happened. ktvu's consumer editor tom vacar spoke to the president of pg & e and asked him if he thought pg & e was at fault. >> reporter: if it was just pg & e, but the ntsb found that state regulators also failed in their duty to protect the public. the ntsb found that pg & e was lax in inspecting this pipe from the first day it was laid and it was lax after an explosion in sacramento killed a man two years ago. as well as a break in the financial district 30 years ago. but that raises a question, do state and regulators share in this blame? >> the ntsb's investigation will have recommendations for both federal and state regulators. but ultimately as i said, we're the owner of pipe. we're the ones that put pipe in

the ground and we're the ones responsible for maintaining that. it falls upon us to ensure the safety and integrity of our system. >> reporter: debra herzman told me by phone state and federal regulators are also to blame. with billions of the dollars needed to upgrade pg & e's vast pipeline system, who will pay? >> part of it will be to the extent that we've made mistakings. and that's on us. we need to make the investment to fix those mistakes. >> reporter: but what about procedures and equipment that would be applicable to all utilities that truly will follow. >> reporter: generally those then will be costs that will be borne by the customers. >> reporter: at this point three things are for sure. pg & e will never be the same, the cpuc will never be the same. and you will pay for much of it going forward. reporting live consumer editor tom vacar, ktvu channel two

news. the executive director of the california public utilities commission responded to the report in a written statement. paul cannon says we have ordered the utilities to test or replace all grandfathered pipes. the ntsb concluded that substandard welding is what caused the pipeline disaster. the bad weld gradually worsened over the yearless. years. it finally ruptured under pressure that would not have posed a danger. as for the aftermath. the ntsb found that an automatic shut off valve would have significantly reduced the time to shutdown the pipe. san bruno residents tell us

they want to see pg & e held responsible for the lives lost and homes destroyed. >> what i see is a very brutal experience. a tough thing that happened to them. it took the lives of people that they shouldn't have died. >> 50 people were injured that day and 38 homes were destroyed and nearly eight years after that blast, many lots remain empty. many people we spoke to today said their biggest fear of today's report is that nothing will come from it. >> reporter: did pg & e failed to learn from a past pipeline blast that has eerie similarities? ken pritchett is in rancho cordova with lessons pg & e could have learned from. >> reporter: this is one house, it is a much smaller event. but critics say what happened here highlighted pipeline safety and it should have

highlighted it prior to san bruno. >> there's a fire, the home blew up. >> reporter: that's a 911 call moments before the christmas eve blast that obliterated this home in rancho cordova. moments that may have erased from people's mind, but not for neighbor hildegard swafford. >> it was horrible. >> reporter: a cigarette set off gas from a leaking residential pipeline. after neighbors had reported smelling gas. >> i'm very mad at pg & e because of all the reports they had and came out and checked and said everything was okay when it was not. >> reporter: the new ntsb report says this blast should have been a wake up call.

>> after the incident at rancho cordova nothing changed. >> reporter: pipeline safety should have been a much higher concern following the rancho cordova blast after investigators found substandard pipe was used. that the pipe was not properly tested and gas smells not properly investigated. >> i think it's clear looking at the record as we can see it now that the puc and pg & e simply did not learn the lessons they should have that very fairly ready apparent after what happened in rancho cordova. >> reporter: the puc decided to levy a fight of $26 million against pg & e for this explosion. but that decision was made after san bruno. ken pritchett, ktvu news. you can read more of that ntsb report and watch video of the hearing into the pipeline explosion on our website ktvu.com. just look under the pg & e hearing tab. we are following developing news out of sacramento county where a crane collapsed at an

amusement park. emergency crews are outside citrus heights where the crane fell into a ride about 90 minutes ago. you can see the crane is almost parallel to the ground opposite of how it should be. there are reports one maintenance worker broke his leg. the ride it fell into was not in operation at the time. oakland police are still around a school that was on lock down all afternoon because of a man was on the run. many upset students showed up to pick up their students. sal castaneda has the story. >> reporter: i want to show you just how close we were to some pretty dangerous police activity. you still see police tape and several officers are at a house that had to be invaded by the s.w.a.t. team forcing the school to be on lock down. >> reporter: police say they had cornered several people suspected of home invasions and armed robbery at this house in melrose avenue. >> given the number of suspects from today and the fact that each suspect was reported to be

armed we elected to set a perimeter around the house. >> reporter: soon after the house was surrounded. four people were voluntarily taken into custody. another man had to be rescued from an attic after he became stuck while hiding from police. at the elementary school, many parents showed up and wanted to take their kids home. many complainted that they were not notified by the school. >> we didn't get no calls. my daughter happened to text me and told me what was going on a little bit. but she's just a fourth grader. >> everybody could have been gone. >> reporter: the kids did not come out until after 4:00. that means they were there for a very long school day. now to complicated matters there was another scene where another house was checked by s.w.a.t. teams just a few blocks that way. so this whole neighborhood has been undersiege making for some pretty tense moments we hear

some sirens, people still arriving at the scene. oakland school officials say unfortunately they're getting used to this kind of thing. sal castaneda, ktvu news. a man suspected of driving the get away car in that was in a drive by shooting that killed a 2-year-old was arraigned today. willie torrence was arrested in las vegas. a man was killed this morning. he and two other people were approached by two men. police say one of those men shot the victim point-blank. >> preliminary investigations are that he may have been mistaken by a gang member and that's why he was shot in the

head. >> reporter: the shooting victims identity is being protected by police and coworkers. he's in critical condition tonight at san francisco general hospital. a jury in san francisco convicted six members of the ms13 gang today on charges ranging from extortion to murder. federal prosecutors argued the crimes were committed to gain entry or move up within the gang's mission. they all now face life in prison. one defendant was acquitted. another 16 pleaded guilty to charges after their arrest in 2008. a panel of federal judges in san francisco heard artoday on who can can order the forced medication of jared loughner. federal prosecutors say it's up to prison officials but loughner's attorney says it's a decision for a judge.

in may loughner was diagnosed with schizophrenia. -- last month the judge blocked the measure saying it would violate state law governing government procedures. the bill now returns to the assembly for a final vote. protesters sounded out outside of a construction construction site saying the company has failed to hire local workers. the group abu accuses avalon of hiring nonunion workers many of whom are from outside the city. >> they are in our community, they hire people from everywhere other than san francisco. so we have a problem with that. >> reporter: protesters say they plan to keep up the protest. avalon has not yet responded for our request for comment.

a bay area woman is putting out a help wanted sign -- a bay area company is putting out the help wanted sign. autoban says it will hire 300 new employees in san francisco. a martinez petroleum company agreed to reach a settlement over their storage system. the company will pay at least $3 million to the effected counties over five years. their deportation documents had already been signed so what saved two members of an east bay family from being forced to leave tonight? also an anti b.a.r.t.

52-year-old fred tolper. that bulldozer rolled down a steep hillside as pelfer was cutting a new road on that wind farm located near north vasco road this all happened yesterday afternoon. cal osha is currently investigating the accident. a superior court judge scheduled ryan -- the oakland man has pleaded not guilty of resisting arrest stemming from last monday's rally and carrying an incendiary device. the incendiary device was icy hot and toller tried to light it. the eric rasmussen live in san francisco with the last minute reprieve that is keeping a family together tonight,

eric. >> reporter: the family's lawyer says it took hundreds of letters even a call from dick durbin to take another look at the case of this father and son who pays taxes and had never been in trouble before. >> reporter: these deportation papers ordered arturo and his son to leave by tuesday. >> my family, my school, my girlfriend. my job everything just, it's really devastating. >> reporter: but immigration officials granted them a 30 day extension. >> in spanish benfrito sr. says i feel comforted because we

finally got the news we wanted. while renfrito's wife won a stay in court, he and his son were denied. >> a father and a son away from a mother and a son. >> reporter: despite being just hours away from leaving the u.s. for good, benfrito sr. never packed a single bag he said out of faith of god that there would be a resolution. his son calls it a miracle. >> to have the chance to live an american dream, but it's all in god's hands. >> reporter: a family's attorney everyone pointed to president obama -- even pointed to president obama's reform. if they can't make the case, the renfrito's already have another deportation date set for september 29th. the coauthor of prop 209 threatened to sue the state to allow public universities to use race when considering

admissions. the law also allows the systems to use gender and economic background in the admissions process. however it does not include quotas that would end the measure of -- >> why else would you give that voluntary permission to use race if it's not your intention to use it. fire crews near yosemite are getting the upper hand on the motor fire. the fire is now 60% contained. four helicopters were in place today putting out the wildfire. that fire has burned more than eight square miles. and we're looking at bay

area microclimates. the current conditions, we go to live storm tracker 2. the big climate. there's the ocean right. there's the bay, there's inland bay valleys. and then there's the big valley. you can see that's where the heat is. right. most of the temperature in the bay area right now in the mild side. a pretty significant sea breeze. these were the high temperatures recorded today. it's many of the bay area small airports and some of the big ones. i guess sfo and oakland. that's a smaller airport, antioch in fairfield, concord, don't have an airport, i was thinking concord airport 82. the forecast for fog tomorrow morning is back in your forecast you knew that. and it'll be right along the coast and it'll be in most neighborhoods that it was in this morning. your wednesday morning looks a lot like this one. your wednesday afternoon looks a lot like this afternoon. right down to the temperatures. the weather system to the north continues to dip south. if this was winter this would be rain. this is not winter.

it's still late summer and so it allows the fog to do is really push inland and drop our temperatures. to average or by low average. that's tomorrow, that was today as well. as we head into thursday and friday. this thing goes north and temperatures warm up. that's been the pattern all summer. in san jose, in the santa clara valley we go up to 80 degrees. good air quality and a nice day. a pleasant day. a fog tomorrow morning about 7:00 a.m. there's the fog footprint. a little bit more than we have this morning. and it will burn off rapidly as it did today. we didn't have a ton of fog this morning in every neighborhood but i think tomorrow morning we'll see a little bit more. and look by the afternoon it kind of burns off. on thursday and friday, this might be the model picking up on that northerly gradient. but tomorrow the winds are going to go north and northeast. that's going to allow temperatures to warm. it's not going to be a heat wave but it's going to get warmer around here that's thursday and friday. in the meantime we have a nice

pleasant forecast for tomorrow. 86 in brentwood, 86 in livermore. santa clara valley 79. and along the coast it's foggy. but it clears out and you will see some sunshine. as it starts to feel a little bit more like fall. as you take a look at your five day forecast with your weekend in view, it starts to look like fog. overnight low in santa rosa. outskirts in town upper 40s. it's starting to cool off and starting to feel like fog. uc berkeley researchers are linking lower birthrate to a fire retardant. every increase of that chemical corresponded to a 4-ounce drop of birth weight. bpa free baby bottles could soon be mandatory in

california. the state senate passed a bill today targeting plastic baby bottles and couples. the bill's author says the controversial chemical could harm the development of young children. the assembly needs to approve changes before it heads to the governor's desk. we now know when barry bonds will be sentenced in connection to his conviction. also coming up, a deeper look at the ntsb finding in the san bruno pipeline explosion. we'll examine the series of missteps that happened leading up to the blast. it's in 30 minutes over on tv 36. up next the staggering new contract for nfl quarterback michael vick. his amazing turn around from prison to a huge payday.
