well, good morning to you. i'm dave clark. >> i'm tori campbell. it's wednesday, september 28th. we want to get right to our top stories. developing news involving a deadly accident in east palo alto. sal has an update. sal? >> we've now confirmed that this deadly accident was the result of a police pursuit. that was just told to one of our reporters on the scene. this happened early this morning, when police made a

stop at -- near university avenue of bay road and east palo alto. police just told us that that person who pulled over initially, then took off, came to this intersection and hit a motorcyclist. that motorcyclist is dead, taken away from the scene. it's an investigation. ktvu anoel walker is -- actually -- are we going to noel walker? yes, we are. >> reporter: good morning, sal. we just finished talking with police officers a minute ago. the helicopters are circling overhead. we are -- we are between university and we're told this all happened because of a call of spit shish activity. someone reported someone in the backyard. it was a burglary or a burglary

in process. officers went to that area in order to be able to investigate what was going on. they saw an suv leaving the area without the lights on. the suv if we can take a live shot here is parked here at the intersection of bay and university. the area here is closed off to traffic. we know that the police pursued that suv. it looks to be gray in color, either a range over -- range rover -- rover or a vehicle. it all happened very quickly, the officers said, that the vehicle then hit an innocent driver, a motorcyclist who was been pronounced dead here on the scene. we know there were -- there's one driver and maybe three people, i believe in the suv who were taken into custody. again, this is all developing right now. obviously this is gonna be a traffic mess in the morning

commute. we're being told people coming off the dumbarton bridge should take a detour. willow instead is probably the better way to go if you are coming off the dumbarton bridge. but again, university between running mead and cavanaugh is closed to traffic. avoid this accident -- avoid this area. we'll remain on the scene and bring you more details as they become available. oakland police are investigating a deadly shooting outside the dragons club. tara moriarty just spoke with the victim's friends and she joins us with more.

>> reporter: good morning. the family's been notified. his name is ike muhammed. he was a member here. witnesses say he was gunned down in the garage that you see. the police say the suspect took off in this direction. witnesses say he was wearing a mask. we want to show you a picture that muhammed's friends say was taken at the raiders' game this sunday. >> on his facebook page, he has nearly 2,000 friends. people have been trickling in and out of here to light candles. the violence erupted around 9:45 last night when muhammed was shot in the garage. he was rushed to the hospital. witnesses say that the bullet struck his chest and arm areas. muhammed is the man pictured in yellow on the right-hand side of the screen. he was a member of the east bay dragons and a popular one.

on the group's website, they have several photos dating back to the 1960s. in speaking with friends this morning, they say they've been scratching their heads trying to figure out why anyone would want to kill ike and that's a question that will be left to oakland police. tara moriarty, ktvu channel 2 news. >> thank you, tara. >> police say the oakland shooting is not related to the casino shooting that killed a san jose hells angel last week. now arrested is this man. he faces charges including assault with a deadly weapon. authorities say villagrana was shooting into a crowd at a motorcyclist crowd last friday in sparks, nevada.

a homeless woman has been arrested after smashing the windows of several police cars. this is video around 3:30 this morning. police say the woman vandalized three patrol cars. they say a homeless man in the area reported the incident and may have pepper sprayed the woman. no one was injureed. president obama will be asking people to study hard and color outside the lines every now and then. coming up at 7:15, we'll have a live report from our washington, d.c. newsroom and find out how a bay area individual will get a special shoutout from that speech today. >> the mtv will hold a -- mtc will hold a hearing and commissioners are expected to approve a measure about relocating their offices from oakland to san francisco.

the agency if it's approved would share building space for the air quality management district and the toll authority. critics say that move costs too much money. they also say it would make it harder for disabled people to go there. 7:07. several teen boys helped lodi police accused of raping a 14- year-old girl in a skate park. donald bush is accused of luring the girl into a park restroom where the attack allegedly took place on sunday. the teens confronted bush when he emerged from the background. it's not clear why bush went to the hospital after this. >> she was crying when she came out of the bathroom. >> that's not right. 13-year-old, 26-year-old. >> police arrested bush on several charges, including sex with a minor. he's in the san joaquin jail.

doctors at sf general say they will not intervene in the murder of two people. the man has been refusing food for almost a month and doctors say his condition was acute after justtwo weeks. but they will not intervene because he has no mental health ires. however, a court-appointed psychiatrist had previously determined that wu is not competent to stand trial. your time is now 7:08. today is another spare the air day. if you have breathing problems. you should stay inside, according to the experts. the unhealthy levels of pollution, expected all over the bay area. you are encouraged if you can to take public transit instead of driving wherever you have to go. the hot weather and the light winds will make it a poor breathing type of day. 7:08. there are still drivers out

there. let's check in with sal for an update. >> yeah. we do have all sorts of slowdowns this morning, unfortunately. a lot of slowdowns this morning. we're gonna start off with a fatal crash investigation in east palo alto. newschopper2 is overhead. university avenue at bay road. about a half a block away from the police station right in front of the mcdonald's, if you know east palo alto. this was caused by a police pursuit. they were chasing someone and that person indeed did run into another vehicle, a motorcycle. the motorcyclist was killed. the university avenue exit or university avenue exit from the dumbarton bridge is not the way to go. use willow instead as you come off the dumbarton bridge. just go to willow and don't use university because you will be detoured. let's go to the toll plaza. it's been backed up. that crash is long gone.

it's backed up more than it normally is. we're waiting 20 to 30 minutes there at the toll plaza. it's backed up beyond the maze. this morning we have slow traffic, which is pretty typical. 680 is already slow from concord to walnut creek. we're looking at hayward union city traffic. and the south bay. they are quitting some slow traffic on -- getting some slow traffic all the way up to the lawrence expressway corridor. i would say 85. it's just a little bit better off and you might want to use that if you can. let's go to steve. >> okay. thank you. did i tell you today is gonna be very warm? well, it is. the coast is clear. i can't find a puff of -- i can't find any wind either. clear and mild. 60s for lows for some, especially closer to the coast and in the city. i had some updated temperatures. sunshine, nice to hot by noon. 60s, 70s and 80s. and it will be sunny for all and warmer.

70s, and 80s. san francisco, though, going 82 for a high today. 82. it's going to be warm for everybody. these are the current temperatures, ocean beach, 62. richmond has come up to 64 now. the financial district, 65. south of market, 66. china basin, 66 already. so you are good to go for warm weather. 60s, 50s for some but i expect that 55 in santa rosa/napa and the 56 in san rafael to warm up fast. same for fairfield and livermore. i couldn't tell you the last time i saw calm at san jose, sfo and up to santa rosa. there's not a puff of a breeze. even though it's not that strong. this, though, again, even though there's warm conditions today, this looks like this because that system right there, right there. will start working its way

good morning. sunrise over the big city. it's already very mild. a lot of 60s for lows. we'll have sunshine and a few high clouds. no big deal. highs, 80s and 90s for many, including closer to the coast. a threat by the head of the iranian navy, he says iran may send military ships close to the east coast of america. the marine admiral said "like the arrogant powers near our borders, iran will also have a

powerful presence close to american marine borders." the admiral didn't say when this could happen or how many iranian ships could be sent. here's a strange twist -- al qaeda is joining the united states in criticizing iran's president for saying that the united states, not al qaeda, was behind the september 11th attacks. now, president mahmoud ahmadinejad repeated that claim last night at the united nations last week. that triggered a walk out by the u.s. and other delegations. iran sees itself as a rival to al qaeda when it comes to anti- americanism and then iran invented the conspiracy theory because it's jealous of the 9/11 attacks. we are now learning that the family of one of the uc berkeley graduates imprisoned in iran went to great lengths trying to keep their jewish religion out of the news. during the time josh fattal was in prison, his mother and father appeared in public a lot

calling for his freedom but his father kept to the sidelines. we all know that's because josh fattal's father is an iraqi- born jew who lived in israel before moving here to the u.s. the family was worried that his ties to israel could make josh fattal's worse because of iran's hard line against israel. 7:17. president obama delivers his third annual back-to-school speech in a few hours. as alison burns reports, the president will signal out a fremont high school student for special mention. alison? >> that's right, tori. the white house is also going to great lengths to emphasize that this is not a political speech of a full -- speech. a full text of the speech was released last night to try to defuse any thought of it being

delivered to the schools. he spoke at a school in denver yesterday telling students to pursue their passion. >> what's great about this country is that any of these young people here, if they have got a good idea, if they go out there and they are willing to work hard. they can start a business. they can create value. >> as an example of that, president obama is going to talk about a mission from mission student high school who created a nonprofit called happy day microfund that gives loans to students to start their own businesses. alison burns, ktvu channel 2 news. in an april pierce -- in an appearance last night at the reagan library, chris christie seemed to sidestep calls about running for president. >> my answer to you is just this -- i thank you for everything you are saying.

i'm taking it in, listening to every word you are saying and feeling it, too. >> in the past, christie has clearly stated, he's not going to run, even jokingly saying he's going to commit suicide so people will know he's not running. but he's never directly said no. families were left homeless on haight yesterday -- in the area of haight yesterday because of a fire. these flames caused a lot of damage to a three-story victoria. one man took some action before firefighters got there. we want in-- we ran inside, got the fire extinguishers and just tried to get everybody out here. -- out of there.

witnesses say they heard several popping sounds just before the fire started. tonight at a special meeting, benicia's city council will consider forcing its firefighters to take a pay cut. city leaders say it's necessary to help deal with the projected $1.7 million budget shortfall. the proposed plan would put salaries and holiday overtime pay. however, the firefighters' union says it already helped the city last year when firefighters agreed to salary reduction and benefit changes. a new study shows most doctors listen to music while performing surgery. but it does not relax all of them. british researchers say 90% of doctors say they like music in the operating room and they say doctors with the most surgical experience were more relaxed by the music but surgeons who had not performed as many operations were more often distracted by the music. arizona researchers say yarning may not always mean you

35 missing after a big typhoon that hit the phillippines. yesterday's storm brought winds up to 90 miles an hour and tons of rain. look how the streets are flooded. rescue teams are trying to evacuate people in low-lying areas. the typhoon is moving out of the area but believe it or not, there's another tropical storm brewing in the pacific. it's expected to reach this area within the next 24 hours. it is 7:24. a sausalito city councilman is promising better behavior and has apologized for slapping the hand of a colleague. at last night's meeting, councilman michael kelly apologized to councilwoman carolyn ford. she accepted. however, the two no longer sit next to each other. two weeks ago, ford held up her hand and said shhhsh. kelly slapped her hand. she then filed charges accusing him of assault. the marin d.a.

is now examining the case. an amazing morning of bad traffic all over the place. but sal's got it all covered. sal? >> well, it is kind of a tough one out there today. >> the traffic at the taupe -- you are gonna be -- at the toll plaza, you are gonna be there for a while. whenever there's traffic problems in the critical hour, it affects traffic for hours, hours. now that the bridge has cleared, it's getting a little bit better. traffic here is slow getting into the valley. 280 is also slow getting into the valley. we're seeing a lot of slow traffic this morning getting into sunnyvale. let's go to the 280 freeway. you can see how slow it is. it's backed up from 101 to the lawrence expressway. now highway 85 is slowing to

students are planning a somber rally today in response to two sexual assaults. kraig debro is live with more. good morning, kraig. >> reporter: good morning, tori. later on today there's gonna be a rally in support for the victims and raise awareness around the issue of sexual assault. at st. mary's campus behind me, we've been allowed to come up. the students are behind this rally. later on, there will probably be more educational aspects to the rally as well.

a spokesperson says the familiarity between those involved in these cases is a little unsettling. >> this is not an instance of someone -- of a predator being in the bushes. these are acquaintances or a friend that betrays someone's trust two sexual say salts -- assaults. on september 11th, a student reports she's assaulted at 3:15 that morning and later in the day, a student is arrest and taken to jail. then on the 25th, another student, another sexual assault. this time a student and acquaintance are accused. there have been no arrests in that case. >> it still comes back to the fact of being aware of your circumstances and who is around you and being aware of what's being served to you, whether that's alcohol or whether it's punch. >> now, for the record, i asked

month. advocates planned a news conference at 11:00 this morning to announce a referendum. today, five san jose unions will announce a plan that they say will reduce pension costs by almost $500 million over the next five years. the unions represent police, firefighters and three other groups. with san jose facing a deficit that could lead to more service cuts pension reform has been a really hut - -- hot-button issue. it is 7:33. emotions were very high at last night's oakland school board meeting as parents depated a plan to -- debated a plan to close several schools. students from lakeview marched to the meeting holding signs. inside, more than 400 people a

packed the auditorium. the superintendent, tony smith says the district's resources are stretched too thin. he's recommending closing five elementary schools. nearly 100 people asked to comment at the meeting. and to close our school after she performed relationships with her teachers and friends is detrimental to her growth as a person. you do not do that to a child that young. >> smith is also proposing merging seven other schools into existing schools, all to save $2 million. the board is expected to vote on the plan at the end of next month. one proposed school closure is raising particular questions. santa fe elementary school has recently seen $850,000 worth of imprompts -- improvements. we asked about upgrades that

were completed last month and we're told the process was put in motion a long time ago before the closure recommendations. a san jose elementary school is taking home a gold medal in a state-run student fitness contest but it's also having trouble finding room for the prize. ruskin elementary won a state- of-the-art fitness center worth $100,000,000. until the campus gets another permanent program, the music program will have to move to the cafeteria. police forced russell shaffer to move his beehives last year after his neighbor was stunned several times. but in a 4-1 vote, the city council approved a one-year permit saying it is start of the -- it is part of the plan. they say they will review the situation at the end of the

year. a marin superior court judge rejected an order to ban plastic bags. the plastic bag organization filed a complaint and asked for an order. the judge refused it. this also imposes a 5-cent fee on paper bags. the coalition of plastic bags will appeal the decision. pg&e is trying to determine what caused a pipeline rupture to field a large fire. the fire was in the middle of a busy street in roseville. here is a picture of it. authorities say the underground pipe ruptured just before 7:00 last night. the fire was ignited by a spark from a car that rolled over it. crews worked overnight to cap off the leak and put the fire out. nearby businesses were evacuated.

no one was injured. our time is now 7:36. we have new details about the fatal shooting by b.a.r.t. police officers in san francisco. now, b.a.r.t. police chief kenton rainey testified before lawmakers yesterday and he says the officers who shot a transient last july did not get crisis intervention training. now, that's a 40-hour course that teaches officers how to deal with mentally ill people. lawmakers are investigating how b.a.r.t. handled the shooting and the protests that followed. 7:37. the first day of the dr. conrad murray trial took a dramatic turn, thanks to a surprising move by prosecutors. they played a never-before- heard recording of michael jackson taken shortly before he died. we'll go live there in just about an hour. 7:37. guess what. happening right now, there is a

there. if you are driving into san francisco, it's gonna be a big commute today. i will tell you why. we had an earlier crash in the 6:00 hour. it was there. blocked two lanes for the time. the authorities got a -- they did a good job debting it out of the way. there -- getting it out of the way. there were no serious injuries. traffic's backed up more than normal. if you count on waiting 15 minutes, count on waiting 25, maybe 30. let's move and take a look at northbound and southbound 880. that traffic is going to be moderately heavy pass the coliseum. in the south bay, we have a lot of slow traffic now. i guess people heard me last time when i told them 85 is the best bet. 85 is slow. northbound from 87 into cupertino, 280 is backed up to 101 and 101 is backed up to

initially stocks opened higher. but now the index is dipping into negative territory during to -- due to concerns about europe. germany will vote on that package tomorrow. taking a live look at the big board, the dow currently down 19. the nasdaq down 8. s&p is down 4. new this morning, amazon is unveiling a new tablet computer. it's called the kindle fire and will compete against the popular apple ipad. the kindle fire will reportedly come in two sizes and the smaller, 7-inch diagonal display will only cost $199

compared to $499 for the ipad. it will run on google's android software. analysts think it can succeed because of the compact size, low price and amazon's name recognition. amazon's stock is up about 2% right now. groupon has come up with a new way for bargain hunters to save money. today it's releasing details of a customer rewards program. merchants who join the service will set a spending target for customers to hit. once the customer reaches that number he or she will qualify for a steeper discount on products and services from that business. the woman accused of killing nursing student michelle le is scheduled to appear in court later this morning. 27-year-old giz selesty bon is charged with -- giselle esteban is charged with murder. police say she killed le because of a lovers' triangle.

looking at these properties and all of this comes after the city was made a decision. they were criticized by a civil grand jury for its code enforcement practices. now, it says the city was placing leans on properties for tens of thousands of dollars before the owners had a chance to either respond or appeal. the city of oakland fees will now be evaluated and compared to other cities. in antioch, the city council wants to bring back a program that targets neighborhood blight. last night they brought out a proposal, a formal request for proposals from an outside firm to run its code enforcement program. they are also researching how much it would cost to develop a city-run program. the city council says this program needs to be reinstated. many neighborhoods are becoming run down. president obama will encourage students all over the country to study hard and color outside the lines every now and then when he makes his annual back- to-school speech today. coming up at 8:15, we'll have a

roseville where this fire started last night and there's a lot of questions this morning about how it began. 8:19. new this morning, developing news, in fact, in just the last hour, power has been restored to downtown santa rosa. a power outage at 5:00 this morning left more than 3500 pg&e customers without electricity. the affected area included north of sonoma to college avenues and brookwood avenue west toward boyd street. pg&e says the high voltage underground cable went bad. crews fixed the problem about 45 minutes ago. police in orange county are looking for the owner of a six- foot long python that was found slithering around outside a mall. animal control officers found it under a parked car in buena park yesterday. they say it was friendly and appears to be someone's pet. the owner has five days to claim the snake or it will be put up for adoption.

well, good morning to you. welcome back. students at st. mary's college in moraga planning a somber rally in response to two campus sexual assaults in the past two weeks. kraig debro has been out there all morning and just talked to a campus representative. kraig? >> reporter: yeah, good morning, dave. in the week of -- in the wake of these two sexual assaults, people on campus have been thinking about different ways how to respond. one of the ways students are responding is by holding this rally later this afternoon. both assaults happened this month in september. two on campus, one was reported the 11th. the other the 25th. the victims in both of -- the

back to you. >> thank you, kraig. a homeless woman was arrested early this morning after she -- after she smashed the windshields of several san francisco police cars. take a look at the video. this was about 3:30 this morning. police say the woman vandalized three police cars. there she is right there. police also say a homeless man in the area reported the incident and may have pepper sprayed the woman. no one was hurt. it is 8:32. parents and students made passionate pleas to the oakland school board in hopes of keeping their schools from closing. students from plakeview marched to last night's meeting holding signs. inside more than 400 people packed the auditorium. opportunity tony smith says the district's resources are stretched too thin. he's recommending closing five elementary schools. nearly 100 people asked to comment at the meeting. >> this is a tremendous lost to

our community. we have a large school with a lot of heart and a lot of love and a lot of rooms to fill. it would be a detriment to close it. >> where was transportation ef ever considered? some of these schools, people will have an issue, a real life issue from getting their first -- in getting their children from point a to point b. >> submission is -- smith is proposing merging other schools to save $2 million. the board is expected to vote on the plan at the end of next month. now one proposed school closure is raising particular questions. san jose elementary school is recently seeing $850,000 worth of improvements. we asked oakland's school spokesman about the upgrades which were completed just last month. he tells ktvu the process was put in motion a long time ago

before the closure recommendations. 8:33. a coalition of california administrators plan to sue the state today over the budget that was passed back in june. the group says the budget shortchanges schools by $2 billion. they are also claiming the state improperly calculated the amount schools should get under the requirements of a 1998 constitutional amendment. that amendment mandates a certain amount of taxes be spent on education. tonight, benicia's city council will consider forcing their firefighters to take a pay cut. they say they need it to deal with the budget shortfall. the proposed plan would cut pages -- would cut wages and holiday overtime pay. firefighters agreed to salary reductions and benefit changes last year. 8:34. firefighters have extinguished a natural gas burning under the

asphalt of a street in roseville. there are plenty of questions about why that fire broke out in the first place. our reporter is live in roseville with more on how that fire started. rich, good morning. >> reporter: morning, certainly this gas line is in question. now what happened last night, this part of the asphalt on kirby way which is a fairly big intersection in roseville caught fire. apparently, there was a four- inch gas line beneath it. of course, we had the fire on top. what happened is that the asphalt basically -- now, we have some video to show you what this looked like last night. it burned for about seven hours until pg&e crews could get on either side of it, dig holes about 7 feet down, about 50 feet on either side of this gas leak and then shut it off. but the line itself, there's some question about it. not too long ago, about a year ago, there was a fire about 150 feet approximately in the same

the future of jared loughner could be determined about what happens today. >> reporter: good morning. that incident you talk about, where has the time gone? today, in court, which starts at 11:00, by the way, you are gonna hear a lot of talk about the medication and whether the meds are doing their job because remember court psychologist deemed 23-year-old jair red lee loughner schizophrenic and not competent to stand trial. he was transferred to a prison medical facility in springfield, missouri, where, the majority of the time, he's been forcibly medicated. the idea, of course, is to restore his mental competency so he's able to understand the charges against him. he's able to assist in his own defense and he can go to trial.
