this movement is part of occupy san jose. this middle class people are protests what they call greed. >> i'm note a criminal and to arrest me it shows how wrong the system is right now. >> reporter: city officials say protesters are welcomed to protest during the day but they are violating the municipal code when they spend the night here in tents. >> tonight we're going to start with citations. if the behavior continues there will likely be arrests. >> reporter: vietnamese activist lee thong was allowed to protest after he was protesting a decision made by the city. >> the city has set legal precedence of allowing this in the past. we think we have a very good case in point. >> reporter: that was the first incident.

area that things may be getting better. we are following a large protest in san francisco. we are showing you a live picture from powell street where hundreds of people are on the move. we're heading toward union square. we are seeing them walking along the street. a live shot here from news chopper 2. this demonstration started about 90 minutes ago with anti war speechs in front seat of the federal building to mark the tenth anniversary of the war in afghanistan. about 15 15 minutes ago the protesters staged a die in. they're expecting this should wrap up in the city hall building. we will continue to monitor this situation and we will bring you more developments as soon as we get them. tonight we're learning more from a man who survived a shooting rampage in a quarry.

playing dead may have saved the man's life, robert handa has the story. >> reporter: today a worker did tell a chilling at, how he survived and some didn't. >> reporter: michael ambrosio says he's a lucky one even with the bullet wound in his left arm. he says almond broke fire yelling you want to f with me. ambrosio said he could see almond's face as he fired. >> just mad, just mad. you could see the anger in his face. i was seeing him and all the gunshots coming out, coming out, coming out. >> reporter: ambroiso says the bullets were so rapid he does not know if he was shot by the handgun or the machine gun. >> they were just bang, bang, bang. and when he brought out the ak that is faster than the

handgun. >> reporter: the back door to the trailer that -- >> the back door to the trailer that would have been an exit point was blocked with a piece of wood. they were unable to open that door. >> reporter: for ambrosio he could only play dead. >> i was bleeding, i covered my head because i was worried about my brain. i had blood on my head. i just kept praying inside saying please. >> reporter: three coworkers suffered fatal shots and ambroiso and several others were wounded. ambrosio says that he will always be reminded about what happened and what he could have done. >> it helps to be with my family. today we heard fire dispatch taping as personnel responded to treat victims of that quarry shooting while the

suspect was still on the lose. >> the suspect came up on a radio at the quarry and advised that he was going to get everybody else. again the suspect came up on the radio threatening to get everybody else. >> reporter: crews arrived at the lee high cement plant to do triage everyone as police were searching for the suspect. you can hear the entire interview with that quarry employee who robert handa spoke with who played dead and ended up staying alive. just look for the quarry shooting tab on ktvu.com. oakland police say they have made an arrest in connection with a robbery and shooting that the shutdown 580 yesterday afternoon. but authorities won't say if that was the gunman that robbed and shot a woman. troops shut down westbound lanes of 580 as police looked for the gunman. the shooting victim has been treated and released from the

hospital. today governor jerry brown sign add bill requiring california utility companies to install automatic remote shut off valves. the bill's author says those ballots could have saved lives during the san bruno pipeline explosion disaster. friends and family said farewell today to a member of an oakland motorcycle club who was shot to death last week. 40-year-old hasan sayd was a member of the -- some of the first explosions around kabul

but 8-year-old magana has rarely seen his dad. >> it's not the funnest of times. but you know you work through it. >> reporter: johnny magana has been left to care for the couples three boys. >> he's had a couple little break downs not too bad. nothing that he can't get over. but he's had them. my question is why are we there. we're wasting valuable time, effort and life. >> reporter: for the hanson family the war in afghanistan has spelled stress at home. >> i've missed a lot of my family's life. probably 3-1/2 years i've been gone away from home. that part has been difficult. >> reporter: for sergeant john hanson is with the army national guard. he just finished a tour in afghanistan last year. he says he owes a lot to his wife and kids who always found a way to get by. >> it's been a sacrifice for the family but you know i think it's made us stronger and

closer in different ways. >> it meant that we had to come together as a unit since we had our father missing. >> reporter: the pentagon says that so far 1,686 american service members have died in afghanistan since operation enduring freedom began. 1,407 of them were killed in action. another 14,442 have been wounded. currently there are about 100,000 american troops deployed in afghanistan. a new state law raises the age limit for children to ride in a car without a safety seat. starting january 4th, children must be in a booster seat. supporters say boosters can increase the safety of a life by 50%.

>> a second offense is going to be over $1,000. >> the only exception is if the child is tall enough 4'9" or taller to fit the seat belt properly without a booster. other car seat laws, babies must ride in a rear facing seat until they are one year old. children older than one year and at least 20 pounds can ride in a forward facing seat. after children reach 40 pounds they must be in a booster in the backseat until the age of 8. san francisco city officials say they want nummi to offer free rides to kids and teens. a board of supervisors committee has ordered nummi to provide free rides to children. nummi would not actually be required to implement it everyone if the law passes. the rain clouds have moved out of town. coming up the one direction temperatures will be headed this weekend. and i'll tell you when 80s return to our five day

a private funeral is being held today for steve jobs. it is a small private gathering. the source would not say when or where it is being held or out of respect for the family. jobs died wednesday of pancreatic cancer. apple says it's planning a memorial soon to honor the company's visionary founder. today the federal government issued a crack down on dispensaries. saying they have 45 days to shut down or face charges. the state's u.s. attorneys say

they are going after pot clubs located near schools and parks and larger operations. they say many commercial dispensaries aren't selling marijuana as medicine but rather to healthy young people. >> i don't think any one of us in this room wants to see our neighborhoods with backpacks full of pot viles. >> prosecutors argue -- protesters argued that feds should let california deal with any problems arising from abuse of the state's medical marijuana law. economists say a new report released today about the u.s. adding jobs last month eases fears about a double dip recession. the labor department says u.s. employers added 103,000 jobs in september. the government says more jobs were added in july and august than previously reported. new at 6:00, tom vacar is live

in oakland where new business is expected to put dozens of bay area residents to work, tom. >> not so long ago this lot was full of garbage and graffiti. today it became a source of jobs. cathy y linen is hoping to get a job. that's because oakland nissan opened a lot today. it's not the oakland she invisioned. >> i think there's been a lot of improvement from what i can see downtown. >> you're ready to come to work here? >> i am. i will go to work today if they hire me. >> i've been here for 15 years with the volkswagen dealership. and i feel safe here. >> reporter: in a city that desperately needs jobs.

>> by december nissan and infinity will hire another 50 to 70. and the restaurant will probably hire a good 20, 25. >> reporter: a restaurant in yet another former dealership. >> i think there's a resurgence coming along. a lot of new housing is here. a lot of people are coming here. i think it's a great city. >> reporter: the general manager came from a san francisco business here to oakland. >> i think people who live here would rather spend their tax dollars here. instead of going across the bridge or other cities to buy their car. >> reporter: some of the profits will go to a nonprofit foundation, a breast cancer foundation. a disease that claimed the life of his wife this summer. >> reporter: all of it a tribute to his wife and a real important shot in the arm for oakland. tom vacar, ktvu channel 2 news. an oakland judge is now deciding what taco bell must do to improve disabled access. the u.s. district judge ruled that a restaurant in san pablo

failed to provide proper handicapped railing in violation of both state and federal law. the ruling comes as a result of a class action lawsuit that was filed back in 2002. taco bell has declined to comment. bevmo says it is moving to a new building but staying in concord. about 100 employees will move there early next year. supervisorring are requiring drug makers make ár makers pay for the disposal of expired drugs. the city only has a couple of places that people can dispose expired medication. young cancer patients traded a hospital room for a coast guard cutter today. the coast guard hosted patients

who had so much high level football under his belt, what made you decide you wanted to be a high school coach. >> well, you know we moved here a few years ago in 2009. and i helped out with the coaching staff and in 2010 became the head football coach. it's part of my passion of coaching kids. the other part is i have kids here. my son is on the football team. it's been fun to coach them. i've been coaching all my life. it's great to share this with my children and all the kids. >> it's good to pump up your chest about your child, and the chance to coach him is a once in a lifetime opportunity. >> he's getting the opportunity to go to cal and play ball there. so it's going to be pretty special. but you know, having that opportunity is just great.
