it's monday, august 29th i'm dave clark. >> and i'm pam cook. we have been here for hours. rosemary is watching the weather for us. >> our temperatures will be running cooler as we enter the workweek today. minimal cooling continues as the trough sets up. this morning we are waking up with patchy fog even dense in some areas. the north bay reporting dense fog this morning. afternoon temperatures will be very similar. slipping in some cases but again the bigger cooling trend comes in the weeks ahead. we'll talk a look at the numbers and somehow you the cooling trend. hi sal. hello rosemary. westbound 80 here looks pretty good. it's getting more crowded as you make your way to the bay bridge toll plaza. also this morning at the toll plaza we are getting an early back up here. let's go back to the desk. in overnight news concord police are investigating a deadly shooting. ktvu allie rasmus is near a

park that is still blocked off by police. >> reporter: concord police crime scene investigators just pull the up here to hill crest park. this is the area marked off. off in the distance you can see one of the investigators had a camera and flashlight. now it's getting lighter out they are going through this area to continue this investigation of the shooting. we have just confirmed that one of the persons who was shot in this park last night died from his injuries. now concord police are investigating a fatal shooting here. it happened just after 10:00 last night at hill crest park in concord near olvera and grant roads. the intersection to olvera and grant is no longer closed but the park is. concord police responded to a call about gunfire in this area. they found the man had been shot. he was lying in the street in olvera road. again that man died from his yours. hill crest park is in a

residential area surrounded by homes and apartment buildings. the park seems safe. it's frequently used by a lot of people. >> first time i have ever seen anything like this. i come here six or seven days in a week in the morning like right now where it's quiet and peaceful. i can't remember the last time i've seen an officer go down the street this early in the morning. >> reporter: now again you were looking at crime scene investigators with concord police going through hill crest park. looking at any evidence. one thing we are waiting to find out from concord police is whether police are still looking for suspects or people involved or connected to the shooting. we are expecting to to get an update from one of the police lieutenants shortly this morning. live in concord allie rasmus. in just a few hours a federal judge in san francisco will start hearing a request to release video from last years

proposition 8 trial. the same sex couples who sued to overturn same sex marriage ban want the video made public. they claim there is extraordinary public interest in the case. however, the sponsors of proposition 8 will disagree and will argue against the video saying witnesses may be harassed. 6:03. we may see something later today that is becoming a familiar sight along market street. protestors demonstrating against bart. but as tara moriarty reports and live from san francisco there is a new twist in what is planned for later on today. tara. >> reporter: 5:00 is when the show down is set to happen here at the civic center bart station. the new twist is there will be a new protest against the protest. they will stand outside of the station carrying picket signs urging police not to shut down the station. they are calling their operation taking back bart. they are upset with a group

called anonymous. prompting police to shut down stations and cancel trains. now police say tonight they will be cracking down much more on these unruly protestors. not waiting as long as they did last time. some bart customers are not sure if dualing protests are answer. >> i don't think they are targeting the right people. there is probably a more proactive way to handle it aside from effecting general just like me that commute via bart. >> reporter: the anonymous protestors have been angry about two things. first an officer involved shooting of a homeless man back in july. and the cutting off of cell phone service. they are make a series of demands from firing the bart chief of police to disarming officers. many disruptions will continue until they get what they want. public support does appear to be waning. bart and san francisco police are finding ways to diminish their impact. if you are planning to take bart just understand that the

bart stations may have issues with it. so that street could be impacted as well effecting people out on the roadways. live in san francisco i'm tara moriarty. the remanence of hurricane irene are moving through canada this morning. one day after hitting the northeast united states. new york city avoided extensive damage but as you can see a lot of trees are down. the evacuation order for 375,000 people have been lifted. the city's subway will open today. that is after shutting down on saturday. critics say the response to irene was overblown. >> you know, they should just look in a mirror they are alive today because of it or inspite of it. we will not take any risks with people's lives and the best scenario possible is you take the precautions and it turns out they are not needed. >> some of the worst damage is in southern vermont.

rivers and creeks overflowed yesterday. forcing families to evacuate their homes on short notice. now who will pay for the hurricane irene recovery effort? state and local governments already in bad economic shape. coming up at 6:14 we'll have a live report from our washington, d.c. bureau with president obama's request and how it could cause fallout among lawmakers. 6:06. happening right now boy a backlog of flights at sfo and airports around the country as new york airport starts to reopen. this is outside of sfo. now new york's three major airports reopen this morning after closing over the weekend because of hurricane irene. we just found out that three flights set to take off this morning to those airports are still canceled. two others heading for charlotte they are also canceled. passengers trying to get to san francisco are the ones facing the most trouble.

24 arrivals from cities around the nation are now canceled. >> depending on an airlines ability to accommodate the passengers off of canceled flights it could take several day too so. >> sfo is telling us one good thing is the airlines had enough notice of hurricane irene's arrival to notify most passengers before they arrived at the airport. six years ago today hurricane katrina devastated new orleans and the gulf coast. you remember the scene outside the super dome in new orleans where thousands of people sought shelter from the hurricane. broken levies triggered devastating flooding. 100 people were killed in the storm. more than $100 billion in damage was caused. the rebuilding is still going on in new orleans hard hit ninth ward area. and memorials are planned throughout today remembering that somber anniversary of

katrina. a bronze monument honoring 25 historic figures will have a new home. this morning three sections are being shuttled from berkeley to the henry jay kizer memorial. the art work is entitled remember them. champions for humanity. the sculptture includes 14 local activists and will be displayed one week from tomorrow. kraig debro is watching that incredible monument being removed. >> ktvu did the snippets and special programs throughout the year. >> you can see those on our website if you missed our special we ran back in april. >> all kinds of good things on the website this morning. >> oh good. >> sometimes i get online i get over. good morning, everybody. there is a new crash unfortunately just came in as we were speaking northbound at 880 marina boulevard. it's an overturned car.

chp is not even there yet. we are not sure which lane it's blocking. it's an overturned car. we'll find out more about this as it comes in. a new crash 880 northbound a flipped over car reported. this mornings commute at the toll plaza backed up far five minute delay. nothing major there. and if you are driving on 280 northbound getting up to highway 17 that traffic is moving along nicely. 6:09 let's go to rosemary. >> we do begin a pattern change as we progress into your monday. similar temperatures expected high pressure still in place. am fog even patchy dense fog in there. spreading inland just a little bit. although east inland looks mostly clear and fairfield is clear as well. low pressure will be setting off the coastline for tuesday and wednesday. that is when we will notice quite a tumble. especially in our inland areas.

afternoon highs will cool anywhere from 5-10 degrees. the fog forecast it looks like noontime today it's backing off the coast. notice right there it could struggle along the east bay for just awhile. noontime we will be mostly clear all the way to the peninsula and we could be partly to mostly cloudy over san francisco most of the day. at 3:00 in the afternoon you can see a little bit right there. temperatures 56-degrees in san francisco. 60-degrees in san jose. 61-degrees in mountain view. these temperatures a few degrees up over yesterday. forecast highs looking at 80s and 90s for the afternoon. but again shaving just a little bit the temperatures here. 83 for napa today. 80 expected in vallejo. wide spread upper 80s and 90s. 81 in fremont.

look at this. hurricane irene blamed for one of vermont famed covered bridges was destroy. that bridge was there for 140 years. yesterday it washed away. hurricane irene has caused wide- spread flooding in vermont and other states as well. the storm as moved out but there is still the flooding threat. it could be days or weeks before power is restored. even though hurricane irene has passed yet another storm is

brewing in congress on how to pay for the damage. alison burns is live in our washington, d.c. bureau with that story. >> reporter: dave, that is right. even before hurricane irene hit the east coast, president obama and federal disaster managers were warning congress that the country's disaster relief fund was running low. now at least eight states report significant damage from the hurricane, president obama is promising governors and mayors the federal government will provide the help they need. >> i want people to understand this is not over. response and recovery efforts will be an ongoing operation. >> reporter: will congress have to declare an emergency bill to pay for billions of dollars in damage from hurricane irene. fema has suspended some payments to states impacted by recent tornadoes. in order to deal with the hurricane damage, president obama is expected to ask congress for more disaster

relief money but that is likely to provoke another fight on capitol hill as republicans are demanding spending cuts in other areas to pay for it. reporting live from washington, d.c. alison burns ktvu channel 2 news. libyan rebels will not negotiate with moammar gadhafi. they have rejected a reported offer to discuss the transfer of power. rebels are considering an offensive against the city of surt. meanwhile, a grizzly discovery at a warehouse vacated by gadhafi forces. the charred remains of dozens of people he held captive. the prisoners ranged in age from 17-70. libyan rebels announced they will not extradite the master mind of the locker beat bombing. doctors diagnosissed him with

cancer. he's reportedly in grave health while his release angered western nations he rei mains popular in libya. the search is on for the man accused of shooting and killing a fort bragg city councilman. he's accused of murdering councilman melo. mleo came across a pot farm in a rugged area near the river and that he was shot by a man guarding that illegal grow operation. time now 6:17. firefighters in solano county want to know what caused a weekend grass fire that came close to burning a home. it started saturday evening in fairfield. the fire burned more than 700 acres before being contained yesterday. pretty strong winds pushed that fire away from one neighborhood but sent it right toward a house sitting on a hill. firefighters were able to keep that or prevent any homes from

being burned. a wild fire near yosemite national park is still burning this morning. highway 140 is still closed. now this fire has burned more than 4700 acres since it began on thursday after a motor home caught fire on the highway. now it's 35% contained but not expected to be completely controlled for more than a week. more than 100 people have been ordered to evacuate and more evacuations are possible. yosemite remains open between highways 41 and 120. 6:18 is the time, sal. i think we should keep mentioning to people that there will be a protest. counter protest at bart in the city. so you might want to plan accordingly this morning. >> we also want to remind you this could effect muni riders. when they close the bart stations if they do and they have in the past the protests people also can't get down to the muni plant form which is

the plant form using the same set of stairs. so in essence when they close the bart stations downtown, they also close the same muni stations. that has been delaying hewn knee as well. let's take a look at westbound bay bridge coming up to the toll plaza. it's now looking like it's about a five minute delay. maybe a little bit more than that. nothing too bad. some of the fast track users are having a better time of it. also this morning on interstate 880 northbound it looks pretty good. however, just down the road from this we do have a crash. northbound 880 with an overturned car. police and fire are on the scene. watch for delays. quiet, calm, and cloudy outside our door this morning. temperatures range from the low to mid 50s to mid 60s. sunrise 6:37 this morning. you can see some of our inland areas dealing with sunny skies. low clouds around the bay and along the coastline this

morning. look at how calm we are. south westerly wind in fairfield 15 miles an hour. a light delta breeze blowing through there this morning. north westerly in livermore. five miles an hour in oakland. switching to south westerly. south westerly winds reported there as well. temperatures mid 50s oakland as well as san francisco. 60-degrees in san jose. upper 50s livermore, concord, napa. 52 degrees in santa rosa. a little bit of dense fog reported for the north bay right around santa rosa. the fog and clouds are burning off once again. temperatures will be similar. we are between patterns. high pressure will begin to retreat to the east as low pressure builds in and along the coastline we'll have that trough there. that will bring in a cooling trend. noticeable tuesday. wednesday looks to be the coolest day by thursday our temperatures are warming once again. afternoon highs once again mid 80s expected santa rosa. wide spread 70s for the east

bay. 89 danville. 91 pittsburgh today. 82 san jose. 81 expected in fremont. and 70s and low 80s for the peninsula. 67 degrees for san francisco. and along the coastline partly to mostly cloudy skies and sitting in the 60s for most. extended forecast there is the drop in our temperatures. rebounding thursday, friday, and into the weekend. have your plans for the weekend just yet? there are your numbers. wide spread low and mid 60s for the coast. and mid to upper 80s expected inland. crude oil prices are creeping up again this morning. oil was selling for more than dollar 85 a barrel. gains on most global stock markets and concerns over hurricane damage to east coast refineries pushed up the price. no damage though was reported at the refineries. industry analysts say gas prices could go down because of the storm. that is because airlines grounded flights and many people didn't drive so demand

it slammed into 63-year-old san francisco attorney don casper on august 14th. a nearby surveillance camera video taped the truck but did not get a license plate. >> we have done the whole nine yards so far. >> one motorist at the check point does remember seeing the vehicle. authorities believe the truck has right front damage. the fresno superintendent of schools says it's up to everyone to pitch in and help schools. larry powell is giving back more than a quarter million dollars of his salary. he says he's financially secure enough to do his job and take home just $32,000 a year. >> i have a great retirement. i've had a great life the community has given to me an awful lot. how about giving something substantial back. so that is what we are doing. >> powell say there is is one catch though. he gets to decide how the money

where we were standing was under water yesterday. the waters of the branches of the river are beginning to recede. some won't recede for a day or two to come. we have some without power in this area. the deli next to us is throwing away thousands of dollars of food. fortunately this is one of communities on the east coast dealing with hurricane irene. irene's three-day run caused major damage all along the east coast in many north eastern cities streets turned into raging rivers. despite being bordered on all sides by land, fast moving flood waters swarmed towns in vermont. this building is dangerously close to falling after a nearby brook tripled its width. soaking rain and rising water forced many to leave their homes. >> they pounded on our door at 10:30 and said we needed to get

out. as soon as we looked out it was utter mayhem down the street. >> reporter: some needed help from rescue crews to escape from water logged homes. >> the storm beat us. >> reporter: the effects of irene are blamed for for 20 deaths in eight states. the cost of the damage is yet to be calculated. >> i want people to understand this is not over. response and recovery efforts will be ongoing. impacts of the steam will be felt for some time. the recovery effort will last for weeks or longer. >> reporter: now hearing that vermont is also under a state of emergency all the flooding there here in new jersey there is some limited train service and bus service. the transit trains are not running. there san issue of trying to get into the city. once you are there the subways as you mention are on a very limited to service right now. good news if you are looking

far this morning the new york city airports and those surrounding the city are going to be reopening this afternoon on what they are calling a staggered schedule. that goes by airline by airline. it will be days before we are back to normal here. >> chris knolle there in millburn, n. commuters said they have had enough with the demonstrations at bart stations. as ktvu tara moriarty tells us a counterprotest is planned for today. it could be messy this afternoon. tara. >> reporter: it is bound to get chaotic here at the civic center part station tonight. they will be out in full force but so will people protesting the protestors. it's a new twist to the monday night bart demonstrations. the movement is called taking back bart. it's comprised of people saying i'm reasoning bien those have

prompted the shut down of bart stations. the new group said it will carry picket signs asking police not to shut down train service. >> it's not surprising. i would be mad as well. >> i think it's excessive and it's effecting the wrong people. >> reporter: the anonymous protestors have been angry about two things. first an officer involved shooting of a hamulose man back -- homeless man back in july and cutting off cell phone service on august 11th. the reason cell phone service coverage was shut off the agency had reports that a splinter group was planning to chain themselves to trains. all of this should get under way at 5:00 tonight. it will impact your commute if you need to get through the civic center station or powell station those are places that have been hit hardest in the past. as well as market street if you

are taking muni or have to take a cab or any of those on the roadway. they have marched on market street in the past. you could be looking at delays. live in san francisco i'm tara moriarty. 6:35. we are approaching the first anniversary of the deadly san bruno pipeline disaster. eight people were killed. 38 homes destroyed on september 9th of last year. coming up at 6:45 when the final report from federal investigators will be released. this morning police are looking for two men that shot and killed an oakland man right in front of his six-year-old son. 39-year-old jose esparsa left the market on international boulevard at 1:00 yesterday afternoon. the gunman approached them and demanded values. esparsa was shot and killed but

his son was not injured. the man accused of shooting and killing a three-year-old oakland boy is scheduled to enter a plea in court today. lawrence denard is wanted in connection with the drive-by shooting that killed little carlos nava. they believe the shooting was gang related and two other men wounded in the shooting were the intended target. here in the bay area a gigantic bronze sculpture is on the move this morning. the 40,000-pound art work features historic figures as well as bay area activists. kraig debro is live in berkeley to tell us who is on the monument. >> reporter: good morning, dave. a lot of people you heard of. maya angel or people you haven't heard of. the man that stood in front of the tank. he's also di picketed on this monument.

workers moved it. crews must'ved it 15 minutes ago. the final resting place is a park near the fox theater. mario is almost at the enof the den step-year project. the sections are picked up by a gianten train. the artist says the kizer foundation provided much of the money for the monument. there are 39 international and local advocates pieces depicted here but some grew criticism. >> i think it all comes to this fear thinking and being uneducated about the full scope of anyone's life. and the entire point that we are imperfect. but when you look at what the so-called controversial people are, look at the positive effect that they had.

shore freeway westbound 80 and getting much busier especially if you are driving through richmond and berkeley. although it's not stop and go. it certainly is becoming a lot more crowded when you get to the bay bridge toll plaza you will see a you there it's backed up for a 15 minute delay. this mornings commute northbound 280 traffic looks okay getting up to highway 17. do have slow traffic there. i want you to mention northbound 880 we do have slow traffic coming up because of an earlier crash. that is northbound 880 at marie that. overturned vehicle they are clearing it up. watch for slow traffic there. again in the south bay we showed you 280. 85 is getting crowded as you approach 17. we have changes ahead as we roll through the workweek. today very subtle though. giving you a live look outside

our doors dealing with gray once again. the marine layer 1,000 feet. very similar to yesterday. but we have a northerly gradient. 52 degrees santa rosa. san francisco 65. hon show say you are 59- degrees. take a look at forecast here. it is around the bay. inland areas concord, livermore, antioch you are waking up with mostly clear skies to knot bay partly to mostly cloudy. even dense fog. we have fog along the coastline. after 9:00 or so notice we get a pretty good burn off. east bay dealing with the low clouds and parts of the peninsula. by noontime it looks like it's peeling away from the east bay. could remain over san francisco for the afternoon once again. so high pressure still in control of our weather pattern. similar temperatures expected for the afternoon. a slight cool down in some cases but a better cool down expected tuesday and wednesday

another protest against bart is planned for tonight as they have done over the last several weeks but this time angry commuters opposing the hacking group plan a counter demonstration. and a new legal fight over proposition 8. this one involving footage video footage from last years trial on the constitutionality of california's same sex marriage ban. at a hearing set for this morning a federal judge in san francisco will consider a request to release that trial footage. a concord park is closed right now while police investigate a deadly shooting. ktvu allie rasmus is on the scene with an update. allie. >> reporter: concord police are investigating this shooting. the investigators arrived an hour ago. you can see they are still on the scene. now that the sun is up they are getting their first day-time view of the crime scene. you can hill crest park is blocked off to the public. right now you can see

investigators are on the other side of the crime scene tape one of the patrol cars left the scene. and over here to the right there is a parked car that the investigators opened up and were looking into a few minutes ago we are not sure if this is a car that may belong to the victim of the shooting or suspect or if it's connected to what happened here last night. concord police responded to a call about gunfire in this area at 10:00. they found a man that had been shot lying in the street on olvera road right next to the park. that man died from his injuries. hill crest park is in a residential area surrounded by homes and apartment buildings. one neighbor we spoke to this morning said the park seems safe and never noticed any problems here. >> it has improved in the last few years as far as some of that. which made it a good park for a lot of activities to go to. they had the kids playing soccer here. the playground is always full. now again you are looking at concord police crime scene

investigators. they arrived an hour ago once the sun came up to take a better look at the crime scene here. we have been calling concord police all morning trying to get more details on what happened. we've been told all morning they will e-mail us a statement. we haven't received anything from them yet. just to clarify they say they are not authorized to give us any more detailed information. what we are trying to find out is if police are looking for suspects in connection with this shooting. there are reports that concord police did detain a couple of people. again, concord police lieutenant we have been trying to get ahold of this morning has not confirmed that for us. live in concord allie rasmus. time now 6:47. the national transportation safety board is about to release its final report on the san bruno pipeline disaster. it's due to be released tomorrow. we are approaching the first anniversary of that deadly explosion. eight people were killed. 38 homes were destroyed on september ninth of last year.

two community events will be held in san bruno next month remembering the victims who died. thousands of students that attend oakland public schools will be back in class today. it's the first day of school for the oakland unified school district. there are 46,000 students in public and charter schools. this morning is the first day of the districts newest charter school. 6:48. the city of san jose wants you to bring your open bag with you to clean up. the city will no longer offer free dog waste bags. they were spending $60,000 a year on the bags to keep the park dispensers stocked. san jose is joining a list of growing bay area cities including palo alto and sunnyvale that will no longer provide the free bags. 6:49 is the time right now. back to sal to check in on traffic. >> right now we are getting a
