complete bay area news coverage starts right now. this is ktvu channel 2 news at noon. >> the advice of my council i invoke the privilege afforded to me by the 5th amendment of the constitution and i respectfully decline to answer any questions. >> just ahead reaction from capitol hill after executives from a bankrupt bay area company traveled a long way to say little. good afternoon, i am tori campbell. the top executives from fremont based solar company made a highly anticipated appearance before a congressional committee in washington, d.c. this morning. but as alison burns reports live from washington, d.c., they left without saying much. >> reporter: it was one of the most aggressive hearings i have covered in quite a while here on capitol hill. republicans were relentless in their questions of their executives, but they were determined not to say very much.

the last time their ceo brian harrison met with some of them was earlier this summer, assuring them his company was making excellent progress. >> he looked me in the eye and assured me that everything was just fine. >> reporter: but now that they have collapsed, taking a half a billion dollar federal loan guarantee down with it, house republicans are seizing the moment to put the company's executives under oath and demand answers. >> i want to ask mr. harrison, if he thinks the american people, who have invested over half a billion dollars, deserve to know what happened to that money? >> what is your plan to pay back the taxpayers 535 million you owe them and when will you pay it back? >> and i respectfully decline to answer any questions. >> while harrison and the vice- president stover invoked their 5th amendment rights and opted not to answer any questions, republicans also used the hearing to take on the obama administration for okaying the

loan, they say all federal loans from the department of energy are now under scrutiny. >> i only wish we have could have appropriated more money invested in crime scene tape and taken it down there and circled their building. >> democrats are accusing republicans of putting on a show. >> republicans in congress are now dancing on their grave but they seem to have a case of collective amnesia, it wasn't too long ago they were urging the department of energy to award loans and loan guarantees to companies in their districts. >> it is also facing a justice department investigation and here on capitol hill republicans are yowfsing all of this to try to make big cuts in the federal loan program that provided that loan in the first place. reporting live from washington, d.c., alison burns, ktvu channel 2 news. >> after a brutal week on wall street stocks are mixed right now. this follows two days of heavy

losses as traders have been racked by growing fears the economy is headed for another recession. europe appears for closer to solving the debt crisis there and u.s. political leaders are in another stand off over spending that could force the government to shut down next week. a live look at the big board the dow bouncing between positive and negative territory, right now still down 8.5, 10,724, nasdaq up 18 and s s&p is up 3. all is quiet on the uc berkeley campus after a student protest yesterday. tara moriarty joins us now with more. >> reporter: we are standing in front of the building where the protesters charged yesterday. police say they actually threw rocks, chunks of concrete and a chair. it happened on the second floor of this building where they

broke a window and smashed through a door. this is video we shot of a struggle between a police officer and a protester. the officer seen here is now out on medical leave for three days because of back and shoulder injuries he received during this confrontation. another officer is also out for three days because of a concussion he received when a protester threw a chair at his head. >> i would say that your video speaks for it several. it shows the officer was clearly assaulted from behind. >> and a dangerous situation for him. >> yes, very dangerous. and the other thing is that these were none students involved in this activity. >> 7 university police officers were injured during the protest yesterday. two demonstrates were arrested, hundreds of students were rallying for change, upset over increased tuition hikes. we asked people what they thought of the footage. >> it bothered me. i think that the message is a

very very important message. its worth fighting for but i wish that it could be done in a less destructive way. >> protesters were supposed to show up here two hours ago for another protest but it never materialized. they do plan on future protests. tara moriarty, ktvu channel 2 news. >> a brief police stand off at a denny's restaurant ended peacefully this morning. this is video as police surrounded the restaurant. that part of the street was shut down during the incident. we spoke to san jose police earlier about what happened. >> at about 4:thriven this morning officers responded to that restaurant on report of a male that had entered the restaurant way a knife, ordered everybody out and threatened to kill himself.

we got him to come out peacefully. >> it was shut down and no one was hurt and the stand off only lasted for two hours. police have not released his name. he was taken into custody and brought to the hospital for an evaluation. power is back on for more than 200 customers in richmond after a power line caught fire and fell in front of one home. they are blaming it on the weather, saying dust on the line combined with fog and mist caused a short-circuit, which brought it down. you can see where it scorched the earth. they turned of power to repair the line and check on the family. every 1 was okay, the line repaired and power restored by 10:00 a.m. oakland remains one of the most dangerous cities in america. fbi statistics show there were 15 violent crimes for every 1000 people last year. that is the most of any bay area city. they were second with 12,

richmond was third with 11. the fbi blames it on violent street gangs and drug dealing. we are following details of a hearing which wrapped up an hour ago. it determined the fate of a 14- year-old convicted of involuntary manslaughter and robbery in the death of an east oakland store owner. cameras were not allowed into the courtroom because of his age. earlier this month he admitted in juvenile court he admitted the crimes during a robbery in may. the store owner, 57-year-old doing suck cang died from a heart attack after a struggle with the boy over liquor he was trying to steal. we just spoke with an attorney for the juvenile justice center who says the 14-year-old was ordered to be rehabilitated at a group home for the next 12 to 18 months. he was facing up to six years at a state juvenile detention facility. a federal judge is expected to issue an injunction by monday against five suspected

gang members in oakland. the order would prohibit them from congregating in parts of the fruitvale neighborhood and be banned from carrying guns and have to obey a curfew, that is part of a injunction against 40 gang members, a hearing for the others is scheduled for december. could street lights be the key to improving safety in oakland? one man is convinced that is the case. kraig debro just talked to a city official for her reaction, good afternoon. >> reporter: good afternoon, true vine ministries is located near the intersection, you can't tell right now, because of the sunlight but at night the people who attend the church here say the lighting is really sad. >> the situation is pitiful. >> reporter: this is what she is talking about, they are

at dozens of bay area hospitals is over but not all the nurses are back at work. kizer nurses are being welcomed back to their hospitals but not sutter nurses, sutter health hired replacement workers, the nurses who try to return today could be placed on call. it was over benefit cuts and other concessions south by management. today contra costa county officials are reporting the first human case of west nile virus this year. a 49-year-old woman who lives in the eastern part of the county has confirmed to be having the virus, officials say she is expected to recover. the county says it had four confirmed human cases of west nile virus last year and no deaths since 2006. federal investigators have released a reportth into the deadly reno air race crash. according to the report investigators are looking that evidence that a piece fell off

the retrofitted world war ii fighter plane. it happened before it crashed last friday, killing 11 and injuring 74 others. investigators say witnesses and photos indicate something broke off the plane after it completed several laps and made a steep turn toward the grandstands, a final ntsb report is expected to take months. the u.n. just announced that today's controversial request for statehood by palestinian leader has been relayed to the security council. he asked for full u.n. membership as a state today despite pressure from president obama to abandon the idea, included in that request is territory in the west bank, east jerusalem and the gaza strip. israel prime minister benjamin netanyahu accused them of looking for a state without peace and argued that palestinian statehood would threaten his nation's security. we are expected to learn

tomorrow now which open schools could close as part of a restructuring plan. the superintendent will make his recommendation on which of eight elementary schools will shut down. the school board will then review the recommendations at their board meeting on tuesday. a final decision on school closures will be made next month. president obama is offering states more flexibility in meeting educational standards spelled out in the no child left behind law. during a white house announcement today he said the congress needs to rewrite the bush era law because of flaws in its implementation, schools will be allowed to opt out of some requirements as long as they enact standards that prepare students for college and careers. >> the economic challenges we face now are economic challenges that have been building for decades now. and the most important thing we can do is to make sure that our

kids are prepared for this new economy. that is the single most important thing we can do. >> the no child left behind act requires that all students are proficient in math and reading by 2014. the department of education predicts that more than 80% of u.s. schools will miss that target, which would also disqualify them for federal education dollars. this weekend president obama comes to the bay area. the president will attend two fund-raising events in the south bay on sunday. on monday the president will participate in a town hall meeting at mountain view's linked in. mills college has a new president. alishia ducuddrow was sworn in this morning. she is their first new president in 20 years and its first black president. >> what stands out to me most right now is how excited this entire community and what a

not hit in north america but now it is predicting that it actually says there is a slim chance any surviving debris will land in the united states. bay area viewers and all of us here at ktvu are remembering veteran channel 2 reporter bob mackenzie, he died yesterday after a long battle with cancer, he was 75 years old. bob had a writing style all his own, plus the incredible talent to see the ordinary and make it extraordinary. his knack for story telling delighted audiences for more than 30 years and he clearly loved his work. >> i have always tried to specialize in feature stories. these are stories that aren't about what went wrong today or even anything that happened today. they are about things that are going on all around us. >> he got a journism degree. he was a tv critic before joining ktvu in 1977. he won 13 local emmys as well
