another innocent victim hit by a stray bullet. this time it's a 5-year-old walking on the sidewalk with her dad. good evening i'm gasia mikaelian in for julie haener. >> and i'm frank somerville. tonight san francisco police say they have surveillance visit yes that may help them track -- surveillance video that may help them track down who shot a 5-year-old walking with her father. the dad heard gunfire and then realized that his daughter had been wounded. heather holmes live and tells us this shooting may have stemmed from a water balloon fight. >> reporter: yes frank that's right. a fight that clearly got way out of hand. tonight that little girl caught in the cross fire is here at the hospital. she is being treated for a gunshot wound to her left knee. the good news though she is stable and expected to survive. the trip home for the bay view father and daughter took a frightening and unexpected

turn. as the two walked the street, gunfire. >> he noticed his 5-year-old daughter fall to the ground. at first he thought she just may have fallen, tripped or something like that. then he noticed she was shot in the knee. >> reporter: police say the father picked up his injured daughter, walked with her for a few blocks until he saw police. this man says he feared for him life. >> when i saw them shooting i went into a store. trying to take cover. when we came out, we saw everybody running and the little girl on the ground. >> reporter: this shooting stemmed from a balloon fight that stem into gunfire. one had a reinvolver the other a semi automatic weapon. >> he said be careful coming home because that was right by your house. >> reporter: police tonight are

calling on witnesses to help them catch the gunman. >> it's really important to come forward because we cannot have kids being shot walking down the street. >> reporter: police have in their possession tonight footage from surveillance camera. they are combing through it right now hoping that it will help them identify those responsible for this shooting that injured an innocent little girl. reporting live tonight here in san francisco, i'm healther holmes, ktvu channel 2 news. police in hayward are investigating a shooting in a hotel that left a woman seriously injured this afternoon. it happened on eighth street. initial reports indicate the woman was in a hall way when she was shot. there's no word on whether the woman was at the hotel, whether she was a guest or employee, police aren't saying much else and right now we have no indications that any arrests have been made. the medical coroner has identified the body of michelle le and is working to determine how the nursing student died. today ktvu news spoke with the

woman who discovered the remains. it was saturday a volunteer searchered from san diego discovered le's body in a remote canyon in senol. mcconnel says she knows what uncertainty is like. her own daughter was raped and killed. her body was not found for a year. >> it's some sort of closure. you never completely get through it but it's some closure. >> reporter: le aoerbgs family is planning a memorial for her -- le's family is planning a memorial for her to say goodbye. parties are being held across the country tonight to celebrate the end of don't ask don't tell the military policy prohibiting gays from serving

openly in the military. vets gathered. it swept a wave of emotion for many gays and lesbians who have served. >> reporter: it was an emotional morning for gay and lesbian veterans celebrating the end of the don't ask don't tell era. former u.s. navy commander zoe dunning came out 18 years ago, she was the nation's only active openly gay service member. >> what's so exciting about this morning when i woke up is knowing that i no longer have to be a spokesperson for those who are serving. they can speak out for themselves, they can tell their personal stories. >> reporter: gay and lesbian vets talked to us about the pain of serving under don't ask

military closer to equality. the admiral called the repeal a matter of integrity. >> we are stronger joint force, a more tolerant joint force, a force of more character and more honor. >> reporter: the pentagon says 97% of the members of the military have received education of implementation of the new policy. >> a rally at the castro activists called for more changes in the future. it's members say an equality still exists because the defense of marriage acts still stands. doma defies marriage between a man and a woman. get equal says that the military still bars transgender people from serving and that needs to be changed. a ceremony intended to help

the healing was held. one by one those who lived in the area stepped up to scoop a shovel full of dirt into the crater on glen view drive. neighbors say today's event offered the community a chance to come together and remember those who died. >> it was an awful experience, we were hoping that this is part of the healing process. to kind of close up the hole and maybe look for a better life in the future. >> reporter: lawmakers who were on hand today rededicated themselves to improve pipeline inspection. now to the south bay where an elderly man unwillingly paid tens of thousands of dollars to rent a mailbox. the owner of a mailbox service in sunny valle is accused of charging him and authorities wonder if there may be others.

make cuts to be more efficient. both hospitals have hired replacement nurses to work during the strike. families are coming together to help the family of a 13-year-old girl who died of a heart attack: maria castro's family held a car wash. castro suffered a heart attack and died saturday night. she had recently got out of the hospital after she was hit by a car on her way to school two weeks ago. ktvu spoke to castro's best friend who says today's efforts are not in vain. >> i think she would come out here and do the same thing we're doing for her. what we're doing for her, will help her pass on to a better place. we're all doing this for her. >> reporter: money collected will help pay for her funeral costs. more heat in the inland bay city, i'll show you which cities will get into the 90s.

what was unveiled about the plan tonight and why some residents are concerned. gasia, we're in front of the new neimam marcus that's slated to open march of next year. the plaza's owner wants to expand the shopping center up to 300,000 square feet, roughly three times the size of this neiman marcus. broadway plaza sits on 5,000 acres. santa monica says it's time to look for the future. >> we trust the community and we're looking forward to starting a process with them today. >> reporter: may bridge officials tell us they do not have a master plan yet but want to expand within the current property. some walnut creek residents question the need. >> i'm really not in favor of expanding. >> reporter: why not? >> i don't know i just like it just the way it is. >> there's plenty of opportunities for residents to weigh in on the process as we move forward.

are demanding that the district keep a school open. parents from kaiser elementary school showed up at a district meeting tonight. the district says that kaiser has the fewest number of children from the neighborhood attending there. but the parents argue that the school is at full capacity and has a diverse population. >> we have one of the highest scores in the district. we're doing very well. >> there are eight schools on the closure list. this friday the superintendent is expected to make his recommendations on which schools to close. the school board is then expected to make a final decision in late october. a new development tonight in the effort to turn clayton valley high school into a charter school. one week ago we told you the mount diablo school board is planning to open charters but

with conditions. they hope to get changes made in a meeting. -- is considering filing a lawsuit against the city. the san rafael city council voted unanimously last night to allow the team to play. a final vote on the matter is scheduled in two weeks. the opponents of the plan say the city needs to conduct an environmental study before making any changes. an update now on a story we first brought you a couple of weeks ago. tonight a little girl has a new custom walker thanks to some ktvu viewers. rita williams tells us how it all began with a crime, but then the little girl's spirits touched two people she didn't even know. >> reporter: with this heartfelt act of kindness today. >> can we remember? >> reporter: good triumpt over evil. >> say thank you mr. wisebart.

crash that some viewers may find difficult to watch. it shows that world war ii era airplane making a loop before slamming right into the ground and then disintegrating. the video was taken by a spectator and provides the best view yet. investigators say it's likely the pilot blacked out before the crash because of the gravitational force. preparations are already under way for an air show in weekend in salinas. officials there say they will probably have to answer more questions because of what happened in reno. but there's a key difference between an air race and an air show. >> reporter: perkins flies this training jet in several air shows every year. >> this airplane is built like a tractor. >> reporter: he even trained pilot jimmy leeward in it in

when the judge shows up. a san francisco woman is in jail tonight accused of murder just days after she stabbed a man who she said broke into her home and tried to choke her. the stabbing happened at the woman's home on kirk view avenue in the bay view sunday morning. police are not releasing any details about the arrest or investigation. but they have identified the woman as athena worthem. the victim has been identified as payne. investigators are trying to determine if the two had been in some kind of relationship. now a look at wall street. analysts are expecting the federal reserve to introduce a new plan. oracle announced their earnings grew in the third

officials officials tonight are trying to figure out what caused an explosion. that rig is still burning tonight. about a dozen workers were on the rig just before the blast but authorities say a warning allowed them time to escape. no one was hurt. but evacuations are still in place for several homes in that area. we have new information tonight about a crime spree in san jose that included a homicide. as we first reported last weekend, paul castillo is facing charges for kidnapping and killing 60-year-old cindy wynn. tonight police say they raided the tree house marijuana collective in san jose in connection with the crimes. police say it appears at least two people at that collective aided castillo but authorities would not release any further details. castillo is said to be arraigned tomorrow. don't expect to hear much

from top executives from solyndra. their executives are being called to capitol hill to testify after receiving $500 million in loan guarantees. today the executives send word that they plan to invoke their fifth amendment right. in news of the world tonight, in afghanistan a suicide bomber today killed the former afghan president. he had been leading efforts to reach peace with insurgents. the bomber posed as a taliban peace envoy and hid the explosive under his turban. libyan's new leaders say they wanted to assure the world that they intend to uphold the principals of peace and security. the leaders also met with

president obama to discuss libya's path forward. in the meantime gadhafi and his troops are still fighting rebels. and in japan, more than 1 million people in the central part of the country have been told to evacuate ahead of a powerful typhoon. the storm is expected to hit in the next several hours. there's already been a lot of wind and rain and so far four people are dead or missing. forecasters also say that typhoon will pass near the damaged fukushima nuclear reactor. federal transit funding is on the chopping block. that has bay area transportation leaders concerned. a bill in congress would reduce funding for transit systems nationwide by 1/3. officials are publicizing what those cuts would mean. they tell us the cuts would reduce service. delay the are replacement of 30 caltrans vehicles as well as delay the replacement of buses. some airlines are taking their baggage fees to a whole

satellite falling to earth. the sand has all but slipped to the bottom of the hourglass. tim lincecum, kershaw match up. lincecum has faced kershaw four times this year. when this fly ball touched out by lincecum. you knew it was going to be a tough night. jerry sands made it 2-0. stayed that way until the eighth for just this third time this year. stewart went deep. it was 2-1. john put two runners on with one out. he got carlos beltran looking the rally dies. then to the ninth after the giants put a runner on. kershaw wins his 20th in the process. the giants need help, they need it fast.

they did get some tonight in arizona where the pirates were winners over the diamondbacks. the giants began the day 3.5 games behind the wild card. the braves shut out florida 4- 0. cardinals also in the wild card race were winners over the mets. the texas rangers are close to wrapping things up. texas taking it out on the a's. a night which the a's have signed bob melvin to be their new manager for the next season. adrian beltran to the deepest part of the ballpark. 3-0 as the rangers go on to get 14 hits off 5a's pitchers. texas now five games up.
