unemployment situation is serious. 17% say somewhat serious. and most don't expect things to improve during the next 12 months. parents, teachers and students fought to save shannon elementary school but it may not be enough. ktvu's jade hernandez is live at the offices where w why they are future is uncertain. >> reporter: today the state department of education tells us more cuts will hurt the struggling school district. and shannon elementary within that school district can't endure one more blow. >> reporter: shannon elementary school has 300 students. it struggled financially. right now they owe the state $9 million. community support saved it from closing till last week. >> hard to get the support of the parents when every other day you are open, you are

closing. the parents here received this letter from the superintendent on friday. today is the first day the board members andparence had a chance to respond. -- and parents had a chance to respond. >> we have the money to pay the debt. >> reporter: he insists shannon has the money it owes. the state department of education says yes, more cuts are expected. even if the debt is paid the school is likely to face more finance problems. the fate could be decided by the end of the year. >> our children are dismantled. we would go with the no child left behind law and i would transfer my kid to a school

across town. >> inside he met with the superintendent about an hour ago. he is trying to secure more support incase the state forces them to close. jade hernandez, ktvu channel 2 news. dozens of protesters gathered outside bank of america today, they are calling on the bank to stop the wave of foreclosures. this is part of a nationwide movement to get banks to help rebuild communities and stop exploiting people. >> we believe they are poor corporate citizens in our city. >> some people withdrawing their money from the banks and demanding the banks to offer loan modifications. we know the name of the second victim stand to death inside a home. john gilbert was discovered on

september 11 at the home. his body along with renee washington was found. investigators say the fire was set to cover up a homicide. no arrests have been made. >> university of california, berkeley students and owners and residents gathered today at one of the most dangerous intersections. among other things the group is calling on the city to install a stop sign or pedestrian lighting. the death of a cancer patient. judith ming had been at alta bates summit medical center since july and died saturday after being given the wrong medication. ktvu's ken pritchett reports on the labor dispute over her death. >> reporter: nurses say it began with a one day strike on thursday, that turned into a 5 day lock out from sutter hospital. she was one of the nurses

locked out. >> i am heartbroken about this patient. and their family. and i felt like i could have prevented this if i was there. >> reporter: she works with cancer patients. the patient who died would have been under her care but a replacement nurse was in charged. >> it was a mistake that should not have happened. the specifics are unknown but she says it would not have happened with staff nurses. the union says the lock out was to blame. alta bates summit medical center countered in writing by saying it is unfortunate and sad the union would exploit the death of a patient. the hospital said repliesment nurses are qualified qualified and the lockout wasn't a

factor. the hospital is investigating as is oakland police. the identity of the replacement nurse or details about her qualifications haven't been released. ken pritchett, ktvu channel 2 news. hospital strikedize lead to an increase number of patient deaths. the study examined the effects of hospital strikes in new york. hospital deathinize creased bine 19% for patients admitted during a strike. >> the hospital's responsibility to have adequate care for their patients while they are striking. >> i think they should -- shouldn't do that. >> the result from the study were similar for hospitals thatome ployed replacement workers and those that did not. san francisco giants' fan

bryan stow is making more progress tonight. he is more responsive now and getting stronger. he has been talking more but still only a few words at a time. also physical therapies will be seeing him fbi days a week. smokers may have to find a new place to light up. they are set to vote on whether to ban spoking in a 17 block area. the banned with effect sidewalks and other public areas. 11,000 kindergarteners haven't received at least one required vaccination. those students parents signed a personal belief exemption where they don't have to give a reason for skipping. that is the highest rate since

the ntsb released its report on the san bruno pipeline explosion. it says events led up to the propose and fire that killed eight people. the ntsb says it started 50 years ago with the installation of pipe. it says pg&e failed to do tests and inspections of the pipeline. pg&e issued this response, pg&e is grateful for the ntsb investigation of the san bruno pipeline explosion accident and embraces the recommendations for emproving operations and management of the gas system. an investigation by the chronicle shows data kept on plastic pipelines has been kept

a secret. it was a plastic pipeline that failed last month causes an explosion. regulators said plastic pipe made before 1973 has a risk of cracking. the digging has begun on the san francisco central subway but it is creating quick sand. ktvu's david stevenson is live in the san francisco area with the implications of this project. >> reporter: criticism about the subway product got dirtier as we get closer to election day. >> reporter: construction cruise on the central subway dug deep below city streets as campaigns fired away at each other on spending. the state senator called for a closer look at what he called mismanagement and financial

fraud. >> that's one of the reasons why i have filed a information request to the mayors' office, mta, sunshine task force to the city administrators office. >> candidates making political hay out of something. >> reporter: all of the agencies deny any wrong doing but it is a sign how political the project has become. it enjoys the support of ed lee and 7 other candidates. though others called for a redesign or expansion of the project to justify the cost. the city attorney dropped his support and promised to cancthal product if elected because of its design. >> it's not helpful. at the end of the day we have a tremendous amount of public support from the local communities and from the federal government. >> business people working near the construction say they are willing to support the product for now. >> we don't know till it's all

kaiser is owning a new medical office building tomorrow. located at franklin parkway in san mutay mocha 64,000 square foot medical office. some of the services include family expodle medicine, ob/gyn. facebook said today it will provide $10 million worth of free advertising on its site. they give credits of $50 to 200,000 businesses. the goal is to -- apple cut orders for i pads by 25%. there were also concerns it will see a challenge from amazon's endwise. apple's stock tumbled $8. a little slice of green in

palo alto shut down. el camino park. cruise will build a new underground reservoir beneath the park as part of a emergency water supply system and will build new facilities in the park. completion is set for the fall of 2013. the weather is interinterrupting scientists efforts to count sea otters. they use scientists and volunteers to conduct the count. heavy fog and strong winds prevented them from completing it. it is on the endangered species list. a beautiful day out there for a monday. let's go out to bay point, towards -- near concord, martinez. it's beautiful out there. pittsburg to the right there. over here and antioch is down that way. winds gusting to 7. water
