and oakland pride were let out early because of the dangerous situation. dozens of officers, swapt and sheriff's department and firefighter department are here. officers are going door to door searching for two men. they have a canine with them, a police copter and officers on the roofs of houses. this started when a man was carjacked and had a gun pointed at his head. four men got into the car and an officer chased him and that crashed into a neighborhood. the four men took off running. the officer chased them on foot. >> our officer saw one suspect drop a gun and as he was giving commands the second suspects pointed a gun that officer. so the officer fired several rounds in defense of his life. the suspect continued over the

fence and fled. >> reporter: officers were able to catch two of the suspects. the officer was not hit by gunfire and they don't believe either of the men were hit by police gunfire. at one point investigators tell us the men knocked down a woman and ran through her house and struck a pg&e meeter and caused a gas leak so they had to come out here to take care of that situation because it was very dangerous. these men caused a lot of havoc, so far no residents have been evacuated but they are trying to detour people around the area. they are still going door to door. they think they might be in this area. janine de la vega, ktvu channel 2 news. for the third week in a row protesters are targeting the civic center station but they are calling calling for someone different they want the protest

to stay above ground. ktvu's david stevenson has more. >> reporter: look behind me, i am standing just above the entrance to the civic center station. you can see 20 protesters standing there. we are hearing the situation down stair as calmer, there are few protesters down there. san francisco police and protesters say things will be different today in terms of where the protest takes place and when it's shut down. bart police call it unsafe, protesters call it effective. the weekly demonstrations were sparked by the july third shooting of charles hill. and the agency's decision to cut cell phone service. the demonstrations prompted station closures and alienated bart riders. >> i hear why they are angry, i don't agree with the way they are going about it. >> i had to leave work early to

avoid them. and trains are packed because everybody is doing that. >> reporter: members of "anonymous" are calling for the protest to stay above ground to keep the focus on the shooting instead of interrupted train service. police say they will move quickly if they stop street traffic tonight as they did last week. >> asking folks to wait to get home because transits. >> reporter: a counterprotest by "commuters take back bart." officials say they are improving their san francisco the weekly demonstrations. >> last monday we didn't have any train delays and only two stations were closed. the scene here at un plaza you can see a number of protesters gathering. we are expecting some of the protesters may go down to the area by the gate and take the

protest down there. people are just arriving. we will be back with a live update later on and let you know whether it effects transit. reporting live, david stevenson, ktvu channel 2 news. the hunt is on for the man accused of killing a councilman. authorities are looking for this man. he shot and killed jere melo saturday morning. authorities believe he was guarding an illegal pot farm that the city councilman accidentally stumbled upon. -- the man accused of killing a three-year-old appeared in court this morning. lawrence denard was supposed to enter a plea in the debt of carlos nava. but his public defender was on

vacation so it was put off for two weeks. willie torrence was returned from las vegas friday and scheduled for arraignment tomorrow. it has been a fierce battle and tonight it's up to a judge to decide whether tapes of the same-sex marriage trial should be made public. ktvu's rob roth has more. >> reporter: here in the castro district where folks are barred from seeing the videotapes of that trial. right now the decision over whether the public has the right to see them are in the hands of a federal judge. >> reporter: this same-sex couple held up a sign today urging the judge to free the tapes. >> we have sat in on the courtrooms many times. and to hear real people talk about their real lives is heart

breaking. >> reporter: attorneys fighting for same-sex marriage rights and media organizations argued for the release of the tapes, saying they are the best record of what happened during the trial and why the judge ruled proposition 8 is unconstitutional. >> proponents don't want this out. they know when the public sees the evidence they are going to lose the public opinion battle just as they lost this case. >> reporter: backers argued the judge made the tape to help him make his decision and witness whose testified against could be suggested to physical harm if their images were made public. >> as a result of this order there haven't been any reports of incidents against

supporters. >> reporter: professional actors have reported excerpts of the trial and posted them on youtube. such recreations are no subtutes. the judge is expected to reach a decision within a couple of week. reporting live in san francisco, rob roth, ktvu channel 2 news. a new analysis of 2010 data shows san francisco has the highest percentage of same-sex couples of any major county in america. fallowed by massachusetts, monroe, florida, oregon and manhattan in new york city. among states the highest percentage of same-sex couples is in the district of clumbue, vermont, massachusetts, california and oregon. the williams institute on sexual orientation law conducted the analilous. >> reporter: death penality opponents announced the start of a petition to put the matter before voters.

members of the group say the death penality isn't economic. money the group said would have been better spent solving crimes. >> it doesn't work. it's fraud because the process has become so incredibly expensive. >> the push to put the matter on the ballot comes after a similar bill. tomorrow federal investigators are set to release their report on the san bruno pipeline explosion. tonight our washington d.c. reporter shows us a behind the scenes look at the pipe in question and the investigation. >> 50 feet of pipe to the d.c. area lab and the reason it is so important, this is where the explosion originated. investigators say it contains vital clues as to what really

happened. >> reporter: the san bruno pipeline explosion is the largest one they investigated in a deck aid. the -- decade. they gave our cameras look at what its investigators looked at. >> lot of pressure a lot of gas wanting to come out. >> reporter: that pressure opened up the pipe, helped by these problem spots. >> this is a -- >> reporter: a weld that goes down the leng of the pipe. these scenes were own -- seems were only welded on the outside. instead of looking like this the seem should have looked like this, welded also from the inside. pg&e records on how the pipe was made and installed were inaccurate. >> one of the biggest difficulties was the lack of records that pg&e demonstrated throughout the investigation. >> reporter: if you are

wondering what this is, they are called coupons, areas of areas of the pipe the ntsb cut out to test. >> reporter: tests shows they were made of substandard materials. pg&e admitted its mistakes and on friday unveiled a plan to upgrade nearly all of its lines. officials will be at tomorrow's hearing. in washington, carol hahn, ktvu channel 2 news. breaking news. deadly construction accident in the east bay. these are live pictures here. this is about 5-7 miles north of interstate 580. what you are looking at here is a bulldozer that was helping to build a road to bring in new, more bird friendly wind turbines. they are enormous and there have been problems in the past

with them killing birds. as the bulldozer was building that road something happened and it flipped and then rolled 700 feet down a hill, killing the driver. there you see where the bulldozer ended up. you see the police on the scene. investigating this. we are working to get more information. the headline, a bulldozer building a road 5-7 miles north of interstate 580 overturned today, rolled down a hill killing the driver. insurance company stocks rose on wall street today. that helped pushed the indexes higher. the dow jones industrial average rose 254.71 points to close at 11,539.25. the nasdaq composite index rose 82.26 to 2,562.11. more signs the economy is not heading towards another recession. consumer spending is back up. spending in the united states

increased out 8% in july compared to june. americans personal income also increased. if that trend continues through the fall it will help the economy avoid another down turn. the u.s. labor department says 60% of part time workers are satisfied not having a full time job. 30% of the people working less than 35 hour as week say they would rather work full time. that was 19% prior to the recession. they speculate some people become used to living on less and don't miss the stress of a full time job. hurricane irene still causing headaches for travelers here in the bay area, coming up, how many flights were canceled today at sfo. back here with the forecast that will cool things off in your neighborhood, where that fog will be when you wake up tomorrow.

. verment lost history from the flooding caused by hurricane irene. you are watching one of the state's famous bridges get washed away. the bridge was swept away by the williams river during the height of the flooding verde. it is about 150 feet long and essentially broke away into the

water. hurricane irene is blamed for 35 deaths tonight and the damage may run into the billions of dollars. >> the amount of damage is devastating in some areas. and will get worse before it gets better. >> that is the new york governor talking about the flooding. look at the raging floodwaters in western massachusetts up and down the east coast beaches were swallowed and roads buckled. 3million people still don't have power and restoring electricity isn't easy. the president says recovery will take weeks. >> i am going going to make sure fema is doing everything to help people on the ground. six kittens were rescued from tropical storm eileen. -- irene. animal care is now putting them up for adoption.

the are still major travel troubles. ktvu's alex savage is live that airport. >> reporter: 30 flights canceled. a lot of people stranded in the bay area. some of those travelers we talked to today, they might be lucky if they get a flight by tomorrow. >> reporter: stuck at sfo, people curled up on chairs to get some rest. a frustrating day with dozens of canceled flights. >> i stayed an extra day. everybody at work knows i have to take a vacation day monday because the flights were canceled sunday. >> trying to get home. >> reporter: they were supposed to be on a flight home to new jersey yesterday but they never got off the ground. now he may have to get creative to get out of san francisco. >> get me out of here tomorrow to texas and they will get me

on a flight to maryland. >> reporter: all the canceled flights out of sfo today were supposed to go to the northeast. they have spent the last three days trying to get home to new jersey after a san francisco vacation to come watch his favorite baseball team. >> we are never going home. i am convinced. we will be here -- really. he is a giants fan. >> reporter: their trips are dragging on because of hurricane irene and the extra rights are starting to add up. >> money is adding up. >> reporter: i asked them whether more flights might be canceled tomorrow, it's a wait and see situation. many airlines are experiencing back logs. best advice, check ahead of time and don't show up here at the airport unless you know your flight will be taking off. alex savage, ktvu channel 2

news. part of highway 12 remains closed at this hour, 7 hours after a deadly crash. happened this morning, known as highway 12 between 80 and north kelly road near the napa-salono line. news chopper two was over the scene. a car traveling westbound crossed the center line and crashed into the oncoming tractor-trailer. killing the driver. the truck driver lost control and caused a crash with two other cars. one person was killed. 7 others injured and taken to the hospital. the chp is still inspecting the scene. crews made progress overnight fighting a wildfire burning since last thursday near yosemite national park. it burned 3700 acres. the entrance to yosemite national park is still closed.

right now the fire is 35% contained. crews don't expect to have it fully contained till next week. burning near the ramp from north bound highway 87 to 280. these are pictures from a traffic camera. the chp issued a sig alert and cleared it a hour later. let's talk about our weather now, over to our chief meteorologist bill martin. >> nice day. beautiful weekend out there. heat in the inland bay valleys. temperatures today cooler than they have been and temperatures tomorrow cool again. right now off shore looking at the fog. i want to move it forward. look that fog off shore. see how it is moving towards the south? we had clearing long the coast today. a big sunny day, or a lot of sunshine. here is the reason why.

towards the bay area, winds coming out of the north, northwest, it's what we are seeing is a wind shift. this direction. it's pealed the fog away from the coast. not leading to a heat wave but giving us a sunny condition and that could be the story tomorrow. 57 in redwood city right now. 68 hayward. 57 doesn't look right. might have a problem. that's not right. i imagine it's probably 73. 84 fairfield. 74 napa. high temperatures today were cooler than they were over the weekend. temperatures trend down the next couple of days and then they might come up. bottom line here, the story this week is more of the same, a little fog nights and mornings, plenty of sunshine and mild temperature monopolies we are not going to see the 90s. tomorrow mini in the mid-80s.

. complete bay area news coverage continues. this is ktvu channel 2 news at 5:00. people in one small town are reeling from shock and sadness after a member of their community is gunned down. >> we will get to that in a moment. first we have developing news from san francisco. i want to show you live pictures from outside the civic center bart station. there are about 50-60 protesters. what is different tonight they are all above ground and that apparently is by design. leaders asked the protesters not to go down to the civic center platform, they are concerned about how many riders are upset with the protesters because they stopped service the past two mondays. right now 50-60 protesters above ground that civic center

take somebody's life over marijuana. bad things. >> reporter: passengers on the train saturday morning heard the shots and the train was locked down and searched. he is known to have a high powered rifle and living in the woods, carved out bunkers to live in and considered very dangerous. jere melo i am told was shot from 20 feet away, he was not armed. live, deborah v, 124-6789. taxi driver attacked another taxi driver with a tire iron because that driver honked at him. they want to speak to anyone who witnessed that. police say the fight started after the victim honk at the suspect for not immediately moving at a green light. he was treated for a gash on his head. family said good-bye to two

navy seals killed when their helicopter was shot down earlier this month. he grew up in a napa valley town. jesse was from willet. both men were buried today in san diego. they were among 30 american service members killed on august 6. a church is trying to find a way to stop thieves. as ktvu's allie rasmus tells us, they are going after copper wire. >> we feel violated. >> reporter: that was his reaction when he saw what thieves did saturday morning. >> they disconnected it and it stopped the flow of power they were begin to pull the copper wire out. >> reporter: 500 yards of

copper wires that powers the church and it wasn't the first time they were targeted. earlier this month someone stole five security cameras and thieves tore apart 7 air conditioning units. >> it's only $39 worth of copper in a $5,000 unit. i know times are difficult and i know people are desperate but you know to take from a church whose mission is to help others and to provide a better quality of life, it's difficult. >> he is thinking about putting up a fence around the church, much like the yoga center did across the street a fence tall enough to keep thieves out but not everyone likes this idea. >> this is a house of worship. >> it is not welcoming. >> reporter: police said this h a problem with copper wire threat. but he hopes there are

witnesses who will come forward. >> someone had to see what was going on. it's unusual to see people removing copper wire from a church. >> members added metal grids and padlocks padlocks to protect something they never thought they needed to. allie rasmus, ktvu channel 2 news. back to school today for students across oakland. these parents dropped their kids off at franklin this morning just before the first bell rang. officials say they made an extra effort to make sure kids didn't play hooky on the first day. in the past the school district reported high abitanty rates on the first day of school. >> 10 people are in the hospital and four under arrest after a college party announced on facebook got too rowdy. thousands of people showed up saturday in an apartment near

colorado state university. 3,000 people rsvp on facebook. four arrested. those taken to the hospital were alcohol related cases. he claims he owns part of facebook, now he is facing a crucial deadline white sox the judge told him to do. plus a big announcement from tiger woods. live pictures of developing news in san francisco. these people are protesting bart. they were gathered on the civic center bart station on the streets but they are now on the move. we will have the latest on the situation coming up.

we continue to follow developing news in san francisco. news chopper 2 is above the scene. the area of the civic center bart station along market street. looks like there are as many as 60 protesters out there. i see a few people in the middle of the street. that is market there and i y haven't seen anybody -- looks like the street is closed now. protesters and police are on the scene at civic center bart station. the next bart station is powell. looks like police are trying to keep people and protesters out of the street but traffic appears to be impacted.

this part of market is closed for right now. this is a developing situation. we don't know if they will march to powell street. if you have done that walk before, it's a 10 minute walk but it's doable. they have been on the move for a few minutes. we don't have word of any arrests or bart interruption. we have a service from bart where they will send us e-mails if there are shut downs or trains not being allowed to stop. we have not receive word on that so we assume bart is running normally. let's bring in ktvu's ken wayne live on the phone where the action is. tell us what you see. >> reporter: right now san francisco police are in the process of reopening market street between 6ing and 7th -- 6th and 7th. a dozen or so protesters were birching on market street from

the -- were marching on market street from civic center bart station where a protesters started chanting on to the street and a small group went into the streets. they have been watched by several dozen san francisco police. once they got into the middle of market street and blocked traffic that's when police entered market street, formed a line to prevent them from traveling north bound towards the ferry building and stopped the protesters and circled them in a giant "u" shape and that's when traffic was stopped for 10 minutes and the police managed to push the protesters on to the sidewalk and now traffic is moving on market street. looks like the protesters are regrouping, deciding what they are going to do next, continue

down market street towards the ferry building, we will have to wait and see what happens. there are lot of police out here. >> what you see on the ground, news chopper 2 is over the scene, sounds like the protesters are headed in the direction of the powell street station. it also looks like police have a heavy presence there, walking long the protesters. >> reporter: right. where i am the protesters stopped. they are gathered on the sidewalk here. that's closer to jones and mcalister where it runs into market street. there is a group of 40-50 that are gathered around here. as you can see, there are a number of san francisco police police officers standing off the sidewalk and in the streets and keeping an eye on them. they have their batons out and watching to see what they do.

you might be able to hear some of the protesters -- now they are on the move, heading towards the ferry building. right now they are chanting the whole system is guilty. we have several dozen protesters now again on the move. heading towards the powell street station. we will have to wait and see what they do next. >> ken wayne live on the ground as we are covering news in san francisco, protesters on the move. sea otters are a threatened species and now programs to protect them are about to be eliminated, what that means means for the animals and how the public can get involved. a cool down and we will look that five-day forecast all in about 10 minutes.

. you may not be aware of this but there are so few sea otters that groups can count all of them. ktvu's robert handa is here to tell us why there is concern about how to protect the remaining ones. >> reporter: there was a plan to restore the population but it failed so now the struggle continues to save them. >> reporter: every day visitors come here and other spots to watch sea otters. >> one of the major attractions

here. seems obvious people like them. >> look like puppy dogs. and they seem to be cute. >> reporter: that led them to launch a program 24 years guy protect them and get them off the threatened species list but now they want to dismantle the program calling it a failure. they say no otter zone in southern california and relocating them did not stop the population decline, including a 4% drop since 2005. now they plan a new approach, leave them alone and let colonies develop on their own. >> this is the opportunity to expand their range, allow them to go where they need to go and not trying to focus them in a part of the coast line. >> reporter: some fisherman tell us they don't like the idea of so many sea otters
