could help investigators solve this case. robert handa, ktvu channel 2 news. students on and around uc berkeley campus are being given an extra warning about the police -- from police about crime in the area. there's been a number of sexual assaults and robberies in the campus in the past ten days. the latest was around 9:00 p.m. saturday night. a student was robbed by three men on chanting way. >> it's weird that it was so early in the evening and at 9:00 you think there's tons of people out and you think you're safe because there's so many people but turns out you're not. >> reporter: three men were arrested earlier this week on suspicion of misdemeanor sexual battery after women were groped on or near the campus. some stunning revelations today about a san jose police officer. ktvu's janine de la vega talked to the san jose police chief about the criminal accusations made against the officer and why the officer was rehired after being fired before.

janine. >> reporter: well sources here at the gilroy police department said they were kicked off about 44-year-old patrick derigo back in 2009. but it wasn't strong enough for them to file charges until now. derigo faces three counts of sexually molesting two teenage boys. derigo molested a 15-year-old and 16-year-old. other teens in the neighborhood woo who didn't want to be identified said they heard strange stories. >> people said he had weird people over. they don't know exactly what because they weren't spying on him or anything. but they just saw weird things going on. things that didn't look right. >> reporter: the allegations are a blow to the police department. >> it's really disappointing number one but it is shocking.

>> reporter: police sources say derigo had gatherings in his home, had sexual contact with the teenagers. >> and there's questions on how long this activity had been going on. the concern is are there any other victims. >> reporter: der igo has a marred past. the department fired him but that decision was overturned by an arbitrator and he was rehired in 2010. derigo lives alone but when we knocked on the door a teenage boy knocked on the door and denied knowing anything. >> because you're raised to think that police officers are there to help you not to do stuff like this. >> reporter: coming up at 6:00 we'll tell you more about derigo's job as a police officer and why there's added concern for police investigators because of his role as a police officer and he had significant contact with children in his role that he

used to have in the department. reporting live from gilroy, janine de la vega. san francisco police closed the intersection of third and fulsome streets this afternoon after a car crashed part way through the wall of a parking garage. that happened about 10 minutes after 1:00 this afternoon. a parking garage employee was helping a customer with a dead battery. and was in the drive's seat as the car drove down a ramp toward the fourth floor. >> and did not know how to operate the brakes, the crashing brake. and crashed into the parking garage. >> reporter: the fire department secureed the car with ropes and chains until a tow truck pulled the truck back inside. the operator complained of pain in the knee but nobody else was hurt. drivers heading the road this holiday weekend will pay higher gas prices. heavy traffic in both directions, according to aaa the average price for a gallon

is $3.87 in oakland and san jose. that's up 77-cents from this time last year. the national average is $3.63 that's the highest for september 1st at any time except for 2008. coming up, we'll tell you how much californians are cutting back on gas since prices went up. jobless rates will probably linger. the police department says it doesn't expect the unemployment rate to fall below 6% in 2017. right now it's about 9%. the labor department reported that new unemployment applications fell for the first time in three weeks. at 5:30, we'll meet a bay area family that's found a way to stay afloat financially by living on a boat. the white house today tried to move the focus off the controversy over president obama's upcoming address on jobs. >> the president is looking forward to the opportunity to talk about what the american people really care about.

the economy, and the need to create more jobs. mr. obama will speak to a joint session of congress one week from tonight. now we changed it from next wednesday to next thursday. because the house speaker said it conflicted with the republican primary debate. there was still some concern that the president would face competition for an audience. >> i can assure you that for all you football fans that he will be completed before kick off between the saints and green bay packers. carney was referring to the opening game of the nfl's regular season. wall street today ended the four day rally in stocks. ending the day with a slump. goldman sachs fell after enforcement actions were announced. other financial stocks also dropped on concerns the government might target other banks. here are today's closing numbers, the dow jones dropped

nations security council to quickly deploy a security mission. strong waves are slamming the bay area coast right now. that is impressive. the video was shot just a few moments ago after half-moon bay. crashes sent foamy white water into the air and over people's heads standing by. it'll be a similar sight at south facing beaches. in san mateo county and in stinson and marin county. that's where ktvu's rob roth is to tell us why the surf is so high, rob. >> reporter: life guards here at stinson beach will be up in those stations keeping a close watch this busy labor day week end. take a look at the waves. some are coming in twice as big as they were yesterday.

the national weather service called these waves powerful southerly swells and they are striking at south facing beaches including stinson. those swells are expected to reach three to 6 feet. >> if they're body surfing they could go over the wave, hit the bottom, get some injuries that way. get stuck outside and you know, afraid to come back in. many things can happen. >> reporter: park rangers expect big crowds here at stinson this weekend and advise parents to keep a close eye on their children. the waves are crashing harder than usual. this father won't let his little ones going in too far. >> i'm scared in the kiddy pool in the backyard. >> we wait a long time to get swells like these. you know everyone who's been waiting for it is on the look out at where to go. >> reporter: never turning your

back on the ocean. larger swells washing up might catch you by surprise. >> reporter: and we're back live, park rangers say the beach will stay open and people are encouraged to come but just to be careful. now the national weather service says swells are expected to peak tomorrow evening and subside by sunday evening. reporting live on stinson beach, rob roth, ktvu. our chief meteorologist bill martin knows that area very well. tell us what do you see right there? >> number one, this is unusual swell. it's coming from the south, it's a souther hemisphere swell. the waves are moving from many thousands of miles away. not 2,000 or 3,000 miles away. big swells coming from the south in this direction from 60,000 miles away. in some of these cases 20 feet

from the swell. gets real flat. looks like a leg. it was flat then the sets will come in. there were 10 feet swells today. you bring a big swell in that way, then with eight or 10-foot set and the water washing up on the cliff it was very dangerous for people entering. even surfers coming in and out of the water. i had to paddle to get into the water. the other thing rob's report is, the swells. i think it's peaking right now. some of the biggest sets in the last couple of hour, the swell will still be big tomorrow. but i think the swell is peaking out tonight. then it's going to gradually stay medium to light tomorrow. dangerous conditions right through the evening. stinson beach, santa cruz, the jetty and half-moon bay. we're going to have your

weather forecast. include some warming at the coast which of course is also dangerous. the coast guard ended its search for an orange county man who was swept into the ocean yesterday. it's another reminder that while the huge waves are something for people to look at they are also very dangerous. some waves will be 20 feet. in new port beach the waves are drawing big crowds and of course a lot of surfers. about 370 people have had to be helped or rescued in hawaii. some of the waves there are hitting about 15 feet high. there's a high surf warning for the south and west facing surf of all the hawaii islands. only experienced surfers should be out in the water. why victims will have to wait on crucial decisions on how and when the court will

what was supposed to be a step forward in the resolution of the aftermath of the san bruno pipeline explosion today turned into a delay. a judge put off the decision on if and when the victim's cases will go to trial. >> this redwood city courthouse was the setting today for a hearing on the san bruno pipeline explosion. >> the most important thing this court can do is set a file date. >> reporter: more than 30

victims of that disaster have filed suit. pg & e favors consolidating the cases when the liability issue is decided followed by mediation on a case by case basis for damages. consolidating the cases could lead to a lengthy trial. mediation would hide information the public should know about. >> how could an organization like this allow this travesy to happen. and at the same time paying themselves bonuses and approving parachutes? how does that happen? >> reporter: the national transportation safety board said the company is to blame for the pipeline blast that killed eight people and

destroyed dozens of homes. the ntsb also criticized pg & e for shotty recordkeeping. to this day investigators don't know where the faulty pipeline came from. late this afternoon i spoke to a pg & e spokesperson. both sides this in case will meet again september 22nd. that's when the judge expects to set a trial date. a suicidal man caused a deadly multi vehicle pile up monday in napa county. the crash was on highway 12 near kelly road. 53-year-old thomas robinson of napa intentionally swerved his ford escort into an oncoming big rig. thompson was killed in the crash. they based their conclusion on

witness statements and notes found at robinson's home. clean up efforts are on the way tonight in the wake of hurricane irene. and there are signs that life is returning to normal. this little lam was born just before the hurricane hit. it survived the storm and staffers named it irene hope. there were also signs of recovery in vermont where the streets were dry today. inside people struggled to dig out of the muddy mess. parts of new jersey are still under a flood advisory and farmers are adding up some devastating losses. >> i had an opportunity to take a look at fields in north carolina. i've never seen anything like it. the corn was destroyed, tobacco hit hard, cotton hit hard. >> reporter: president obama is scheduled to tour the damaged area. the east coast is just beginning to recover from

hurricane irene. this is a satellite imagine of hurricane katia. it's the second atlantic hurricane of the season. so far forecasters have not predicted if or when katia will make landfall. but so far, companies have begun to pull out their workers off rig as a precaution. the water management district says pollution levels will be unhealthy. the combination of warmer temperatures and light winds will cause the poor air quality out there. people are advised -- are asked to reduce smog levels by car pooling or use mass transit. another option is work from home if possible. let's go now to our chief meteorologist bill martin for what's in store. >> definitely a warm up. it was warmer today. we have temperatures going into the low 90s. tomorrow a little warmer still,

that's why you have your spare the air day. i'm going to switch off the buoys and turn on the temperatures. temperatures right now running a few degrees warmer than they were at this time -- than yesterday. 68 in napa, that's kind of cool. the fog is not a big issue at the coast. we're going to see less fog as temperatures, -- there's some good temperatures there. it's like our storm tracker was not giving us good numbers. 87 at concord, 89 at livermore. current temperatures outside pretty warm to hot. temperatures tomorrow as these red 90s start to come our way. the winds are starting to come a little bit north and east. not a major classic heat wave offshore flow. enough though that the air quality district issues a spare the air day for tomorrow. that's them going, we're losing the on shore push of air. when you lose the on shore push you start to bring the heat to the coast. it's going to be a nice day

people who live in san jose and have unlicensed cats and dogs can register them with no penalty for the next six days. the city has launched an amnesty program that waves citations. anyone who renews a license will be entered in a drawing to win cash. the law requires san jose residents to license their cats and dogs. the san francisco pet shelter put out an s.o.s. today. their kennels are full with dogs. the math just didn't add up. care and control has 95 dog

kennels and 110 dogs in need of homes. officials say with the economic downturn and high unemployment many people can't afford their pets and are making the tough decision to give them up. right now they're asking those pet owners to try to keep them at least for a while. >> we're also asking people who are finding dogs, stray dogs, lost dogs to keep them at their home s if they can't safely and temporarily do that until we get over this space crunch. >> and if you happen to be looking for a dog animal care and control says this is a great time to pick up one of those fuzzy little critters. from now until september 12th, the shelter is cutting dog adoption fees in half. police are keeping a very close eye on another tree protest happening in berkeley at people's park. the man who calls himself moon shadow has been perched in a tree since sunday night. he says he's protesting the treatment of homeless people in the area and the proposal by local business to revitalize a

park who could propose a ban on unlicensed events. he says he will stay in the tree at least a week. >> they've cut down trees across the street. and i'm afraid that they're going to start cutting down trees here. they made a threat last november during an election that they wanted to build a museum and a soccer field here. >> police say that moon shadow is trespassing and may be sited. if you have a pet peeve or a good chance to champion the white house wants to hear from you. the obama administration unveiled an online service. it allows you to create and sign petitions. if you're petition pulls in 5,000 signatures within one month it'll get reviewed by white house staffers. they'll then send it on to white house experts and you will get an official response. to stay financially afloat some states choose to stay in boats. i'm tom vacar, low cost living

mortgages, a new trend is taking shape -- underwater. they're staying afloat financially by choosing to live on the water in a boat. tom vacar is here to explain why for many their boat is a lifesaver. >> reporter: for more and more people it's only their boat that keeps them afloat. >> i entertain my clients, i work out of here and i live out of here. >> reporter: greg sason has lived aboard the annie for the last decade here at san rafael's marina. >> this is my room. >> reporter: a divorced changed his living and financial conditions. >> it is less expensive than getting another house. and that was my decision. >> reporter: since his monthly dock rent is only $634. the great recessions losses have created many new live aboards. >> what we have seen is our phone rings a lot more. our waiting list is longer. and we have more people wanting

minnesota. bachmann approached the republican convention in wisconsin. she said america must treat its veterans with respect. >> ronald reagan worked to restore the economy. we need to have strong viable leadership. >> reporter: bachmann is expected to attend a labor day presidential forum in south carolina. the agenda calls for a number of gop candidates to appear. one of bachmann's opponents john huntsman laid out his idea for spurring job growth today. the former utah governor campaigned in manchester new hampshire today. huntsman said he would drastically scale back the scope of the federal government and simplify the tax code. then he called for a change in the political climate. >> people are sick and tired of side shows. they are sick and tired of the circus environment that is politics these days. they want substance. >> huntsman is on his six day campaign swing through new

before the report came out. there's a new app for teenage drivers. the app is part of the company's campaign to reduce accidents involving teenage drivers while texting. the centers for disease control says more children are receiving vaccinations for preventable diseases. the cdc found the rate of vaccination for children 19 to 25 months old has gone up from 90% in 2009 to 91.5% last year. that covers vaccinations for measles, mumps and rubella. 68.8% received a vaccination last year. the cdc reports that doctors are prescribing fewer antibiotics to children under 14. it's data shows that pediatric prescriptions for antibiotics have gone down 10% since the

building. that study released today estimates that san francisco drivers will be in an accident once ever 6.4 years. that is more often than drivers in many other cities in fact, that puts san francisco 185th on its best driver's list of the country's 200 largest cities. according to the report fort collins colorado and boise idaho have the safest drivers. all state says the list is not used to set rates. you might think that the nation's freeways and highways might be the most dangerous places to drive. but scott mcfarland says america's back roads have four times as many deadly accidents. >> reporter: you take the turn too fast. you look down at your cell phone. you cross the center line on the windy back roads there's sometimes less, or zero margin for error. the back roads in the bay area

are among the most dangerous in the country. 1,064 californians died last year not on highways, but on back roads. the nation's crash rate is downright frightening too. >> we're still looking at 32, 33,000 people a year who are killed on our roadways. >> that's too many. that's not success, that's progress. >> we were up over 40 just a year ago. >> but that's still too many. >> the nation's road builders want washington to approve hundreds of billions of the dollars in new construction projects. they say deteriorating back roads, bridges are so unsafe they're triggering some of these accidents and deaths. they say if the government invested in new signs, wider shoulders and perhaps some rumble strips on back roads, your next drive would be safer. but money right now is hard to come by.

>> this country is just a wall economic, we can't afford to have any sacred cows. we need to somehow pair it down. >> reporter: all these bay area numbers come from this report from the transportation research group. one other here worth mentioning. one out of 10 roads driven are the smaller roads not freeways. scott mcfarlane, 12 news. thieves at a car crash helped themselves to bags of marijuana this morning. a white 1992 toyota pickup truck crashed at the intersection of playa del rey. the driver ran away leaving onlookers to steal bags of pot.

a handgun was recovered from the scene. no other vehicles were reported in the crash. and we're going to julie haener with stories we're working on for ktvu news at 6:00. take a look at this, the newest great white shark at the monterey aquarium is also the smallest. the key tests they're doing now to see how long the shark will be on display. the newest member of the california supreme court reports on the family history that brought him to this day. these stories and much more coming up in about 10 minutes. safety nets are being installed inside the national cathedral in washington, d.c. it's a precaution to protect people after damage from last week's 5.8 earthquake. the cathedral central tower was damaged sending debris down on to the roof. other areas inside were cracked but officials say overall the church's structure is sound. the cathedral will reopen to the public on the weekend of

september 11. napa valley vineyards are expecting lower yields. the harvest usually starts in september but the napa valley grape growers association tells ktvu news this afternoon it won't reach full swing until october. this spring's rain and low temperatures could lead to 1/3 fewer grapes being harvested than in an average year. wine makers are keeping grapes on their vines longer so they can soak up more sunshine before being harvested. the baby giraff met a real baby giraff. in a double play officials named that little calf. that little giraff is named brandon. and of course brandon is known as the baby giraff. >> it's an interesting bit of

information or bit of weather and wave stuff outside. we'll go to live storm tracker 2. here's the golden gate bridge. talk about those south swells. you know the head lands are going to get wacked pretty good. especially in this area if you're out by point benita. when the tide starts to swing. if you're near the south tower, you're going to see waves here that could easily be eight, 10 feet high right at the bridge. it's on a high tide not a low tide. if you're boating around just be prepared for that. that south swell impacting lots of coastal areas. even four points. the fog is getting peeled away from the coast. you're looking at sunshine in the avenues right now. more sun tomorrow, tomorrow will be the warmest day of the week. fire danger comes up. air quality we talked about it, it's a spare the air day. with that said the thing i

worry about as the fog clears from the coast, 750,000 people live out here in the san francisco area. if you all run to ocean beach or baker beach, you be careful. the rough currents are nasty out there because of the south swell. there's a lot of water moving. if you go out there you will see swells from south to right. the guards out there will tell you try to stay out of the water if you can. forecast highs for your friday, boy this week flew by as you go into your bay area weekend, still warm but not as warm as these. forecast highs along the coast, 70 in pacifica, that's why i'm a little worried right. be careful as you go out to the beaches. we showed you, gosh el granada there at the jetty. that really picks up the south swell. there's your five day forecast with your weekend in view.
