fremont to capitol hill. two egg executives on the hot seat -- two executives on the hot seat right now. what a local minister plans to do to catch more criminals in the act. a surprising morning after the dow plunged. mornings on 2 begins right now. good morning you to. welcome to mornings on 2. it's friday, september 23. we begin with developing news from san jose. an early morning standoff with an armed man at a denny's restaurant is now over. paul chambers is live in san jose to let us know how this all started. good morning, paul. >> reporter: good morning. we just got here on scene. i can tell you here behind me, this is the restaurant. this is the denny's that was located with the situation. it appears that everything is clear. it was about an hour ago that

police negotiators were able to get the man out and to leave the denny's restaurant. we can take a look at some video we shot from our chopper this morning. it appears right now there are people inside but police say around 4:45 this morning, a man walked into the restaurant believed to be armed with weapons, possibly a knife and a gun. police say the man demanded all the workers and people inside the restaurant to leave. he then lowered all the shades and it's believed he was going to harm himself but police were able to successfully get him to leave without incident. that happened about 6:09 this morning. we can come back out here live once again. you can see the 145euds shades are back open. the restaurant is not open. i asked the manager if they're open. they said not right now. i tried to talk to the restaurant manager or some of 9 workers involved but as of right now we just got here on the scene. it is a clear situation. no one was harmed. the man was taken to a mental hospital for evaluation.

>> paul, thank you. our time is now 7:02. one local minister says if street lights were brighter, the streets of oakland would be safer. ktvu's craig debro is here to tell us about a new plan to reduce crime. >> reporter: the proponents after brighter oakland city want to make changes to a city ordinance in order to better fight crime. the idea came out of the true vine baptist church over there or true vine ministries. people we talked to there this morning say better lighting alone won't solve all of oakland's crime problems, but there is a lot of room for improvement. >> the situation is pitiful. >> reporter: out here is west grant avenue and market street. minister zachary kerry wants to make changes in east oakland too. right now a local ordinance regulates the intensity of street lighting. he wants to have exemptions for that ordinance in east and west oakland. in other words, he wants to be able to have stronger street

lights in east and west oakland he believes -- he believes that more lighting there is, the less likely that criminals are going to commit crime. opponents of the order any nantz as it is -- ordinance as it is written now say energy conservation aside, the dim bulbs are giving crooks a chance to commit crime. >> if a crime is committed in -- and there's no lighting, everybody can get away. but if we have lighting, people don't respect lighting. >> as long as they're in the light, they are subject not to do as much crime. crime, you know, is done in the dark. >> reporter: this isn't their first foray into crime fighting. back a september 17, true vine ministries, they held a march in oakland. about 3,000 people showed up. in addition to better lighting, they want more cooperation on

regulating illegal guns and guns that are used to commit crimes. they're trying everything they can. they say they have split cool support. i talked to -- political support. i talked to people this morning. they're getting positive reaction right now. it hasn't led to a change in the ordinance but they're pushing for that. reporting live in oakland, craig debro, ktvu channel 2 news. a new report says oakland remains one of the most dangerous cities in america. f.b.i. statistics show there were 15 violent crimes for every 1,000 people last year. that's the most of any bay area city. emeryville was number two with 12. the f.b.i. is blaming much of the crime on violent street gangs as well as drug dealings. it is 7:04. we now have a sketch of a suspect who police say tried to kidnap a girl in south san francisco.

he grabbed the 11-year-old girl near a middle school but the girl was able to break free. police say the attacker was wearing an orange hat with the letter "t." he has a piercing in his right ear and two piercings on the left side of his neck. a heads up for hikers near stanford. there are reports that thieves broke in and burglarized six cars. it happened yesterday morning while people were hiking along trails near stanford's radio telescope antenna called the dish. one of the people's whose car was broken into said several laptops were stolen along with hiez wife's -- his wife's purse, passport, keys and at least $1,000 in cash. time 7:05. happening right now in washington, d.c., two top executives from freemont based solyndra on the house seat testifying before a house committee on capitol hill. these are live pictures you're looking at. they're there before the

congressional panel. the chief executive officer brian harrison is appearing today along with other members of the staff. they're not answering any questions. instead they're taking the fifth amendment. the house subcommittee is investigating possible wrongdoing relating to a $528 million federal loan. one of the toughest questions came just about 15 minutes ago. oklahoma congressman john sullivan asked the c.e.o. brian harrison about a meeting they had in july weeks before solyndra went bankrupt. >> i guess a lot can change in five weeks. in our meeting you lied to me about the financial health of your company because just five weeks later your company was bankrupt. what happened? >> make sure you stay with us here on ktv mornings on 2. coming up at 7:45, we'll take you live to our washington, d.c. newsroom. we'll get an update on this morning's hearings. chief financial officer

w.j. stover is no stranger to controversy. the bay citizen is reporting this morning he also served as cfo at micron technologies between 1994 and 2007. that was -- the tenure came at the same time as an investigation into a price fixing scheme with four other computer chip companies. only one micron employee ever went to jail. it's 7:07. tonight there will be a candlelight vigil for a prominent women from campbell who was killed in a violent crime spree. family and friends will gather at the plant mall, the same shopping center where she was carjacked and kidnapped one week ago today. her body was found the next day. the suspect 33-year-old paul castillo is in custody accused of shooting and wounding a man during a robbery attempt at a gas station. time 7:07. let's check in with sal. you've been busy record this morning. >> i have been busy.

this morning's commute has been -- in some areas it's been lighter but in other areas certainly not. let's go out and take a look at some of the pictures now. 680 southbound getting slow traffic as we head south. no major problems heading to that area. we did have a minor accident nearby but it has been removed. also this morning's commute is looking good on 880 so far coming from san leandro on the left toward oakland. and you can see that traffic at the toll plaza is backed up for at least a 10-minute wait. let's go to steve. thank you. some interesting clouds drifting up from southern california. it makes for a beautiful sunrise on this first day of fall. happy friday, everybody. feels more like summer, doesn't it? especially away from the coast. actualactually by the coast. the story today might be some of these tropical clouds with rain already in southern california and along the central california coast. some of that cinching -- that is inches northward and bears

watching. already happening this time in the morning tells me there's a lot of energy there associated with this low. it should generally be a day and a half and then will get bumped inland and that will take care of it. then we'll have to focus our attention on a cold front, the first cold front of the season that will be in here sunday. the lightning or high-based thunderstorms are possible santa cruz mountains south. if you don't get anything like that, will you get tropical feel so the humidity will go way up. it will be hot, muggy inland yet by the coast it will probably be foggy. if not foggy, clear, cool. because of the thunderstorms red flag warning out. you get maybe not so much in the way of rain but you get the lightning, low humidity and high temperatures that creates higher fire danger. again that's monterey county, son bonita county more than us. there's also a cold front stalled out in the gulf of alaska but it will start moving here soon.

50s, low to mid- to upper. cold front running into a lot of resistance. that's in the form of high pressure which also will scawsh some of the -- squash some of the fog. a lot of cold air coming out of alaska. it will modify itself by the time it arrives on sunday. it will bring dramatic changes in temperatures. today a wide variety. if you don't have the fog, it will be nice, mild. if you get the clouds, it will be very hot and humid. if you're stuck in the fog, it's cool. so 60s, 70s coast and bay. 80s as you move inland and 90s, mid- to upper to down right hot, kind of muggy far enough away from the coast up to vacaville, clear lake, maybe towards gilmore, morgan hill. muggy conditions. with your weekend in view saturday will be cooler as the fog gets a little enhancement. sunday partly sunny, mostly cloudy, cooler, possibly rain. tuesday warmer. >> thank you, steve. it is 7:10. stocks are mixed right now

after fears of a new recession caused international investors to continue to dump stocks overnight. wall street started the morning in negative territory. but financial stocks are leading the push there at 1% right now. industrials are also in strong shape. taking a live look at the big board, the dow had peeked in positive territory for a moment. right now it's done at 36. the nasdaq is up 5 and the s&p is up half a point. the g20 nations say they are committed to a strong and coordinated international response to boost the struggling global economy. they released that statement from south korea as global stock markets have plunged amid worries the world economy is heading back into recession. the g20 says the fragility of the financial system, market turbulence, weak economic growth and unacceptably high unemployment all need to be addressed. also new this morning, grease appears increasingly likely to default on its debt -- greece

welcome back. governor brown comes to san francisco. he'll be announcing plans for legislation to create jobs in california. the governor will appear at two events today. the first he'll be at gaps

corporate headquarters at 11:30 and then at pier 27 at 1:30 this afternoon. a federal judge gave the city of oakland a deadline of january to make changes to the police department. the reform -- [indiscernible] yesterday the judge criticized the oakland police department for failing to comply with a complete list of reforms. however, he stopped short of placing the department under federal control. an oakland -- oakland mayor told the judge he's committed to implementing those changes. it's 7157 this morning. the -- 7:15 this morning. the coroner's office will release its report of a shooting of an unarmed man in bay point. it's expected to provide critical and new information about the death of 24-year-old johnny achoa in march. investigators say both officers were in grave danger when he tried to speed away from a traffic stop. the sheriff's department says one deputy was briefly trapped

in the car after he tried to grab the keys from the ignition. the car then hit the other deputy. the man accused of changing a fake bomb to an australian teenager as part of an extortion attempt is being extradited back to australia today. 50-yard paul douglas peters has been held in a kentucky jail since his arrest in louisville last month. he introinto a millionaire's home and tape add fake bomb to the daughter's neck. no explosives were found. three men, including one from here in the bay area have been arrested charged with computer hacking. 23-year-old cody creten gur is one of the men. an ohio man and a man from mountain view, they were also arrested. all three have been charged in the hacking attacks on sony pictures entertainment and the san cruz county computer

servers. time 7:15. happening right now in washington, d.c., a congressional hearing is under way. lawmakers are looking into the shortage of life-saving medications all over the country. reportedly the shortage is so severe, people's lives are at stake. according to the associated press, at least 15 recent deaths are blamed on medication shortages. it is 7:17. a hayward soldier is back home this morning after spending the last nine months in iraq. 23-year-old army specialist don teegan was greeted by friends and family at the oakland airport last night. the army medic is home for two weeks and he hopes his next assignment will be to go to afghanistan. >> i want to get out there and help my guys out before we leave or anything like that. >> he says while at home he plans to sleep a lot and eat at his favorite thai restaurant. time 7:17. pakistan's foreign minister lashing out at the united states for accusing pakistan's

intelligence agency of supporting terror attacks on american troops in afghanistan. yesterday during congressional testimony, the chairman of the joint chiefs of staff admiral mike mullen said pakistan's intelligence agency played a direct role in supporting insurgents who carried out the deadly attack on the american embassy in kabul last week. pakistan's foreign minister condemned that allegation and warned the united states risk losing pakistan as an ally. the president of yemen is calling for a cease-fire after his surprise return to his country today. he has been in saudi arabia for the past three months. he's recovering from injuries he got in an attack on his presidential compound. protesters demanding the president's resignation have been clashing violently with government troops. it is 7:18. today the nba could announce the cancellation of the start of training camps and some exhibition games after talks to

end the lockout ended again without a deal. meanwhile nba players are making plans to play overseas. kobe bryant could be among them. the laker star has been offered $6.7 million to play basketball for an italian team. bryant helps to speak italian and in fact spent part of his childhood in italy while his father played basketball over there. the team is offering bryant some different contract options including a game-by-game deal. we will know tonight which oakland schools could close as part of a restructuring plan. the superintendent will make his recommendation on which of eight elementary schools will shut down. the school board will then review the recommendations at their board meeting on tuesday. a final decision on school closures will be made next month. happening right now, these are live pictures from the white house in washington, washington, d.c. where we are waiting for president obama to september the outline for an

educational plan that allows states to opt out of part of the no child left behind law. that would essentially end his predecessor's signature accountable measure which basically has defined public school life nationwide for nearly a decade. mr. obama plans to invite states that agree to overall low performing schools and adopt more rigorous teacher evaluations to apply for some relief from the bush era laws 2014 deadline to bringing all students to proficiency in reading and math n. is very important for education and an important change and again the president will be making that announcement shortly. we will continue to monitor that and bring it you to when he does start talking. time 7:20. we've been talking about the san francisco giants. can somebody help them? some are saying it looked like it's finally time to wait until next year. a winning lotto ticket unclaimed. where it was sold in the bay area and how much it's worth.

that countries who outeducate us today are going to outcompete us tomorrow. but today students are sliding against their piers around the -- their peers around the globe. today kids trail too many other countries in math, science, and reading. that's true, by the way, not just in inner city schools, not just among poor kids. even among what are considered our better off suburban schools we're lagging behind where we need to be. today as many as a quarter of our students aren't finishing high school. we have fallen to 16 in the proportion of young people with a college degree even though we know 60% of new jobs in the coming decades will require more than a high school diploma. what this means is if we're serious about building an

economy that lasts, an economy of which our work pays off with the opportunity for solid middle class jobs, we've got to get serious about education. we are going to have to pick up our games and raise our standards. we're in the midst of an ongoing enormous economic challenge. and i spent a lot of my time thinking immediately about how we could put folks back to work. and how we can stabilize the world financial markets and those things are all important but the economic challenges we face now are economic challenges that have been building for decades now. >> you've been watching president obama live at the white house. he is saying that to help states, districts and schools move forward with education reform, his administration will provide flexibility from the law of no child left behind in exchange for a real commitment to undertake change. he's also tying education to the ongoing unemployment

problems saying the two are directly connected. now, education secretary arnie duncan will provide details of the waiver process. that will be sent to state governments later today. the president of a nonpartisan research group center on education policy basically saying this is the beginning of the end of the no child era. president bush signed the no child law in 2002. it requires regular testing in reading and math. critics complain it's resulted in schools focus doing much time and energy on testing rather than educating children. so interesting to see how this will play out. the. saying we need to get serious about education, pick up our game, change our standards so this is his attempt to start that. our time 7:28. speaking of the president, he'll be becoming here to the bay area but we'll tell you what just happened that is very disturbing just before he gets here. we're live at the u.c. berkley campus where a second way of protests are planned.

day of uc berkley campus. police and students clashed yesterday. this could be just the beginning. >> reporter: that's right. we spoke to a protest organizer this morning and she said in less than three hours, students are once again expected here on campus. they're angry about tuition hikes. yesterday the protests started off peacefully but ended tummously. -- tumultuously. two people ended up getting arrest the. one had a scuffle with a police officer whose magazine clip went flying. police say the other protesters threw chunks of concrete and a chair. the protesters charged into the hall take take over the building. police ordered them out at 9:00 last night, this after nine hours of demonstrations. >> this confrontation with the police might distract from the real message the students want

how the newcomer managed to steal the show. a federal judge is expected to issue an injunction by monday against five suspected gang members in oakland. the order would prohibit them from congregating in parts of the fruitvale neighborhood. they would also be abandoned -- banned from carrying guns and meet a curfew. a hearing for the other 35 departments is scheduled in december. our time 17:35. -- is 7:35. the oakland mayor is firing back now, days after a city resident, one of her neighbors, complained that her front yard is a mess. that neighbor kenneth pratt went before city council tuesday. he claimed the mayor's home does not comply with the fire code because of overgrown vegetation. he also says the city selectively enforces code violations. however, the mayor says she is subject to the same rules as

everybody else. i'm saying no preferential treatment. we have all the fire inspections on record two years ago. they tell us to get rid of certain edges and certain trees and we did that. >> ktvu asked the assistant fire chief about the mayor's property and he told us her property has been in compliance. it 7:36. a six-ton satellite is expected to hit somewhere on earth today. reporter chris gutierrez is live in houston with when the impact may happen and where. chris? >> reporter: good morning. to be honest with you, your guess is as good as mine. nasa officials here at the johnson space center, there's this whole time of orbiter scientists that are looking at that right now. they're following this satellite with radars, thanks to the department of defense. but where and when this thing will land we still don't know at this hour. we'll probably know better when we get closer to the two-hour frame from two hours out or so. we do know thankfully that this

yeah. tonight the giants open a three- game series against the first place arizona diamondbacks. the numbers don't look good. the giants have six games left. they're six back in the division race, four behind in the wild card. the giants, though, refuse to give up. they've won nine of the last 11 games so it's not over till it's over. last year remember it came down to the very last game of the season for the giants to get in the playoffs. who knows. let's check in with sal. >> they were playing better last year although they could still do it. let's take a look at the commute. traffic is moving along okay here on highway 24 driving up to the last lafayette bart station and beyond that to oakland. no major problems there. also this morning we're looking at the oakland bay bridge toll plaza. westbound there's at least a 10 to 15-minute delay there. let's take a look at the south bay where north 101 is busy.

so is northbound 280 approaching 17. 85 slowing in saratoga and up to cupertino. as we move the maps over to the peninsula, 101 and 280 looks good. you can look at half moon bay. remember, we had an earlier crash in half moon bay. it has not recovered. that crash was there a long time ago but still very heavy traffic in this area and right now this is a look at 880 in hayward, union city. that's moderately heavy. let's go to steve. >> thank you. great tweets coming in this morning. frank from san jose said hey, some interesting skies down here. and jessica from beautiful pinal set this picture. some clouds coming up from southern california. they are producing rain showers down towards central california. a lot of these are streaming up, especially towards -- well, they start south, head north but they're covering most of the bay right now so this will add not only clouds to the mix but a tropical feel today. so thank you, jessica, one of the couple of photos i've seen

coming in on twitter this morning. sp weather by the way if you want to take a photo. the information coming in today also talks about kind of mild or cool conditions depending where you are and shows clouds associated with it coming up central california highway 1, maybe 101 as well. monterey, salinas valley, but can take cruz mountains to san jose in line for some possible showers. right now they're just missing us. it's this close. you can see it's all coming around a lull. that will be there around 24 hours. then it will get kicked in by that cold front right over my shoulder. but today that's what's producing those mid and high level clouds and gives us that tropical feel. the low just formed the last 24 hours. it's been drawing up moisture. it will fire up thunderstorms over the sierra too but possible lightning, and a hug gi, hot -- muggy, hot feel inland. first day of fall. because of the thunderstorm, it's usually not so much the rain. it's the lightning. a red flag warning out.

monterey county, higher hills, the national forest, low humidity, hot temperatures. 64 already in livermore. i think they were 98 yesterday. i'm going for the same today. sonomo county airport, santa rosa 51. concord, fairfield 59. at last check there was no wind at all at fairfield or travis. calm, zero. another hot day. the low will eventually get bumped out of here and a pretty good system coming in here. this is your sunday cooldown right there. it's still a couple days away but there's looft cold -- a lot of cold air for this time of year bottled up in there. the high pressure is squashing the fog so it could be low and thick. by tomorrow i think it will lift and by sunday morning it will be up around 2,000 feet and even well inland. we'll cool down with the system coming in. but until then plenty going on. a mix of sun and clouds. 90s inland. very muggy. 60s, 70s, 80s to near 100 degrees for antioch and again a possibility of maybe a few showers popping up later o. all we need is a trigger mechanism

that the global economy is slipping into another recession. there was a lot of selling off overseas in markets overnight, but right now the u.s. markets kind of holding steady. the dow down slightly, down 25 to 10,708. senate a zach is -- nasdaq is up 8 and s&p is flat. the moody's rating agency announced its downgrade of eight great banks. it says the downgrade is due to the worsening economic climate in grace and the bank's exposure to government bonds. it comes as greece tries to meet the materials of its international bailout. greece appears to increasingly likely to default on its debts. the fears once again have shaken up international markets. democrats in the senate say they will vote down a bill passed by the house to replenish disaster aid funds and prevent a government shutdown. early this morning the

republican controlled house passed this bill. democrats object to cuts in clean energy programs. the senate will vote on the bill today but time is running out. the disaster aid account could run out of money early next week and without action, a government shutdown is possible a week from today. the two top executives from fremont based solar company solyndra took a lot of heat on capitol hill this morning. we explain why it was a very short hearing. >> reporter: tori, the two men were excused from the hearing room after repeating dozens of times they would not be answering any questions. in fact, the hearing ended less than a half an hour after solyndra's c.e.o. brian harrison and senior vice president w.g. stover were sworn in. they invoked their fifth amendment rights and opted not to testify but congress kept

good morning. welcome back to mornings on 2. i'm tori campbell. we're starting with developing news out of san jose. almost a two-hour standoff between police and an armed man is over. ktvu's paul chambers is there telling us how it started and ended. >> reporter: it was about two hours that police negotiators got the man to successfully leave the denny's restaurant behind me. the man was held up inside the restaurant alone for an hour and a half. >> at about 14:-- [indiscernible] the male entered the restaurant with a knife, ordered everybody out and threatened to kill himself.

ear and two piercings on the left side of his neck. time is now 8:03. it's a warning for hikers near stanford university. there are reports thieves broke into and burglarized six cars parked in a dirt parking lot at alpine road and peers lane. it happened yesterday morning while people were hiking along the trails near stanford's radio telescope antenna called the dish. one of the people whose car was broken into says several laptops were stolen along with his wife's purse which had her passport, her keys and at least $1,000 cash. it is 8:03. convicted murderer yousef bay iv may be allowed to represent himself in a kidnapping and torture case. he and four others kidnapped two women in 2007 and tortured one of them to extort money. this is not connected to bay's conviction in the murder of oakland post editor chauncey bailey. but a decision must be made in the torture case before he can

muni bus ran over her arm. the whole incident we're told was captured on a surveillance camera. police are saying it appears the bicyclist was actually at fault for making an illegal lane change. >> apparently the bicyclist was attempting to maneuver around a double parked vehicle that was in the number three lane. however, the bicyclist did so entering a lane that was already occupied by another vehicle which was the muni bus. >> now the attorney for the bicyclist says he has not seen that surveillance tape and is threatening to sue to get it. the bus driver didn't stop after the accident but muni is saying the bus driver probably didn't know what happened. it is 8:18. the u.s.-mexico border in southern california is back open now following a shooting involving boarder patrol officers. it happened yesterday afternoon during a confrontation with a man who was being questioned at the crossing. investigators say the officers opened fire after the man pulled out a gun which was later determined to be a fake. the suspect was taken to the

hospital with nonlife threatening injuries. the shooting remains under investigation. in michigan a father and his two sons are recovering after being injured in a car bombing. this is video taken a short time ago -- a short time after their car exploded on tuesday. investigators say someone planted a bomb in the car. it went off while the father was driving his sons to football practice. all three are expected to survive. investigators don't know the motive. a $10,000 reward is being offered for information leading to arrests. time 8:18. we have breaking news. this just came in. the nba, the national basketball association just announced training camps have been postponed indefinitelily. the nba is also canceling 43 preseason games. the nba hasn't been able to work out a new collective bargaining agreement with the players association. nba players have been locked out since july. the regular season is scheduled to open november 1 if a deal

welcome back. it's 8:30. a second weach of student protests -- round of student protests. we tell you why students say they're energized and not planning to stop. >> reporter: that's right. a protester organizer we spoke to earlier this morning says a lot of freshmen participated in the demonstrations yesterday. the issue affects all students and they will not go quietly.

>> reporter: two people ended up getting arrested. one had a scuffle with a police officer yesterday when their magazine clip went flying. police say the other protesters threw chunks of concrete and a chair. the protesters charged into the hall to take over the building. police ordered them out at 9:00 last night. this after nine hours of demonstrations. one of the biggest problems officers said were the signs that protesters used to protect themselves. >> whether they make a shield like this and then attack an officer, that dsm raises our level of concern. >> reporter: -- that definitely raises our level of concern. >> reporter: protesters hope the clashes don't detract from the message that students are angry that basic tuition and mandatory fees have sored to more than $13 240u -- soared to more than $13,000 this year. one student said he may be forced to drop out of school. >> because the cost and the job market right now, it could not be beneficial to get my four-

year degree. >> reporter: in an hour and a half, hundreds of students are once again expected here on campus and we will of course be here to bring you the latest. live in berkley, i'm tara moriarty, ktvu channel 2 news. >> thank you, tara. it's 8:32. arson is to blame for a fire that destroyed a concord home earlier this month. the fire started on september 5 at a home on schuyler court that was under construction. it also damaged two other homes nearby. investigators say the fire burned too quickly and all accidental causes have been ruled out. there are no suspects but anyone who saw something suspicious that day should contact the contra costa county fire district. jaycee dugard is suing the federal government saying parole officers failed to properly monitory her kidnapper philip garrido. he held her captive for 18 years. he was fird under -- first

under federal parole until the state of california assumed responsibility in 1988. dugard has already received a $20 million settlement from the state. any money received in the federal lawsuit will go to dugard's nonprofit foundation. time 8:33. three men including one from the bay area have been arrested. they're charged with computer hacking. 23-year-old cody cretten ger is one of the men. he's connected to a hacking group. an ohio man and a man from mountain view were also arrested. the three have been charged in the hacking attacks on sony pictures entertainment and santa cruz county computer service. tonight there will be a candlelight vigil for a prominent woman from campbell killed in a violent crime spree. the family and friends of cindy win will gather at the plant mall in san jose, the same shopping summer why where she was carjacked and kidnapped one week ago today. her body was found the next day. the suspect 33-year-old paul castillo is in custody.

he's also accused of shooting and wounding a man during a robbery attempt at a gas station. it is 8:34. this morning the coroner's office will release its report on a fatal police shooting of an unarmed man in bay point. it's expected to provide critical information about the death of a 24-year-old in march. both officers were in grave danger when he tried to speed away from a traffic stop. the sheriff's department says one deputy was briefly trapped in the car after he tried to grab the keys from the ignition. the car then hit the other deputy. a federal judge gave the city of oakland a january deadline to make changes to the police department. the reforms sterm stem from the 2003 riders misconduct case. yesterday the department was criticized for failing to comply with a complete list of reforms but stopped short of placing the department under federal control.

oakland mayor jean quan told the judge she's committed to implementing the changes. we're going to know tonight which oakland schools could close as part of a restructuring plan. the superintendent will make his recommendation on which of the eight elementary schools will shut down. the school board will then review the recommendations at their board meeting tuesday. a final decision on school closures will be made next month. a federal judge is expected to issue an injunction by monday against five suspected gang members in oakland. the order would prohibit them from congregated in parts of the fruitvale neighborhood. they would also be banned from carrying guns and they would have to obey a curfew. the injunction is part of a lawsuit filed by the city of oakland against 40 alleged gang members. a hearing for the 35 other defendants is scheduled in december. 8:35. within the last 20 minutes, we learned that the six-ton satellite is not falling toward earth as fast as nasa had

expected. experts are now predicting it will crash late tonight or early tomorrow. apparently its orientation has also changed and that is slowing its fall. most of the satellite will disintegrate. it's about the size of a bus but about 12,000 pounds of it is expected to rain down somewhere although nasa says it's unlikely that any surviving debris will land in the u.s. a palo alto lawmaker is holding his 11th and final there ought to be a law contest. state senator joe smitty is looking for proposals for new laws or to repeal or modify an existing law. 18 contest entries have become laws over the years including the law requiring drivers to turn on their headlights in bad weather. the deadline to enter the contest is october 31. if you would like to submit a law, we set up a link to the contest on the web links section of ktvu.com. today governor brown comes

to san francisco to announce plans for legislation to help create jobs in california. the governor will appear at two events today. first he'll be at the corporate headquarters at 11:30 a.m. and then appear -- then at pier 27 at 1:30 p.m. time 18:37. sal is on his job. -- time is 8:37. sal is on his job helping folks all over the bay area. good morning you to. traffic is doing pretty well in some areas but not here on 880. the whole week we've seen slow traffic getting in from san leandro to oakland. about the only good thing i can say is there haven't been a lot of major crashes. we're always thankful for that but the traffic is still pretty slow. let's move along and take a look at the golden gate bridge. i would say this is a traffic trouble spot because visibility is very low. you have to use your windshield wipers. be careful. these are the conditions that may lead to a crash. also this morning we're looking at the san mateo and done burton -- dunbarton bridges. those look good. northbound 101 slow traffic.

southbound 85 and 280, a traffic trouble spot on the right showld near cupertino -- shoulder in cupertino. plenty going on. some clear spots out there. a lot of high and mid-level clouds coming up from southern california and thick fog. so the combination of the three will mean a cool day for some. nice for others and kind of hot and muggy for a few, especially away from the coast and some of these clouds coming up from southern california are starting to pop up a little bit here. so santa clara valley, maybe off towards the east bay, parts of the peninsula, keep an eye on the sky here. it's getting closer and closer. it's starting to line up. so from san jose to santa cruz mountains south, it does look like maybe some high-base stuff. probably won't happen but the mere fact that things are starting to pop up very early in the morning bears watching. all associated with an area of low pressure off of southern california. it will be here till probably about saturday. then it will get bumped in by that system coming in from the gulf of alaska which has a little bit of oomp to it. i think it will give us our

first light rain of the season. until that arrives we have a high fire danger out because of low humidity and associated lightning with the thunderstorm. mainly monterey county but anybody heading up to the seer would where it's possible there as -- sierra where it's possible there as well. some locations especially north bay not as warm but it's going to be kind after mild, muggy day for a while and then hot and muggy inland till we can get this cold front to come through. it will happen. fall will start to be on the increase saturday night as it gets closer and then sunday the system will sweep through. plenty of cold air behind that. looks like it will hold together to give us a rather dramatic change in our temperatures and sky conditions as we head towards sunday. today sun and clouds. 90s inland. muggy. some of these will be upper 90s. 60s and 70s closer to the coast. 70s and 80s around the bay. kind of a pretty sunrise today with some of those clouds around if you weren't stuck in the fog. but mid up toker 90s. one -- mid- to upper 90s.
