the remains discovered over the weekend and late yesterday evening they confirmed those remains did in fact belong to missing nursing student michelle le. today a forensic pathologist will work to find out the exact cause of death. she was taking a nursing class and left during a break and never returned and in the weeks that followed her family organized eight searches over the weekend and it was during one of those searches they found a body in the miles canyon area. that was in an unincorporated part of pleasantton. the volunteer who found those remains is the mother of a murdered teenager. she was abducted back in 2009. this weekend she was in the bay area to help with the search for michelle le. she was leading a search group and she was the first to

discover those remains. now again those remains were positively confirmed as belonging to missing nursing student michelle le. her family asked for privacy during this difficult time and her family also said they would let us know about plans for a public vigil for michelle le. live in oakland, allie rasmus ktvu channel 2 news. well the woman accused of killing michelle le will be back in court next week. 27-year-old giselle esteban was in court yesterday but did not enter a plea. it was postponed until she is officially assigned an attorney. now the lawyer representing giselle esteban's proceedings would only say the seven month pregnant defendant is quote, coping. antioch police are investigating the mysterious death of a pedestrian. investigators say a man in his 60s was killed while walking on to lone tree way 9:30 last night. they are still interviewing

>> now the second teenage victim survived the attack and police are still searching for suspects. they say there is no information suggesting the teenage victims were involved with gangs. san francisco police chief greg sir is defending the shooting of two innocent by standers in the north beach neighborhood. he addressed concerns of neighbors and business owners. officers opened fire on a suspected drug dealer. the suspect threatened officers but the gunfire hit two innocent by standers instead. >> the officer was not intenting to -- intending to hit anybody but the suspect who was threatening his life and to that end, i am just thankful the by standers were not hurt anymore seriously than they were. >> 21-year-old jesus rodriguez is now facing assault weapons and narcotics charges.

it included a homicide and he is due to appear in court. castillo was arrested in west sacramento. he shot a man last friday in san jose at a gas station. a short time later he kidnapped cindy went. her body was found and when leaves behind three children. a candlelight vigil is planned for her. he is scheduled to die by lethal injection tomorrow. coming up why some say his ex- execution should be stopped. back here in san jose, 11 people are homeless after a large fire swept through their apartment complex. firefighters rushed through a home in japan town at 4:30 yesterday. you can see from this viewer's picture heavy smoke and flames were pouring from the attic.

training were in place. another setback for the uc berkeley graduates jailed in eye a ran. the lawyer for shane bauer and josh fattal tried to get the judge's signature on paperwork but was told on friday judge would not be back until today. court officials tell them the judge has not returned yet. still not clear when he will be back, josh fattal and shane bauer are accused of being spice and crossing into iran illegally. shane bauer and josh fattal deny any wrongdoing. a diplomatic campaign is underway in new york. palestinians are trying to regain full membership. mahmoud ahmadinejad is leading the charge and today he will meet with french president nicolas sarkozy to try and gather support, however united states is promising to veto membership until they resume

explosion and 38 homes were destroyed. the owners have agreed to pay $44 million to settle all claims tied to that disaster. that huge oil spill in november 2007 polluted the san francisco bay and killed thousands of birds and fish. the record-breaking settlement was announced and is designed to send a clear message to would be polluters. >> for those who will poll out our environment has happened here in the bay and there is a price to pay. they will be held accountable. >> the money will be used to repair the environment damage that still exists in the bay. four-years after that spill and they will be used to reimburse the many government agencies that responded to the disaster. right now it is 4:40, we will go back to sal and up notice there were still lanes closed for construction and paving.

dead, 17 remain in the hospital and we understand two people are still unaccounted for. among the dead, the man flying the airplane that crashed friday afternoon. two marines were killed in a helicopter crash in camp pendleton. it sparked a brush fire on the base near the community of fall brook. the two marines died at the scene. their names have not been released and the cause of the crash is still under review. in the meantime the brush fire is 80% contained and has burned 20%. it burned out on its own and it started yesterday morning at valley organ knicks. crews are not attacking the

fire. >> it will take hundreds of thousands of gallons of water to put it out. the health of the company burned out into ash. >> he says the compost pile could burn down between three and five days, in the meantime they have issued an air alert for today through thursday. today a death row inmate in georgia could find out whether a last minute appeal will spare his life. troy davis was found guilty of murdering a police officer in 1991 and since then many witnesses have backed off on their testimony. davis is scheduled to die by lethal injection tomorrow. demonstrators urged the board not to move forward and others urged the boards to move forward with the execution. >> some say he is a victim, we
