a apple prototype. it happened at a tequila bar. apple traced the home but it was not found. there are reports the iphone 5 will be released this fall. two men are set to be arraigned to selling a prototype from last year. the justice department is blocking a merger from at&t and t-mobiles. alleging customers could face higher prices and fewer choices if it goes through. at&t will fight the claims in court. the dealed with make at&t the largest wireless carrier in the united states. the dow rose 53.58 points to 11,613.53. the nasdaq composite index rose 3.35 to 2,579.46. the end of trading was the end of august, which was a brutal month. the dow lost tiv% of its value. president obama is coming

to the bay area. it begins september 25. he will start in seattle and stop in san francisco, los angeles and san diego before wrapping up in denver on the 7 7th. and next week the president will outline his jobs plan. president obama sent a letter to john boehner and harry reid asking to speak to both chambers next wednesday. john boehner wants him to make it next thursday instead. the debate is also set for the 7 7th in california. jobs are on the minds of people in oakland. dozens of people turned out for a career fair this afternoon. companies that greeted applicants were verizon and clear channel radio.

a state appeals court ruled furloughs issued by agrees agrees was valid. other officials refused to comply saying they violated their authority. but the court found the order did not interfere with rights. people who live in a 50- year-old housing project in san francisco say this is a day they weren't sured with ever come. >> i am glad to have a roof over my head. >> today officials announced funding to help rebuild the housing project. a $30 million grant will pay a third of the cost to billed a community on that site. construction could begin in a year and a half. investigators are trying to figure out what caused concrete to come down on three workers today. ktvu's david stevenson is live

as investigators work to piece together what happened. david? >> reporter: look at the building behind me. set to become a commercial space next june but work came to a halt with an accident that sent four men to the hospital. works were began pouring at 3:30 this morning. a section gave way, crashing down on three carpenters. >> that whole section of concrete fell on them and knocked them down three flights of stairs. >> we were on the site of the accident minutes after it happened. they were rushed to san francisco general hospital. a fourth carpenter was allots hurt but released this afternoon. >> three were very severe. everybody had some sort of

fun center. cal-osha and operators are investigating. wildlife group is trying to save ducks that someone shot. two injured ducks were found. property manager say four ducks were shot. one died. several others haven't been found. they are trying to capture and treat the birds. blow guns are illegal in california and whoever shot the dugs could face charges. state fish and game wardens say fishing hooks and lines aren't the only threat to brown peles. a dozen birds found with puncture wounds were attacked by sea lions. a spokesman says sea lions and pelicans competing for the same food services. officials are warning a mountain lion was spotted near

school this weekend saw three schools on lock down and police swarming around neighborhoods. school lock downs in oakland aren't that out of the ordinary. the oakland school district and how it deals with the violence all around it. ktvu's john fowler investigated the effects of the violence and the crime among some oakland school children. john? >> reporter: what happened at this school was hardly unusual. we discovered on average each week 3 oakland schools are on lock down. primarily because of violence in the neighborhood and crime. >> reporter: this school yesterday. police searched for gunman around the school. >> it's the equivalent of living in a war zone. shootings. homicides. robberies. domestic violence. >> reporter: the an martin

center. experts say many students are traumatized. >> it effects the way they see the world. themselves. and then they grow up interacting with the world in a negative way. >> violence towards self and others and propertity. >> sign of -- signs of being withdrawn. not interacting. >> reporter: psychologist say schools can provide only so much safety. >> you walk outside the school doors sometimes and within the school doors you will see siphons violence. >> reporter: don't blame teachers or administrators. >> without creating safe communicates and environments how can kids concentrate? >> reporter: parents complained they weren't notify of the lock down. today a spokesman said in the future schools will notify

parents immediately. reporting live, john fowler, ktvu channel 2 news. while some california schools are making progress and meeting testing standards, many continue to fail. 49% of public schools met the requirement. 913 schools failed. officials say the state is handicapped by large numbers of students who don't speak english and poor attendance. including the bay area. >> oakland 17% are absent. that's a pattern that stays with the student. by the time they are in 9th grade they lost one year of schooling. >> despite the challenges, public schools seen a 15% gain in testing scores in the last year. >> reporter: more sidewalk changes on the golden gate bridge. today the bridge district said the west sidewalk, which has

been closed will reopen to bicyclist september 10. on september 13 a section of the east sidewalk will be closed 700 feet south of the marine side. that means pedestrians will no longer be able to cross the bridge till mid-january. facebook is issuing a challenge to hackers. bring it on. they are inviting people to break into the site. it's offering $500 for details on how they did it. two weeks ago a hacker promised to shut down the site on labor day. some people believe the campaign may be connected to that threat. >> my guess is facebook really is afraid of "anonymous" and it may be a kind of cat-and-mouse game where facebook thinks it can outsmart "anonymous" and vice versa. >> facebook says it has already paid more than $40,000 in

right now. it's a big southern heme sphere swell. high energy, deep water swell. when it hits the south faces beaches it jacks up, they are dangerous. flat like a lake and then there is a wave. divers, i wouldn't bother going diving. they are going to be undivable. today we had clearing conditions and a mild day. tomorrow in the next day, more high pressure. winds tweak off shore. you see what it does to the fog. north, but then they wrap around here thursday and friday. that will warm up us. what happens too, we got the rip currents to worry about, even at ocean beach and the fire danger and the air quality to think about. not a heat wave, no heat advisories, but one of the warmer stretches we have seen this summer.
