down. good morning on this friday. traffic is moving along well in many areas. we have some freeway closures there. is highway 4. now highway 4 westbound looks good, but eastbound highway 4, there's a full freeway closure for road work this morning, eastbound highway 4, it's going to be at summersville road until about 5:30 a.m. so about one more hour. it's a full roadway closure. and there's a detour set up. this is for the road work there. and also the morning commute looks good on interstate 880, southbound 880 right at the oak street off ramp, or the jackson street off-ramp there, a little bit of road work in some of the lanes. and this morning's commute is okay san francisco northbound 101 traffic looks good approaching the 80 split. back to pam. we begin with an arrest in the fatal shooting of the san jose hell's angel. he is a rival, member of a

rival motorcycle club. we are in san jose this morning with more information about the man in custody. >> reporter: well, he is 53 years old. and as you mentioned, a member of the rival motorcycle gang. we got off the phone with police who made the arrest last night. and here's what they told us, they said an officer was doing his patrols on the campus when he noticed a car parked in the dark, the driver sitting there. something touched off suspicion so he asked for a driver's license and he figured out that a warrant was out for his arrest. he is suspected of shooting the victim in the back and killing him last weekend. flags are flying at half staff at the hell's angel clubhouse where members have been mourning his death. we spoke to a spokesman who says his friend of 20 years had one leg, a single parent and loved to sing country music. >> he was a fantastic hell's

angel and a fantastic friend. >> reporter: with that, authorities say security video shows him shooting him. sources say he was a mover and shaker. he is originally from hawaii. and coming up, what possibly could have caused the tension between the two. a fun value planned october 15th. we're live in san jose, channel 2 channel 2 news. developing news. we are learning that an american-born cleric linked to al-qaeda has been killed. u.s. officials confirm that he was killed in an air strike in yemen. now we don't know if the u.s. military was involved in the attack. he is suspected of playing a key part in the failed underwear bombing in detroit and the deadly fort hood shootings two careers ago and he is the most prominent al- qaeda figure to be killed since

the death of osama bin laden. the manhunt for a fugitive is becoming more pressing and more dangerous. the 35-year-old murder suspect shot at three members of a special unit of the county sheriff's office yesterday. they were not hit, and they did fire back about ten rounds. the sheriff's office does not know if he was wounded in the gun battle. >> as the team was performing their task, they came under fire from a subject which they identified, they could see that it was the suspect who was approximately 100-meters away. >> now investigators believe he was firing a high powered assault rifle and that he is not receiving any outside help. more law enforcement are headed to the county to help the 40 officers now looking for him. there's a $30,000 reward for anyone with any information leading to his arrest and conviction. also this morning, police in oakland are searching for

suspects in an overnight shooting. a ktvu news crew was on the scene just moments after last night's gun fire at 88th and international. police say one man was wounded in the attack. a friend drove him to the hospital and at this point, his condition is not known. police are interviewing witnesses as they try to determine what led up to the shooting. san francisco's gang task force is investigating a shooting in the bay view district. police say a 22-year-old man was gunned down near 3rd shortly after 9:00 last night. the victim was rushed to the hospital and is expected to survive. so far, no word of any arrests. later this morning, you should know that crews will be venting natural gas in oakland and in san carlos. now it will take place on 52nd avenue. the natural gas is being removed so crews can conduct pressure tests on the pipelines in the area. in san carlos, the venting will

be near highway 280 and edgewood road. people near both areas, you may smell gas, but should not be alarmed. firefighters are still on the scene of a stubborn house fire. that fire on atlas road started at 5:30 yesterday evening. firefighters say the ark tex chuck of the home -- architecture of the homemade it difficult to put it out. no one was in the building when the fire started, but investigators are trying to determine how that fire started. and more reports throughout the morning. oakland firefighters say a battery left in a junk car may have caused a fire at a steel recycling plant. that started yesterday afternoon near market street. two dozen firefighters worked to put it out. only a small amount of material burned, but smoke could be seen for miles and it did raise concerns about air quality. >> if there's any significant concern for toxins to the

public, we would let that out using the press. >> air quality officials did check the area, no shelter in place orders were called and no one was hurt in the fire. we're now learning the findings of an independent investigation into a memorial day drowning off crown beach. a 53-year-old died on may 30th. now police officers and firefighters watched from the shore, but couldn't respond at the time because they did not have water rescue certification. the investigation report now criticizes the city for a lack of the certification along with a break down in command and miscommunication. >> i think the way the government ought to look at this report is no excuses, changes come, we've made some changes, more changes are coming. >> one change includes the purchase of several water rescue boats. the city council will take a look at the report at the

october meeting. a pilot was killed after his homemade plane crashed. the plane went down in a vineyard ten miles southeast at about 7:00 last night. investigators say it had just taken off if the airport. the pilot was the only person onboard. the federal investigators are trying to determine what went wrong. a company is recalling bags of chopped lettuce because of a possible contamination. now the lettuce was processed by true leaf farms. not distributed here in california, but it was shipped to oregon and possibly washington and idaho. so far, no reports of anyone getting sick. the recall is not related to the outbreak in the cantaloupes which are grown in colorado. now we have more information on the outbreak on our website. last minute push is underway at local school

districts to get students vaccinated against whooping could have. the school district has set up clinics on two campuses this week. students from around the district are being bussed in so they can get their shots. a school spokesman says unvaccinated students will bullpen sent home. parents who don't want their children to receive the vaccine must fill out paper work to be in compliance. well, despite a number of warning sign, nothing was done to improve pedestrian safety at an east intersection where a 6- year-old girl was hit and killed on wednesday. a uc berkeley study from a year ago named bay road and gloria way one of the most dangerous intersections. in april, a 9-year-old boy was hit and seriously injured in the same spot. it was in the crosswalk also. now bank of america's plan to start charging customers $5 a month to use debit cards is getting strong reaction this

morning. the country's largest bank announced the fee yesterday claiming it's needed to make up for $2 billion in lost revenue. the new rule limits how much banks can charge for debit card transactions. >> $5 a month doesn't seem like a month, but it adds up. suddenly, hundreds of dollars and at a time when people are struggling to make ends meet, every $5 a month counts. >> san francisco's based wells fargo along with chase bank are testing out their own $3 fee. wells fargo is discontinuing the rewards program. right now, it is 4:39. and we understand there's some road work on highway 4. is that slowing things down? >> it is. eastbound highway 4, we do have road work i want to tell you about. and that road work is going to be there. now i want to tell you about it here eastbound as you come up, you can see it's a full closure

as you head out to summersville road. this stretch of the freeway. and we have road work that has highway 17, the opposite side of the bay, down to one lane between the summit and bear creek road because of construction. only one lane is open until 5:00 a.m. according to caltrans. you might want to wait a little bit, it will still be light on the commute. and the traffic will be better. let's go to live pictures now there. say look at westbound bay bridge. the traffic is light into san francisco. and also this morning, looking at the 280 freeway here in san jose. that looks pretty good. 4:40. steve. >> thank you, sir. well, a couple days ago, remember last sun, clouds and rain and wednesday was hot. yesterday started to cool down. today really cool down. a lot happened in just one week almost. and we're going to continue this trend of cooling and looks like maybe rain beginning to move in next week.

timing always tough, but monday and wednesday. so with that in mind, the pattern though is changing. no doubt about it. 60s on the lows. if it wasn't for the low clouds, a south wind ahead of this, a mild pattern, but for some, the difference between the highs and lows won't amount to much. tomorrow will be cooler as we get the front to come by. west, southwest 26 at fair field. yesterday at this time, they were calm. there's a huge difference. and an indication of a strong gusty breeze and cooling out to the valley. system first to come in always falls apart and that's what's happening. but just bumps the high out of here and opens the door for the sea breeze and lifts the fog. what's behind that. a lot of energy racing across the pacific and that will start this system comes in. the weekend will be okay, but low clouds, cooler, breezy and about 5 to 15 miles per hour cooler on the afternoon highs friday into saturday. much cooler next week. looks like rain. again, if i had to stick my

neck out, i would say monday and late tuesday night into tuesday. fire danger reduced. does not look like a big rain event, but locally one to two. we'll get to that next week. today, fog, sun, cooler, windy at times and local drizzle. that will happen over the next 24 to 36 hours. 50s, 60s, 70s and low 80s, but the temperature trend will be to bring things way down. and extended forecast, increasing low clouds, bigger cool down saturday into sunday. and rain on monday, unsettled on tuesday. >> all right. thank you. 4:42 is the time. heavy downpours in new jersey are adding to the misery already caused by tropical storm irene. 5inches of rain fell in an hour and a half on wednesday. that triggered flash floods in the northwestern part of the state. and there may be more rain to come. flood warnings and watches are in effect throughout the region this weekend. a new report shows an increase in the number of

sexual assaults at stanford university. there were 21 sexual assaults reported last year. in 2009, there were 12 cases reported and in 2008, there were ten. now a spokesperson for the university says it does not necessarily mean there are more attacks on campus, but that student outreach has led to more people reporting the attacks. reports of hate crimes are dramatically up at uc berkeley. according to police, there were 18 incidents last year up from only 3 in 2009. most reported incidents involved signs drown around campus. only one person has been arrested. a 15-year-old boy has been arrested in the shooting of a cookout side a san francisco restaurant. now the cook at the restaurant was shot while taking a smoke break on august 30th. police call the killing a case of mistaken identity. the suspect is an alleged gang

member. police say he was already in custody when he was arrested on went. california prison officials are threatening to discipline thousands of inmates who are taking part in a second statewide hunger strike. the strike is protesting conditions in solitary confinement as well as gang security measures. now strike leaders renewed the hunger strike this week because they say officials failed to follow-through on promises made to end a previous hunger strike back in july. officials say they are reviewing the policies, but that the process takes several months. and the program to transfer 30,000 inmates from california state prisons to county jails begins tomorrow. the u.s. supreme court ordered california to reduce its prison population to reduce overcrowding. now governor brown came up with the realinement program to transfer less serious offenders to county jails. >> from everything i can tell, this is a viable plan that as we work together, will not only

ensure public safety, but fix a prison system that has been profoundly dysfunctional for decades. >> some counties say the jails are already full meaning they'll have to release some of their prisoners to make room for state inmates and county officials worry about funning from the state to not only house the prisoners, but provide supervision for probation and other services. we are hearing from one of the two survivors of that deadly shooting rampage inside an ihop in carson city. the sergeant says she was having breakfast with four other army national guard members on september 6th. she says they were paying the bill when the suspect walked into the restaurant with an ak- 47 and started shooting. she remembers the gunman smiling as he was firing. i will never forget that face. i mean, i know every line on his face because he's in my dreams. he's, i see him all the time.

>> sergeant kelly says she tried to use a table as a shield from the gun fire. she was shot in the leg, but four people were killed including three other national guard members. funeral services are being planned for a soldier killed in afghanistan. the 21-year-old army specialist was killed monday by an improvised explosive. he joined the army in march of 2009 and was assigned to the first division out of kansas. after his enlistment, relatives planted american flags in the front yard and tied a yellow ribbon to the tree. his grandfather knew he was destined to serve his country. >> i would catch him practicing and all he had to do when he got in. he was dedicated to it. >> now this was his first deployment under operation enduring freedom. his family just returned from delaware. they attended a military

service for the return of his remains. two paramedics who responded to michael jackson's mansion the day he died will testify today in the trial for jackson's doctor. now they're expected to say that dr. conrad murray never mentioned giving jackson a powerful drug. jackson's bodyguard told jurors yesterday that murray ordered him to stash several viles of medicine before telling him to call 911. >> i was standing at the foot of the bed. he reached over and grabbed a handful of viles. and then he reached out to me and said, here, put these in a bag. >> prosecutors say murray who has pleaded not guilty to involuntary manslaughter charges tried to hide evidence that he had been giving jackson the medication as a sleep aid. the bodyguard testified that he thought murray was preparing to take the items to the hospital. ambulances are supposed to take you away from danger, but

in southern california, one was right in the heat of it all. a mechanical issue sparked a fire in an ambulance outside a shopping plaza yesterday. now some good samaritans used a fire extinguisher to try to put it out, but they backed off when oxygen tanks started exploding. fortunately, no one was injured. the ambulance was not carrying patients at the time. here in the bay area, a paralyzed man suffered life- threatening injuries his bed caught on fire. that happened yesterday evening. the victim called 911. and pleaded for help as he was trapped and couldn't move. one firefighter trying to rescue him suffered third degree burns to his hands and second degree burns to his face. >> the firefighter that was burned could only pull him out a certain distance before the room suffered a flash over as they were leaving the room. that caused more burning to our

firefighter as well to the victim. >> other firefighters eventually pull out the victim. he was take on the the hospital with third degree burns throughout his body. the injured firefighter is being treated at the burn center in san francisco. now the cause of the fire is still under investigation. well, you may call it an impulse decision. what former governor arnold schwarzenegger is revealing about how he decided to run for office. and the concerns about facebook that has some people calling for a federal investigation.

to investigate the network. they claim they are tracking users even after the users log off. now two u.s. congressmen are calling for into an investigation. >> these companies make their money by selling information on you and the fact they're selling information on you shouldn't surprise anybody or protect this information very well shouldn't surprise anybody either. >> facebook denies any privacy breech and this comes one week after the company announced the new time line feature, but critics say time line increases user's privacy risk. arnold schwarzenegger is revealing that his decision to run for governor of california was something he did on an impulse. he announced the run for governor on the jay leno show back in august 2003. in an interview published, he says he was booked to promote his film, but on the way to the show, he decided to announce his run for governor.

he said, quote, i thought, well, this will freak everyone out. i will be so funny that i will announce that i am running and i told him i was running and two months later, i was governor. arnold schwarzenegger says his decision to run for governor surprised his friends and even his wife. he said he assured everyone that he had no plans to run for office. traffic could be a nightmare in san francisco this weekend because of three major events. the three-day harley strictly blue grass concert started today. 60,000 visitors are expected each day. another 45,000 people are expected to visit tomorrow for the kick-off of the open convention. that will run through next week. on top of that, psych lis will head their monthly critical mass event tonight. 4:53. traffic. >> it sounds like a traffic trifecta. good morning. let's go out and happy friday

to you. let's tell you about some of these things we're looking at, northbound 101 san francisco. so far looks good now. you want to get out there. i want to avoid the traffic. i want to get out at 4:54 a.m. you will avoid the traffic for sure there. is a look now at the bay bridge toll plaza, traffic moving nicely. and driving in the mountains until about, for a few more minutes, only one lane in each direction because of road work. and we have a full freeway closure in pittsburgh and bay point eastbound highway 4 at summersville. full freeway closure until 5:30 for another half hour for road work in the area. they're picking it up, but it could be out there until 5:30. >> thank you. happy friday. changes, roller coaster ride and makes sense, that time of year. but very warm to hot conditions on wednesday. well, blown out yesterday, inland temperature warmed up,

but today, they'll cool off as well. strong sea breeze already in. mild on the low as well, i couldn't tell you last time i saw all 50s. because of the low cloud deck, a southerly breeze ahead of it. san jose, cloudy, cloudy to mostly cloudy. the key, fair field, west, southwest 26 miles per hour. yesterday, calm. san jose, southeast 13 miles per hour, even with the clouds. that's a cool direction for the north bay. just a little puff south. but that's why it's so mild, getting breeze. once it turns more westerly or northwesterly, we will drop the temperatures into the weekend. besides drizzle, we're not really expecting any rain until early next week. but into the weekend, temperatures coming down, we'll get that breeze to kick in. a lot out here. but the first system coming in is falling apart. but that will get the door
