but ntsb investigators say just as blame worry, pg & e for failing to make sure the pipe was safe. >> if pg & e personnel had inspected the inside of the pipe the missing weld should have been detected. >> reporter: the yuletity failed when it came to the emergency response. not only did it take a pg & e crew 95 minutes to shut off the valve. at first the control center could not pinpoint the explosion point. while pg & e got the brunt of the criticism, investigators also blamed state and federal regulators for lax oversight and for giving utility a pass on old pipes when they should have been pressure tested. >> you have got to make sure they're doing it the right way and when they violate that trust the penalty has to be high. >> reporter: among the 29 29 recommendations the safety board made. better inspections inside the pipes and the elimination of a

rule that exempts older pipes from getting tested. san bruno's major who sat front and center during the proceedings had this to say about the final report. >> the ntsb did a great job. i think now we as a community will keep doing what we have been doing and that's rebuilding. now the ntsb is done with its san bruno investigation its work on this issue is far from over. there are four or five more pipeline investigations pending. and the agency had to put off a lot other cases because of lack of funds. we put those findings to chris john he is the president of pg & e. the night of the deadly gas line explosion, pg &

e president chris johns went to san bruno. tonight he was at the ntsb safety board meeting where pg & e was severely criticized. first, john does not agree with the ntsb investigation. >> we have interpreted them to the best of our capabilities. we've tried to embrace how others have interpreted them. >> reporter: having said that john's agrees there's lots of room for improvement. >> it is apparent based on the ntsb has stated today that they believe we could have done more. so we are going to take what they have asked and the recommendations that they've said and we're going to integrate them into our plans. >> reporter: we're there as the ntsb found inadequate pipeline

investigation in december. many are still convinced the fight over who's responsible isn't over yet. jade hernandez live in san bruno, people there say they want more. >> reporter: they want requirements, they want legislation more than what the ntsb can give. nearly year after the explosion, these lots are still vacant and the father who wants to move his family back into that home says this report is only the first step in holding pg & e accountable. >> reporter: the ntsb report validates bill mcgulligans claim that pg & e acted with blatant disregard. >> we need requirements and we need legislation. >> reporter: a year later this is what it looks like inside of mcgooligans home finally being rebuilt after the explosion. as a survivor his perspective is from a pain only the

neighborhood knows. >> it's really difficult to look at this. these aren't just empty lots. these aren't just homes, they were my names, they were my friends. katherine, jose and maria. michael down the block. >> reporter: he wants the public utility commission held accountable. >> they were asleep at the switch quite frankly. and allowed all the bad things that allowed this explosion to happen under their watch. >> reporter: maria tells us what happened when she ran out of her home. >> my nostrils hurt with every breath. >> reporter: today she moves back into her home. her biggest fear is nothing will come of it. >> i'm worried that something awful like this might happen again and are we going to be victims again. >> looking out there, what i see is a really brutal experience. a really tough thing that happened. it took the lives of people who, you know they shouldn't have died. >> reporter: the mcgooligan family hopes to move back into their home by this christmas.

the california assembly today approved the new pipeline safety bill designed to help prevent another explosion and fire. it would require utilities to install automatic shut all valves. jackie spears says she will push for automatic shut off valves. spears has introduced legislation. >> i don't think congress gets it yet. so i'm going to try to meet with the committee chairs to try to make my case to them again. >> reporter: congresswoman spiers says she was pleased with what she called a hard

hitting safety record by ntsb. the board says pg & e failed to make corrections after the 2008 gas line explosion which killed a 72- year-old man in rancho cordova. authorities say the utility violated safety rules in connection with that explosion. ktvu's ken pritchett will have reaction from rancho cordova. our coverage on san bruno will also continue on our website. you can go to ktvu.com and click on the pg & e hearing tab. we have breaking news now from sacramento county. want to show you live pictures here. this is the scandia funds center. what has happened is a crane, some type of crane has collapsed. there is also word that it may have hit one of the rides. it's a little difficult to tell from these pictures. but you can see there this fun center is right next to interstate 880. from what we understand one worker has broken his leg as a

result of this. we are working to get more information. as we do we will bring it to you. the scandia fun center directly adjacent to interstate 880, some type of crane there has just collapsed. as we get more information we will pass it along to you. a school in oakland was put on lock down all day. students were just allowed to go home within the past hour. we want to put up a map to show where it all happened. sal castaneda, is the search for suspects still going on? >> this is horseman elementary school right here. there is police action going on. as a matter of fact if you look just down the block past all the media trucks here, this is where the original police action took place. one house up the block, another around the corner. this meant the school all 350 students had to be held inside the campus on lock down.

now we took this video. children were held here until just before 4:00 when they were releasing small groups to their parents making for an extra long schoolday. police say the school had to be shut down after a chase led them to a suspect in a near by home. five people were detained without injury. it's unclear if police believe all five were involved in the crime spree. which included several home invasions. one person told them he needed to be rescued after he was stuck inside the attic of this home. >> told us that he was unable to exit the home that he had been caught in some portion of the home at that point we determined that he was indeed caught in a hiding place and with the assistance of the oakland fire department we were able to extract him from the house. >> reporter: after the rescue was made police officers waited for a search warrant to search the house. now down the street parents

heard about the i incident and started to show up at the school. some became angry, they started to get frustrated when they couldn't take their kids home. >> i heard about it on the news. the school didn't call me, if a kid would have gotten shot, sorry is not going to help me. >> reporter: the latest is that the original house up there is clear. they've already taken five people into custody. it's unclear if they found all the people in the house. still heavy police presence in this neighborhood. a parolee is behind bars tonight.

about 9:00 last night a sheriff's deputy on patrol noticed a suspicious person peering into a car. he ran the license plate and found that it was a stolen vehicle. >> . the sheriff's department sent ktvu this picture of quinett's weapon. it turned out to be a b.b. gun. a reward is now being offered for information leading to an arrest of whoever killed an oakland hand right in front of his 6-year-old son. esparza was shot and killed. he had just cashed his paycheck

and was killed after refusing to hand over $300 to two men that approached him on the street. police are offering a reward money for information leading to the arrest of the suspects. some mixed news tonight on the housing front. new numbers show the june home prices went up for the third straight month thanks to spring buying. experts say the market is still shaky and big declines are expected early this year. june home priced rose .2%. but that's still down 5.5% from the same time last year. minutes released today from this month's meeting revealed the feds discussed a number of solutions to keep interest rates low for the next couple of years. they also announced the next meeting date. not everyone was on board. three members opposed the

interest plan says it could spark inflation. the discussion at the federal reserve was enough to send stocking up today. minutes that were released today from the feds latest policy meeting on august 9th. at the closing bell the dow was up 21 points. the nasdaq was up 14. the aftermath of hurricane irene. the strong words today from the governor of new york after he surveyed some of the serious damage irene left behind. also the latest on the situation at bay area airports. slightly cooler around here today. but as we go into the next couple of days we're going to see an increase in daytime highs. i'll let you know how warm we could get in the city.

arizona representative giffords is making more recoveries. giffords has been using a cane as recently as june but is now walking without it. she also is writing left- handed. she does not have use of her right hand. a federal appeals court in san francisco today heard arguments on whether that suspect in that shooting should

be medicated. he has been at a federal prison facility since may after mental health experts determined he suffers from schizophrenia. no word on when the ninth circuit court of appeals will rule. a the flood waters from hurricane irene began to recede today. all across the east, people are starting to take a look at the toll the hurricane did. 40 people were killed including three in vermont. >> a monumental tragedy. on a number of levels that frankly i have no words to describe. >> reporter: today crews worked to restore electricity and took stock of washed out roads and bridges. the governor toured the

devastation and promised to rebuild. >> nothing, nothing can defeat new yorkers. i believe that. we're not just going to rebuild, and everything you see we're not just going to rebuild. we're going to build it back better than ever before. >> reporter: in north carolina's outer banks many of the restaurants are back up and running. owners say they hope to recoop their losses. janet napolitano says that they will request emergency moneys. we just spoke to a spokesperson for san jose international airport. they said the two jet blue flights to boston and new york were on schedule and they expect all flights to be on schedule tomorrow as well. same goes for sfo and oakland international airport. with disaster preparedness next month, a new toll is pushing people to include their pets in

their plans. 35% of pet owners don't have a plan for their pet in the event of an emergency. something that emergency workers are calling alarming. they are now urging everyone with a pet to try to figure out what they'll do with them in case their homes are evacuated. it will take until friday morning to contain a wildfire close to yosemite park. after sending 400 more firefighters there last night to join the 400 already on the fire line. this morning they reopened the stretch of highway 140. the fire which authorities believe started at a motor home has burned through 250 acres since has thursday. yesterday at this time our chief meteorologist bill martin said we should expect a bit cooler weather and i think we got it. >> a couple of degrees cooler out there gasia. that's how it's going to go again tomorrow. not cooler so much but temperatures tomorrow a lot like what we achieved today. we got fog right along the coast you can see it here out

in the beaches of san francisco. out toward point rays. and up toward bodega bay. current temperatures not that impressive. 80 in livermore, daytime highs will get into the mid-80s. in the hot spots as we move into tomorrow, the warmest spots are going to be low 80s at best. maybe a couple of mid-80s. right now livermore 80. and much cooler right along the coastal areas with temperatures in the 50s. overnight lows tonight. not as cool as last night. santa rosa got down into the 40s. we've been seeing a couple of 40s. that is an indication. obviously the days are getting shorter. you see it in the morning, you see it at night with the earlier sunsets. the temperatures we're starting to see 40s popping up in the bay. as we start to go through the equinox, we're going to start to see the temperatures go from the 50s to the 40s.

some of those spots you will find 40s. this low pressure center will stick around. the temperature yesterday was pretty warm. as we head into wednesday about the same. as we get into thursday. temperatures will start to come up and we will see numbers on thursday back into the 90s in some spots. so bay area microclimates. the big ones right out on the bay. you're just -- tomorrow you're just in the low to mid-50s out by treasure island. low 70s as you head out toward kensington. and you get into the 80s down toward livermore valley. you will see the upper 80s as you go toward vacaville and beyond that. if you look at the temperature forecast for tomorrow very similar to what we had today. the extended forecast does call for a bit of a warm up. we're going to talk about that when we come back. that warm up is going to skid into your bay area weekend as well. i'll see you back here at 5:45. it's reaching a boiling point. where rebels in libya are

in libya, rebel forces have given gadhafi and his supporters an ultimatum, surrender within four days or be attacked. and nato leaders say the end of

gadhafi's days are near. >> they're losing control on multiple fronts. >> reporter: nato says rebels have secured the capital city of libya. now rebels are heading to gadhafi's hometown of sirque. the rebels also are angry that gadhafi's wife, daughter and two of his sons escaped to algeria. u.s. officials say the move violated a united nations ban on travel by gadhafi and his family. >> the government of algeria has sent a letter to the u.n. we are reviewing that letter now in new york. but clearly, there has to be an international community decision in response. >> reporter: libyan rebel leaders also claimed today that another one of gadhafi's sons a feared military commander is dead. they said he died in an air strike south of tripoli. nato officials have vowed to continue their air strikes

against gadhafi to help protect the citizens of libya. muslims around the bay area and the world are celebrating the end of ramidan. members of one mosque joined in the south of market neighborhood for the festival of eid alfiter. ramidan is a month long period of prayers, con contemplation and prayer from dawn to midnight. customers didn't have to spend much time at all looking over the menu because it only has just two items. grilled cheese and soup. it's a brain child of jonathan caplas who also created the flip video camera. >> i think it's a nostalgia thing. i think it's mom used to make me grilled cheese or it was the first food i ever made myself or that kind of thing. there's just something about warm gooey cheese inside

it happened in an instant, a worker at a restaurant in san francisco goes outside for a break. moments later he's in critical condition after being shot in the head. tonight police are looking for two suspects they also say this may be a tragic case of mistaken identity. david stevenson is in the city tonight and tells us what the gunman reportedly said moments before the gunfire. >> reporter: workers are shaken tonight after one of their own was shot not far from their front door. san francisco restaurant hogs and rocks is shutdown tonight

after a cook was critically wounded this morning while he was taking a smoke break. >> it's thought he was mistaken for a gang member and was shot. >> reporter: the cook joined a coworker and another man for a cigarette break in this driveway at about 12:30 this morning. the three were approached bid two other men who pointed a gun at the victim and asked him are you a scrub? neighbors tell us who shots were fired and said police were on the scene almost immediately applying cpr to the victim. essler says surveillance tape shows two men approaching the shooting sight then running away. >> two latin males approximately 25 years of age. wearing dark clothing and hoodies, last seen fleeing from san carlos. >> reporter: the victim is a father of two. coworkers describe him as

polite and friendly and said he also worked a 4:00 a.m. shift at a downtown san francisco bakery. this particular stretch of 19th street isn't usually a trouble spot. >> working there in the past it's always been very trendy, upper scale area of the mission. something that we don't see too common in that location. >> reporter: police tell us they aren't ready to release any images yet from that surveillance tape. but they're asking anyone with information of the shooting to call police. david stevenson. the transient wanted with connection to the shooting of a councilman is still hiding out. police describe him as armed and dangerous. they say he shot congressman jere melo with a high caliber rifle.

authoritys are urging anyone who spots him does not approach him. it's a 380-year-old tree and many people are fighting hard to save it. ktvu has been reports since may the tree is blocking a drinking water pipeline in menlo park. that's where ktvu's robert handa join us now with this new push to save the tree known as granny, robert. >> reporter: the clock is ticking for people in this menlo park neighborhood who want to rescue the tree which as you can see is on this right of way. the pipeline path. today members got some unexpected support. the deadline is set in one week the san francisco public utilities commission will decide the fate of granny. the tree directly in the path of a pipeline. the homeowners have been negotiating for months. they would consider running the pipes understood beneath the

researchers say vehicle pollution and climate change may lead to more changes in hospitals in children. the report says better measures to reduce carbon pollution are needed to improve the health of everyone, especially children. our health and science editor john fowler is in san francisco with what health officials here in the bay area are saying about bird flu tonight. >> reporter: doctors say the risk is really now just theoretical. but the potential is serious. it's a mutant avian influenza virus that so far has killed

june, most are from the monterey area. the wildlife center says almost all of them have life threatening fishing line and tackle injuries. they are urging fishermen to dispose of their lines and hooks properly. drivers in daily city had to hit the breaks to make way for some most unusual pedestrians early this morning. our cameras were rolling as the animals from ringling brothers made their way off the trains and on to their trailers. >> as you can see outside right now we have fog making its way through the gate. if we come in a bit closer, out toward south golden gate bridge

that fog is coming in. these were the fogs recorded. high temperatures tomorrow just about the same. maybe a little cooler. a couple of degrees cooler in the antioch. 83 instead of 85 but you get the picture. just a mild weather pattern. no surprises. it's just what we've been dealing with the last few months. actually. here's how the fog looks right now out on the avenues or here is how it looked tonight. up toward golden gate park up toward the med center then all the way over to daly city. it burns off with the same urgency that it did today. then tomorrow or as we head into thursday less fog warmer, friday less fog warmer. so we see a return to the 90s. in the meantime tomorrow very similar to what we had today. with temperatures at or just slightly below the average. the forecast high for san jose tomorrow then 80 degrees for a daytime high. 75 will be your lunchtime temperature. we have less fire danger.
