"mornings on 2" begins right now. well, good morning to you. welcome to "mornings on 2." i'm dave clark. >> i'm tori campbell. san jose police are investigating an overnight shooting. it all started because of a report of a stolen car. allie rasmus is live at the scene where there are still some unanswered questions. allie? >> reporter: exactly -- [ no audio ] >> reporter: we know there was some sort of confrontation that happened here on barington court. at some point police tried to pull over a car that had been

stolen. that stolen vehicle was a ford mustang. there were two men in the car. members of the santa clara county auto theft task force saw that mustang and the task force is made up of san jose and chp officers, they ran the license plate of that car, realized it had been reported stolen. when they tried to pull over the driver, a con fronttation broke -- confrontation broke out and two officers fired weapons. a man was shot. >> we don't have all of the details to provide a statement as to what led up to it investigators are processing the scene where this occurred. and also the officers involved in this are being questioned along with the suspects. >> reporter: now, the 31-year- old man is being treated at the hospital. we're told he has non-life- threatening injuries. the other person in the car, a 40-year-old man, was not injured and is being questioned by police.

the question investigators are trying to figure out this morning, i'm back out here, we've seen investigators go through vehicles. two questions they are trying to answer. what exactly prompted the officer foss shoot at the suspect and which officers struck the suspect, whether it was the san jose police officer or the chp officer, again, both agencies are part of the task force and they were working together when they tried to pull over this car this morning. allie rasmus, ktvu channel 2 news. >> thank you. 7:02. we're learning new information about a hayward shooting that sent one man to the hospital with life-threatening injuries. it happened just before 8:00 last night on newhall street near huntman avenue. hayward police now say two 20- year-old men were fighting for an unknown reason. investigators say family members tried unsuccessfully to break up the fight. that's when one of the men went inside his home, got a shot gun

and then fired on the other man. police arrested the suspect about an hour later. sheriff's deputies say 22- year-old billy nare and 18-year- old jessica pagan left the redwood place mental rehabilitation center on wednesday on a 340-minute pass but they -- on a 30-minute pass but they never came back. both left the facility without their meditation. starting today, a new healthy happy meal is coming out from mcdonald's. the new version includes less fries and more fruits. >> reporter: good morning.

justice department lawsuit blocking at&t's proposed acquisition of t-mobile. the justice department filed a lawsuit blocking the $39 billion deal saying it would hurt competition in the wireless market. but this group of democratic house members said the merger would create 55,000 to 100,000 new jobs in the u.s. consumer groups have argued the opposite, that the merger would actually cost jobs and hurt consumers. >> consumers all across the country, don't want higher prices, >> reporter: the group "free press" reports that ten of them have collectively received about $500,000 in campaign funds from at&t. reporting live from washington, d.c., alison burns, ktvu channel 2 news. >> all right, thank you.

7:16. defense secretary leon panetta says unemployment nationwide could jump 1% if the pentagon is cut more than a trillion dollars. those cuts would take effect automatically if they can't agree on the cuts by november 23rd or if congress rejects the committee's plan. if that happens, the defense budget would automatically be cut $1 trillion. supporters of wikileaks are being auctioned on e bare. among the items, a bag of coffee that wikileaks' founder said he smuggled out of a london prison where he was jailed ten days back in december of last year.

a norwegian cruise ship is in danger of captising. video shows thick, black smoke pouring from the ship yesterday. two crewmen were killed and hundreds of passengers were forced to evacuate. the ship is tilting at an angle. salvage crews are pumping water from the ship. they say the fire started in the engine room but it's still unclear what caused it. concerns that plans to reconfigure the delta may end up threatening the --

east bay everything okay ut it's -- east bay, everything okay there? >> the east bay is okay. things are moving along on highway 4. it's just a little lighter than usual as you drive through the area. the 101, san mateo and also getting over to the east bay in hayward, you can see both -- i just moved the maps so you can see both at the same time, i would say hayward, south interstate 880 is busy from 238 on dune to -- on dune to union city. sun for some already but there is a lot of low clouds out there. not sold out on the coast. but there's plenty of gray to go around.

it this all comes after they fired carol bartz. a $5 miami class action lawsuit has been filed on behalf of a benicia woman. it's over the kona blend coffee. the suit claims safeway profited off the reputation and sold coffee with very little kona coffee in it. leaders of union baptist church in vallejo are on alert after two thefts in three weeks. church leaders are worried that the thief or thieves are planning to return.

an elite group of firefighters now in minnesota helping to battle one of that state's largest wildfires in their history. teams of professional u.s. forest service firefighters from arizona and new mexico, they arrived yesterday. they are gonna work alongside minnesota firefighters trying to get the upper hand on a fire that's burned more than 100,000 acres. it was sparked by lightning almost a month ago.
