from mother nature. just about 45 minutes from now, the trial of michael jackson's doctor, dr. conrad murray, will resume in los angeles. during yesterday's testimony, prosecutors played more audio of a recording of michael jackson slurring his words. reporter adam housley is outside the courthouse now with the reaction to that and what is expected in the courtroom today. >> reporter: good morning, dave. our producer put it well yesterday. it was shock and yawn. huh two types of a trial, a very active, drama-filmed, first part of the trial yesterday, then the second half it really was tough to stay awake for a lot of people watching it. that first half, though, dramatic because you had a forensic specialist come on the stand and talked about e-mails he retrieved from dr. murray's iphone, and then following that he had a chance to go through the iphone, retrieve some of the audio recordings. remember back on the first day of this trial during opening statements?
7:50 am
huh that audiotape of michael jackson talking groggy. he's obviously heavily drugged. yesterday they played the entire portion of that message, the entire conversation between dr. murray and michael jackson. here's a snippet. >> that was dr. murray yesterday, and michael jackson talking to each other on his iphone, just a month and a half before michael jackson would die. you can see he was extremely sedated, and the prosecution alleges he should have seen that, known that, his patient was having trouble with these types of drugs. dave, today back to the more yawn part of the trial, we have the csi part as well, where they'll have people talking about all the different drugs, one by one, that were found in that room the day michael jackson died. that's expected to take at least through today, maybe into the first part of next week. there is no court on monday due to the holiday. but this trial, the prosecution getting into the part now where
7:51 am
they're talking about the drugs and really the more tedious types of things before you get back into maybe more drama as they close out the prosecution's case. by the end of next week. reporting live, adam housley, ktvu channel 2 news. >> thank you. we're following breaking news from cupertino. we're just learned the police may have shot the gunman responsible for yesterday's deadly workplace shooting in coupe tiananmen. ktvu's tara moriarity is there now. what do you know? >> reporter: here's what happened. my photographer and i were walking one street over on homestead in front of the parking lot where the woman was attempted to be hijacked and shot at. we were just knocking on doors, trying to get some interviews, when we heard a round of gunfire. we heard several gunshots, and of course jumped out of our skins and ran to the street nearby and this is where we are right now. it's the street right behind homestead.
7:52 am
you can see all of the police -- sheriff's deputies higher now. we do not know if this is connected. we did see it a woman just moments ago loading her infant into the car. we don't know if this is regarding the same story we've been talking about yesterday, regarding the alleged gunman, similar each allman, but there are a lot of sheriff's deputies here on scene and as we mentioned they are -- they're securing the area here. they've cordoned off this section of the street. they're standing in front of a residence where we heard the gunshots but we do need to confirm with deputies whether it's related to the search for shareef allman. >> we'll check back with tara coming up at the top of the hour. we'll have more mornings on 2 right after this. stay with us.

investigating that fatal helicopter crash in new york. the chopper was carrying a pilot and several tourists when it crashed into the east river tuesday, just moments after takeoff. one woman onboard who was celebrating her 40th birthday was killed in the impact. the ntsb says this is a complicated case because many different factors could have caused the crash. >> weight capabilities could have been affected by the wind. that's the kind of thing you're now understanding how the weight interact with the wind and that is a good example of how complicated this can get. >> investigators say pilot error, wind speeds and the wealth of the aircraft could all have contributed to the crash. the pilot says he noticed a problem right when he took off, but lost control when he tried to land back on solid ground. sacramento international airport just opened a brand-new terminal this morning. take a look at -- >> some new video we just got

this in off that ribbon-cutting ceremony just a couple hours ago. the new terminal is three times larger than the one replacing. it features a tram, more than a dozen new restaurants, and six million dollars worth of public art. the terminal price tag is $1 billion. we're told it's paid for by parking and airline ticket surcharges, as well as airline fees and federal grants. we want to check in with sal once again for an update on the commute. >> we're going quickly, we have a lot of breaking news. the traffic is pretty heavy all over the place, including at the toll plaza. you'rer you're trying to get into san francisco, 25 minute wait. steve has a quick forecast. >> a lot of showers, thundershowers over the area. the national weather service just issued a special marine warning off half moon bay. i don't know. computers thinking. there it goes. here we go. right there. right off that cell.
7:57 am
some of that may come in towards the san mateo coast, so keep that in mind. that's a special marine warning for strong thunderstorm and very strong cells off towards the east bay so suffice to say it's very strong active morning. temperatures are only in the upper 50s or low 60s for many today so very cool conditions. showers, thundershowers possible hail, after today things will calm down and then we'll warm up as we head into the weekend. won't be a barnburner but dry and temperatures will come up. >> thank you, steve. it's 7:57. breaking news again. we've just learned police splay shot the gunman who was responsible for the deadly workplace shooting at a cement plant. we will have a live update shortly. the search for ace missing south bay mother came to a sad ending. a gruesome discovery made and why the case is still a mystery. >> we're live at apple headquarters in coupe tiananmen, where people are remembering steve jobs. coming up you'll hear from a man who brought his two children here and what he says he wants them to remember.
8:00 am
it is thursday, october 6th. again, we are following breaking news. we are getting word, reporter on the scene in cupertino heard some gunshots where police had been looking for the suspect who killed three people and wounded seven others yesterday. a reporter has been asked to move her location by police. so we're not able to goat a live report from her right now. but we will hopefully get -- establish contact with them shortly. so we will be continuing to follow this story, obviously, throughout the morning. but once again, the search going to be for over 24 hours for the suspect shareef allman who was a worker at a cement plant where this incident started yesterday morning may have been shot by police. and we will have a live update coming up shortly. meanwhile, also happening right now, president obama is holding a news conference. the white house is not said if there's any particular topic but he is talking right now so let's listen in.
8:01 am
>> have said this jobs bill will have a significant effect for our economy and for middle- class families all across america. what these independent experts have also said is that if we don't acted, the opposite will be true. there will be fewer jobs, there will be weaker growth. so as we look towards next week, any senator out there thinking about voting against this jobs bill, when it comes up for a vote, needs to explain exactly why they would oppose something that we know would improve our economic situation at such an urgent time for our families and for our businesses. congressional republicans say one of the most important things we can do is cut taxes. then they should love this plan! >> president obama is talking about the jobs bill that he is hoping congress will vote on and pass in the next week. there was some dramatic changes to it recently, democrats proposing a surtax on people
8:02 am
earning at least a million dollars a year. obviously, this is still a heated issue debate going on in congress. a story we'll continue to follow for the rest of the hour here on mornings on 2. meanwhile, employees at nearby apple headquarters were also told to stay indoors yesterday during the search for the gunman. but today there's a different focus at apple. millions of people around the world are mourning the death yesterday of steve jobs. ktvu's claudine wong is live outside apple headquarters in cupertino. >> reporter: in many different ways and on many mediums, we've been standing over by that memorial that sits in front of apple headquarters this morning talk to people who stopped by headquarters here, employees asked not to talk to reporters but ordinary people have also come to pay tribute to steve jobs. and the last 20 minutes we've talked to a man named tony who came here with his 10-year-old
8:03 am
daughter and nine-year-old son, they all had roses to add to the growing memorial. and he said they stood there in front of memorial and remembered this day, this is history. we asked him about that before he left. >> i want them to remember? just this experience, this is huge. this is something that many years from now they can think back on the day when an amazing man named steve jobs passed away and they were here to be part of this. they saw that, how important he is, and just neat experience. >> it has been a day of tributes across the bay area are and across the world. we got these pictures from san francisco that the apple store where people having leaving notes and cards as well. and in the last hour, we also got this video from the home of steve jobs in palo alto, a growing tribute there as well. those who can't go to the local spots are still remembering online there have been tributes and even a push for steve jobs' day on apple's website.
8:04 am
there's a picture of steve jobs, a statement and an e-mail address to send e-mail condolences. remembrances continue here. it's interesting because i asked his father about his kids and bringing his kids here, and i said do you think they get it, they understand what is happened today? and he said i'm not sure because the reality is they're nine and 10. they don't remember what it was like before steve jobs changed everyone's lives. claudine wong, ktvu channel 2 news. >> interesting. thank you, claudine. here is a look at jobs' notable innovations throughout his life. he founded apple in 1976 in. 1984, the macintosh was released and jobs resigned the following year. by 2001 he returned to running apple and the first ipod went on sale. in 2007, apple released the iphone. and then last year, apple unveiled its tablet computer, thishes pad. we'll have continue coverage throughout this morning's
8:05 am
newscast. also you'll find more coverage on the life and legacy of steve jobs on our channel 2 website, just go to ktvu.com. our time is 8:04. we're following breaking news in cupertino. we just learned police may have shot the gunman responsible for yesterday's deadly workplace shooting at a cement plant in cupertino. ktvu's tara moriarity is back with us, you heard the gunshots, right? >> reporter: we did. they were several of them. and my photographer and i were walking along homestead in front of the parking lot where shareef allman was last seen and heard a round of gunfire go off. we're of course extremely nervous. let's listen to what it sounded like. [gunfire] >> oh, my god!
8:06 am
>> reporter: sheriff's deputies, everybody rushing to the scene here. and our helicopter is above us right now. we want to look, we can see what it looks like at the scene. where street over to homestead on lawyer on and peacock, kicked out the area where we believe the shots came from. and what is interesting to note here is just maybe a half hour before, we were speaking with sheriff's deputies, and this man had pulled up into the parking lot and said i was evacuated from my house yesterday, and i'm really nervous to go back. i didn't even have time to lock the doors. can you come with me and look through the house and make sure that everything is okay? i've got kids and i'm really nervous. so they did. and literally within 15 minutes, when we were walking along the sidewalk, that's when we heard the shots. immediately we ran across the street to tell sheriff's deputies, and then they started zooming off in all different directions to get to the location. we don't know if this is indeed the gunman that everybody has been looking for. but there are dozens of law
8:07 am
enforcement here, about 10 minutes ago an ambulance pulled up and wheeled out a stretch. we did notice a woman carrying a child come out of the one of homes there. yesterday authorities say that lehigh cement operator shareef allman opened fire at a safety meeting, killing three coworkers and injuring six others, then he came to this area allegedly and tried to steal a car from a woman and shot her in the league. so that is what we know at this point. we see tons of law enforcement coming in and out. and we'll continue to monitor this situation and let you know if indeed this is connected, because at this point sheriff's deputies are not talking to us. but we will of course keep you posted. tara moriarity, ktvu channel 2 news. >> i don't know if you can see because the camera must be zoomed in, but it looks like someone is being loaded into the back of an ambulance. >> yes, i'm just seeing that. >> yes, so we're just not sure
8:08 am
-- obviously -- >> i don't know if anyone is in that stretcher or not. i can't quite see. >> right. >> but i know that they did load it out. there was really just an -- an intense amount of urgency with officials when they first arrived. we did notice they seemed to back off within five minutes of us arriving here, then some of the officers took off. some of the deputies left. so again, we don't know if this is the man. but it's interesting to note on the other side of the house where the shots came from, where we heard them come from, is a house that has a fence that is down right now. and the woman who lives there said deputies came yesterday, s.w.a.t. teams kicked down the fence because they bleed allman was hiding in her backyard. if it turns out he is found in the house -- it's really right on top of where all of the s.w.a.t. teams and law enforcement had been looking for him. >> and we understand that the gurney is empty. it might be some equipment on there that they may be load
8:09 am
into the ambulance. it's not a person so we just want to claire day for that. but it looks like a lot of the neighborhood is still cordoned off and it was interesting, you talked to the person who wanted to go back but was a little nervous, and that is understandable because we just don't know where this suspect is at the moment. >> that's right. and neighbors are standing around here. i don't know if you can see any of them. but they're just sort of scratching their heads, this is stuff never happens around here! pretty quiet neighborhood, very nice, tree lined, really nice homes. and we'll just continue to stay here and see if sheriff's deputies can give us any confirmation whether this is indeed the man that they have been looking for. >> before you go, you did a very good job with your reported, but just you and me talking, how scared were you when your photographer, when you heard the shots? >> oh, pretty scared! i've never heard gunfire go off like that so close to where i've been standing. and it was several shots. it wasn't just like one, two,
8:10 am
three. i'm thinking seven or eight shots. it sounded -- not as loud as i thought it would be, but we can definitely hear what was coming from. the tape didn't capture the initial shots. you can just hear a very low three shots that were fired. so we caught like the tail end of it. but we definitely heard it. it definitely got us running. like i said, we whipped across the street and we notified sheriff's deputies and said you got to check this out! >> all right. you'll stay there on the scene and get more information and we'll check become with you probably in just about 15 minutes as we get more information on this new development in the shooting rampage there in on the sunnyvale-cupertino border. now we want to check in with sal because people need to get to work and school. >> good morning to you. let's go outside and look at some of these commutes which have by pretty slow. on highway 4, the whole thing is slow from antioch, couple breaks but slow to 680. 680 is backed up from 242 to
8:11 am
danville and 24 westbound, slow traffic and spots on the way to oakland. we talked about that. let's move to the live pictures now, interstate 880 in oakland is getting slower patch the coliseum. and the backup continues at the bay bridge toll plaza. it's thick here, backed up for a 25-management delay. let's go to steve. >> all right. we're getting reports of very heavy rain, danville, san ramon and walnut creek, lafayette, and also on the san mateo coast and a special marine warning issued. all rotating around. we'll have one more little cell and just be hit and miss showers, but really cool air is beginning to filter in right there, west of this area, a marine warning for i have strong thunderstorm cell which is moving towards san mateo coast. hopefully it will collapse but just west from marine mainly but look at the red on the san mateo coast. get this that move just a
8:12 am
little bit, i don't know. let's try it again. if not -- there we go. now we'll move that over. looks as it stretches over to the peninsula, towards palo alto, mountainview and also into the santa cruz mountains. there's a little bit of a break from the 880 corridor south of hayward to fremont but then it starts to pick up again. livermore now on the 580 corridor, 680 to clayton and antioch and pittsburg highway 4. so not surprised they're having delays there. and then right there by concord, also into pleasant hill that's kind of also starting to show some pretty strong thunderstorm activity, and we're not done yet. you can going back over towards richmond and then over the richmond-san rafael bridge, and then also whack over to west marin. so there's a lot going on here this morning. all associated with that system right there, it will be the last one in the weather pipeline, then we'll calm down tonight. but man, will it get cool tonight. really cool temps today. thunderstorms, strong hail, brief heavy rain but moments of pockets of sun. but it's a very active day.
8:13 am
so 60s on the temps. and on the 5-day forecast, we will have calmer conditions starting tomorrow and mostly sunny and warmer into the weekend. >> all right. our time is 8:12. we'll have much more on this hour's breaking news. police may have shot the gunman responsible for yesterday's deadly workplace shooting. these are live pictures from newschopper 2. >> the presidential election is now just 13 months away, and it may be clear which republicans are in and which ones are out. plus, hundreds of prison inmates headed for san francisco along with more money to keep an eye on them. how the city plans to keep people safe from the criminals. the district attorney joining us live next on mornings on 2. breaking news. ktvu has learned the gunman in the cupertino shootings may have been shot. we're looking at the gunshot -- indicators here, in a neighborhood in sunnyvale. our reporter was in the neighborhood and actually heard the gunshots as we look up we can see there is a tarp, yellow tarp, which looks like there may be a body in front of the sunnyvale home. stay with ktvu as this news develops. we have several crews on the ground and will bring you more coming up. thank you, sal. it's 8:16. the presidential election is now just 13 months away, and the republican list of candidates may be set. now that sarah palin is out, carol hahn reports from our washington, d.c. bureau what analysts make of the remaining
8:17 am
options. carol. >> reporter: good morning, tori. sarah palin finally made it official in a statement to supporters of 2008 vice presidential nominee won't enter the race adding she would be more effective helping other republicans win office. palin's retreat comes a day after new jersey governor chris christie his decision not no run. but still leaves a crowded field of republican contenders. but former massachusetts governor mitt romney and texas governor rick perry remain the front-runners. perry's campaign yesterday announced it raised more than $17 million in 7 weeks, despite the lackluster debate performances. then there's former pizza executive herman cain surging in the polls. but one veteran watcher tells mess it's romney who poses the biggest threat to president obama. >> because he has the potential to string together a coalition of conservatives who don't like the president, but also pragmatists, moderates, suburban voters who don't find mitt romney particularly scary. >> recent polls also show romney with a slight lead but
8:18 am
still anybody's race, which is why all eyes will be on the next debate scheduled for next tuesday. karen hahn, ktvu channel 2 news. more than 600 prison inmates have coming to san francisco over the next year, but many of them won't be behind bars. it's part of a plan called realignment. the lot of people won their houses going to work. san francisco district attorney george gascon joins to us talk about it. good morning, thank you for being here. >> good morning, how are you? >> good. so non-violent, non-sex offenders will be transferred from state prison to county jails, a lot of them going right on probation, not behind bars. a lot of convicted criminals on the streets. how will this work? >> well, you know, i think that we have been preparing for this since january. and i know that it appears to be very concerning, and certainly there's some uncertainty as to how we're going to handle some of those people. but i think the reality is if you look back and you look at the fact that most of the people we sent to prison before
8:19 am
were coming out about 47% within 90 days, most of them were reoffending and they were coming back and really the service necessary to ensure we're being helped to rehabilitate were not there. what we're trying to do in san francisco is shift that paradigm and come up with a more thoughtful way of dealing with the people, monitoring on streets and the 1 that need to continue to be incarcerated until they can be eased back into the community do so. so we believe that while we don't have all the answers, we're certainly on the good path to actually become safer than we were before. >> so i know more money is coming here and part of that will include some more staff for you or for the probation officers. and more gps monitoring, which sounds high-tech. they can even detect if someone consumed alcohol. but what will it take really to keep these offenders from committing crime again? >> well, first of all, one of things we're doing is we're going to be a lot more
8:20 am
thoughtful about the way we determine who should be released and who should stay incarcerated. we're prepared to do a better risk assessment, to determine the people that actually can go back into the community and if they're going back into the community under what circumstances, and the people that need for continuing to be incarcerated until we work with them. i believe the things we're preparing now are going to actually give us better results down the line. again, if you go back and looking at the real offending rate, 77%, for people that went to state prison in san francisco, it's really untenable socially, economically, and we also know that often people that are not violent, when they go into incarcerating setting, they become more crime prone. if we do other things with them in the community, like probation. >> so just a remind people we're talking about non- violent, non-sex offenders. >> correct. >> the violent sex offenders will stay. >> those will continue to be sent to state prison, just like they are today. and even those that are coming back, some will continue to be
8:21 am
incarcerated. they're just incarcerated at this county jail, and but again, we're looking more rehabilitating people and trying to ease people back into the community. >> all right. so that's just one effect to this week so district attorney george gascon, thank you for joining us. let us know how it's working then. >> my pleasure. love to come back in a few months and talk about it. great. >> thank you. >> let's go back over to for you're and dave. >> thank you, pam. we will continue to follow the breaking news out of santa clara county. we've got word just a short time ago police may have captured the man suspected in yesterday's multiple shooting. also the big decision today that could bring millions of dollars of improvements to caltrans. >> good morning. interstate 880 traffic is slowing down past the coliseum. and getting slow to the bay bridge.

investors react to go the news steve jobs' death. apple stock opened almost $5 lower but the losses have since disappeared and the stock is now trading almost $5 higher. and there's been a lot of confidence in the near term. apple remains one of the most valuable companies in the world thanks to all that strong sales. but the question is, the long- term picture. with the technology sector arguably the most competitive industry in the world, the long- term picture remains a big question for apple. today caltrain's board of directors expected to vote on a multimillion-dollar improvement
8:25 am
plan. it's a $231 million contract to bring a new train control system to caltrain. it includes a new fiber optic communications, a backup central control facility, and a new communications subsystem. the goal is to help prevent train to train collisions as well as derailment. we want to check in with sal, see what is happening on the roads and there's some rain out there causing problems. >> this week hasn't been great with the commute. let's go through the pictures, westbound bay bridge, 25-minute wait to the stand but no trouble spots on the span. also this morning san francisco look at that commute, that's just not a very good one. getting up into the city downtown area. you can see traffic is okay. northbound or westbound highway 4, some slow traffic. i want to mention there's a new crash in cupertino northbound 280 after deanza boulevard. two vehicles and tow truck on the scene. steve. >> lots of rain and some of

that is severe weather. especially off to san mateo coast and we're going to have a day where just about anything goes here as far as possibility of sun, clouds, showers and thundershowers. the heaviest activity continues to rotate down along the san mateo coast. that's off the coast, special marine warning for those two cells. so far no reports of any rotation or anything. hopefully they'll collapse. but it will be for marine interests only. but still they are driving towards south-southeast. so have to keep an eye on that very active. look how that is just from boulder creek, santa cruz mountains to mountainview, heading towards los gatos, san jose. from brian on a tweet said getting very active down here, towards san jose, i'm not surprised. also from livermore up to danville, reports of moderate to heavy rain and even towards parts of clayton, and highway 4, things are looking to be improving as this system kinds of moves east and south. but that's not the case from oakland back over towards san rafael and over the golden gate
8:27 am
and the richmond-san rafael bridge so we're not done yet. one more system rotating down, could give us any severe weather today. so we'll keep an eye on that. very cool temperatures, thunderstorms, maybe some sun mixed in bay lot of clouds and thundershower activity or brief heavy rain. 50s and 60s on the highs today. some might be too high if this system holds on for a little longer. it will clear out by tonight, then tomorrow will be sunny but really cool. then your weekend, mostly sunny and little warmer weather there. >> thank you. we have much more on this hour's breaking news. we're looking live, authorities have just confirmed they have shot and killed the gunman responsible for a deadly workplace shooting yesterday. he has been shot and killed. we'll bring you a live update from this scene. >> in san francisco, police move in for the second time in about 12 hours, we'll tell you what they're doing now and where protestors might end up.
