customers after two suspicious devies found on atm's. good evening. >> police in pleasant hills say they have found an unusual scam to steal your money at the atm. eric is live now in pleasant hills at the bank where it happened. >> reporter: the first strange thing is that it involves atm's behind these closed doors. a tech first found metal box isotached to two of the machines and they had cell phones inside them. police say it was not the normal card skimer at these atm's. >> just a box, a metal box that attached up to the machine. >> reporter: the tech first noticed the boxes did not belong just after eight thursday night and called police. >> scary, i go to this one all the time. >> reporter: some customers

were even more upset to learn investigators found cell phones inside the boxes. police seem to think the phones were actually recording video of the customers and their cards but some wonder if it was more high end than that. >> who knows if they were trying to get a picture or if they were using the cell phone to instantly up load date a. >> reporter: this appoint police don't believe anyone's information was compromised because they recovered the devices before the thieves could come back. they are waiting for bank security to pull video that may show who was so bold to attempt the crime in a busy strip mall at a bank within door atm's. >> you wouldn't think the card wouldn't be protected. >> reporter: based on what police could get from the phones they think they may have been recording for about an hour before that tech found

them. we are live,. >> we have new video of a shooting in pittsburgh. we are told by authorities a 29- year-old man was shot near the pittsburgh health center. the health center is behind a wal-mart store, the shooting happened just before 6:30 this evening. we are told the victim was taken to the hospital in critical condition. the gunman is still on the loose. police in sunnyvale are trying to unralph el the circumstances around the death a 2-year-old boy. police found the body of the child in an apartment. they said there were no obvious signs of trauma. a short time after that a woman associated with the apartment was spotted apparently trying to jump from a nearby overpass. after a brief struggle officers pulled her to safety and she was taken to the hospital. they haven't determined as yet how the child died. >> hundreds of people turned out in san jose tonight to honor the memory of a woman

whose life was cut short. tonight's vigil look place at the same center where she was star jacked a week ago. we are live in san jose to tell you about the huge show of support. >> reporter: i'm told in the culture white is a symbol of mourning. tonight the white roses were hand handed out to celebrate a woman who died in a crime that many still find difficult to understand. one thousand people held candles for 60-year-old cindy wynn described as a daughter, a sourocks sister, a mother. >> the cindy i know was the kindest, kind of person ever and had such strength of heart that anyone she met touched them and inspired them. >> reporter: it was a week ago when she was kidnapped from

struck her. instead i want everybody to see the beauty in what the community has created, how it's come together. >> reporter: she will be laid to rest tomorrow next to her mother who died earlier this year. live in san jose. >> happening now the final moments of a nasa satellite. about two hours ago nasa predicted the satellite would come back between 8:45 and 9:45 tonight. the latest word that we have came just 30 minutes ago. the agency said the satellite should be down, they are just waiting for confirmation. earlier today the satellite appeared as a fuzzy image. nasa said it may take an hour to confirm that the satellite has made its death plunge. one we taked to said it's unlikely it'll hit anyone. >> what's protecting us right

lawyers supporting the proposition want a court to review the decision but they are worried the release could happen before the appeals court actually gets a chance to issue a ruling. the widow of a man shot and killed by police has filed a ten million dollar civil rights lawsuit against the city. the 37-year-old derek jones was shot last november when he reached for his waistband. officers thought he was reaching for a gun. it was actually a small silver colored scale. police admit he was unarmed but say he did have marijuana on him and was legally drunk at the time. >> criminal rates rise after dark but some are saying police are turn up the lights. they point to this area, it doesn't have veto lights and some say that invites crime. >> people going to -- respect lighting, in the dark anybody can do anything in the dark. when it's light people not

mosquito? >> reporter: tonight michael kinger went door to door to let his neighbors know mosquito with the west nile cyrus were found in this area. >> they found yesterday a mosquito trap around this intersection with over 20 infected moss no, mosquito. >> reporter: he is concerned about his family and neighbors. >> i was surprised shocked that the mosquito infected with west nile virus are here in the neighborhood. >> reporter: ten days ago vector control fogged the same neighborhood to kill mosquito but today they confirmed to us that this week they found infected mosquito here along with two infected birds elsewhere in the county. health officials reported the county's first human case of west nile virus this year. a 49-year-old woman who is now recovering. >> this is 100% preventable as long as you protect yourself. >> reporter: people aged 50 and

they are trying to agree on a short term deal to keep the government running. today the senate blocked a bill to provide fema money for victims of natural disasters because the bill contained $1.6 billion in spending cuts. democrats said it's unfair to tie the cuts to emergency aid. republicans countered by saying a huge debt the government has to be more careful with spending. >> harry reid is holding a bill up with full funds for no reason, no reason but for politics. >> do they want the government to shut down? do they want fema to close? >> reporter: he is planning to pitch a compromise plan on monday that is similar to the house bill though it wouldn't contain spending cuts to off set that emergency aid for fema. >> thousands of nurses from 34 forth eastern california hospitals tried to return to work today after a one day strike but not all of them were

allowed back in. >> reporter: martha had her scrubs on today. >> normally right now i would be starting my shift. i take care of kids with cancer and i love my job. i wish i was there. >> reporter: she and hundreds of others weren't allowed back because they participated in a one day strike yesterday. they are in contract negotiations and are fighting for better health benefits. the hospitals hire temporary workers to fill the positions for five-days. >> we do a five-day contract because it's easier to recruit them to come. it's worth their while to comer to five-days than for one. >> reporter: spokespersons for both hospitals say it's not a lock out. they say nurse who didn't strike are still working but the union points to nurses at kaiser who were welcome back. >> 17,000 went on strike and they weren't locked out and they had more people to bring into take care of the patients.

>> reporter: cool spent the day looking online at the latest news from her union and thinking about her patients. vincent said he was concerned when he heard that temporary workers may be caring for his son. >> from what i can see the nurse that are here now do -- it's like they haven't missed a beat. they do a good job. i was happy with the care. >> reporter: at some of the hospitals some procedure has to be postponed and surgeries rescheduled. nurses will be allowed back next tuesday morning. reporting from oakland. >> traders of hewlitt packard stock didn't endorse meg whittman. it ended off 48 cents closing at $22.32ful whittman took over yesterday. she held a town hall meeting today that lasted for about an

hour. she said hp needs to earn back their trust and respect. on the broader market a four day sell off ended but it was still the worst week in three years. the dow gained 37 points, but even so lost more than 6% of its value this week. the nasdaq picked up 27. carl icon dropped his bid to buy chlorox. he pressed them to put itself up for sale and tried to buy it three times. his latest bid was $80 a share. they dropped the bid after concluding share holders wouldn't go for the plan. >> a few scattered showers, a red flag warning in effect for the areas south of monterey and the forest here by big surer fought next hour as the thunderstorms kind of move up. they shouldn't get this far north. you can see activity there, for

. the health department is working on a plan to let diners determine a restaurant's health record from a colored placard. they would provide green for history of good inspections, yellow or red would indicate poor inspections. a similar system in los angeles gives restaurants an a, b or c rating for the most recent inspection. normally jack london square isn't really crowded but tonight it is packed with thousands of people attending the third yearly eat real festival. they are expecting even more

the southern california bank she used. she is in federal custody accused of fraud for allegedly taking hundreds of thousands of dollars from two other politicians. senator feinstein doesn't know how much she is missing because the first california bank won't release any account information. she said the bank knew what was happening and did nothing to stop it. vandals in los angeles have attacked a newly opened cam page office for the president. it happened last night they say several staff members were in a back room at the time but nobody was hurt. it appears that a tire iron was used. >> the president is set to visit the bay area on sunday to raise money for his campaign war chest. on monday both the president and top republicans will be here to tout jobs. it shows silicon valley's growing influence on politics. >> reporter: for many years

. the oakland school is preparing to close as many as ten schools. a preliminary list contains eight elementary schools and two middle schools. a final list is expected to be released tomorrow and we will have it tomorrow. then on tuesday the school board meets to vote on the recommended closures. many families bracing for them one school is expanding. the learning without limit school on 40th avenue showed off a new 20 million-dollar facility today. a bond measure paid for the improvements to the campus.

. in southern salano this is a live picture from the waterfront where the crew just arrived. we can tell you there was a fire burning at an industrial pier there. it's not clear when or how it started. the crew is gathering more information on exactly what happened and we will bring you the update when we learn more. >> jury selection has wrapped up in the trial of michael jackson former doctor. he is facing charges of manslaughter in connection with jackson's death from a powerful sedative. he died in february of last year. it took six hours to pick the

seven man, five women jury. in florida a judge more than doubled amount of money that casey anthony must repay to cover the costs of investigating the death of her daughter. a jury acquitted her in july but police and prosecutors say she lied to authorities before the girl's body was found. after the sheriff's department resubmitted the bills the judge today added another $119,000 to the bill. bringing the total to more than $200,000. >> halloween is now five week away and one tradition could be squashed. how nature tricked the pumpkins in half moon bay. >> reporter: the stage is set here in half moon bay for halloween. the signs are up. s rides are going, fall air is due tomorrow but it seems someone forgot to cue the

grows christmas trees says the pumpkins he buy may cost him more but he won't charge customers more. farmers say the cut green pumpkins will turn orange if time for halloween. in half moon bay. >> more now on the nasa satellite falling back to earth. the agency still hasn't confirmed it's down. they had predicted would break up and calm back about 9:45 tonight but they said it'll take about an hour or more to confirm that plunge. they said there is only a very, remote chance that anyone would be hit by a piece of the satellite. >> there is a few scattered showers south the area. check out the live storm tracker. this is where the red flag warning went up for areas south of monterey. we had reports of tunedder lightning in this area.
