy lost 30 beehives worth about a thousand dollars a piece but he says he's lucky he and his neighbors still have their homes. >> very fortunate it didn't get into the willows and nobody was hurt. the santa fe railroad who

and performed shakespeare. here in this auditorium inside san quentin, convicted murders, armed robbers, three strikers and other offenders were actors performing shakespeare 12 nights. this man is serving time for killing a woman. >> we can use things in our life, sad things, things that made us angry and transform that into something positive. >> reporter: 13 convicts have been rehearsing 30 weeks for this performance. this man says he killed someone when he was 16. >> at 16, i build a lot of walls and i kind of looked away that child. after participating in shakespeare i really allowed that little boy to come out. >> reporter: much of shakespeare dialogue was there for the actors to recite. the inmates are performing

wilson. many people admired wilson's candor, excitement. he re mained a vital source of information after his retirement nine years ago. an 84-year-old woman could lose her driver's license over an accident that injured three people. the woman was trying to park at the u.s. bank at tennessee and amador streets yesterday afternoon when she apparently hit the gas instead of the brakes. she plowed into the crowded bank lobby. the senate passed a bill today providing stopgap funding for the faa administration. the measure ends the two week partial shut down of the faa which cost the government an estimated $400 million in lost taxes. republicans refused to compromise until $16 million in air service subsidies to 13 rural communities was eliminated. top postoffice executives say they need action from congress or they will not be

able to make a payment to the government. the postal service wants congress to change its operating rules to rules so it can change its business. the state commission in charge of teacher credentials says it's making changes after an auditor called it one of the worse run agencies she'd ever been. the governor this week named six new members to the panel which wrapped up the two days of meetings today. the commission says it has eliminated a backlog of thousands of alleged misconduct cases. a popular smart phone game is making the leap to the social network. zynga announced today its words with friends game is now available on facebook. the san francisco company says people who use the game on their phones can now transfer their ongoing matches to facebook.

honda recalled 100,000 vehicles worldwide to fix a software program that could affect the automatic transmission. the recall affects accord sedans, crvs and honda elements. honda says without the update the transmission could be damaged if the driver shifts quickly between gears. state water watchdogs have released a draft to restore the delta. the delta stewart council is considering charges fees for water use and the use of levies. the draft asking for enforcive flow. it also calls for more waters to be conserved by farms and cities. and a doze of fog along the coast. we started on point rays on live storm tracker 2. you can see out here toward bodega bay, you have a doze of clouds. it's been there most of the day. you have some and then all the

nhl star sean avery was arrested in los angeles this morning and booked on charges he shoved a police officer. police say they were called to avery homes in the hollywood hills on a noise complaint. when the new york ranger player answered the door, officials say he pushed an officer. avery was released on bail earlier this morning. so far no comment from the rangers. giants getting ready to play, a's already in progress. >> game two with a series with the phillies a little less than an hour away. and the a's in progress and it's not going very well. down in tampa they were already down 1-0 against the rays when evan longoria a shot off mascoso. damon will bust around from first. mascosa would not make it through the innings.

the a's are trailing 6-2. could be a fourth straight loss for them. meantime, second round of the bridge stone, everybody curious of course about tiger and his come back. his first competitive play since mid-may but there are other golfer's involved. like phil pinky michael mickelson. i don't know about those pink pants. the ball bounces in for eagle but phil a 3-over 73 after 36. tiger started in the back nine and his putter not in top form. he misses this shorty. and bogies the 14th hole. and coming up on the sixth, missing yet another short put. tiger shot a 1-over nine. that's seven shots back of the four leaders. meantime, after losing their probowl tight end zack miller to the sea hawks, today the raiders sign kevin bosh.
