with that story. >> reporter: the patient has been identified as judith ming of oakland. i spoke with her husband. he was devastated about what happened here that hospital but he didn't want to comment on camera about this incident which is under investigation. >> all i can think of was the family. and i wish i was there to present them from occurring. >> she is a nurse at alta bates summit medical center. the patient who died was one of many cancer patients under her care but she was not on the job. she and others conducted a one day strike on thursday, that turned into a five day lock out. >> it was a mistake that should not have happened. >> reporter: it was at the hands of a replacement nurse. the patient died after

receiving a medication. in a statement alta bates summit medical center said this was a tragic accident. and our hearts go out to the family and the nurse. many nurses said the lock out was the choice of sutter hospitals and this would not have happened with staff nurses. the hospital said replacement nurses are accredited and that it is unfortunate and sad the union would exploit the death of a patient. the nurses expect to be back on the job when the lock out ends tomorrow. >> i was available to work and i was turned down. the hospital says it's investigating as are oakland police. the identity of the nurse and her qualifications have not been released. ken pritchett, ktvu channel 2 news. the question, are you more likely to die from a car crash

or medical mistake? at 5:30, john fowler will have the answer to that very question. the ntsb came down hard on pg&e for that pipeline explosion in san bruno last year. >> reporter: this is the final report by the national transportation safety board. it comes as crews clean up for the day, rebuilding at least some of what was lost. >> the fire ball came over the house. it apparently took the shed. >> reporter: his home was one of 100 damage or destroyed in the pipeline explosion. his was damaged. he hopes safety improvements comes. >> will they follow? there has been so much that has been hidden. >> reporter: it killed eight

people and incinerated this neighborhood. the cause was due to a poory welded piece of pipe. the ntsb called for improvements in spike inspection. the report also urged the california public utilities commission to conduct an audit of pg&e's operation. he is the puc execkive director. >> eight people died in san bruno. no one is hiding behind a rock trying to get away from the responsibility. >> pg&e says it embraces the board's recommendations for improving the operations and management of the gas system. the pg&e watch dog agency praised the ntsb report. >> lot of death and destruction could have been avoided if pg&e had done its job in terms of

than last year. new poll shows california voters are overwhelming pessimistic about the state's economy. for the third year 90% of voters describe the economy as being in bad times. and half of them don't believe things are going to get better. 91% say california's economy is undergoing bad times. 5% said the state is in good times. when asked about the unless outlook for the next year, 30% believe the economy will get worse. 26% say it will get better. voters are not more optimistic when it comes to their own financial well being. the poll asked if they are better off or worse off today than one year ago. fifty% say worse off. 22% say better off and 28%

crashed. happened at 3:50 this morning near the oakland coliseum. officers spotted the van and gave chase. the van hit the center median and officers weren't sure if the driver was inside or if he was armed. some folks back up in the traffic. >> good thing they stopped us from going through because if somebody is armed you don't want to be in their way. >> a s.w.a.t. team found no one inside. police say an officer shot and killed a man who threatened the officer. this happened before 5:00 yesterday afternoon. officers say they made a traffic stop and the passenger ran away. when they caught up with him there was a struggle and the man pulled a gun. one of the officer shot and killed the man. it is under investigation. police say they are looking for the driver. police are searching for a gunman involved in a shooting
