tropical storm lee comes on shore raising fears. >> and just days before the 10th anniversary of 9/11 a new warning about threat from small planes. >> complete bay area news coverage starts right now. this is ktvu channel 2news at five. >> good evening. i'm ken wayne. >> i'm heather holmes. an eight hourlong standoff between a gunman and deputies came to an end this morning when authorities found the man dead. it started with a domestic disturbance at an apartment on the 4300 block of san pablo road around 7:00. deputies say the man barricade himself inside the unit with his wife and three children, a half hour later he let them go. over the next several hours negotiators tried to convince him to give up and at 3:15 this morning they went in and found the 43-year-old suspect dead inside.

his name and cause of death have not been released. >> the police are investigating an accident where a driver was struck and killed standing outside a car. it happened just before 3:00 on westbound interstate 80. it's not clear why the victim stepped outside the car. the two right lanes the freeway were blocked for about two hours while officers investigated. we are getting new information on an arrest in a shooting in east oakland yesterday. police now say they have a possible suspect in custody in the case. the 25-year-old shooting victim was found at 73rd avenue with several gun shot wounds just before 4:00 a.m. he is in critical condition. investigators say the gun fire was apparently sparked by an argument a few hours earlier. >> police are looking for a man who tried to kidnap a woman early yesterday. authorities say the 23-year-old was walking on water street near east washington when the man approached told her to come

with him. the woman refused and that's when he grabbed her by the neck and then forced her to the ground. the woman fought back and ran away. police only have a vague description, a man in his 20s who was wearing a black shirt and jeans. downtown oakland tonight a celebration of gay pride. patty lee joins us from the event that's only in its second year but has already attracted tens of thousands of people. >> reporter: right now i'm live on franklin street in front of the international stage. it's one of four stages on this four block stretch. i talked to one of the oers and he said about 20,000 people have already come through the gates but the bingest draw, jennifer holiday is still an hour away and expected to bring a second surge of fans from the drums, to the strumming of

not constitutional. once that is decided the case will head back to federal court. >> a new twist tonight in the case of that missing i-phone prototype. it was reportedly lost in a mission district restaurant in july. apple investigators were able to track it to a home and they contacted san francisco police. according to the department officers provided back up and didn't enter the home. the man living there said officials identified themselves as sfpd so he let them into search. they failed to find the phone. turns out the officials were apple investigators and the man said had he known they worked for apple he wouldn't have let them in. >> today the president promised that the federal government will help those who lost homes and property to hurricane irene. the president visited pattern son new jersey. he appeared to refer to some

of lee continues with a live report from new orleans. we will take a look at how the gulf coast area is dealing this heavy rain. that story coming up. >> mark joins us now with more on lee and what is in store for the gulf coast over the next few hours. >> reporter: this is normally the time of year the tropics do at least increase in activity and right now i'm tracking multiple storms there. is katia on the right portion of the screen. we will watch that, right now a hurricane as i said but there is lee the center of circulation closing in on louisiana, baton rouge and there is -- see all the swirls pushing in to the area with the moderate to heavy rainfall, the thunderstorms and the potential for tornadoes. now winds at 40 miles an hour only move together north right around six miles an hour and that has always been the main problem with this system. you can pick out here is the forecast track. it's a monday morning and eventually on track into

2010. the army said he didn't contract it in new york state. it's investigating to find where and how he became ill. the highway patrol's maximum enforcement program is underway and the number of dui arrests are up. according to the chp officers statewide have arrested over a thousand people suspected of driving under the influence. that's up from last year's total of 980 for the same period. statewide there have been 11 traffic deaths up from eight last year. the maximum enforcement program runs through midnight monday. >> a flight to southern california was diverted after a passenger allegedly made a bomb threat. spirit airlines flight 245 was headed from las vegas to los angeles and turned around midflight. a male passenger made what sounded like suspicious comments to another passenger. when the plane landed all the passengers were taken off and the plane was searched.

no explosives were found. the man was arrested there at gate. the remaining passengers were rescreened then boarded a new flight. the tsa is using new technology to look for suspicious items. after getting a lot of complaints about the full body scanners revealing to much new software has been put in that only reveals the contour of a body. officials say it's a more modest scan that still provides detailed targeting. >> the advantage is it enhances privacy. >> i don't feel like i'm showing everything to everybody. >> reporter: the updated scanning system is being used in baltimore, memphis and washington. >> we are learning that the research lab where a sciencist died in an explosion friday

the cahone pass. it's now 80% contained. it broke out friday in the center divide of interstate 15. since then more than 1100 acres have burned. it's now open and all of those evacuation orders have been lifted. full containment is expected tomorrow evening. dangerous weather forced the evacuation of notre dame's football stadium. both teams and more than eight thousand fan has to leave the stadium twice after lightning struck close by and high winds whipped around the stands. fans had to take cover in buildings and under the stadium. notre dame ended up losing the game to south florida. >> hard to complain about overcast weather around here with stuff like that. >> we finally have warmer temperatures to talk about over the next few days, temperatures have been cooling off but will soon head the other direction. i can show you this, still that
