san jose has made a decision about how many medical marijuana dispensaries the city is going to allow. robert handa has just ran out of that meeting, robert how many pot clubs will there be. >> reporter: right now the number set is 10. yet they will change that number if they find they can control that number with policing. they decided to limit the number of clubs in san jose to 10. now the other two major issues they needed to resolve here were the what was going to happen in terms of the permit application process. in terms of how people will apply for their business licenses. now at this point, they have decided to go ahead with the first come first serve basis. which is something that the pot club owners didn't like. they felt that was too archaic.

but they will announce next month when they can place their application. and there were questions on whether pot clubs would be able to grow the marijuana plants on- site. and they said they were subject to raids. they can monitor how the marijuana is grown, where it goes and that it's sold legally. so for the three main points, they've decided to keep marijuana clubs in san jose, the number to 10. they will be required to grow their marijuana on-site. and the permit application process will be decided on a first come first serve basis. now this ordnance needs to come back for a second reading in a couple of weeks. they could make some changes at that point. but they will start implements parts of this ordnance soon.

and that will begin in late october. going into november with final regulations in place by the end of the year. we'll have more details tonight at 10:00 as well as reaction. robert handa is reports live in san jose. thank you. we're following other developing news in san jose. news chopper 2 is over the 600 block of sixth street. the suspicious device was foundeded in the home this afternoon as police were making an arrest. we are told that san jose firefighters are also standing by. we don't have any word of evacuations in this neighborhood at this point. we will stay on top of this developing news and bring you more information just as soon as we get it. authorities are offering more incentive tonight to help find a suspect. police are now offering a $30,000 reward for information leading to the arrest of aaron bassler. that reward has gone up from $17,000.

bassler is accused of shooting and killing council member jerry mellow while bassler was guarding a drug operation east of fort bragg. today oakland police announced four arrests. police say it was a tipster told them that the suspect bragged about killing florez. the surveillance you're looking at right here shows them running from the scene. torrez was shot and killed may 21st as he was gardening. investigators say the four arrested were out hunting for victims and robbed torrez of his i pod and gold necklace. the search continues at this hour for a teenager who escapeded from a juvenile detention facility in contra costa county. ktvu's paul chamber talked to the boy's mother after she received a phone call from her son. paul-- >> reporter: julie, i just checked with the mother. i literally just got offer the phone.

he says he gave her a call. he was at a local hospital getting stitched up because he needed stitches. then he got a little worried thinking police might close in on them and he took off. this wasn't the only two other escapes in the last two years. now three men, four men left from this facility last night. earlier today three of them were found at an antioch wal- mart. but there's still the one on the lose. >> if you found the other three, why haven't you found mine. >> reporter: tracy brown is talking about her son spencer. for the last few weeks he's lived in this teenage facility. part of his sentence was to spend six to nine months here but last night he escaped. >> about 8:30 in the evening we noticed that three more young men were missing. they were from two different buildings so they were noticed at two different times. >> reporter: due to budget

cuts, the adult to youth ratio is 15-1. >> maybe they've had one or two offenses, they are not serious offenses. >> if we see anybody loitering the neighborhood knows about it. i haven't heard anything. >> reporter: with spencer on the lose his mother and brother just want him to turn himself in. >> i just really hope that you will either come home so mom and i can take you back. or just go to the nearest police station. >> i'm just giving it to god and hoping for the best. but right now i just want him found. >> reporter: the young man just talked to his mom saying he was at a hospital. but he left the hospital. likely the four men will return to the facility, it's up to a judge to make that decision. thousands of female prisoners may qualify for a new program that will allow them to

finish their sentence close to home. it's for less serious offenders who have young children. if they qualify, the inmates must transfer into a substance abuse facility or other transitional housing. a st. mary's college sophomore is behind bars accused of raping another student in a dorm room. nicholas consaki was arrested. the victim reported the assault early that morning. the case has now been turned over to moraga police. prowlers were spotted in one neighborhood overnight. officers began a search about 1:30 this morning on garland drive near ross road. that's where residents say they saw two prowlers. police say the men took off running. officers and a police dog looked for those men for several hours but didn't find them. contra costa county is tackling a massive budget hole and they're doing it from the top down. eric rassmussen live in walnut

creek with what the county's top earnings earners are giving up and what's next. >> reporter: now some union employees including firefighters have already done the same thing. they say that it might be the only way to keep some fire stations such as this one here in walnut creek open. >> i think it's important for us to make a commitment to the community, make those sacrifices. >> reporter: contra costa chief makes about $93,000 a year but he could see his pay drop a couple of thousand dollars by january. >> all in favor of demotion please say aye. >> reporter: it's just part of what county supervisors approved. cutting salaries including some of contra costas highest paid leaders. county administrator twal will also see his salary dropped. he says it's designed to match

the sacrifices of some union workers including firefighters who have already agreed to 5% cuts. in all the nonunion pay cuts will save the county $2.6 million a year. combined with another 5 million in union salary cuts it's a savings of more than $8 million. >> it's cuts that really affects people. it's very difficult for people to take that kind of pay cut. and for lower people like we represent, we make very difficult choices. >> reporter: the county can't force elected officials to take a pay cut but these officials say they'll do it and they're asking other elected officials like the sheriff and d.a. to do the same. county administrator told me there's more cutting to be done but negotiations are still going on. he says with a lot of counties union employees. we're live here in walnut creek, eric rasmussen. tuition at uc schools may

be going down again. that means basic tuition could top $22,000 and that wouldn't include other fees, books and room and board. officials say such a hike is necessary to keep the quality of education high. but parents say it's asking too much. >> it is a huge burden and we're not sure how we're going to finance this at this point. we are looking at things like our 401k. do we stop contributing or do we pull money out. >> reporter: a decision is expected in november. a bay area university is among the nation's top colleges. u.s. news and world report ranks stanford number five in the list of this year's top colleges tied with several others including cal tech in southern california. harvard and princeton are tied at number one. the rankings are based on a number of criteria including students test scores, and peer evaluations. hundreds of students learned about their college options in vallejo today.

into a liquor store last night. three robbers went into three ring liquor. one robber pistol whipped the clerk and then ran off. another customer held the suspect until police arrived. the clerk suffered minor injuries. the families of two uc berkeley grads being held in iran say they are overjoyed. today the court ordered shane bauer and josh fattal to pay $500,000 each. that was the same amount paid by their friend sarah shourd. the family said it's a quote huge relief to read that they are going to be released. we hope to say more when they were finally more in our arms. the transportation secretary came to see the work at the new oakland control tower everyone though the

voters in california could soon text their support for political campaigns. the state's fair political contribution will allow donations by text. opponents say the new donations would be difficult to track. business software company taleo says it will soon be hiring more workers for its east bay headquarters. the company says it is expanding with new offices at the dublin cultural center. taleo makes software to help customers review and manage employees. cisco systems today lowered it's long term growth forecast. the company told analysts today that it expects sales to grow between five and 7% annually for the next three years. shares rose as analysts called the projection achievable even in this slow economy. wall street made modest

gains today, early trading bounced around. but corporate news led to steady gains. the dow was up 44 points, the nasdaq was up 37. biologists gave mother nature a helping hand in restoring the bay. it all happened at the eden landing ecological park this afternoon. >> two, one. >> reporter: eight levees will be broken filling salt ponds with bay water. it's a plan to restore tidal wetlands along the bay. today east actions will provide a wealth of habitat. >> we're basically bringing the landscape back so the tides can come back. the tides will be bringing in all the species that we expect are recolonize. >> officials say the project has also created 40 new jobs. and the state of california has a lot going on right now. right here we've got fog and

mild temperatures. but let's go south here toward santa barbara. we're looking at a flash flood warning for san louis obispo county. and those are for those thunderstorms you see lining the west of the sierra nevada. so we're missing out, there's your live picture. and there's the fog. that's sutro tower you know that. the fog is a little deeper so it's getting out over sutro tower. these are the highs from today. some places a little bit cooler. and highs tomorrow they're going to trend down a little bit more. so the changes i said very subtle as we go through the next couple of days. the high pressure weakens this low pressure takes up shop and temperatures trend down. this mechanism, this series of event the low comes in and temperatures drop have been going on, have been going on all summer and through the spring. that's where we stand now. these are subtle.

these aren't huge temperature drops so just subtle cooling as we go through the bay area thursday. and even into friday. as we look at the forecast for the fog it's back at the coast. there's dense areas especially right along the coast. there you see it. we show you the live picture. this model a little bit more aggressive. but bottom line we're going to see more fog tomorrow morning and hence a little bit further cooling. so as we go into tomorrow, this high pressure is setting up pretty nicely at least for the time being and we're looking at temperatures along the coast in the upper 50s and low 60s. forecast highs then for cities where you live or near where you live. it's 85 at livermore. a little cooler than today. air quality is good. fire danger not off the charts and it's just, steady as she goes if you will. summer around here can be hot, then it can be cold, then there can be thunderstorms. we have not seen these big swings, temperature swings, any

kind of swings really for the entire summer. definitely more of the same. there's your weekend always in view. you see it just cools off. it'll be a real nice weekend. fog is less and less each day as we go through fog. it's having trouble setting up. so there's a little less fog. we're getting close to the equinox. >> a san francisco appeal threw out a lawsuit. school officials in san diego county ordered math teacher bradley johnson to remove the banners that included phrases such as in god we trust. today the appeals court ruled against the claim saying he should not be expressing his personal views in a public classroom. coming up on bay area news at 7:00. high tech workers ditch the computer to rally outside of san francisco city hall. they say they're being unfairly evicted from their offices. what they plan to tell city leaders we'll have that story
