roof into his building. so a dicey situation, but nobody hurt. now the investigation into what started this fire begins. ken wayne, ktvu. new at 6:00, ktvu's ken pritchett is at the state capital where he learned about changes, ken. >> reporter: one of those new changes we learned about at today's hearing at the capital is that b.a.r.t. police officers will be wearing cameras on their lapel by year's end. the shooting of oscar grant is what started the changes, followed by the shooting of hill. >> i want the are real thing. >> reporter: new training and procedures are in place.

independency of a organization like mine. >> reporter: right now cooperation between the board and b.a.r.t. is good. school districts are on the state including san francisco unified are planning to sue the state of california. the sacramento bee says they want $2.1 billion in education funding that they say state leaders should have provided in the budget. the schools will be holding a press conference tomorrow to explain their case. school issues aren't the only educational controversy in the bay area. a bake sale at uc berkeley that is the talk of the country. a live report on that tonight on news 36. eric rasmussen is live with new information he just learned in the last half hour about a new requirement nurses are facing as they come back to work. eric-- >> reporter: julie this is something we are hearing just as nurses make their way out. they say they are all now being

tested on what is considered a very basic procedure for feeding patients. they say that's because it involve it is same procedure that was done by a replacement nurse over the weekend. and today we got a chance to talk to one of those replacement nurses that knows what happens. >> my heart goes out to anyone involved. >> reporter: this replacement nurse did not want to be identified. >> they came to us to make sure that we felt comfortable and competent. >> reporter: sources are now confirming published reports that a 23-year-old replacement nurse at alta base medical center mistakingly gave ming a

nutritional item through a catheter instead of a feeding tube. >> some of us can't get jobs back where we live and some of us are single mothers and have really low rate of pay. so we do sympathize with the nurses. but at the same time, couldn't turn down an opportunity. >> reporter: the company would only tell us they are still preparing a statement. but the returning nurses say they are finding more problems as they return to work. >> we started seeing reports from staff and family members that they were concerned that the nurses that were in there appeared to be completely unfamiliar with the surroundings, with equipment. >> reporter: today the hospital would only say it's cooperating with local and state officials investigating what happened. the state says it does not know how long that investigation could take. we're live here in oakland, eric rasmussen. dna evidence may have

cracked two cold case killings. back in 1996 two residents of alameda were found stabbed to death just 12 days apart. the victims did not know each other. dna evidence implicates a transient. he is currently serving a life sentence for another killing. a candlelight vigil is set to get away for nursing student michelle le. today marked seven months that she disappeared and was killed. organizers say the vigil will both honor le's life and thank all of the volunteers who helped search over and over to find her body. new at 6:00, ktvu news has learned the fbi may be trying to reopen the case against a crime lab technician. charges were filed against her but later dropped. ktvu has obtained this memo from the fbi which madden's

attorney says demands grand jury attention. >> they decided there will be no charges to be brought against debby madden, that should have been the end of it. >> the da's office dropped hundreds of cases because of the madden implication. a warning about an imposter who may be trying to get your information. someone is posing as an employee of the court in sunnyvale. this individual has called at least two people asking for personal information about their court case. the sunnyvale court handles family matters. >> for instance domestic violence. someone trying to look for somebody or something like that, it could be dangerous. the court says it never

ever asks for personal information and says if you get a call do not reveal anything. jurors heard opening statements today at the opening trial of michael jackson's doctor. they also heard a startling recording that jackson made six weeks before he died and he was so drugged that his voice was barely recognizable. >> [mumbling ] >> prosecutors say the recording will help prove that dr. conrad murray knew the drugs he was giving jackson were dangerous. murray's defense attorney says jackson caused his own death by self-medicating, taking a powerful anesthetic after the doctor left the room. it was the first count of its kind counting same-sex couples. the census counts 131,729 married same-sex couples.

notice on what the bear may have left behind. >> reporter: we're sorry to report that we didn't spot a bear. however we did spot berries. and these berries according to biologists may be proof that a bear may have been here. >> reporter: this afternoon we were lucky enough to spot this buck in the brush. >> it's not uncommon to have encounters with you know a coyote or two but not a bear. >> reporter: two biologists found droppings near the same area. >> all we see is bear excrement, bear scat, it appears to be from a -- that appears to be from a bear. how we know that is because of the quantity, because of the size of it.

people died in distracted driver accidents each year. that number has now doubled to 600. transportation fishes say talking on a cell phone reduces your driving concentration by 27% and texting is even worse. >> the younger somebody is the more likely they are to be using their cell phone for texting or calling. but we are seeing an awful lot of it with those 25 to 54-year- olds. especially on the phone. they don't text near as much. >> reporter: researchers say talking to someone in the backseat or trying to reach something on the floor are also causes of fatal distracted accidents. students at cal brought held a bake sale, charging more for some, and less to others. >> reporter: the university didn't tell the berkeley college republicans that they couldn't sell these cup cakes the way that they wanted to. they just wanted them to make

more unsettled weather pattern. that's what it looks like now. suffice to say your bay area weekend is going to be cooler. 88 in napa, 84 in vallejo, the up shot if we do get a bunch of rain next week. that puts the kabash on fire season if you get over a half an inch of rain. 93 in livermore, 93 in pleasanton. 87 in san jose. your forecast highs certainly above the average. certainly warmer than today. tomorrow will be the warmest day of the week. but thursday is going to follow close behind with fairly nice daytime highs as well. there you go 77 in san francisco. that's a warm one downtown. your five day forecast then going up and then they're coming down. then it feels like winter down here. i've been looking at weather maps for a lot of years. when you see a pattern like that develop, you think wow this looks more like november. not september. so it'll be interesting. in the meantime. nice couple of days then cooler for the weekend. >> enjoy it while it lasts.
